संभावत्ता होने से, कन्द्याकुमारी वन संभाग के बडे भाग को जी.ओ.(एमएस) सं. 128(इ एवं एफ) ददनांक 20 नवम्बर,
2007 के द्वारा कन्द्याकुमारी वन्द्यजीव ऄभयारण्य के रूप म ें घोजित दकया गया था जजसके ऄन्द्तगात 402.395 वग ा
दकलोमीटर क्षत्रे अता ह;ै
और, हमारे दिे म ें पजिमी घाट फूलों के जलए सबस े समृद्ध क्षेत्रों में से एक ह ै जहा ं फूल पौधों की कम से कम
3500 प्रजाजतयों को ईगाया जाता ह ै जो भारत में फूल पौधें का 27% ह ै यहा ं 58 स्ट्थाजनक जेनरे ा ह ैं जजसमें 47
मोनोटायजपक ह।ै ऄगजस्ट्थयमलइ पहाजडयों (ऄररयानकवु पास से ऄरालवइमोजी पास तक) म ें लगभग 189 स्ट्थाजनक
प्रजाजतयााँ ह।ैं स्ट्थाजनक के जनरटक संसाधनों जैस े जपपेर प्रजाजत, गर्दकजनया, आयगेजनया, आक्सोरा, हीप्टाग,े कलामुस,

सुरजक्षत और संरजक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन में ईद्योगों या ईद्योगों की श्रेजणयों के प्रचालन तथा
प्रसंस्ट्करण को प्रजतजिद्ध करना अवश्यक ह;ै
ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ
परित पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) (जजसे आसम े आसके पिात् पयावा रण ऄजधजनयम कहा
गया ह)ै की धारा 3 की ईपधारा (1) तथा ईपधारा (2) के खंड (v) और खंड (xiv) और ईपधारा (3) द्वारा प्रदत्त
िजियों का प्रयोग करत े हुए, तजमलनाडु राज्य में कन्द्याकुमारी जजल े के कन्द्याकुमारी वन्द्यजीव ऄभयारण्य की सीमा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
के चारों ओर 0 (िून्द्य) स े 3.0 दकलोमीटर तक जवस्ट्ताररत क्षत्रे को पाररजस्ट्थजतकी संवेदी जोन (जजस े आसम ें आसके
पश् चात ् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप म ें ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार ह,ै
ऄथाात ् :--
1. पाररजस्ट्थजतकी सवं दे ी जोन का जवस्ट्तार और सीमा--(1) पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार कन्द्याकुमारी
वन्द्यजीव ऄभयारण्य की सीमा के चारों ओर 0 (िून्द्य) स े 3.0 दकलोमीटर तक ह ै और पाररजस्ट्थजतकी संवेदी जोन का
क्षेत्रफल 117.7772 वगा दकलोमीटर ह।ै पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार संरजक्षत क्षेत्र की जवजभन्न ददिाओं म ें
नीचे ददया गया ह:ै-

पाररजस्ट्थजतकी संवेदी जोन का िून्द्य जवस्ट्तार कन्द्याकुमारी वन्द्यजीव ऄभयारण्य की ईत्तर, ईत्तर-पूवा और पूव ाददिाओं
में कलाक्कड मुंदनथुरइ बाघ ररजवा की सीमा के कारण ह।ै ईसी प्रकार, पाररजस्ट्थजतकी संवेदी जोन का जवस्ट्तार पजिम
और ईत्तर-पजिम में िून्द्य ह ैक्योंदक यह केरल राज्य के नय्ेयार वन्द्यजीव ऄभयारण्य सीमा ह।ै दजक्षण म,ें यह
पोइगइमलइ ररजव ावन के साथ िून्द्य ह।ै
(2) कन्द्याकुमारी वन्द्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का वणान ईपाबधं -I के रूप म ें
संलग्न ह।ै
(3) सीमा जववरण और ऄक्षांि और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन का सीमांकन करत े हुए कन्द्याकुमारी
वन्द्यजीव ऄभयारण्य का मानजचत्र ईपाबधं -IIक, ईपाबधं -IIख, ईपाबधं -IIग और ईपाबधं -IIघ के रूप में सलं ग्न ह।ै
(4) कन्द्याकुमारी वन्द्यजीव ऄभयारण्य की सीमा और पाररजस्ट्थजतकी संवेदी जोन के भू-जनदेिांकों की सूची ईपाबधं -III
के सारणी क और सारणी ख म ेंदी गइ ह ै।
(5) पाररजस्ट्थजतकी संवेदी जोन की सीमा के ऄंतगात अने वाल े ग्रामों की सूची मुख्य वबदओंु के भू-जनदेिांकों के साथ
ईपाबधं -IV के रूप म ें सलं ग्न ह ै।
2. पाररजस्ट्थजतकी सवं दे ी जोन के जलए अचं जलक महायोजना.– (1) राज्य सरकार, द्वारा पाररजस्ट्थजतकी संवेदी जोन के
प्रयोजन के जलए, राजपत्र म ें ऄंजतम ऄजधसूचना के प्रकािन की तारीख स े दो विा की ऄवजध के भीतर, स्ट्थानीय
व्यजियों के परामिा से और आस ऄजधसूचना में ददए गए ऄनुबंधों का पालन करते हुए, राज्य सरकार के सक्षम
प्राजधकारी के ऄनुमोदनाथा एक अंचजलक महायोजना बनाइ जाएगी।
(2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना आस ऄजधसूचना म ें जवजनर्ददष् ट
रीजत स े तथा प्रासंजगक केंरीय और राज्य जवजधयों के ऄनुरूप तथा केंरीय सरकार द्वारा जारी ददिा जनदेिों, यदद कोइ
हों, के ऄनुसार बनायी जाएगी ।
(3) अंचजलक महायोजना ईि योजना म ें पाररजस्ट्थजतकी और पयाावरण संबंधी सरोकारों को िाजमल करन े के
जलए राज्य सरकार के जनम्नजलजखत जवभागों के परामि ा स ेबनाइ जाएगी, ऄथाात्:-भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 5
(i) पयाावरण;
(ii) वन और वन्द्यजीव;
(iii) कृजि;
(iv) राजस्ट् व;
(v) िहरी जवकास;
(vi) पयाटन;
(vii) ग्रामीण जवकास;
(viii) वसचाइ और बाढ़ जनयंत्रण;
(ix) नगरपाजलका ;
(x) पंचायती राज; और
(xi) लोक जन मााण जव भाग।
(4) जब तक आस ऄजधसूचना म ें जवजनर्ददष्ट न हो, अंचजलक महायोजना म ें वतामान म ें ऄनुमोददत भ-ू ईपयोग,
ऄवसंरचना और दक्रयाकलापों पर कोइ प्रजतबंध नहीं लगाया जाएगा तथा अचंजलक महायोजना म ें सभी
ऄवसंरचनाओं और दक्रयाकलापों म ें सुधार करके ईन्द्ह े ऄजधक दक्ष और पाररजस्ट्थजतकी-ऄनुकूल बनाने की व्यवस्ट्था की
जाएगी।
(5) अंचजलक महायोजना में वनरजहत और ऄवक्रजमत क्षेत्रों की बहाली, जवद्यमान जल जनकायों के संरक्षण,
अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय जनता की
अवश्यकताओं तथा पाररजस्ट्थजतकी एव ं पयाावरण के ऐसे ऄन्द्य पहलुओं की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया
जाना अवश्यक ह।ै
(6) अंचजलक महायोजना में सभी जवद्यमान पूजा स्ट्थ लों, ग्रामों एव ं िहरी बजस्ट्तयों, वनों की श्रेजणयों एव ं
दकस्ट् मों, कृजि क्षेत्रों, उपजाउ भजू म, ईद्यानों एव ं ईद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षत्रे ों, बगीचों, झीलों और
ऄन्द्य जल जनकायों की सीमा का जनधाारण दकया जाएगा तथा सहायक मानजचत्र भी ददया जाएगा। आस महायोजना म ें
जवद्यमान और प्रस्ट्ताजवत भ-ू ईपयोग की जविेिताओं का ब्यौरा देने वाल े मानजचत्र भी ददए जाएंगे।
(7) अंचजलक महायोजना में पाररजस्ट्थजतकी संवेदी जोन म ें होने वाले जवकास का जवजनयमन दकया जाएगा और
सारणी म ें यथासूचीबद्ध प्रजतजिद्ध एवं जवजनयजमत दक्रयाकलापों का पालन दकया जाएगा। आसमें स्ट्थ ानीय जनता की
अजीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-ऄनुकूल जवकास का भी सुजनिय एवं संवधान दकया जाएगा।
(8) अंचजलक महायोजना, क्षेत्रीय जवकास योजना की सह-काजलक होगी ।
(9) ऄनुमोददत अंचजलक महायोजना, जनगरानी सजमजत के जलए एक संदभ ा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना
के ईपबंधों के ऄनुसार जनगरानी के ऄपने कताव्यों का जनवाहन कर सके ।
3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी करने के जलए
जनम्नजलजखत ईपाय करेगी, ऄथाात्:-
(1) भ ू ईपयोग.- (क) पाररजस्ट्थजतकी-संवेदी जोन म ें वनों, बागवानी क्षेत्रों, कृजि क्षेत्रों, मनोरंजन के जलए जचजन्द्हत
ईद्यानों और खुल े स्ट्थानों का वहृ द वाजणजज्यक या अवासीय पररसरों या औद्योजगक दक्रयाकलापों के जलए प्रयोग या
संपररवतान ऄनुज्ञात नहीं दकया जाएगा:
परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क), में जवजनर्ददष्ट प्रयोजन से जभन्न प्रयोजन के जलए कृजि और
ऄन्द्य भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा ऄनुमोदन से क्षेत्रीय नगर
योजना ऄजधजनयम तथा यथा लाग ू केन्द्रीय सरकार एव ं राज्य सरकार के ऄन्द्य जनयमों एवं जवजनयमों के ऄधीन तथा6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
आस ऄजधसूचना के ईपबंधों के ऄनुसार स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय जरूरतों को पूरा करने के जलए
ऄनुज्ञात दकया जाएगा:-
(i) जवद्यमान सडकों को चौडा करना, ईन्द्ह ेंसुदढृ करना और नइ सडकों का संजनमााण करना;
(ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रदिू ण ईत्पन्न न करने वाल ेलघु ईद्योग;
(iv) कुटीर ईद्योग एवं ग्राम ईद्योग; पाररजस्ट्थजतकी पयाटन में सहायक सुजवधा भण्डार, स्ट्थानीय सुजवधाएं तथा
ग्रह वास; और
(v) पैराग्राफ 4 में ईजल्लजखत बढ़ावा ददए गए दक्रयाकलाप:
परंत ु यह भी दक क्षेत्रीय िहरी जनयोजन ऄजधजनयम के ऄधीन सक्षम प्राजधकारी के पूवा ऄनमु ोदन के जबना
तथा राज्य सरकार के ऄन्द्य जनयमों एव ं जवजनयमों एव ं संजवधान के ऄनुच्छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त
जवजध, जजसके ऄंतगता ऄनुसूजचत जनजाजत और ऄन्द्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्द्यता)
ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास
दक्रयाकलापों के जलए जनजातीय भूजम का प्रयोग ऄनुज्ञात नहीं होगा:
परंत ु यह भी दक पाररजस्ट् थजतकी संवेदी जोन के ऄंतगात अने वाली भूजम के ऄजभलेखों म ें हुइ दकसी त्रुरट
को, मानीटरी सजमजत के जवचार प्राि करने के पिात,् राज्य सरकार द्वारा प्रत्येक मामले म ें एक बार सुधारा जाएगा
और ईि त्रुरट को सुधारन े की सूचना केंरीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय को दी
जाएगी:
परंत ु यह भी दक ईपयुाि त्रुरट को सुधारन े म,ें आस ईप-पैरा में यथा ईपबंजधत के जसवाय, दकसी भी दिा म ें
भू-ईपयोग का पररवतान िाजमल नहीं होगा।
(ख) ऄनप्रु युि या ऄनुत्पादक कृजि क्षेत्रों म ें पुन:वनीकरण तथा पयाावासों और जैव-जवजवधता की बहाली के प्रयास
दकए जाएंगे।
(2) प्राकृजतक जल स्रोत-. अंचजलक महायोजना म ें सभी प्राकृजतक जल स्रोतों के अवाह क्षेत्रों की पहचान की जाएगी
और अंचजलक महायोजना म ें ईनके संरक्षण और बहाली की योजना सजम् मजलत की जाएगी और राज्य सरकार द्वारा
जल अवाह प्रबंधन योजना आस रीजत से बनाइ जाएगी दक ईसमें अवाह क्षेत्रों म ें जवकास दक्रयाकलापों को प्रजतजिद्ध
और जनबंजधत दकया गया हो ।
(3) पयटा न या पाररजस्ट्थजतकी पयटा न.– (क) पाररजस्ट्थजतकी संवेदी जोन में सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप
या जवद्यामान पयाटन दक्रयाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेदी जोन सम्बंधी पयाटन महायोजना के ऄनुसार
ऄनुज्ञात होगा।
(ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य सरकार के पयाावरण और वन जवभाग के परामि ासे पयाटन जवभाग द्वारा
बनायी जाएगी।
(ग) पयाटन महायोजना अंचजलक महायोजना का घटक होगी।
(घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जाएगी।
(ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दक्रयाकलाप जनम्नानुसार जवजनयजमत दकए जाएंग,े ऄथाात्:-
(i) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, आनम ें जो भी
ऄजधक जनकट हो दकसी होटल या ररजॉटा का नया संजनमााण ऄनुज्ञात नहीं दकया जाएगा:
तथाजप, पाररजस्ट्थजतकी-पयाटन सुजवधाओं के जलए संरजक्षत क्षत्रे की सीमा से 1 दकलोमीटर की दरू ी स े परे
पाररजस्ट्थजतकी संवेदी जोन की सीमा तक पूवा पररभाजित और ऄभीजहत क्षेत्रों म ें पयाटन महायोजना के ऄनुसार,
नए होटलों और ररजॉटा की स्ट्थापना ऄनुज्ञात होगी;भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 7
(ii) पाररजस्ट्थजतकी संवेदी जोन के ऄन्द्दर सभी नए पयाटन दक्रयाकलापों या जवद्यमान पयाटन दक्रयाकलापों का
जवस्ट्तार, केन्द्रीय सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा जारी ददिाजनदेिों तथा
पाररजस्ट्थजतकी पयाटन, पाररजस्ट्थजतकी जिक्षा और पाररजस्ट्थजतकी जवकास पर बल दने े वाल ेराष्ट्रीय व्याघ्र संरक्षण
प्राजधकरण द्वारा जारी पाररजस्ट्थजतकी पयाटन संबंधी ददिाजनदेिों के ऄनुसार (समय समय पर यथा संिोजधत)
होगा;
(iii) अचं जलक महायोजना का ऄनुमोदन होने तक, पयाटन के जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार
को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के अधार पर सबं ंजधत जवजनयामक
प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन में दकसी नए होटल/ररसोटा या
वाजणजज्यक प्रजतष्ठान का संजनमााण ऄनुज्ञात नहीं होगा।
(4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी जोन के ऄतं गता अन े वाल े बहुमूल्य प्राकृजतक जवरासत के सभी स्ट्थलों
जैसे दक जीन पूल ररजव ा क्षत्रे , िैल संरचना, जल प्रपात, झरन,े दरे, ईपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा
ईत्प्रपात अदद की पहचान की जाएगी और ईनकी सुरक्षा एव ं संरक्षण के जलए अंचजलक महायोजना के भाग के रूप
म ें एक जवरासत संरक्षण योजना बनायी जाएगी।
(5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन में भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा
ऐजतहाजसक, स्ट्थापत्य संबधी, सौंदयाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण
के जलए अंचजलक महायोजना के भाग के रूप म ें एक जवरासत संरक्षण योजना बनायी जाएगी।
(6) ध्व जन प्रदिू ण.– पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदिू ण (जवजनयमन और जनयंत्रण) जनयम, 2000 म ें जनयत
ईपबंधों के ऄनुसार पाररजस्ट्थजतकी-संवेदी जोन म ें ध्वजन प्रदिू ण के जनयंत्रण के जलए जवजनयमों को कायााजन्द्वत दकया
जाएगा।
(7) वाय ु प्रदिू ण.- पाररजस्ट्थजतकी-संवेदी जोन म ें वाय ु प्रदिू ण की रोकथाम और जनयंत्रण, वाय ु (प्रदिू ण जनवारण और
जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) के ईपबंधों और ईसके ऄधीन बनाए गए जनयमों और ईनम ें दकए गए
संिोधनों के ऄनुसार दकया जाएगा।
(8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन म ें ईपचाररत बजहस्राव का जनस्ट्सारण साधारणों मानकों के
ऄन्द्तगात पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अन े वाले पयाावरणीय प्रदिू ण के
जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों जो भी ऄजधक किोर हो के ईपबंधों के
ऄनुसार होगा।
(9) िोस ऄपजिष्ट.- िोस ऄपजिष्ट का जनपटान एव ं प्रबन्द्धन जनम्नानुसार दकया जाएगा:-
(क) पाररजस्ट्थजतकी संवेदी जोन म ें िोस ऄपजिष्ट का जनपटान और प्रबधं न भारत सरकार के पयाावरण, वन और
जलवाय ु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना स.ं का.अ. 1357(ऄ), ददनांक
8 ऄप्रैल, 2016 के तहत प्रकाजित िोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा;
ऄकाबाजनक पदाथों का जनपटान पाररजस्ट्थजतकी संवेदी जोन से बाहर जचजन्द्हत दकए गए स्ट्थानों पर पयाावरण-
ऄनुकूल रीजत स े दकया जाएगा;
(ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्द्य प्रौद्योजगदकयों (इएसएम) का प्रयोग करते हुए जवद्यमान जनयमों और
जवजनयमों के ऄनुरूप िोस ऄपजिष्ट का सरु जक्षत और पयाावरण ऄनुकूल प्रंबंधन ऄनुज्ञात दकया जाएगा।
(10) जवै जचदकत्सा ऄपजिष्ट .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:-
(क) पाररजस्ट्थजतकी संवेदी जोन में जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु
पररवतान मंत्रालय की समय–समय पर यथा संिोजधत ऄजधसूचना संख्या सा.का.जन. 343 (ऄ), तारीख8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
28 माचा, 2016 के तहत प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया
जाएगा।
(ख) पाररजस्ट्थजतकी संवेदी जोन म ें मान्द्य प्रौद्योजगदकयों का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के
ऄनुरूप िोस ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनुकूल प्रंबधं न ऄनुज्ञात दकया जाएगा।
(11) प्लाजस्ट्टक ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन में प्लाजस्ट्टक ऄपजिष्ट का प्रबंधन, भारत सरकार के
पयाावरण, वन और जलवाय ु पररवतना मंत्रालय की समय-समय पर यथा संिोजधत ऄजधसूचना स.ं सा.का.जन.
340(ऄ), तारीख 18 माच,ा 2016 के तहत प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधो के ऄनुसार
दकया जाएगा।
(12) जनमाणा और जवध्वसं ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन म ें जनमााण और जवध्वंस ऄपजिष्ट का
प्रबंधन, भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय की समय-समय पर यथा संिोजधत
ऄजधसूचना स.ं सा.का.जन. 317(ऄ), तारीख 29 माच,ा 2016 के तहत प्रकाजित संजनमााण और जवध्वंस ऄपजिष्ट
प्रबंधन जनयम, 2016 के ईपबधं ों के ऄनुसार दकया जाएगा।
(13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन म ें इ–ऄपजिष्ट का प्रबंधन, भारत सरकार के पयाावरण, वन और
जलवायु पररवतान मंत्रालय द्वारा प्रकाजित तथा समय-समय पर यथा संिोजधत इ–ऄपजिष्ट प्रबंधन जनयम, 2016 के
ईपबंधों के ऄनुसार दकया जाएगा।
(14) सडक-यातायात.- सडक-यातायात को पयाावास-ऄनुकूल तरीके स े जवजनयजमत दकया जाएगा और आस संबंध म ें
अंचजलक महायोजना म ें जविेि ईपबंध िाजमल दकए जाएगं े। अंचजलक महायोजना के तैयार होने और राज्य सरकार
के सक्षम प्राजधकारी स े ऄनुमोददत होने तक, मानीटरी सजमजत प्रासंजगक ऄजधजनयमों और ईनके तहत बनाए गए
जनयमों एव ं जवजनयमों के ऄनुसार सडक-यातायात के ऄनुपालन की मानीटरी करेगी।
(15) वाहन जजनत प्रदिू ण.- वाहन जजनत प्रदिू ण की रोकथाम और जनयंत्रण लागू जवजधयों के ऄनुसार दकया जाएगा।
स्ट्वच्छतर ईंधन के प्रयोग के प्रयास दकए जाएंगे ।
(16) औद्योजगक आकाआया.ं- (i) सरकारी राजपत्र म ें आस ऄजधसूचना के प्रकािन की तारीख को या ईसके बाद
पाररजस्ट्थजतकी संवेदी जोन म ेंदकसी नए प्रदिू णकारी ईद्योग की स्ट्थापना ऄनज्ञु ात नहीं होगी।
(ii) जब तक आस ऄजधसूचना म ें जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन म ें केंरीय प्रदिू ण जनयंत्रण बोड ा द्वारा
फरवरी, 2016 में जारी ददिाजनदेिों म ें दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गरै -प्रदिू णकारी ईद्योगों की
स्ट्थापना ऄनुज्ञात होगी। आसके ऄजतररि, गैर-प्रदिू णकारी कुटीर ईद्योगों को बढ़ावा ददया जाएगा।
(17) पहाडी ढलानों का सरं क्षण: पहाडी ढलानों का सरं क्षण जनम्नानुसार दकया जाएगा:-
(क) अंचजलक महायोजना म ें पहाडी ढलानों के ईन क्षेत्रों को दिााया जाएगा जजनम ें दकसी भी संजनमााण की
ऄनुज्ञा नहीं होगी;
(ख) जजन ढलानों या जवद्यमान खडी पहाडी ढलानों म ें ऄत्यजधक भू-क्षरण होता ह ैईनम ें दकसी भी संजनमााण की
ऄनुज्ञा नहीं होगी ।
4. पाररजस्ट्थजतकी सवं दे ी जोन म ेंप्रजतजिद्ध या जवजनयजमत दकए जान ेवाल े दक्रयाकलापों की सचू ी- पाररजस्ट्थजतकी संवेदी
जोन म ें सभी दक्रयाकलाप, पयाावरण ऄजधजनयम के ईपबंधों और तटीय जवजनयमन जोन ऄजधसूचना, 2011 एव ं

वाजणजज्यक स्ट्थापना । जनमााण के जसवाय, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के
भीतर या पाररजस्ट्थजतकी संवदे ी जोन की सीमा तक, आनम ें जो भी
ऄजधक जनकट हो, नए वाजणजज्यक होटलों और ररजोटों की स्ट्थापना

पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, पयाटन महायोजना और
लागू ददिाजनदेिों के ऄनुसार आनम ें जो भी ऄजधक जनकट हो, सभी
नए पयाटन दक्रयाकलाप करने या जवद्यमान दक्रयाकलापों का जवस्ट्तार
करने की ऄनुज्ञा होगी ।
9. संजनमााण दक्रयाकलाप । (क) संरजक्षत क्षत्रे की सीमा स े 1 दकलोमीटर के भीतर या
पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, आनमें जो भी ऄजधक
जनकट हो, दकसी भी नय े वाजणजज्यक संजनमााण की ऄनुज्ञा नहीं
होगी:
परंत,ु स्ट्थानीय लोगों को ऄपनी अवास सम्बन्द्धी जनम्नजलजखत

10. गैर प्रदिू णकारी लघ ुईद्योग। फरवरी, 2016 में केन्द्रीय प्रदिू ण जनयंत्रण बोडा द्वारा जारी ईद्योगों के
वगीकरण के ऄनुसार गरै -प्रदिू णकारी ईद्योग तथा ऄपररसंकटमय लघु
और सेवा ईद्योग, कृजि, पुष्प कृजि, बागबानी या कृजि अधाररत
ईद्योग, जो पाररजस्ट्थजतकी संवेदी जोन स े देिी सामजग्रयों स े ईत्पाद
बनाते ह,ैं सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे।
11. वृक्षों की कटाइ । (क) राज्य सरकार के सक्षम प्राजधकारी की पूवा ऄनुमजत के जबना वन
भूजम या सरकारी भूजम या राजस्ट्व भूजम या जनजी भूजम पर वृक्षों की
कटाइ की ऄनुज्ञा होगी ।
(ख) वृक्षों की कटाइ केंरीय या संबंजधत राज्य के ऄजधजनयमों और
ईनके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार जवजनयजमत
होगी ।
12. वन ईत्पादों और गैर काष्ठ वन लाग ू जवजधयों के ऄधीन जवजनयजमत होगा ।

5. पाररजस्ट्थजतकी सवं दे ी जोन ऄजधसचू ना की मानीटरी के जलए मानीटरी सजमजत.- केंरीय सरकार, पयाावरण (संरक्षण)
ऄजधजनयम, 1986 की धारा 3 की ईपधारा (3) के तहत आस ऄजधसूचना की प्रभावी जनगरानी के जलए मानीटरी
सजमजत गरित करती ह,ै जो जनम्नजलजखत स ेजमलकर बनगे ी, ऄथाात ् :-

(सेवारत या सेवाजनवृत्त) म ें एक जविेिज्ञ / प्रकृजत संरक्षण के क्षत्रे म ें काम सदस्ट्य;
करने वाल ेगैर सरकारी संगिन (एनजीओ) के एक प्रजतजनजध।
(vi) भूजवज्ञान और खनन का एक प्रजतजनजध सदस्ट्य;
(vii) लोक जनमााण जवभाग का एक प्रजतजनजध सदस्ट्य;
(viii) राज माग ा का एक प्रजतजनजध सदस्ट्य;
(ix) जजला ग्रामीण जवकास एजेंजसयों का एक प्रजतजनजध सदस्ट्य;
(x) जजला वन ऄजधकारी, कन्द्याकुमारी प्रभाग, नागेरकोआल सदस्ट्य-सजचव।
6. जवचाराथ ाजविय.- (1) मानीटरी सजमजत आस ऄजधसूचना के ईपबंधों के ऄनुपालन की मानीटरी करेगी।
(2) मानीटरी सजमजत का कायाकाल तीन विा तक या राज्य सरकार द्वारा नइ सजमजत का पुनगािन दकए जाने तक
होगा और आसके बाद मानीटरी सजमजत राज्य सरकार द्वारा गरित की जाएगी।
(3) पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अने वाल े और भारत सरकार के तत्क ालीन पयाावरण और वन मंत्रालय की
ऄजधसूचना स.ं का.अ. 1533(ऄ) तारीख 14 जसतंबर, 2006 की ऄनुसूची म ें िाजमल दक्रयाकलापों की आस
ऄजधसूचना के पैरा 4 के ऄधीन सारणी में यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों को छोडकर वास्ट्तजवक
जवजनर्ददष्ट स्ट्थलीय दिाओं के अधार पर मानीटरी सजमजत द्वारा संवीक्षा की जाएगी और ईन्द्ह ें ईि ऄजधसूचना
के ईपबंधों के ऄधीन पूवा पयाावरण ऄनापजत्त के जलए केन्द्रीय सरकार के पयाावरण, वन और जलवायु पररवतान
मंत्रालय को भेजा जाएगा।भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 13
(4) आस ऄजधसूचना के पैरा 4 के ऄधीन सारणी म ें यथा जवजनर्ददष्ट प्रजतजिद्ध दक्रयाकलापों को छोडकर, भारत सरकार
के तत्क ालीन पयाावरण और वन मंत्रालय की ऄजधसूचना संख्या का.अ. 1533(ऄ) तारीख 14 जसतंबर, 2006
की ऄनुसूची म ें िाजमल न दकए गए परंत ु पाररजस्ट्थजतकी संवेदी जोन के ऄतं गता अन े वाले दक्रयाकलापों की
वास्ट्तजवक स्ट्थल- जवजिष्ठ दिाओं के अधार पर मानीटरी सजमजत द्वारा संवीक्षा की जाएगी और ईन्द्ह े संबंजधत
जवजनयामक प्राजधकरणों को भेजा जाएगा।
(5) मानीटरी सजमजत का सदस्ट्य-सजचव या संबंजधत ईपायुि ऐसे व्यजि के जवरूद्ध, जो आस ऄजधसूचना के दकसी
ईपबंध का ईल्लंघन करता ह,ै पयाावरण (संरक्षण) ऄजधजनयम, 1986 की धारा 19 के ऄधीन जिकायत दज ा करन े

सकेगी ।
(7) मानीटरी सजमजत प्रत्येक विा 31 माच ा की जस्ट्थजत के ऄनुसार ऄपनी वार्विक कारावाइ ररपोटा राज्य के मुख्य
वन्द्यजीव वाडान को, ईपाबधं -V म ेंददए गए प्रपत्र के ऄनुसारजून तक 30 ईस विा की , प्रस्ट्ततु करेगी ।
(8) केन्द्रीय सरकार का पयाावरण, वन और जलवाय ु पररवतान मंत्रालय मानीटरी सजमजत को ईसके कृत्यों के प्रभावी
जनवाहन के जलए ऐसे जनदेि दे सकेगा जो वह ईजचत समझे ।
7. आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए केंरीय सरकार और राज्य सरकारयदद , ईपायऄजतररक्त ,

और ईत्तर पर कलाकड मुदनु थरु ाइ बाघ ररजवा के द्वारा अच्छाददत ह।ै ऄभयारण्य के पूवी
ददिा का भाग पुन: कलाकड मदूं नथुराइ बाघ ररजवा के साथ सीमा स े जुडता ह।ै ईत्तर और
पजिम म ें ऄजधसूजचत वन क्षेत्र से जघरे होने के कारण पाररजस्ट्थजतकी संवेदी जोन ऄभयारण्य

पवू ा ईत्तरी कोण से, सीमा दजक्षण की ओर पनागुडी ग्राम म ें ऄभयारण्य सीमा के साथ जाती ह ै
और महन्द्े राजगरी ररजवा वन म ें आसरो कम्पाईंड पहुचाँ ती ह ै और कवलदकनरु-ऄरलवइमोझी
सडक को पार करती ह।ै

ह ै और पुनः पजिमी ऄंजतम म ें आसरो कम्पाईंड वाल पहुचाँ ती ह,ै आसके बाद पोइगइमलाइ
ररजवा वन के साथ पार करती ह ै जहााँ पाररजस्ट्थजतकी संवेदी जोन सीमा िून्द्य ह,ै आसके बाद
यह थाडागइमलाइ एक्सटेंिन ररजवा भूजम (तजमलनाडु वन ऄजधजनयम, 1882 के ऄधीन

अथीचनपधु ुर झील के ऄंतगात पहुचाँ ती ह ै जहााँ यह थोवलाइ चैनल को जद्वजवभाजजत करके
कीचड वाली सडक पहुचाँ कर झील की बाहरी सीमा के साथ पार करती है और कट्टुपुदरु
और ऄलजगयापंजडयापुरम ग्रामों और थोवलाइ चैनल सीमा बनाकर, आन सभी की लम्बाइ के
ऄंतगता अच्छाददत क्षेत्रों के चनै ल के साथ जाती ह ै यह तदीकरनकोनम म ें साइफोन तक
पहुचाँ ती ह।ै
साइफोन को पार करन े के बाद, यह आसके बाद थोवलाइ चनै ल पर अती ह ै और
पुथन डैम चैनल के साथ पार जाती ह ैजहााँ थोवलाइ चैनल अरंभ होती ह।ै
बांध से, यह कोधयार बायं े तट चनै ल से जडु ती ह ैजो दक सीमा को पार करके जाती ह ै
यह मजनयंकुझी पहुचाँ ती ह ै जहााँ सडक चनै ल को काटता ह ै जजसके पररणामस्ट्वरूप सीमा
सडक पर स्ट्थानांतररत हो जाती ह ैऔर सडक पार करके यह पचे ीप्पराइ में बांध पहुचाँ ती ह।ै
बांध तटबंध को पार करके, सीमा थोडालीक्कडु से पझली एस्ट्टेट तक जाती ह ै जहााँ यह
जचत्तर I बांध पहुचाँ ती ह।ै
बांध के ऄतं गता सडक पर जात े हुए, सीमा तटबंध पर पार करके और आसके बाद
बांध सीमा के साथ जाती ह ै यह जचत्तर I और जचत्तर II के बांधों से जुडकर चैनल से जमलती
ह।ै
आस जबन्द्द ु से, सीमा चनै ल सडक पर जाती ह ै यह पथुकनी जंक्िन से और आसके बाद
ऄरुनकनी जंक्िन स े जमलती ह।ै जंक्िन से, पाररजस्ट्थजतकी संवेदी जोन सीमा सडक से सीधी
जाती ह ै और ऄभयारण्य सीमा से जमलती ह ै आसके बाद ऄभयारण्य सीमा के साथ पार करके
ऄंतराज्यीय सीमा तक पहुचाँ ती ह ैजजसमें पाररजस्ट्थजतकी संवेदी जोन िून्द्य ह।ै

ईत्तर पूवा से अरंभ होकर, पाररजस्ट्थजतकी संवेदी जोन सीमा अनदं हनर चैनल पर जाती ह ै और
ररजवा वन सीमा पहुचाँ ती ह ै और ररजव ा वन के ईत्तर पजिम कोण पहुचाँ कर सीमा पर जाती ह ै
और जहााँ यह एक दकलोमीटर बफर बनाए रखती ह।ै
पजिम एक दकलोमीटर बफर स,े यह एक दकलोमीटर बफर रेखा में पवात श्रणे ी को पार करके दजक्षण
की ओर जाती ह ै और जचरमदम ररजवा भूजम (तजमलनाडु वन ऄजधजनयम, 1882 के ऄधीन
धारा 4 की ऄजधसूजचत भूजम) सीमा पहुचाँ ती ह।ै यहां से, यह ररजवा भूजम के साथ जाती ह।ै

S.O. 795(E).—In supersession of Ministry’s draft notification S.O. 3545(E), dated 20th July,
2018, the following draft of the notification, which the Central Government proposes to issue in
exercise of the powers conferred by sub-section (1), read with clause (v) and clause (xiv) of sub-
section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is
hereby published, as required under sub-rule (3) of rule 5 of the Environment (Protection) Rules,
1986, for the information of the public likely to be affected thereby; and notice is hereby given that
the said draft notification shall be taken into consideration on or after the expiry of a period of sixty
days from the date on which copies of the Gazette containing this notification are made available to
the public;
Any person interested in making any objections or suggestions on the proposals contained in
the draft notification may forward the same in writing, for consideration of the Central Government

Draft Notification
WHEREAS, the Kanniyakumari Wildlife Sanctuary is spread over an area of 402.395 square
kilometers and is situated in Agastheeswaram, Thovalai, Kalkulam and Vilavancode Taluks of
Kanniyakumari District in the State of Tamil Nadu. In due recognition of the tremendous biological
potential, major chunk of Kanniyakumari forest division was declared as Kanniyakumari Wildlife
Sanctuary comprising an area of 402.395 square kilometers vide G.O. (Ms) No.128 (E&F) dated
20th November, 2007;
AND WHEREAS, floristically, the Western Ghats is one of the richest areas in our country
harboring not less than 3500 species of flowering plants which is 27% of the Flowering plants in
India. There are 58 endemic genera of which 47 are monotypic. The Agasthiyamalai hills
(Ariyankavu pass to Aralvaimozhi pass) have approximately 189 endemic species. The genetic
resources of endemics like Piper sp, Garcinia, Eugenia, Ixora, Hiptage, Calamus, Amorphophallus
and Dioscorea are recorded in the Sanctuary while endemic medicinal and endangered plants are also
some of the natural wealth of this place;
AND WHEREAS, important flora available in the Sanctuary are karuvelam (Acacia
nilotica), seyakkai (Acacia concinna), parambai (Acacia ferruginea), kattumaram (Albizia falcataria),
chilavagai (Albizia odoratissima), velvagai (Albizia procera), vekkali (Anogeissus latifolia), kola
niyila or vellakkadambu (Anthocephalus cadamba), moongil (Bambusa bambos), kondapanai
(Bentinckia condapanna), perambu (Calamus rotang), kalakkai (Carissa carandas), moongil
(Dendrocalamus strictus), ruthraksham (Elaeocarpus tuberculatus), kodapuli (Garcinia cambogia),
kathadi (Grevillea robusta), thanukku (Gyrocarpus jacquini), acha (Hardwickia binata), nannari
(Hemidesmus indicus), koduka puli (Holarrhena antidysenterica), avi (Holoptelia intergrifolia),
maravetti (Hydnocarpus laurifolia), venteak (Lagerstroemia lanceolata), iluppai (Madhuca latifolia),
maglam (Mimusops elengi), kattujathika (Myristica attennuata), irul (Ochlandra travancorica),
vengai (Pterocarpus marsupium), senchandanam (Pterocarpus santalinus), sandanam (Santalum
album), naval (Syzygium cumini), teak (Tectona grandis), nirmarudhu (Terminalia arjuna),
karimarudhu (Terminalia tomentosa), palai (Wrightia tinctoria), elandai (Zizyphus mauritiana), etc;
AND WHEREAS, Kanniyakumari Wildlife Sanctuary being a part of Western Ghats is rich
in wildlife with at least 40 types of mammals, about 120 species of birds including 14 species of
migratory birds and rich diversity of fishes, reptiles and amphibians. There are more than 2272
species of flowering plants recorded here apart from 62 species of orchids and 91 species of ferns. The
major fauna recorded from the Sanctuary are Asian elephant (Elephas maximus), golden jackal (Canis
aureus), barking deer / Indian muntjak (Muntiacus muntjak), Indian leopard (Panthera pardus fusca),
common palm civet (Paradoxurus hermaphroditus), gaur (Bos gaurus), Indian crested porcupine

mongoose (Herpestes edwardsii), Indian mouse deer (Moschiola meminna), Indian pangolin (Manis
crassicaudata), Indian wild dog (Cuon alpinus), jungle cat (Felis chaus), lion tailed macaque
(Macaca silenus), Nilgiri langur (Trachypithecus johnii), Nilgiri marten (Martes gwatkinsi), Nilgiri
tahr (Hemitragus hylocrius), northern plains grey langur (Semnopithecus entellus), rusty spotted cat
(Prionailurus rubiginosus), sambar deer (Rusa unicolor), slender loris (Loris tardigradus), sloth bear
(Melursus ursinus ursinus), small Indian civet (Viverricula indica), striped hyena (Hyaena hyaena),
royal bengal tiger (Panthera tigris tigris), wild boar (Sus scrofa), etc; while important avifauna of the
Sanctuary are Asian brown flycatcher (Muscicapa dauurica), Asian fairy-bluebird (Irena puella),
Asian koel (Eudynamys scolopaceus), Asian paradise-flycatcher (Terpsiphone paradisi), black-
shouldered kite (Elanus axillaris), blue-winged parakeet (Psittacula columboides), changeable hawk-
eagle (Nisaetus cirrhatus), common flameback woodpecker (Dinopium javanense), coppersmith
barbet (Psilopogon haemacephalus), crested serpent-eagle (Spilornis cheela), emerald dove
(Chalcophaps indica), Asian golden oriole (Oriolus oriolus), Asian sparrowhawk (Accipiter nisus),
great Indian hornbill (Buceros bicornis), greater racket-tailed drongo (Dicrurus paradiseus), grey
junglefowl (Gallus sonneratii), Indian treepie (Dendrocitta vagabunda), little scaly-bellied green
woodpecker (Picus squamatus), malabar trogon (Harpactes fasciatus), nilgiri wood-pigeon (Columba
elphinstonii), plum-headed parakeet (Psittacula cyanocephala), scarlet minivet (Pericrocotus
speciosus), southern hill-myna (Gracula indica), vernal hanging-parrot (Loriculus vernalis), etc;
AND WHEREAS, important Ichthyofauna, amphibians and reptiles of the Kanniyakumari
Wildlife Sanctuary are commerson's glassy perchlet (Ambassis commersonii), spotted snakehead
(Channa punctaus), giant danio (Danio aequipinnatus), orange chromide (Etroplus maculates), sucker
fish (Garra mullya), mozambique tilapia (Oreochromis mossambicus), black mahseer (Tor khudree),
Asian common toad (Duttaphrynus melanostictus), Indian bull / golden frog (Hoplobatrachus
tigerinus), Günther's frog (Indirana diplostica), Gund’s leaping frog (Indirana leptodactylus), black
torrent frog (Micrixalus saxicola), pink-thiged torrent frog (Micrixalus phyllophilus), kalakad
wrinkled frog (Nyctibatrachus vasanthi), golden frog (Rana aurantiaca), bicolored / malabar frog
(Rana curtipes), kalakad gliding frog (Rhacophorus calcadensis), malabar gliding frog (Rhacophorus
malabaricus), marble sand frog (Sphaerotheca rolande), malabar tailed caecilian (Uraeotyphlus
malabaricus), red caecilian (Uraeotyphlus oxyurus), Dubois’ hill frog (Zakerana keralensis), common
krait (Bungarus caeruleus), common green forest lizard (Calotes calotes), Indian chameleon
(Chamaeleo zeylanicus), Indian day gecko (Cnemaspis indica), mugger or marsh crocodile
(Crocodylus palustris), Indian star tortoise (Geochelone elegans), anamalay gecko (Hemidactylus
anamallensis), bamboo pit viper (Trimeresurus gramineus), horseshoe pit viper (Trimeresurus
strigatus), Russell’s viper (Daboia russelii), checkered keelback or asiatic water snake (Xenochropis
piscator), etc;
AND WHEREAS, rare, endangered and threatened species found in the Sanctuary are sage-
leaved alangium (Alangium salvifolium) begonia (Begonia cordifolia), rattlepod (Crotalaria scabra),
Karapu Tekel (Derris benthamii), Munroe’s marble tree (Elaeocarpus munroii), Heydotis (Hedyotis
eualuate), ashok (Polyalthia rufensis), vannila creeper (Vanilla wightiana), (Acranthera grandiflora),
(Actinodaphne lanata), (Anacolosa densiflora (Ceropegia pusilla), (Impatiens neo-barnesii),
(Impatiens nilagirica), (Memecylon flavescens), (Nothopegia aureo-fulva), (Psychotria globicephala),
(Aporosa lindleyana), (Arenga wightii), (Bentinckia condapanna), (Elaeocarpus venustus), (Santalum
album), Nilgiri Tahr (Hemitragus hylocrius), lion-tailed macaque (Macaca silenus), red slender loris
(Loris tardigradus), Asian elephant (Elephas maximus), dhole (Cuon alpinus), royal Bengal tiger
(Panthera tigris tigris), Indian pangolin or scaly anteater (Manis Crassicaudata), etc. While the
endemic species available in the Sanctuary are Aglaia barberi, Batrachostomus moniliger, Atlantia
wightii, Collocalia unicolor, Biophytum intermedium, Dendrocitta leucogastra, Biophytum
longibracteatum, Harpactes fasciatus, Brysophyllum tetrandrum, Iole indica, Canthium
neligherrense, Lonchura kelaarti, Cinnamomum travancorium, Megalaima rubricapilla,
Cymbopogon polyneuros, Megalaima viridis, Cymbopogon travancorensis, Myiophonus horsfieldii,
Derris benthemii, Nectarinia lotenia, Didymocarpus repens, Nectarinia minima, Eugenia
calacadensis, Ocyceros griseus, Eugenia singampattiana, Pomatorhinus horsfieldii, Euphorbia
vajravelui, Psittacula columboides, Gordonia obtuse, Pycnonotus priocephalus, Hedyotis eulata,
Rhopocichla atriceps, Homalium jainii, etc;36 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries
of Kanniyakumari Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from
ecological, environmental and biodiversity point of view and to prohibit industries or class of
industries and their operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v)
and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986
(29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3)
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an
area to an extent varying from 0 (zero) to 3.0 kilometres around the boundary of Kanniyakumari
Wildlife Sanctuary, in Kanniyakumari District in the State of Tamil Nadu as the Eco-sensitive Zone
(hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under,
namely: -
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an
extent of 0 (zero) to 3.0 kilometres around the boundary of Kanniyakumari Wildlife Sanctuary
and the area of the Eco-sensitive Zone is 117.7772 square kilometres. The extent of Eco-sensitive
Zone at various direction of the Protected Area are given below:-

Zero extent of Eco-sensitive Zone in the North, North-East and East directions of
Kanniyakumari Wildlife Sanctuary is due to the bordering Kalakkad Mundanthurai Tiger
Reserve. Similarly, Eco-sensitive Zone extent is zero in the West and North-west as it is
bordering Neyyar Wildlife Sanctuary of Kerala state. In the south, it is zero along the
Poigaimalai Reserve Forest.
(2) The boundary description of Kanniyakumari Wildlife Sanctuary and its Eco-sensitive Zone is
appended in Annexure-I.
(3) The maps of the Kanniyakumari Wildlife Sanctuary demarcating Eco-sensitive Zone along
with boundary details and latitudes and longitudes are appended as Annexure-IIA, Annexure-
IIB, Annexure-IIC and Annexure-IID.
(4) List of geo-coordinates of the boundary of Kanniyakumari Wildlife Sanctuary and Eco-
sensitive Zone are given in Table A and Table B of Annexure III.
(5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-
ordinates at prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of
the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of
publication of this notification in the Official Gazette, in consultation with local people and
adhering to the stipulations given in this notification for approval of the competent authority of
State.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government
in such manner as is specified in this notification and also in consonance with the relevant
Central and State laws and the guidelines issued by the Central Government, if any.भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 37
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the
State Government, for integrating the ecological and environmental considerations into the
said plan:-
(i) Environment;
(ii) Forest and Wildlife;
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Municipal;
(x) Panchayati Raj; and
(xi) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use,
infrastructure and activities, unless so specified in this notification and the Zonal Master Plan
shall factor in improvement of all infrastructure and activities to be more efficient and eco-
friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing
water bodies, management of catchment areas, watershed management, groundwater
management, soil and moisture conservation, needs of local community and such other aspects
of the ecology and environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban
settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as,
parks and like places, horticultural areas, orchards, lakes and other water bodies with
supporting maps giving details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to
prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and
promote eco-friendly development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring
Committee for carrying out its functions of monitoring in accordance with the provisions of
this notification.
3. Measures to be taken by the State Government.- The State Government shall take the
following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces
earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted
into areas for commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purpose other than
that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the
recommendation of the Monitoring Committee, and with the prior approval of the competent
authority under Regional Town Planning Act and other rules and regulations of Central
Government or State Government as applicable and vide provisions of this Notification, to
meet the residential needs of the local residents and for activities such as:-
(i) widening and strengthening of existing roads and construction of new roads;
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local

(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and
industrial development activities without the prior approval of the competent authority under
Regional Town Planning Act and other rules and regulations of the State Government and
without compliance of the provisions of Article 244 of the Constitution or the law for the time
being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers
(Recognition of Forest Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone
shall be corrected by the State Government, after obtaining the views of Monitoring
Committee, once in each case and the correction of said error shall be intimated to the Central
Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any
case except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with
afforestation and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans
for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the
guidelines shall be drawn up by the State Government in such a manner as to prohibit
development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing
tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for
the Eco-sensitive Zone.
(b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in
consultation with State Departments of Environment and Forests.
(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.
(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the
Eco-sensitive Zone.
(e) The activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from
the boundary of the protected area or upto the extent of the Eco-sensitive Zone
whichever is nearer:
Provided that beyond the distance of one kilometre from the boundary of the
protected area till the extent of the Eco-sensitive Zone, the establishment of new
hotels and resorts shall be allowed only in pre-defined and designated areas for eco-
tourism facilities as per Tourism Master Plan;
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-
sensitive Zone shall be in accordance with the guidelines issued by the Central
Government in the Ministry of Environment, Forest and Climate Change and the eco-
tourism guidelines issued by National Tiger Conservation Authority (as amended
from time to time) with emphasis on eco-tourism, eco-education and eco-
development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of
existing tourism activities shall be permitted by the concerned regulatory authorities
based on the actual site specific scrutiny and recommendation of the Monitoring
Committee and no new hotel, resort or commercial establishment construction shall
be permitted within Eco-sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the
gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points,
walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up
for their preservation and conservation as a part of the Zonal Master Plan.भाग II खण् ड (ii) भारत का राजपत्र : ऄसाधारण 39
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical,
architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone
and heritage conservation plan for their conservation shall be prepared as part of the Zonal
Master Plan.
(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be
complied in accordance with the provisions of the Noise Pollution (Regulation and Control)
Rules, 2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be
compiled in accordance with the provisions of the Air (Prevention and Control of Pollution)
Act, 1981 (14 of 1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in
accordance with the provisions of the General Standards for Discharge of Environmental
Pollutants covered under the Environment Act and the rules made thereunder or standards
stipulated by State Government whichever is more stringent.
(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in
accordance with the Solid Waste Management Rules, 2016, published by the Government
of India in the Ministry of Environment, Forest and Climate Change vide notification
number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed
in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with
the existing rules and regulations using identified technologies may be allowed within
Eco-sensitive Zone.
(10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in
accordance with the Bio-Medical Waste Management, Rules, 2016 published by the
Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R 343 (E), dated the 28th March, 2016.
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with
the existing rules and regulations using identified technologies may be allowed within the
Eco-sensitive Zone.
(11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall
be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published
by the Government of India in the Ministry of Environment, Forest and Climate Change vide
notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to
time.
(12) Construction and demolition waste management.- The construction and demolition waste
management in the Eco-sensitive Zone shall be carried out as per the provisions of the
Construction and Demolition Waste Management Rules, 2016 published by the Government
of India in the Ministry of Environment, Forest and Climate Change vide notification number
G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the
provisions of the E-Waste Management Rules, 2016, published by the Government of India in
the Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly
manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan
and till such time as the Zonal Master plan is prepared and approved by the Competent
Authority in the State Government, the Monitoring Committee shall monitor compliance of
vehicular movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance
with applicable laws and efforts shall be made for use of cleaner fuels.40 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no
new polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the
classification of Industries in the guidelines issued by the Central Pollution Control Board
in February, 2016, unless so specified in this notification, and in addition, the non-
polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be
permitted;
(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not
be permitted.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the
Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules
made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact
Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act,
1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972
(53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table
below, namely:-

Provided that, beyond one kilometer from the
boundary of the protected area or upto the extent of
Eco-sensitive Zone whichever is nearer, all new
tourist activities or expansion of existing activities
shall be in conformity with the Tourism Master Plan
and guidelines as applicable.
9. Construction activities. (a) New commercial construction of any kind shall
not be permitted within one kilometer from the
boundary of the protected area or upto extent of
the Eco-sensitive Zone, whichever is nearer:
Provided that, local people shall be permitted to
undertake construction in their land for their use
including the activities mentioned in sub-
paragraph (1) of paragraph 3 as per building
bye-laws to meet the residential needs of the
local residents.
Provided further that the construction activity
related to small scale industries not causing
pollution shall be regulated and kept at the
minimum, with the prior permission from the
competent authority as per applicable rules and
regulations, if any.
(b) Beyond one kilometer it shall be regulated as
per the Zonal Master Plan.
10. Small scale non-polluting industries. Non-polluting industries as per classification of
industries issued by the Central Pollution Control
Board in February, 2016 and non-hazardous, small-
scale and service industry, agriculture, floriculture,
horticulture or agro-based industry producing

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective
monitoring of the provisions of this notification under sub-section (3) of section 3 of the
Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring
Committee, comprising of the following, namely:-

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions
of this notification.
(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the
new Committee by the State Government and subsequently the Monitoring Committee shall be
constituted by the State Government.
(3) The activities that are covered in the Schedule to the notification of the Government of India in
the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th
September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as
specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring
Committee based on the actual site-specific conditions and referred to the Central Government
in the Ministry of Environment, Forest and Climate Change for prior environmental clearances
under the provisions of the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India
in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th
September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as
specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring
Committee based on the actual site-specific conditions and referred to the concerned regulatory
authorities.
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s)
shall be competent to file complaints under section 19 of the Environment Act, against any
person who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry associations or concerned stakeholders to assist in its deliberations
depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the
31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State
as per proforma appended at Annexure V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give
such directions, as it deems fit, to the Monitoring Committee for effective discharge of its
functions.
7. The Central Government and State Government may specify additional measures, if any, for giving
effect to provisions of this notification.
8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by
the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

BOUNDARY DESCRIPTION OF KANNIYAKUMARI WILDLIFE SANCTUARY AND ITS
ECOSENSITIVE ZONE IN THE STATE TAMIL NADU
Block 1 – Comprising of Klamalai, Veerapuli, Veerapuli Extension, Asambu, Thadagaimalai,
Poigaimalai and Mahendragiri Reserve Forests
North The Kanniyakumari Wildlife sanctuary is covered by Neyyar Wildlife Sanctuary
of Keral state on the west and Kalakad Mundanthurai Tiger Reserve on the North.
A portion of the Sanctuary on the eastern side again shares boundary with Kalakad
Mundanthurai Tiger Reserve. Being surrounded by notified forest area on the
North and West, Eco Sensitive zone is not proposed on the Northern and Western

East From the northern corner, the boundary runs along the sanctuary boundary in the
Panagudy village southwards and reaches the ISRO compound in Mahendragiri RF
and traverses the Kavalkinaru-Aralvaimozhi road.
South The boundary starts at the ISRO entrance and traverses the Kavalkinaru-
Aralvaimozhi road and again reaches the ISRO compound wall at the western end,
then traverses along the Poigaimalai reserve forest boundary where the eco
sensitive zone boundary is zero, then it traverses along the Thadagaimalai
extension reserve land (land notified under section 4 of Tamil Nadu Forest Act,
1882) until it reaches the Aathichanpudhur lake falling at the reserve land
boundary where it traverses along the outerboundary of the lake reaching the mud
road that bisects the Thovalai channel and travels along the channel covering areas
falling Kattupudur and Algiapandiapuram villages and on all these lengths, the
Thovalai channel remains the boundary until it reaches the Syphon at
Tadikarankonam.
After traversing on the Syphon, it then catches up the Thovalai channel and
traverses all along the channel to the Puthan dam from where the Thovalai channel
starts.
From the dam, it connects to the Kodhayar left bank channel on which the
boundary traverses until it reaches Maniankuzhi where the road bisects the channel
resulting in boundary shifting to the road and traverses on the road until it reaches
the dam at Pechipparai.
Traversing on the dam embankment, the boundary runs over the road
leading to Thodalikkadu via Pazhali estate from where it reaches the Chittar I dam.
Running on the road inside the dam premise, the boundary traverses on the
embankment and then travels along the dam boundary until it meets the Channel
connecting the Chittar I and Chittar II dams.
From this point, the boundary runs on the channel road till it meets Pathukani
junctionand then the Arunkani junction. From the junction, the ESZ boundary runs
perpendicular to the road and meets the sanctuary boundary then traversing all
along the sanctuary boundary to reach the interstate boundary until which the eco
sensitive zone boundary is zero.
West ESZ boundary runs through Inter State boundary with Kerala State (Neyyar
Wildlife Sanctuary)
North West ESZ boundary runs through Neyyar WLS of Kerala State and Kalakkad
Mundanthurai Tiger reserve
North East ESZ boundary runs through Kalakkad Mundanthurai WLS
South East ESZ boundary runs on the Mahendragiri RF boundary
South West ESZ boundary runs through Inter State boundary with Kerala State
Block 2 – Velimalai RF
North Starting from the east, the ESZ boundary runs on the Anandhanar channel and
reaches the reserve forest boundary and travels over the boundary reaching the
north west corner of the reserve forest and from where it maintains one kilometer
buffer.
West From the one kilometer buffer, it travels southward across the mountain ridges at
one kilometer buffer line and reaches the Chiramadam reserve land (land notified
under section 4 of Tamil Nadu Forest Act, 1882) boundary. From here, it travels

South As the eco sensitive zone boundary falls southwards while traversing the reserve
land boundary, it further continues to run over the reserve land boundary and
connects to the reserve forest boundary and then runs over it until it reaches the
Mukkadal dam.
East From the south eastern corner of the reserve land boundary, it traverses towards
the Mukkadal dam. Here, the eco sensitive zone boundary excludes the dam and
its water spread area and runs along the reserve forest boundary
circumnavigating the waterline and reaches the spillway of the dam and catches
the Anandhanar channel. Then, it runs northward over the channel.
North West ESZ boundary runs on one kilometer buffer from the reserve forest / sanctuary.
North East ESZ boundary runs on the Anandhanar channel
South East ESZ boundary runs on the Chiramadam reserve land boundary.
South West ESZ boundary runs on the Chiramadam reserve land boundary.
Block 3 – Therkumalai East RF and Therkumalai West RF
North Starting from the east at the junction where NH944 (new number) (Nagercoil-
Kavalkinaru NH) meets the NH 44 (Kanniyakumari-Srinagar NH), it traverses
westward along the road line excluding the road and reaches the point where the
road bisects the Thovalai channel.
West From the point of bisection, the ESZ boundary runs on the Thovalai channel
southwards until it reaches Potraiyadi.
South From Potraiyadi, the Thovalai channel runs as Radhapuram channel and reaches
Thirumoola nagar from where it maintains one kilometer buffer.
East From Thirumoola nagar, the ESZ boundary runs on one kilometer buffer line
where it travels the lands in Levinjipuram, T. Karungulam and Pazhavoor
villages and reaches Ananthikulam near the NH944.
North West ESZ boundary runs on the NH944 (new number) (Nagercoil-Kavalkinaru NH)
and reaches the Thovalai Channel.
North East ESZ boundary runs on one kilometer buffer line where it travels in the Pazhavoor
village lands.
South East ESZ boundary runs on the radhapuram channel.
