This gazette notification is a corrigendum to a previous notification regarding the recognition of property rights of residents in unauthorized colonies in Delhi.
Specifically, it corrects the sub-regulation (ii) of Regulation 3 of the National Capital Territory of Delhi (Recognition of Property Rights of Residents in Unauthorised Colonies) (Amendment) Regulations, 2023, which was initially published on May 15, 2023.
The correction pertains to the charges to be recovered for vacant plots situated in category-2 land.
Key Changes
The corrigendum modifies the charges for vacant plots in category-2 land based on the cumulative vacant plot area owned by a resident in all unauthorized colonies.
For vacant plot areas less than 100 sqm, the charge is now defined as ½ x Land area x 0.5% of the circle rate of the locality.
For vacant plot areas equal to or more than 100 sqm but less than 250 sqm, the charge is defined as ½ x Land area x 1% of the circle rate of the locality.
For vacant plot areas greater than or equal to 250 sqm, the charge is defined as ½ x Land area x 2.5% of the circle rate of the locality.
Impact Analysis
Impact on Residents of Unauthorized Colonies
Residents with larger vacant plot areas (250 sqm or more) will be subject to a higher charge of 2.5% of the circle rate.
Impact on Delhi Development Authority (DDA)
DDA needs to update its systems and processes to reflect the revised charges.
Suggested Action Items
Legal counsel should review the changes to determine if any existing contracts or agreements need to be updated.
