**Report: Analysis of Customs and Excise Amendment Notification G.S.R. 466(E)**
**1. Executive Summary:**
This report analyzes the amendment to a customs notification, specifically G.S.R. 466(E), published on June 30, 2021. The amendment addresses errors in a previous notification (No. 41/2018-Customs N.T.) and clarifies regulations pertaining to Customs Brokers, their employees, and potential revocation of licenses. Key changes include corrections to specific text on page 22 and 23 of the original notification and revisions to rules regarding employee conduct and license revocation. The report identifies affected stakeholders and infers implementation aspects and expected outcomes based solely on the provided text.
**2. Introduction:**
This report provides an analysis of the amendment to a notification issued by the Ministry of Finance, Department of Revenue, Central Board of Excise and Customs, as published in the Gazette of India under G.S.R. 466(E) on June 30, 2021. The analysis is based solely on the provided text of the notification.
**3. Policy Overview:**
* **Amendment to:** Notification No. 41/2018-Customs N.T., published in the Gazette of India, Extraordinary, Part II, Section 3, Subsection i, vide number G.S.R. 451(E), dated May 14, 2018.
* **Core Objective(s) (Inferred):** To correct errors in the original notification and to clarify regulations pertaining to Customs Brokers, employee conduct and license revocations.
**4. Background and Rationale:**
The amendment appears to be driven by the need to:
* **Correct Errors:** Rectify typographical or other errors present in the original notification (41/2018-Customs N.T.). This is directly stated in the text as a 'Corrigenda'.
* **Clarify Regulations for Customs Brokers:** Refine rules around conduct of Customs Brokers, employee authorizations and situations that could lead to license revocation. Specifically, the changes focus on requirements for employee authorization and behavior, and the grounds on which licenses can be revoked.
**5. Key Provisions / Changes:**
This section details the specific changes introduced by the amendment:
* **Change 1: Textual Corrections (Page 22 & 23):** The amendment replaces the text on page 22 and 23 of the original notification to correct errors in the items designated by letters.
* **Change 2: Replacement of lines 46 to 51 on Page 28** The amendment replaces lines 46-51 with the following text (quoted directly from the provided text):
* "Any change in the persons issued a F card or G card or H card and actually engaged in the work in the Customs Station on behalf of a licensee firm or company shall be communicated forthwith by the firm or the company, as the case may be, to the Deputy Commissioner of Customs or Assistant Commissioner of Customs, and no new person other than 'F', 'G' or 'H' card holders, shall be allowed to work in the Customs Station as a duly authorised employee on behalf of that firm or company."
* "The Customs Broker shall exercise such supervision as may be necessary to ensure proper conduct of his employees in the transaction of business and he shall be held responsible for all acts or omissions of his employees during their employment."
* "Revocation of licence or imposition of penalty - The Principal Commissioner or Commissioner of Customs may, subject to the provisions of regulation 17, revoke the license of a Customs Broker and order for forfeiture of part or whole of security, on any of the following grounds, namely: a failure to comply with any of the conditions of the bond executed by him under regulation 8; b failure to comply with any of the provisions of these regulations, within his jurisdiction or anywhere else; c commits any misconduct, whether within his jurisdiction or anywhere else which in the opinion of the Principal Commissioner or Commissioner of Customs renders him unfit to transact any business in the Customs Station; d adjudicated as an insolvent; e of unsound mind; and f convicted by a competent court for an offence involving moral turpitude or otherwise."
**Effect of Change 2:** This change clarifies the responsibilities of Customs Brokers regarding employee authorization, conduct, and the potential revocation of their licenses. Specifically, the changes:
* Mandate immediate communication of changes in 'F', 'G', or 'H' card holders to Customs authorities.
* Restrict customs station work to only cardholders
* Explicitly state that Customs Brokers are responsible for their employees' actions.
* Detail specific grounds for license revocation, including non-compliance, misconduct, insolvency, unsound mind, and criminal convictions.
* **Change 3: Omission of lines 1-6 on page 29**
* **Effect of Change 3:** This removes the text present on lines 1-6 of page 29. This is likely removing old text that is now redundant or no longer applicable.
**6. Target Audience and Stakeholders:**
Based on the provided text, the primary target audience and stakeholders are:
* Customs Brokers: The notification directly impacts their licensing, responsibilities, and the conduct of their employees.
* Customs Broker Employees: The changes affect who is eligible to work in Customs Stations ('F','G','H' card holders) and their conduct.
* Customs Officials (Deputy Commissioner, Assistant Commissioner, Principal Commissioner, Commissioner of Customs): These officials are responsible for implementing and enforcing the regulations, including overseeing employee authorization, receiving notifications of changes, and potentially revoking licenses.
* Licensee firms or companies: these firms are responsible for communicating changes in personnel to Customs officials.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:**
* Central Board of Excise and Customs (CBEC) is ultimately responsible.
* Deputy Commissioner of Customs and Assistant Commissioner of Customs are responsible for receiving notifications of changes in cardholders.
* Principal Commissioner or Commissioner of Customs is responsible for license revocation decisions.
* **Timelines/Procedures:** The notification mandates *immediate* communication of any changes in the persons issued 'F', 'G', or 'H' cards. The revocation of license is "subject to the provisions of regulation 17".
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these specific changes are:
* **Improved Accountability:** Holding Customs Brokers responsible for their employees' actions should promote greater oversight and accountability.
* **Enhanced Regulatory Compliance:** Clarifying grounds for license revocation should encourage stricter adherence to regulations.
* **Streamlined Communication:** The mandate for immediate communication of personnel changes aims to keep Customs authorities informed about who is authorized to work in Customs Stations.
* **Error Correction:** Removing existing text on pages 22, 23 and 29 should rectify any errors that were present in the original text.
**9. Conclusion:**
The amendment G.S.R. 466(E) to Notification No. 41/2018-Customs N.T. represents a refinement of existing customs regulations. By correcting errors and clarifying the roles and responsibilities of Customs Brokers and their employees, the amendment aims to enhance accountability, improve regulatory compliance, and streamline communication with Customs authorities. These changes are significant for Customs Brokers and their employees, as they introduce stricter requirements for employee authorization, conduct, and potential license revocation.
