In view of the guidelines and Schedule of programme as fixed by the Bar Council of India and communicated under its letter No.BCI:D:2664/2018 dated 05.07.2018 for election for the post of Member- Representative to Bar Council of India from Bihar State Bar Council, Chairman and Vice-Chairman, Bihar State Bar Council, the process of filing and finalization of nominations was fixed on 07.07.2018 from 10.00 AM to 05.00 PM and Publication of the List after final scrutiny at 05.30 PM. The process was completed as per this Schedule. 2. Mr. Manan Kumar Mishra and Mr. Ranjan Kumar Jha filed their nominations for the post of Member- Representative to Bar Council of India from Bihar State Bar Council and the list containing their names was published. 3. Mr. Lalit Kishore, Advocate General, Bihar and Mr. Ramakant Sharma filed their nomination for the post of Chairman, Bihar State Bar Council and the list containing their names was published. 4. Mr. Dharamnath Prasad Yadav and Mr. Prem Kumar Jha filed their nomination for the post of Vice-Chairman, Bihar State Bar Council and the list containing their names was published. 5. Vide the aforesaid letter No.BCI:D:2664/2018 dated 05.07.2018, the Schedule was fixed on 08.07.2018 at 10.30 AM for withdrawal of the nomination, at 11.00 AM for Election and 11.45 AM for declaration of the result of the Election of Member-Representative for Bar Council of India. As per the letter the process was conducted by the Secretary of the Bar Council of India and the Secretary of Bihar State Bar Council. In view the process the Election of the Member-Representative for Bar Council of India was conducted by the said two secretaries and Mr. Manan Kumar Mishra was declared elected as Member-Representative for Bar Council of India from Bihar State Bar Council. 6. Vide the aforesaid letter No.BCI:D:2664/2018 dated 05.07.2018, the Schedule was fixed on 08.07.2018 at 12.30 PM for commencing the election process for the Chairman and Vice-Chairman of Bihar State Bar Council and declaring the result thereof at 01.45 PM. This election process was to be conducted by the Hon'ble Returning Officer in presence of the undersigned. In view the process the Election of the Chairman and Vice-Chairman Bihar State Bar Council was conducted by the Hon'ble Returning Officer. The Election process by secret ballot for the post of Chairman started, but, shortly after the initiation of the process the full house of the elected members requested the RO to stop the secret ballot process saying that they have reached at a consensus to elect unanimously Mr. Lalit Kishore, Advocate General, Bihar and Mr. Dharmnath Prasad Yadav, Member as Chairman and Vice-Chairman, Bihar State Bar Council respectively. The two candidates namely Mr. Ramakant Sharma, Member and Mr. Prem Kumar Jha, Member who were contesting respectively for the post of Chairman and Vice-Chairman, Bihar State Bar Council also stated that they do not oppose the unanimous decision of the members of the Bihar State Bar Council to elect Mr. Lalit Kishore, Advocate General, Bihar and Mr. Dharmnath Prasad Yadav, Member as Chairman and Vice-Chairman, Bihar State Bar Council respectively. Rather Mr. Prem Kumar Jha, member further submitted that he wants to withdraw his candidature from the Post Vice-Chairman, Bhiar State Bar Council, which permission was accorded by the Hon'ble Returning Officer during the process. 7. As a result Mr. Lalit Kishore, Advocate General, Bihar and Mr. Dharmnath Prasad Yadav, Member was declared as Chairman and Vice-Chairman respectively by the Hon'ble Returning Officer. 8. With regard to the process conducted for election of the Member-Representative for Bar Council of India from Bihar State Bar Council the Secretaries of Bar Council of India and Bihar State Bar Council have jointly submitted their report a copy of which was given to the undersigned.
