(1986 का 29) की धारा 3 की ईपधारा (2) के खंड (v) और खंड (xiv) तथा ईपधारा (3) के साथ परित ईपधारा (1) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, जारी करन े का प्रस्ट्ताव करती ह,ै पयाावरण (संरक्षण) ऄजधजनयम, 1986 के जनयम 5 के ईपजनयम (3) की ऄपेक्षानुसार, जनसाधारण की जानकारी के जलए प्रकाजित दकया जाता ह;ै जजनके ईससे प्रभाजवत होने की संभावना ह,ै और यह सूजचत दकया जाता ह ै दक ईि प्रारूप ऄजधसूचना पर, ईस तारीख स,े जजसको आस ऄजधसूचना को ऄंतर्ववष्ट करन े वाले भारत के राजपत्र की प्रजतयां जनसाधारण को ईपलब्ध करा दी जाती ह,ैं साि ददन की ऄवजध की समाजि पर या ईसके पश् चात् जवचार दकया जाएगा; ऐसा कोइ व्यजि, जो प्रारूप ऄजधसूचना म , ऄंतर्ववष्ट प्रस्ट्तावों के संबंध म , कोइ अपजत्त या सुझाव देने का आच्छुक ह,ै वह जवजनर्ददष्ट ऄवजध के भीतर, केन्द्रीय सरकार द्वारा जवचार दकए जाने के जलए ऄपनी अपजत्त या सुझाव सजचव, 52डी/15 के ऄतं गात अता ह।ै कुगजत वन्द्यजीव ऄभयारण्य जहमाचल प्रदेि के चम्बा जजले के भरमौर 1328 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ईप-संभाग म, जस्ट्थत ह ैऔर चम्बा वन्द्यजीव संभाग के प्रिासजनक जनयंत्रण के ऄतं गता अता ह;ै और, कुगजत वन्द्यजीव ऄभयारण्य का नाम कुगजत ग्राम पर रखा गया ह ै जो दक भरमौर ईप-संभाग के अददवासी क्षेत्र के ऄंतगात अता ह।ै ऄभयारण्य ऄजधसूचना संख्या एफटी. 43-51/50-VI ददनांक 19 जसतम्बर, 1962 को मूल रुप से ऄजधसूजचत दकया गया था, ईसके बाद ऄजधसूचना संख्या 5-11/70- एसएफ ददनांक 27 माच,ा 1974 को संिोजधत दकया गया। ऄभयारण्य का कुल क्षेत्रफल 405.49 वगा दकलोमीटर ह।ै ऄभयारण्य पयाावास से और दरू स्ट्थ क्षेत्र म, होत े हुए बुजधल नाला के जलग्रहण क्षेत्र म, भरमौर के पूवा म , जस्ट्थत ह।ै आस प्रकार, आस अदि ा वास स्ट्थान को जहमालयन आबेक्स (कापरा आबेक्स), जहम त,दअु (पथैं ेरा ईनजसया), जहमालयन तहर (हजेमत्रगस जेमलाजहकस), कस्ट्तूरी मगृ (मॉस्ट्कस मॉजसएरीफेरस), घोराल (नेमोथडैस गोरल), त,दअु (पथैं ेरा पाडास), भरू ा भाल ू (ऄरसस ऄरकटोस), काला भालू (सले ेनारक्टोस जथबेटानस), मोनाल (लोफफोरस आपेजेनसे ), पजिमी रागोपैन (रागोपैन मले ानोसेफालस), चकोर (एलेक्टोररस चुकर), कोकलास (पुकारैजसया मैक्रोलोफा), अदद की जविेषता के कारण महत्वपूण ा बताया जा सकता ह;ै और, ऄभयारण्य म, मख्ु य वनस्ट्पजत देवदार (सेडरस देवदार), कैल (जपनस वाजलजचयाना), स्ट्प्रूस (जपका जस्ट्मजथयाना), जसल्वर फर (एजबस पपड्रो), बैन (क्वेरकस सेमीकापोफोजलया), गलु ाबी बुरान (रोडोड,ड्रोन कैम्पैनलु ैटम), अदद ईपलब्ध ह।ै ऄभयारण्य म , चरागाहों के जंगली क्षेत्रों और जवस्ट्तृत चरागाह का ऄच्छा ऄंतराफलक ह ैं जो पिुओं के साथ-साथ पजक्षयों के जलए अदि ा वास स्ट्थान बनात े ह।ैं आसके ऄलावा, "कैपलग" के रूप म , नाजमत एक मंददर समृद्ध धार्वमक और सांस्ट्कृजतक जवरासत का महत्वपूणा प्रजतजनजधत्व ह।ै यह मंददर ग्रेच ू पास की ओर कुग्ती से 5 दकलोमीटर की दरू ी पर जस्ट्थत ह ै और जहमाचल प्रदेि और ऄन्द्य राज्यों के कइ तीथायात्री यहां अत े ह।ैं वन्द्यजीव के ऄलावा, मनोरम घाटी प्रकृजत के प्रजत ईत्साही लोगों के जलए साहजसक रैककग माग ा प्रदान करता ह।ै ऄभयारण्य के दजक्षणी सीमांत पर, प्रजसद्ध कैलाि पवता और मजण महिे झील ह ै जहा ाँ हर साल ऄगस्ट्त-जसतंबर के दौरान मेला मनाया जाता ह ैऔर तीथायात्रा और पयाटन की दजृ ष्ट स े सबस े महत्वपूण ा ह;ै और, कुगजत वन्द्यजीव ऄभयारण्य के चारों ओर के क्षत्रे को, जजसका जवस्ट्तार और सीमाए ं आस ऄजधसूचना के पैरा 1 म , जवजनर्ददष्ट ह,ैं पाररजस्ट्थजतकी, पयाावरणीय और - की दजृ ष्ट स े पाररजस्ट्थजतकी संवेदी जोन के रूप म , सुरजक्षत और सरं जक्षत करना तथा ईि पाररजस्ट्थजतकी संवेदी जोन म , ईद्योगों या ईद्योगों क के प्रचालन तथा प्रसंस्ट्करण को प्रजतजषद्ध करना अवश्यक ह;ै ऄतः, ऄब, केन्द्रीय सरकार, पयाावरण (संरक्षण) ऄजधजनयम, 1986 के जनयम 5 के ईपजनयम (3) के साथ परित पयाावरण (संरक्षण) ऄजधजनयम, 1986 (1986 का 29) ( इ इ क र क ग ) की ईपधारा (1) तथा धारा 3 की ईपधारा (2) एव ं ईपधारा (3) के खंड (v) और खंड (xiv) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, जहमाचल प्रदेि राज्य क चम्बा क कुगजत वन्द्यजीव ऄभयारण्य की सीमा के चारों ओर िून्द्य 1.0 क र तक जवस्ट्ताररत क्षत्रे को पाररजस्ट्थजतकी संवेदी जोन (जजसे आसम, आसके पश् चात ् पाररजस्ट्थजतकी संवेदी जोन कहा गया ह)ै के रूप म ,ऄजधसूजचत करती ह,ै जजसका जववरण जनम्नानुसार है, ऄथाात ् :- 1. पाररजस्ट्थजतकी सवं दे ी जोन का जवस्ट्तार और सीमा . -(1) पाररजस्ट्थजतकी संवेदी जोन क र कुगजत वन्द्यजीव ऄभयारण्य क क र ओर िून्द्य 1.0 क र क जवस्ट्तृत और र क क 38.67 ग क र पाररजस्ट्थजतकी संवेदी जोन का िून्द्य जवस्ट्तार ईजचत िहराया गया ह ै दक “ ऄभयारण्य दजक्षण पूवा पर धौलाधर वन्द्यजीव ऄभयारण्य और ईत्तर पजिम ददिा पर टुंडाह वन्द्यजीव ऄभयारण्य के चारों ओर ह।ै ईत्तरी ददिा पर जहां लहौल और स्ट्पीजत की जजला सीमा के बीच ग्लेजियर और ऄगम्य क्षेत्रों के साथ बफा से ढके पवातों को दिााता ह।ै आसजलए, आन ददिाओं म, पाररजस्ट्थजतकी संवेदी जोन प्रस्ट्ताजवत नहीं दकया गया।” (2) कुगजत वन्द्यजीव ऄभयारण्य और आसके पाररजस्ट्थजतकी संवेदी जोन की सीमा का र ईपाबधं -I क । (3) सीमा जववरण और ऄक्षािं और देिांतर के साथ पाररजस्ट्थजतकी संवेदी जोन के क दिाात े हुए कुगजत वन्द्यजीव ऄभयारण्य क मानजचत्र ईपाबधं -IIक और ईपाबधं -IIख के रूप म , सलं ग्न ह।ैं[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 3 (4) पाररजस्ट्थजतकी संवेदी जोन और कुगजत वन्द्यजीव ऄभयारण्य की सीमा के भू-जनदेिांकों की सूची ईपाबधं -III क सारणी क और र ख म ,दी गइ ह।ै (5) मुख्य पबदओंु पर पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन े वाले ग्रामों की सूची ईनके भू-जनदेिांकों के साथ ईपाबधं -IV के रूप म ,संलग्न ह।ै 2. पाररजस्ट्थजतकी सवं दे ी जोन के जलए अचं जलक महायोजना.– (1) राज्य सरकार, द्वारा पाररजस्ट्थजतकी संवेदी जोन के प्रयोजन के जलए, राजपत्र म , ऄंजतम ऄजधसूचना के प्रकािन की तारीख स े दो वषा की ऄवजध के भीतर, स्ट्थानीय व्यजियों के परामिा से और आस ऄजधसूचना म, ददए गए ऄनुबंधों का पालन करते हुए, राज्य सरकार के सक्षम प्राजधकारी के ऄनुमोदनाथा एक अंचजलक महायोजना बनाइ जायेगी। (2) राज्य सरकार द्वारा पाररजस्ट्थजतकी संवेदी जोन के जलए अचंजलक महायोजना आस ऄजधसचू ना म , जवजनर्ददष् ट रीजत स े तथा प्रासंजगक क,रीय और राज्य जवजधयों के ऄनुरूप तथा क,रीय सरकार द्वारा जारी ददिा जनदेिों, यदद कोइ हों, के ऄनुसार बनायी जाएगी। (3) अंचजलक महायोजना म , पाररजस्ट्थजतकी और पयाावरण संबंधी सरोकारों को िाजमल करने के जलए आस े राज्य सरकार के जनम्नजलजखत जवभागों के परामि ास े बनाया जाएगा, ऄथाात्:- (i) पयाावरण; (ii) वन और वन्द्यजीव; (iii) कृजष; (iv) राजस्ट् व; (v) िहरी जवकास; (vi) पयाटन; (vii) ग्रामीण जवकास; (viii) पसचाइ और बाढ़ जनयंत्रण; (ix) नगरपाजलका; (x) पंचायती राज; (xi) जहमाचल प्रदेि राज्य प्रदषू ण जनयंत्रण बोड;ा और (xii) लोक जन मााण जव भाग (4) जब तक आस ऄजधसूचना म , जवजनर्ददष्ट न हो, अंचजलक महायोजना म , वतामान म , ऄनुमोददत भ-ू ईपयोग, ऄवसंरचना और दक्रयाकलापों पर कोइ प्रजतबंध नहीं लगाया जाएगा तथा अचंजलक महायोजना म , सभी ऄवसंरचनाओं और दक्रयाकलापों म , सुधार करके ईन्द्ह े ऄजधक दक्ष और पाररजस्ट्थजतकी-ऄनुकूल बनाने की व्यवस्ट्था की जाएगी। (5) अंचजलक महायोजना म , वनरजहत और ऄवक्रजमत क्षेत्रों के सुधार, जवद्यमान जल जनकायों के संरक्षण, अवाह क्षेत्रों के प्रबंधन, जल-संभरों के प्रबंधन, भू-जल के प्रबंधन, मृदा और नमी के संरक्षण, स्ट्थानीय जनता की अवश्यकताओं तथा पाररजस्ट्थजतकी एव ं पयाावरण के ऐसे ऄन्द्य पहलुओं की व्यवस्ट्था की जाएगी जजन पर ध्यान ददया जाना अवश्यक ह।ै (6) अंचजलक महायोजना म , सभी जवद्यमान पूजा स्ट् थलों, ग्रामों एवं िहरी बजस्ट्तयों, वनों की श्रेजणयों एव ं दकस्ट् मों, कृजष क्षेत्रों, उपजाउ भूजम, ईद्यानों एव ं ईद्यानों की तरह के हररत क्षेत्रों, बागवानी क्षेत्रों, बगीचों, झीलों और ऄन्द्य जल जनकायों की सीमा का सहायक मानजचत्र के साथ जनधाारण दकया जाएगा। और प्रस्ट्ताजवत भू-ईपयोग की जविेषताओं का ब्यौरा भी ददया जाएंगा। (7) अंचजलक महायोजना म, पाररजस्ट्थजतकी संवेदी जोन म , होने वाले जवकास का जवजनयमन दकया जाएगा और सारणी म , यथासूचीबद्ध पैराग्राफ 4 म, प्रजतजषद्ध एवं जवजनयजमत दक्रयाकलापों का पालन दकया जाएगा। आसम ,4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] स्ट् थानीय जनता की अजीजवका की सुरक्षा के जलए पाररजस्ट्थजतकी-ऄनुकूल जवकास का भी सुजनिय एवं संवधान दकया जाएगा। (8) अंचजलक महायोजना, क्षेत्रीय जवकास योजना की सह-काजलक होगी । (9) ऄनुमोददत अंचजलक महायोजना, जनगरानी सजमजत के जलए एक संदभ ा दस्ट्तावेज होगी तादक वह आस ऄजधसूचना के ईपबंधों के ऄनुसार जनगरानी के ऄपने कताव्यों का जनवाहन कर सके । 3. राज्य सरकार द्वारा दकए जान े वाल े ईपाय.- राज्य सरकार आस ऄजधसूचना के ईपबंधों को प्रभावी बनाने के जलए जनम्नजलजखत ईपाय करेगी, ऄथाात्:- (1) भ-ू ईपयोग.– (क) पाररजस्ट्थजतकी संवेदी जोन म , वनों, बागवानी क्षेत्रों, कृजष क्षेत्रों, मनोरंजन के जलए जचजन्द्हत ईद्यानों और खुल े स्ट्थानों का वहृ द वाजणजज्यक या अवासीय पररसरों या औद्योजगक दक्रयाकलापों के जलए प्रयोग या संपररवतान ऄनुज्ञात नहीं दकया जाएगा: परंत ु पाररजस्ट्थजतकी संवेदी जोन के भीतर भाग (क), म , जवजनर्ददष्ट प्रयोजन स े जभन्न प्रयोजन के जलए कृजष और ऄन्द्य भूजम का संपररवतान, मानीटरी सजमजत की जसफाररि पर और सक्षम प्राजधकारी के पूवा ऄनुमोदन से क्षेत्रीय नगर योजना ऄजधजनयम तथा यथा लाग ू केन्द्रीय सरकार एव ं राज्य सरकार के ऄन्द्य जनयमों एवं जवजनयमों के ऄधीन तथा आस ऄजधसूचना के ईपबंधों के ऄनुसार स्ट्थानीय जनवाजसयों की जनम्नजलजखत अवासीय जरूरतों को पूरा करने के जलए ऄनुज्ञात दकया जाएगा जैस:े - (i) जवद्यमान सड़कों को चौड़ा करना, ईन्द्ह ,सुदढृ करना और नइ सड़कों का संजनमााण करना; (ii) बुजनयादी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण; (iii) प्रदषू ण ईत्पन्न न करने वाल े लघ ुईद्योग; (iv) कुटीर ईद्योग एव ं ग्राम ईद्योग; पाररजस्ट्थजतकी पयाटन म , सहायक सुजवधा भण्डार, और स्ट्थानीय सुजवधाएं तथा ग्रह वास; और (v) पैरा -4 म , ईजल्लजखत दक्रयाकलाप को बढ़ावा देनाः परंत ु यह भी दक क्षेत्रीय िहरी जनयोजन ऄजधजनयम के ऄधीन सक्षम प्राजधकारी के पूवा ऄनमु ोदन के जबना तथा राज्य सरकार के ऄन्द्य जनयमों एव ं जवजनयमों एव ं सजं वधान के ऄनुच्छेद 244 के ईपबंधों तथा तत्समय प्रवृत्त जवजध, जजसके ऄंतगता ऄनुसूजचत जनजाजत और ऄन्द्य परंपरागत वन जनवासी (वन ऄजधकारों की मान्द्यता) ऄजधजनयम, 2006 (2007 का 2) भी अता ह,ै का ऄनुपालन दकए जबना वाजणजज्यक या औद्योजगक जवकास दक्रयाकलापों के जलए जनजातीय भूजम का प्रयोग ऄनुज्ञात नहीं होगा: परंत ु यह भी दक पाररजस्ट् थजतकी संवेदी जोन के ऄतं गता अन े वाली भूजम के ऄजभलेखों म, हुइ दकसी त्रुरट को, मानीटरी सजमजत के जवचार प्राि करन े के पिात्, राज्य सरकार द्वारा प्रत्येक मामल े म , एक बार सुधारा जाएगा और ईि त्रुरट को सुधारन े की सूचना क,रीय सरकार के पयाावरण, वन और जलवाय ुपररवतान मंत्रालय को दी जाएगी: परंत ु यह भी दक ईपयुाि त्रुरट को सुधारन े म,, आस ईप-पैरा म, यथा ईपबंजधत के जसवाय, दकसी भी दिा म , भू-ईपयोग का पररवतान िाजमल नहीं होगा (ख) ऄनुप्रय ु या ऄनुत् पादक कृजष क्षेत्रों म, पनु : वनीकरण तथा पयाावासों बहाली के प्रयास दकए जाएंगे। (2) प्राकृजतक जल स्रोत.- अंचजलक महायोजना म , सभी प्राकृजतक जलमागों के अवाह क्षेत्रों की पहचान की जाएगी और अंचजलक महायोजना म , ईनके संरक्षण और बहाली की योजना सजम् मजलत की जाएगी और राज्य सरकार द्वारा जल अवाह प्रबंधन योजना आस रीजत से बनाइ जाएगी दक ईसम, अवाह क्षेत्रों म , जवकास दक्रयाकलापों को प्रजतजषद्ध और जनबंजधत दकया गया हो । (3) पयटा न एव ं पाररजस्ट्थजतकी पयटा न.– (क) पाररजस्ट्थजतकी संवेदी जोन म , सभी नए पाररजस्ट्थजतकी पयाटन दक्रयाकलाप या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेदी जोन सम्बंधी पयाटन महायोजना के ऄनुसार ऄनुज्ञात होगा।[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 5 (ख) पाररजस्ट्थजतकी पयाटन महायोजना राज्य सरकार के पयावा रण और वन जवभाग के परामिा से राज्य के पयाटन जवभाग द्वारा बनायी जाएगी। (ग) पयाटन महायोजना अंचजलक महायोजना का घटक होगी। (घ) पयाटन महायोजना पाररजस्ट्थजतकी संवेदी जोन की वहन क्षमता के अधार पर तैयार की जायेगी; (ङ) पाररजस्ट्थजतकी पयाटन संबधं ी दक्रयाकलाप जनम्न ानुसार जवजनयजमत दकए जाएंग,े ऄथाात:्- (i) र की सीमा स े एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, आनम , जो भी ऄजधक जनकट हो, दकसी होटल या ररजॉट ा का नया सजन्नमााण ऄनुज्ञात नहीं दकया जाएगाः परंत ु यह, पाररजस्ट्थजतकी पयाटन सुजवधाओं के जलए र की सीमा स े क दकलोमीटर की दरू ी स े परे पाररजस्ट्थजतकी सवं ेदी जोन की सीमा तक पूवा पररभाजषत और ऄभीजहत क्षेत्रों म , पयाटन महायोजना के ऄनुसार, नए होटलों और ररजॉट ा की स्ट्थापना ऄनुज्ञात होगी; (ii) पाररजस्ट्थजतकी संवेदी जोन के ऄन्द्दर सभी नए पयाटन दक्रया-कलापों या जवद्यमान पयाटन दक्रयाकलापों का जवस्ट्तार, केन्द्रीय सरकार के पयाावरण, वन और जलवायु पररवतान मंत्रालय द्वारा जारी ददिाजनदेिों तथा पाररजस्ट्थजतकी पयाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल देन े वाले राष्ट्रीय व्याघ्र संरक्षण प्राजधकरण द्वारा जारी पाररजस्ट्थजतकी पयाटन संबंधी ददिाजनदिे ों (समय-समय पर यथा संिोजधत) के ऄनुसार होगा; (iii) अंचजलक महायोजना का ऄनुमोदन होने तक, पयाटन के जवकास और जवद्यमान पयाटन दक्रयाकलापों के जवस्ट्तार को वास्ट्तजवक स्ट्थल-जवजिष्ट संवीक्षा तथा मानीटरी सजमजत की जसफाररि के अधार पर संबंजधत जवजनयामक प्राजधकरणों द्वारा ऄनुज्ञात दकया जाएगा और पाररजस्ट्थजतकी संवेदी जोन म , दकसी नए होटल/ ररजॉटा या वाजणजज्यक प्रजतष्ठान का संजन्नमााण ऄनुज्ञात नहीं होगा । (4) प्राकृजतक जवरासत.– पाररजस्ट्थजतकी संवेदी जोन के ऄंतगात अन े वाले बहुमल्ू य प्राकृजतक जवरासत के सभी स्ट्थलों जैसे दक जीन पूल ररजव ा क्षत्रे , िैल संरचना, जल प्रपात, झरन,े दरे, ईपवन, गुफाए,ं स्ट्थल, वनपथ, रोहण माग,ा ईत्प्रपात अदद की पहचान की जाएगी और ईनकी सुरक्षा एव ं संरक्षण के जलए अंचजलक महायोजना के भाग के रूप म , एक जवरासत संरक्षण योजना बनायी जाएगी। (5) मानव जनर्वमत जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेदी जोन म, भवनों, संरचनाओं, कलाकृजत-क्षेत्रों तथा ऐजतहाजसक, स्ट्थापत्य संबधी, सौंदयाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों की पहचान की जाएगी और ईनके संरक्षण के जलए अंचजलक महायोजना के भाग के रूप म , एक जवरासत संरक्षण योजना बनायी जाएगी। (6) ध्व जन प्रदषू ण.- पयाावरण ऄजधजनयम के ऄधीन ध्वजन प्रदषू ण (जवजनयमन और जनयंत्रण) जनयम, 2000 म , जनयत ईपबंधों के ऄनुसार पाररजस्ट्थजतकी संवेदी जोन म, ध्वजन प्रदषू ण की रोकथाम एवं जनयंत्रण के जलए जवजनयमों का ऄनुपालन दकया जाएगा । (7) वाय ु प्रदषू ण.- पाररजस्ट्थजतकी सवं ेदी जोन म,, वायु प्रदषू ण के जनवारण और जनयंत्रण का वायु (प्रदषू ण जनवारण और जनयंत्रण) ऄजधजनयम, 1981 (1981 का 14) और ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार ऄनुपालन दकया जाएगा । (8) बजहस्राव का जनस्ट्सारण.- पाररजस्ट्थजतकी संवेदी जोन म , ईपचाररत बजहस्राव का जनस्ट्सारण, पयाावरण ऄजधजनयम और ईसके ऄधीन बनाए गए जनयमों के ऄधीन अने वाल े पयाावरणीय प्रदषू ण के जनस्ट्सारण के जलए साधारण मानकों या राज्य सरकार द्वारा जनयत मानकों, जो भी ऄजधक किोर हो, के ईपबंधों के ऄनुसार होगा। (9) िोस ऄपजिष्ट.- िोस ऄपजिष्ट का जनपटान एव ं प्रबन्द्धन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म , िोस ऄपजिष्ट का जनपटान और प्रबंधन पयाावरण, वन और जलवायु पररवतना मंत्रालय म, भारत सरकार की समय-समय पर यथा संिोजधत ऄजधसूचना स.ं का.अ. 1357(ऄ), ददनांक 8 ऄप्रैल, 2016 के तहत प्रकाजित िोस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ऄकाबाजनक पदाथो का जनपटान पाररजस्ट्थजतकी संवेदी जोन स े बाहर जचजन्द्हत दकए गए स्ट्थानों पर पयाावरण- ऄनुकूल रीजत स े दकया जाएगा; (ख) पाररजस्ट्थजतकी संवेदी जोन म , मान्द्य प्रौद्योजगदकयों का प्रयोग करत े हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप िोस ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनुकूल प्रबंधन (इएसएम) ऄनुज्ञात दकया जायेगा। (10) जैव जचदकत्सा ऄपजिष्ट .- जैव जचदकत्सा ऄपजिष्ट का प्रबंधन जनम्नानुसार दकया जाएगा:- (क) पाररजस्ट्थजतकी संवेदी जोन म, जैव जचदकत्सा ऄपजिष्ट का जनपटान भारत सरकार के पयाावरण, वन और जलवाय ु पररवतान मंत्रालय द्वारा ऄजधसूचना स.ं सा.का.जन 343 (ऄ), तारीख 28 माच,ा 2016 के तहत प्रकाजित जैव जचदकत्सा ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा । (ख) पाररजस्ट्थजतकी संवेदी जोन म , मान्द्य प्रौद्योजगदकयों का प्रयोग करते हुए जवद्यमान जनयमों और जवजनयमों के ऄनुरूप िोस ऄपजिष्ट का सुरजक्षत और पयाावरण ऄनुकूल प्रबधं न ऄनुज्ञात दकया जायेगा। (11) प्लाजस्ट्टक ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन म , प्लाजस्ट्टक ऄपजिष्ट का प्रबंधन, पयाावरण, वन और जलवायु पररवतान मंत्रालय म, भारत सरकार की समय-समय पर यथा संिोजधत ऄजधसूचना स.ं सा.का.जन 340(ऄ), तारीख 18 माच,ा 2016 के तहत प्रकाजित प्लाजस्ट्टक ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधो के ऄनुसार दकया जाएगा। (12) जनमाणा और जवध्वसं ऄपजिष्ट का प्रबधं न.- पाररजस्ट्थजतकी संवेदी जोन म , जनमााण और जवध्वंस ऄपजिष्ट का प्रबंधन, पयाावरण, वन और जलवायु पररवतना मंत्रालय म , भारत सरकार की समय-समय पर यथा संिोजधत ऄजधसूचना स.ं सा.का.जन 317(ऄ), तारीख 29 माच,ा 2016 के तहत प्रकाजित संजनमााण और जवध्वंस ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (13) इ–ऄपजिष्ट.- पाररजस्ट्थजतकी संवेदी जोन म , इ–ऄपजिष्ट का प्रबंधन, पयाावरण, वन और जलवाय ु पररवतना मंत्रालय म, भारत सरकार द्वारा प्रकाजित तथा समय-समय पर यथा संिोजधत इ–ऄपजिष्ट प्रबंधन जनयम, 2016 के ईपबंधों के ऄनुसार दकया जाएगा। (14) सड़क-यातायात.- सड़क-यातायात को पयाावास-ऄनुकूल तरीके स े जवजनयजमत दकया जाएगा और आस संबंध म , अंचजलक महायोजना म , जविेष ईपबंध िाजमल दकए जाएगं े। अंचजलक महायोजना के तैयार होने और राज्य सरकार के सक्षम प्राजधकारी स े ऄनुमोददत होने तक, मानीटरी सजमजत प्रासंजगक ऄजधजनयमों और ईनके तहत बनाए गए जनयमों एव ं जवजनयमों के ऄनुसार सड़क-यातायात के ऄनुपालन की मानीटरी करेगी। (15) वाहन जजनत प्रदषू ण.- वाहन जजनत प्रदषू ण की रोकथाम और जनयंत्रण लाग ू जवजधयों के ऄनुसार दकया जाएगा। स्ट्वच्छतर ईंधन के ईपयोग के जलए प्रयास दकए जाएंगे । (16) औद्योजगक इकाआया.ं- (i) सरकारी राजपत्र म , आस ऄजधसूचना के प्रकािन की तारीख को या ईसके बाद पाररजस्ट्थजतकी संवेदी जोन म ,दकसी नए प्रदषू णकारी ईद्योग की स्ट्थापना ऄनज्ञु ात नहीं होगी। (ii) जब तक आस ऄजधसूचना म , जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन म , क,रीय प्रदषू ण जनयंत्रण बोड ा द्वारा फरवरी, 2016 म, जारी ददिाजनदेिों म , दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गरै -प्रदषू णकारी ईद्योगों की स्ट्थापना ऄनुज्ञात होगी। आसके ऄजतररि, गैर-प्रदषू णकारी कुटीर ईद्योगों को बढ़ावा ददया जाएगा। (17) पहाड़ी ढलानों का सरं क्षण.- पहाड़ी ढलानों का संरक्षण जनम्नानुसार दकया जाएगा:- (क) अंचजलक महायोजना म , पहाड़ी ढलानों के ईन क्षेत्रों को दिााया जाएगा जजनम , दकसी भी संजनमााण की ऄनुज्ञा नहीं होगी । (ख) जजन ढलानों या जवद्यमान खड़ी पहाड़ी ढलानों म , ऄत्यजधक भू-क्षरण होता ह ैईनम , दकसी भी संजनमााण की ऄनुज्ञा नहीं होगी । 4. पाररजस्ट्थजतकी सवं दे ी जोन म , प्रजतजषद्ध या जवजनयजमत दकए जान े वाल े दक्रयाकलापों की सचू ी- पाररजस्ट्थजतकी संवेदी जोन म , सभी दक्रयाकलाप, पयाावरण ऄजधजनयम के ईपबंधों और तटीय जवजनयमन जोन ऄजधसूचना, 2011 एव ं पयाावरणीय प्रभाव अकलन ऄजधसूचना, 2006 सजहत ईसके ऄधीन बने जनयमों और वन (संरक्षण) ऄजधजनयम,[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 7 1980 (1980 का 69), भारतीय वन ऄजधजनयम, 1927 (1927 का 16), वन्द्यजीव (संरक्षण) ऄजधजनयम, 1972 (1972 का 53) सजहत ऄन्द्य लागू जनयमों तथा ईनम , दकए गए संिोधनों के ऄनुसार िाजसत 1995 का 202 म , टी.एन. गौडाबमान जथरुमूलपाद बनाम भारत संघ के मामल ेम ,अदेि तारीख 4 ऄगस्ट्त, 2006 और ररट याजचका (सी) स.ं 2012 का 435 म , गोवा फाईंडेिन बनाम भारत संघ के मामले म , तारीख 21 ऄप्रैल, 2014 के अदेि के ऄनुसरण म ,प्रचालन होगा । 2. प्रदषू ण (जल, वाय,ु मृदा, ध्वजन, पाररजस्ट्थजतकी संवेदी जोन म , कोइ नया ईद्योग लगान े और वतामान अदद) ईत्पन्न करने वाले ईद्योगों प्रदषू णकारी ईद्योगों का जवस्ट्तार करने की ऄनुमजत नहीं होगीः की स्ट्थापना । जब तक दक आस ऄजधसूचना म , जवजनर्ददष्ट न हो, पाररजस्ट्थजतकी संवेदी जोन म , फरवरी, 2016, म , क,रीय प्रदषू ण जनयंत्रण बोड ा द्वारा जारी ददिाजनदेिों म , दकए गए ईद्योगों के वगीकरण के ऄनुसार केवल गरै - प्रदषू णकारी ईद्योगों की स्ट्थापना होगी। आसके ऄजतररि, गैर-प्रदषू णकारी कुटीर ईद्योगों को प्रोत्साहन ददया जाएगा। 3. बड़ी जल जवद्युत पररयोजनाओं की लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन्द्यथा ईपबंजधत के जसवाय) स्ट्थापना । होंगे। 4. दकसी पररसंकटमय पदाथ ा का लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन्द्यथा ईपबंजधत के जसवाय) प्रयोग या ईत्पादन या प्रस्ट्संकरण । होंगे। 5. प्राकृजतक जल जनकायों या भजू म लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन्द्यथा ईपबंजधत के जसवाय) क्षत्रे म , ऄनपु चाररत बजहस्रावों का होंगे। जनस्ट्सारण । 6. नइ अरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेदी जोन के भीतर नइ और जवद्यमान अरा जमलों का जवस्ट्तार ऄनुज्ञात नहीं होगा । 7. ईंट भट्टों की स्ट्थापना करना। लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन्द्यथा ईपबंजधत के जसवाय) होंगे । 8. जलावन लकड़ी का वाजणजज्यक लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन्द्यथा ईपबंजधत के जसवाय) ईपयोग। होंगे । 9. पोजलथीन बगै ों का प्रयोग । लाग ू जवजधयों के ऄनुसार प्रजतजषद्ध (ऄन्द्यथा ईपबंजधत के जसवाय) जोन की सीमा तक, आनम , जो भी ऄजधक जनकट हो, नए वाजणजज्यक होटलों और ररसोटो की स्ट्थापना ऄनुज्ञात नहीं होगी: परंतु, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर बाहर या पाररजस्ट्थजतकी संवेदी जोन की सीमा तक, पयाटन महायोजना और लागू ददिाजनदेिों के ऄनुसार आनम , जो भी ऄजधक जनकट हो, सभी नए पयाटन दक्रयाकलाप करने या जवद्यमान दक्रयाकलापों का जवस्ट्तार करने की ऄनुज्ञा होगी । 12. संजनमााण दक्रयाकलाप । (क) संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर या पाररजस्ट्थजतकी संवेदी जोन के जवस्ट्तार तक जो भी जनकट हो, दकसी भी प्रकार का वाजणजज्यक संजनमााण ऄनुज्ञात नहीं दकया जाएगा: परंतु स्ट्थ ानीय लोगों को पैरा 3 के ईप परै ा (1) म , सचू ीबद्ध दक्रयाकलापों सजहत ईनके ईपयोग के जलए ईनकी भूजम म , स्ट्थानीय जनवाजसयों की अवासीय अवश्यकताओं को पूरा करने जलए संजनमााण करने की ऄनुमजत भवन ईपजवजधयों के ऄनुसार दी जाएगी परन्द्तु ऐस े लघ ु ईद्योगों जो प्रदषू ण ईत् पन्द्न नहीं करते ह,ैं स े सबं ंजधत संजनमााण दक्रयाकलाप जवजनयजमत दकए जाएंग े और लाग ू जनयमों और जवजनयमों, यदद कोइ हों, के ऄनुसार सक्षम प्राजधकारी की पूव ा ऄनुमजत स ेही न्द् यनू तम पर रखे जाएंगे । (ख) एक दकलोमीटर स े अग े अंचजलक महायोजना की ऄनुसार जवजनयजमत होंगे । 13. गैर प्रदषू णकारी लघ ुईद्योग। फरवरी, 2016 म , केन्द्रीय प्रदषू ण जनयंत्रण बोड ा द्वारा जारी ईद्योगों के वगीकरण के ऄनुसार गरै -प्रदषू णकारी ईद्योग तथा ऄपररसंकटमय लघ ु और सेवा ईद्योग, कृजष, पुष्प कृजष, बागबानी या कृजष अधाररत ईद्योग, जो पाररजस्ट्थजतकी संवेदी जोन से देिी सामजग्रयों स े ईत्पाद बनाते ह,ैं सक्षम प्राजधकारी द्वारा ऄनुज्ञात होंगे। 14. वृक्षों की कटाइ । (क) राज्य सरकार के सक्षम प्राजधकारी की पूवा ऄनुमजत के जबना वन भूजम या सरकारी या राजस्ट्व या जनजी भूजम पर वृक्षों की कटाइ नहीं होगी । (ख) वृक्षों की कटाइ क,रीय या संबंजधत राज्य के ऄजधजनयम या ईसके ऄधीन बनाए गए जनयमों के ईपबंधों के ऄनुसार जवजनयजमत होगी । 15. वन ईत्पादों और गैर काष्ठ वन लाग ू जवजधयों के ऄधीन जवजनयजमत होगा । ऄधीन जवजनयजमत होगा । संरक्षण । 21. राजत्र म , वाहन यातायात का लाग ू जवजधयों के ऄधीन वाजणजज्यक प्रयोजन के जलए जवजनयजमत संचलन । होगा । 22. स्ट्थानीय जनता द्वारा ऄपनायी स्ट्थानीय जनता के प्रयोग के जलए लाग ू जवजधयों के ऄधीन ऄनुज्ञात जा रही वतामान कृजष और होंगे। बागवानी पद्धजतयों के साथ डेयररयां, दग्ु ध ईत्पादन, जल कृजष और मत्स्ट्य पालन। 23. फमों, कारपोरेट, कंपजनयों द्वारा स्ट्थानीय अवश्यकताओं को परू ा करने के जलए लागू जवजधयों के बड़े पैमाने पर वाजणजज्यक पिधु न ऄधीन जवजनयजमत (ऄन्द्यथा प्रदान दकए गए) होंगे संपदा और कुक्कुट फामों की स्ट्थापना । 24. प्राकृजतक जल जनकायों या भू क्षत्रे जल जनकायों म, के प्रजत जागरुकता। सदक्रय रूप स े बढ़ावा ददया जाएगा । 5. पाररजस्ट्थजतकी-सवं दे ी जोन ऄजधसचू ना की जनगरानी के जलए जनगरानी सजमजत.- आस ऄजधसूचना के ईपबंधों की प्रभावी जनगरानी के जलए क,रीय सरकार, पयाावरण (सरं क्षण) ऄजधजनयम, 1986, की धारा 3 की ईपधारा (3) एतद्वारा, एक मानीटरी सजमजत का गिन करेगी जो जनम्नजलजखत स े जमलकर बनेगी, ऄथाात ् :- क्र.स. मानीटरी सजमजत का गिन पद नाम (i) पाररजस्ट्थजतकी, प्रबंधकीय या प्रिासजनक ऄनुभव और स्ट्थानीय मुद्दों की ऄध् यक्ष, ; समझ वाला एक प्रजतजष्ठत व्यजि। (ii) प्रभागीय वन ऄजधकारी (प्रादेजिक) सदस्ट्य; (iii) राज्य सरकार द्वारा नाजमत दकए जाने वाले वन्द्यजीव संरक्षण के की जस्ट्थजत के ऄनुसार ऄपनी वार्वषक कारावाइ ररपोटा राज्य के मुख्य वन्द्यजीव वाडान को, ईपाबधं V म , ददए गए प्रपत्र के ऄनुसार, ईस वषा की 30 जनू तक प्रस्ट्तुत करेगी । (8) केन्द्रीय सरकार का पयाावरण, वन और 32035‟00” N Latitudes and 76034‟23” E to 76053‟02” E Longitudes which falls on Survey of India toposheet No.52D/10,52D/11,52D/14 and 52D/15 on scale1:50,000. The Kugti Wildlife Sanctuary is located in Bharmour sub-division of Chamba district of Himachal Pradesh and falls under the administrative control of Wildlife Division Chamba; AND WHEREAS, Kugti Wildlife Sanctuary is named after the Kugti village which falls in Bharmour sub-division of tribal area. The Sanctuary was originally notified vide Notification No. Ft. 43-51/50-VI dated 19th September, 1962, further revised vides No. 5-11/70-SF dated 27th March, 1974. The total area of the Sanctuary is 405.49 square kilometres. The Sanctuary is located in the east of Bharmour in the catchment of Budhil nallah away from habitation and in the remote area. Thus, the significance can be attributed to the ideal habitat harbouring Himalayan Ibex (Capra ibex), snow leopard (Panthera uncia) ,Himalayan tahr (Hemitragus jemlahicus), musk deer (Moschus moschieferus), ghoral (Nemorthaedus goral), leopard (Panthera pardus), brown bear (Ursus arctos), black bear (Selenarctos thibetanus), monal (Lophophorous impejanus), western tragopan (Tragopan melanocephalus), chakor (Alectoris chukar), koklas (Pucrasia macrolopha), etc; AND WHEREAS, the major flora available in the Sanctuary are deodara (Cedrus deodara), kail (Pinus wallichiana), spruce (Picea smithiana), silver fir (Abies pindrow), ban (Quercus semicarpofolia), pink burans (Rhododendron campanulatum), etc. The Sanctuary has good interface of wooded areas and vast expenses of pastures that forms an ideal habitat for animals as well as birds. Besides this, one temple named as “Kailing” is an important representation of the rich religious and cultural heritage. This temple is located at a16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] distance of 5 kilometres from Kugti towards Grechu pass and is visited by many pilgrims of Himachal Pradesh and other states. Apart from wildlife, the panoramic valley provides an adventurous trekking route for nature enthusiasts. On the southern fringe of the Sanctuary, there is the famous Kailash Mountain and Mani Mahesh Lake where fair is celebrated during August-September every year and is most important from pilgrimage and tourism point of view; AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Kugti Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act 1986 (29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying from zero to 1.0 kilometre around the boundary of Kugti Wildlife Sanctuary, in Chamba district in the State of Himachal Pradesh as the Eco-sensitive Zone (hereafter in this notification referred to as the Eco-sensitive Zone) details of which are as under, namely: - 1. Extent and boundaries of Eco-sensitive Zone. – (1) The extent of Eco-sensitive Zone shall vary from zero to 1.0 kilometre around the boundary of Kugti Wildlife Sanctuary and the area of the Eco-sensitive Zone is 38.67 square kilometres. Zero extent of Eco-sensitive Zone was justified as “the Sanctuary is surrounded by Dhauladhar Wildlife Sanctuary on South East side and Tundah Wildlife Sanctuary on North West direction. On the Northern side the district boundary of Lahual and Spiti lies, exhibiting snow bound mountains with glaciers and inaccessible terrains. Hence, No Eco-sensitive Zone has been proposed in these directions”. (2) The boundary description of Kugti Wildlife Sanctuary and its Eco-sensitive Zone is appended in Annexure-I. (3) The maps of the Kugti Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary details and latitudes and longitudes are appended as Annexure-IIA and Annexure-IIB. (4) Lists of geo-coordinates of the boundary of Kugti Wildlife Sanctuary and Eco-sensitive Zone are given in Table A and Table B of Annexure III. (5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co- ordinates at prominent points is appended as Annexure-IV. 2. Zonal Master Plan for Eco-sensitive Zone.-(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority of State. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any. (3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental considerations into the said plan:- (i) Environment; (ii) Forest and Wildlife; (iii) Agriculture;[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 17 (iv) Revenue; (v) Urban Development; (vi) Tourism; (vii) Rural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Himachal Pradesh State Pollution Control Board; and (xii) Public Works Department. (4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly. (5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention. (6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features. (7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities‟ livelihood. (8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan. (9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification. 3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:- (1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or residential or industrial activities: Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central Government or State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents and for activities such as:- (i) widening and strengthening of existing roads and construction of new roads; (ii) construction and renovation of infrastructure and civic amenities; (iii) small scale industries not causing pollution; (iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (v) promoted activities given under paragraph 4: Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of Article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): Provided also that any error appearing in the land records within the Eco- sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change: Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph. (b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities. (2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas. (3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone. (b) The Eco-Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with State Departments of Environment and Forests. (c) The Tourism Master Plan shall form a component of the Zonal Master Plan. (d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone. (e) The activities of eco-tourism shall be regulated as under, namely:- (i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is nearer: Provided that beyond the distance of one kilometre from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan; (ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development; (iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.[भाग II—खण् ड 3(ii)] भारत का राजपत्र : ऄसाधारण 19 (4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan. (5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan. (6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 under the Environment Act. (7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder. (8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environment Act and the rules made thereunder or standards stipulated by State Government whichever is more stringent. (9) Solid wastes.- Disposal and Management of solid wastes shall be as under:- (a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone; (b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-sensitive Zone. (10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:- (a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016. (b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone. (11) Plastic waste management.- The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time. (12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time. (13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. (14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder. (15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels. (16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco- sensitive Zone. (ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted. (17) Protection of hill slopes.- The protection of hill slopes shall be as under:- (a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted; (b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted. 4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the protected area or upto extent of the Eco-sensitive Zone, whichever is nearer: Provided that, local people shall be permitted to undertake construction in their land for their use including the activities mentioned in sub- paragraph (1) of paragraph 3 as per building bye-laws to meet the residential needs of the local residents. Provided further that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any. (b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan. 13. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:- S N Constituent of the Monitoring Committee Designation An eminent person with proven having knowledge of ecology, (i) managerial or administrative experience and understanding of Chairman, ex officio local issues. (ii) Divisional Forest Officer (Territorial) Member; A representative of Non-governmental Organisation working in (iii) the field of wildlife conservation to be nominated by the State Member; Government XEN, HP Pollution Control Board, having jurisdiction of the (iv) Member; area (v) An expert in Biodiversity nominated by the State Government Member; One expert in Ecology from reputed institution or university of (vi) Member; the State (vii) Sub-Divisional Magistrate, Bharmour or his representative Member; (viii) D ivisional Forest Officer (Wildlife) Member-Secretary. 6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions of this notification. (2) The tenure of the Monitoring committee shall be for three years or till the re- constitution of the new Committee by the State Government and subsequently the Monitoring Committee shall be constituted by the State Government. (3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest number S.O. 1533 (E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site- specific conditions and referred to the concerned regulatory authorities. (5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment Act, against any person who contravenes the provisions of this notification. (6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per proforma appended at Annexure V. (8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions. 7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification. 8. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon‟ble Supreme Court of India or High Court or the National Green Tribunal. [F.
