अतः अब, केन्द्रीर् सरकार, पर्ाावरण (संरक्षण) जनर्मावली, 1986 के जनर्म 5 के उपजनर्म (3) के साथ परठत
पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) )जिसे इसम ें इसके पिात ् पर्ाावरण अजधजनर्म कहा गर्ा ह(ै की
उपधारा (1) तथा धारा 3 की उपधारा) 2 (के खडं (v) और खंड (xiv) एव ं उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करत े
हुए, िम्मू और कश्मीर राज्र् के िुजपर्ां जिल े के जहरपोरा वन्र्िीव अभर्ारण्र् की सीमा के चारों ओर 0 (िून्र्) स े 1.0
दकलोमीटर तक जवस्ट्ताररत क्षत्रे को जहरपोरा वन्र्िीव अभर्ारण्र् पाररजस्ट्थजतकी-संवेिी िोन) जिसे इसम ें इसके पिच् ात्

जहरपोरा वन्र्िीव अभर्ारण्र् के आसपास पाररजस्ट्थजतकी सवं ेिी िोन िून्र् से 1.0 दकलोमीटर तक जवस्ट्तृत ह।ै
जहरपोरा वन्र्िीव अभर्ारण्र् का पाररजस्ट्थजतकी संवेिी िोन उत्तर-पजिमी सीमा (पबंि ु ए8 स े ए9 तक) की ओर
िून्र् रखा गर्ा ह ैक्र्ोंदक र्ह क्षत्रे टाटा कुट्टी वन्र्िीव अभर्ारण्र् की सीमा को छूता ह।ै
(2) जहरपोरा वन्र्िीव अभर्ारण्र् और इसके पाररजस्ट्थजतकी संवेिी िोन की सीमा का वणना उपाबधं -I के रूप म ेंसंलग्न ह।ै
(3) सीमा जववरण और अक्षांि और िेिातं र के साथ पाररजस्ट्थजतकी संवेिी िोन का सीमांकन करत े हुए जहरपोरा वन्र्िीव
अभर्ारण्र् के मानजचत्र उपाबधं - IIक, उपाबंध- IIख, उपाबंध- IIग और उपाबंध- IIघ के रूप म ें संलग्न ह।ै
(4) पाररजस्ट्थजतकी संवेिी िोन और जहरपोरा वन्र्िीव अभर्ारण्र् की सीमा के भ-ू जनिेिांकों की सूची उपाबधं -III की
सारणी क और सारणी ख म ें िी गई ह ै।
(5) प्रमुख पबंिओंु के भ-ू जनिेिाकं ों के साथ पाररजस्ट्थजतकी संवेिी िोन के अतं गता आन े वाल ेग्रामों की सूची उपाबधं -IV के रूप
में संलग्न ह।ै
2. पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना– (1) संघ राज्र्क्षेत्र की सरकार, पाररजस्ट्थजतकी संवेिी िोन के
प्रर्ोिनों के जलए रािपत्र म ें इस अजधसूचना के प्रकािन की तारीख स े िो वषा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के
परामिा से और संघ राज्र्क्षेत्र की सरकार के सक्षम प्राजधकारी के अनुमोिन के जलए इस अजधसूचना में दिए गए अनुबंधों का
पालन करत े हुए आंचजलक महार्ोिना तैर्ार करेगी।
(2) संघ राज्र्क्षेत्र की सरकार द्वारा पाररजस्ट्थजतकी संवेिी िोन के जलए आचंजलक महार्ोिना ऐसी रीजत स े िो इस
अजधसूचना म ें जवजनर्िष्टा दकए गए ह,ैं के अनुसार तथा सुसंगत केंद्रीर् और संघ राज्र्क्षेत्र की सरकार के अनुरुप और केंद्रीर्
सरकार द्वारा िारी मागाजनििे ों, र्दि कोई हों, द्वारा तैर्ार होगी ।
(3) आंचजलक महार्ोिना, उि र्ोिना में पाररजस्ट्थजतकी और पर्ाावरणीर् बातों को समाकजलत करन े के जलए संघ राज्र्क्षत्रे
की सरकार के जनम्नजलजखत जवभागों के परामिा से तैर्ार होगी.—
(i) पर्ाावरण;
(ii) वन और वन्र्िीव;
(iii) कृजष;
(iv) रािस्ट्व;
(v) िहरी जवकास;
(vi) पर्ाटन;
(vii) ग्रामीण जवकास;
(viii) पसंचाई और बाढ जनर्ंत्रण;
(ix) प्रिषू ण जनर्ंत्रण बोड;ा
(x) नगरपाजलका;
(xi) पंचार्ती राि; और

(4) आंचजलक महार्ोिना अनमु ोदित जवद्यमान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई जनबंधन अजधरोजपत नहीं
करेगी िब तक दक इस अजधसूचना में इस प्रकार जवजनर्िष्टा न हो और आचंजलक महार्ोिना सभी अवसंरचना और
दक्रर्ाकलापों म,ें िो अजधक िक्षता और पाररजस्ट्थजतकी अनुकूल हों, का संवधान करेगी ।
(5) आंचजलक महार्ोिना म ें अनाच्छादित क्षेत्रों के िीणोद्धार, जवद्यमान िल जनकार्ों के संरक्षण, आवाह क्षेत्रों के प्रबंधन,
िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मृिा और नमी संरक्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा
पाररजस्ट्थजतकी और पर्ाावरण से संबंजधत ऐसे अन्र् पहलओंु , जिन पर ध्र्ान िेना आवश्र्क ह,ै के जलए उपबंध होंगे ।
(6) आंचजलक महार्ोिना जवद्यमान और प्रस्ट्ताजवत भूजम उपर्ोग जविेषताओं के ब्र्ौरों स े अनुसमर्थात मानजचत्र के साथ
सभी जवद्यमान पूिा स्ट् थलों, ग्रामों और नगरीर् बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजष क्षेत्रों, ऊपिाऊ भूजम, हररत क्षेत्र
िैसे उद्यान और उसी प्रकार के स्ट् थान, उद्यान कृजष क्षेत्र, फलोउद्यान, झीलों और अन्र् िल जनकार्ों का अभ्र्ंकन करेगी।
(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन म ें जवकास को जवजनर्जमत करेगी और सारणी म ें सूचीबद्ध पैरा-4 में
प्रजतजषद्ध और जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट्थ ानीर् समुिार्ों की िीजवका को सुरजक्षत करन े के जलए
पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित और उसकी अजभवृजद्ध भी करेगी।
(8) आंचजलक महार्ोिना प्रािेजिक जवकास र्ोिना की सह जवस्ट्तारी होगी ।
(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कार्ों को करने के
जलए मानीटरी सजमजत के जलए एक संिभा िस्ट्तावेि तैर्ार करेगी ।
3. सघं राज्र्क्षत्रे की सरकार द्वारा दकए िान ेवाल ेउपार्.- संघ राज्र्क्षेत्र की सरकार इस अजधसूचना के उपबंधों को प्रभावी
करन े के जलए जनम्नजलजखत उपार् करेगी, अथाात:् —
(1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, उद्यान कृजष क्षेत्रों, कृजष क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए
जचजन्हत दकए गए पाकों और खुल े स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए
उपर्ोग र्ा संपररवतान नहीं होगा:
परंत ु पाररजस्ट्थजतकी संवेिी िोन के भीतर भाग (क) में जवजनर्िष्टा प्रर्ोिनों स े जभन्न प्रर्ोिनों के जलए कृजष और अन्र्
भूजम का संपररवतान मानीटरी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्द्रीर्
सरकार र्ा संघ राज्र्क्षेत्र की सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स,े और
इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को पूरा करने के जलए
अनुज्ञात दकर्ा िाएगा, िैसे:-
(i) जवद्यमान सडकों को चौडा करना और उन्ह ेंसुिढृ करना तथा नई सडकों का संजनमााण;
(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;
(iii) प्रिषू ण उत्पन्न न करने वाल े लघ ुउद्योग;
(iv) कुटीर उद्योगों जिनके अंतगात ग्रामीण उद्योग भी ह;ैं सुजवधािनक भण्डार और स्ट्थानीर् सुजवधाएं सहार्क पाररजस्ट्थजतकी
पर्ाटन जिसके अन्तगात गृह वास सजम्मजलत ह;ै और
(v) पैरा 4 के अधीन दिए गए संवर्धात दक्रर्ाकलाप:
परंत ु र्ह और दक प्रािेजिक नगर र्ोिना अजधजनर्म और संघ राज्र्क्षेत्र की सरकार के अन्र् जनर्मों और जवजनर्मों
के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन और संजवधान के अनच्ु छेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध के उपबंधों
के अनुपालन के जबना, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता)6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
अजधजनर्म, 2006 (2007 का 2) भी ह,ै वाजणजज्र्क र्ा औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम का
उपर्ोग अनुज्ञात नहीं होगा:
परंत ु र्ह और भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर भू-अजभलेखों म ें उपसिं ात कोई गलती, मानीटरी सजमजत के
जवचार प्राप्त करने के पिात ् संघ राज्र्क्षेत्र की सरकार द्वारा प्रत्र्ेक मामल े म ें एक बार ठीक होगी और उि गलती के सुधार
की सूचना केंद्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी:
परंत ु र्ह और भी दक गलती के सुधार म ें इस उप पैरा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भू-उपर्ोग का
पररवतान सजम्मजलत नहीं होगा;
(ख) वनीकरण तथा वास िीणोद्धार दक्रर्ाकलापों सजहत अप्रर्क्ु त र्ा अनुत्प ािक कृजष क्षेत्रों म ें पुन: वनीकरण करन े के प्रर्ास
दकए िाएंगे।
(2) प्राकृजतक िल स्रोतों.- आचजं लक महार्ोिना में सभी प्राकृजतक झरनों के आवाह क्षेत्रों की पहचान की िाएगी और उनके
संरक्षण और नवीकरण के जलए र्ोिना सजम् मजलत होगी और संघ राज्र्क्षेत्र की सरकार द्वारा ऐसे क्षेत्रों पर र्ा उनके जनकट
जवकास दक्रर्ाकलाप प्रजतजषद्ध करने के बारे म ें िो ऐसे क्षेत्रों के जलए अजहतकर हो ऐसी रीजत स े मागाििाक जसद्धांत तैर्ार
दकए िाएंगे।
(3) पर्टा न र्ा पाररजस्ट्थजतकी पर्टा न.- (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप
र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी संवेिी िोन के जलए होगा।
(ख) पाररजस्ट्थजतकी पर्ाटन महार्ोिना संघ राज्र्क्षेत्र की सरकार पर्ाटन जवभाग द्वारा संघ राज्र्क्षेत्र की सरकार पर्ाावरण
और वन जवभाग के परामि ासे तैर्ार होगी।
(ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना के एक घटक के रूप म ें होगी।
(घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िाएगी।
(ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जनम्नानुसार जवजनर्जमत होंगे, अथाात:् -
(i) संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट
ह,ै नर् ेवाजणजज्र्क होटल और ररिॉटा के सजन्नमााण अनज्ञु ात नहीं होंग:े
परंत,ु र्ह दक संरजक्षत क्षत्रे की सीमा से एक दकलोमीटर की िरू ी से परे पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक
होटलों और ररिॉटा की स्ट्थापना केवल पूव ा पररभाजषत और नामजनर्िष्टा क्षेत्रों म ें पर्ाटन महार्ोिना के अनुसार पाररजस्ट्थजतकी
पर्ाटन सुजवधाओं के जलए ही अनुज्ञात होगा;
(ii) पाररजस्ट्थजतकी संवेिी िोन के भीतर सभी नए पर्ाटन दक्रर्ाकलापों र्ा जवद्यमान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार केंद्रीर्
सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् के मागाििाक जसद्धांतों के द्वारा तथा राष्र ीर् ा र्ाघ्र स संरक्षण
प्राजधकरण, द्वारा िारी पाररजस्ट्थजतकी–पर्ाटन, पाररजस्ट्थजतकी-जिक्षा और पाररजस्ट्थजतकी-जवकास पर बल िेत े हुए (समर्-
समर् पर र्था संिोजधत) िारी मागाििाक जसद्धांतों के अनुसार होगा;
(iii) आंचजलक महार्ोिना का अनुमोिन दकए िाने तक, पर्ाटन के जलए जवकास और जवद्यमान पर्ाटन दक्रर्ाकलापों के
जवस्ट्तार को वास्ट्तजवक स्ट्थल जवजनर्िष्टा संवीक्षा और मानीटरी सजमजत की जसफाररि पर आधाररत संबंजधत जवजनर्ामक
प्राजधकरणों द्वारा अनुज्ञात दकर्ा िाएगा और पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नर् े होटल र्ा ररसोट ा र्ा
वाजणजज्र्क स्ट्थापना का संजनमाणा अनुज्ञात नहीं दकर्ा िार्ेगा ।
(4) नैसर्गका जवरासत.- पाररजस्ट्थजतकी संवेिी िोन म ें महत्वपूणा नैसर्गाक जवरासत के सभी स्ट्थलों िैसे िीन कोि आरजक्षत
क्षत्रे , िैल जवरचनाएं, िल प्रपातों, झरनों, घाटी मागों, उपवनों, गुफाए,ं स्ट्थलों, भ्रमण, अश्वरोहण, प्रपातों आदि की पहचान
की िाएगी और जवरासत संरक्षण र्ोिना आंचजलक महार्ोिना के भाग के रुप म ें परररक्षण और सरं क्षण के जलए तैर्ार की
िाएगी।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7
(5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन में भवनों, संरचनाओं, जिल्प-तथ्र्, ऐजतहाजसक, स्ट्थापत्र्,
सौंिर्ापूरक और सांस्ट्कृजतक महत्व के क्षेत्रों की और उपक्षेत्रों पहचान और उनके संरक्षण के जलए जवरासत र्ोिना आंचजलक
महार्ोिना के भाग के रुप में तर्ै ार की िाएगी।
(6) ध्व जन प्रिषू ण.- पर्ाावरण अजधजनर्म के अधीन ध्वजन प्रिषू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 में जनर्त उपबंधों
के अनुसार पाररजस्ट्थजतकी संवेिी िोन में ध्वजन प्रिषू ण के जनर्त्रं ण और जनवारण का अनपु ालन दकर्ा िाएगा।
(7) वार् ु प्रिषू ण.- पाररजस्ट्थजतकी संवेिी िोन म,ें वार्ु प्रिषू ण के जनवारण और जनर्ंत्रण का वार् ु (प्रिषू ण जनवारण और
जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार अनुपालन दकर्ा
िाएगा।
(8) बजहस्राव का जनस्ट्सरण.- पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सरण, साधारण मानकों के उपबंधों के
अनुसार पर्ाावरण अजधजनर्म और उसके अधीन बनाए गए जनर्मों के अधीन आने वाले पर्ाावरणीर् प्रिषू ण के जनस्ट्सरण के
जलए साधारण मानकों र्ा संघ राज्र्क्षेत्र की सरकार द्वारा जनर्त मानकों, िो भी अजधक कठोर हो, के उपबंधों के अनुसार
होगा।
(9) ठोस अपजिष्ट.- ठोस अपजिष्ट का जनपटान और प्रबंधन जनम्नानुसार दकर्ा िाएगा:-
(क) पाररजस्ट्थजतकी संवेिी िोन म ें ठोस अपजिष्ट का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और
िलवार्ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ. 1357(अ), तारीख 8 अप्रैल, 2016 के द्वारा प्रकाजित ठोस
अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथो का जनपटान पाररजस्ट्थजतकी
संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थानों पर पर्ाावरण-अनुकूल रीजत से दकर्ा िाएगा;
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के
अनुरूप ठोस अपजिष्ट का सुरजक्षत और पर्ाावरण-अनुकूल प्रबधं न )ईएसएम (अनज्ञु ात दकर्ा िा सकेगा।
(10) िैव जचदकत्सा अपजिष्ट .- िैव जचदकत्सा अपजिष्ट का प्रबंधन जनम्नानुसार दकर्ा िाएगा.-
(क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिष्ट का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु
पररवतान मंत्रालर् की अजधसूचना सं.सा.का.जन 343 (अ), तारीख 28 माचा, 2016 के द्वारा प्रकाजित िैव जचदकत्सा
अपजिष्ट प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(ख) पाररजस्ट्थजतकी संवेिी िोन में मान्र् प्रौद्योजगदकर्ों का उपर्ोग करते हुए जवद्यमान जनर्मों और जवजनर्मों के
अनुरूप िैव-जचदकत्सा अपजिष्ट का सुरजक्षत और पर्ाावरण-अनकु ूल प्रबंधन अनुज्ञात दकर्ा िा सकेगा।
(11) प्लाजस्ट्टक अपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिष्ट प्रबंधन का जनपटान भारत सरकार के
पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना सं.सा.का.जन 340(अ), तारीख
18 माचा, 2016 द्वारा प्रकाजित प्लाजस्ट्टक अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।
(12) जनमाणा और जवध्वसं अपजिष्ट प्रबधं न.- पाररजस्ट्थजतकी संवेिी िोन म ें संजनमााण और जवध्वंस अपजिष्ट प्रबंधन का
जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत अजधसूचना
सं.सां.का.जन 317(अ), तारीख 29 माचा, 2016 द्वारा प्रकाजित संजनमााण और जवध्वंस अपजिष्ट प्रबंध जनर्म, 2016 के
उपबंधों के अनुसार दकर्ा िाएगा ।
(13) ई–अपजिष्ट.- पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिष्ट प्रबंधन का जनपटान भारत सरकार के पर्ाावरण, वन और
िलवार्ु पररवतान मंत्रालर् की समर्-समर् पर र्थासंिोजधत द्वारा प्रकाजित ई–अपजिष्ट प्रबंध जनर्म, 2016 के उपबंधों के
अनुसार दकर्ा िाएगा।
(14) र्ानीर् र्ातार्ात.- र्ातार्ात की र्ानीर् गजतजवजधर्ां आवास के अनुकूल जवजनर्जमत होंगी और इस संबंध म ें आंचजलक
महार्ोिना म ें जविेष उपबंध सजम्मजलत दकए िाएंगे और आंचजलक महार्ोिना के तैर्ार होने और संघ राज्र्क्षेत्र की सरकार8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
के सक्षम प्राजधकारी द्वारा अनुमोदित होने तक, मानीटरी सजमजत सुसंगत अजधजनर्मों और उसके अधीन बनाए गए जनर्मों
और जवजनर्मों के अनुसार र्ानीर् दक्रर्ाकलापों के अनुपालन को मानीटरी करेगी।
(15) र्ानीर् प्रिषू ण.- लागू जवजधर्ों के अनुपालन में वाहन प्रिषू ण का जनवारण और जनर्ंत्रण दकर्ा िाएगा और स्ट्वच्छक
ईंधन के उपर्ोग के जलए प्रर्ास दकए िाएंगे।
(16) औद्योजगक ईकाइर्ा.ं- (i) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात ् पाररजस्ट्थजतकी संवेिी िोन के
भीतर कोई नए प्रिजू षत उद्योगों की स्ट्थापना की अनुज्ञा नहीं िी िाएगी।
(ii) केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा फरवरी, 2016 म ें िारी समर्-समर् पर र्था संिोजधत मागाििाक जसद्धान्तों म ें
उद्योगों के वगीकरण के अनुसार, िब तक दक अजधसूचना म ें इस प्रकार जवजनर्िष्टा न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर
केवल गैर-प्रिषू णकारी उद्योगों को अनुज्ञात दकर्ा िाएगा और इसके अजतररि, गैर प्रिषू णकारी उद्योगों को बढावा दिर्ा
िाएगा।
(17) पहाडी ढलानों को सरं क्षण.- पहाडी ढलानों का संरक्षण जनम्नानुसार होगा:-
(क) आंचजलक महार्ोिना पहाडी ढलानों पर क्षेत्रों का संकेत होगा िहां दकसी भी संजनमााण की अनुज्ञा नहीं िी िाएगी;
(ख) कटाव के एक उच्च जडग्री के साथ जवद्यमान खडी पहाडी ढलानों र्ा ढलानों पर दकसी भी संजनमााण की अनुज्ञा नहीं िी
िाएगी ।
4. पाररजस्ट्थजतकी सवं िे ी िोन म ें प्रजतजषद्ध और जवजनर्जमत दकए िान े वाल े दक्रर्ाकलापों की सचू ी.- पाररजस्ट्थजतकी संवेिी
िोन म ें सभी दक्रर्ाकलाप पर्ाावरण अजधजनर्म के उपबंधों और उसके अधीन बनाए गए जनर्मों जिसके अन्तगात तटीर्
जवजनर्मन िोन, 2011 और पर्ाावरणीर् समाघात जनधाारण अजधसूचना, 2006 और अन्र् लाग ू जवजधर्ों के जिसम ें वन

11. स ंजनमााण दक्रर्ाकलाप । (क) संरजक्षत क्षेत्र की सीमा से एक दकलोमीटर के भीतर र्ा
पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनमें िो भी जनकट हो,
दकसी भी प्रकार के नर् ेवाजणजज्र्क संजनमााण की अनुज्ञा नहीं होगी:
परंत ु र्ह दक स्ट्थानीर् लोगों को अपनी आवास सम्बन्धी जनम्नजलजखत
आवश्र्कताओं को परू ा करने के जलए, पैरा 3 के उप पैरा (1) म ें
सूचीबद्ध दक्रर्ाकलापों सजहत अपने उपर्ोग के जलए, अपनी भूजम में

परंत ु र्ह और दक गैर–प्रिषू णकारी लघु उद्योगों से संबंजधत संजनमााण

सक्षम प्राजधकारी की पूवा अनुमजत से जवजनर्जमत दकए िाएंगे और वे
न्र्ूनतम होंगे ।
(ख) एक दकलोमीटर क्षेत्र से परे र्े आंचजलक महार्ोिना के अनुसार
जवजनर्जमत होंगे ।
12. प्र िषू ण उत्पन्न न करने वाले लघ ु फरवरी, 2016 म ें केन्द्रीर् प्रिषू ण जनर्ंत्रण बोडा द्वारा िारी उद्योगों म ें
उद्योग। वगीकरण के अनुसार समर्-समर् पर र्था संिोजधत गरै -प्रिषू णकारी
उद्योग और अपररसंकटमर् में, लघु और सेवा उद्योग, कृजष, पुष्प कृजष,
उद्यान कृजष र्ा पाररजस्ट्थजतकी संवेिी िोन से िेिी सामग्री से उत्पािों
को उत्पन्न करन े वाले कृजष आधाररत उद्योग सक्षम प्राजधकारी द्वारा
अनुज्ञात होंगे।
13. व ार् ु और र्ानीर् प्रिषू ण। लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।
14. व ृक्षों की कटाई। (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूवा अनुज्ञा के जबना वन,
सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर र्ा वनों म ें वृक्षों की कटाई नहीं
होगी ।
(ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा संघ राज्र्क्षेत्र अजधजनर्म र्ा
उसके अधीन बनाए गए जनर्मों के उपबंध के अनुसार जवजनर्जमत
होगे ।
15. व न उत्पािों र्ा गैर काष्ठ वन उत्पािों लाग ूजवजधर्ों के अनुसार जवजनर्जमत होंगे ।

अजधजनर्म, 1986 की धारा 3 की उप-धारा (3) के अधीन इस अजधसूचना के उपबंधों की प्रभावी मानीटरी के जलए
मानीटरी सजमजत का गठन करती ह,ै िो जनम्नजलजखत स ेजमलकर बनगे ी, अथाात:् -

काम करने वाल ेगैर-सरकारी संगठन का एक प्रजतजनजध
4. क्षेत्रीर् अजधकारी, िम्मू और कश्मीर राज्र् प्रिषू ण जनर्ंत्रण बोडा सिस्ट्र्;
5. प्रभागीर् वनाजधकारी, िुजपर्ां सिस्ट्र्;
6. िम्मू और कश्मीर िैव जवजवधता बोडा / पररषि से एक जविेषज्ञ सिस्ट्र्;

6. जनिेि–जनबधं न.- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन को मानीटरी करेगी।
(2) मानीटरी सजमजत का कार्ाकाल अगल े आिेि होने तक दकर्ा िाएगा, परंत ु र्ह दक सजमजत के गैर-सरकारी सिस्ट्र्ों को
समर्-समर् पर संघ राज्र्क्षेत्र की सरकार द्वारा नामजनर्िष्टा दकर्ा िाएगा।
(3) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ.
1533 (अ), तारीख 14 जसतम्बर, 2006 की अनुसूची म ें सजम्मजलत ह,ैं और िो पाररजस्ट्थजतकी संवेिी िोन म ें आत े ह,ैं
जसवार् इसके िो परै ा 4 के अधीन सारणी म ें र्था जवजनर्िष्टा प्रजतजषद्ध दक्रर्ाकलापों के, मानीटरी सजमजत द्वारा वास्ट्तजवक
जवजनर्िष्टा स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूवा पर्ाावरण
अनापजत्त के जलए केद्रींर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् को जनर्िष्टा दकर्ा िाएगा।
(4) उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ांक का.आ. 1533
(अ) तारीख 14 जसतंबर, 2006 की अनुसूची म ें सजम्मजलत नहीं ह,ै और िो पाररजस्ट्थजतकी संवेिी िोन म ें आते ह,ैं जसवार् इसके
पैरा 4 के अधीन सारणी म ें र्थाजवर्नाष्ट प्रजतजषद्ध दक्रलाकलापों के मानीटरी सजमजत द्वारा वास्ट्तजवक जवजनर्िष्टा स्ट्थलीर् ििाओं
के आधार पर संवीक्षा की िाएगी और उसे संबंद्ध जवजनर्ामक प्राजधकरणों को जनर्िष्टा दकर्ा िाएगा।
(5) मानीटरी सजमजत का सिस्ट्र्-सजचव र्ा संबद्ध उपार्ुि ऐसे व्यजि के जवरूद्ध, िो इस अजधसूचना के दकसी उपबंध का
उल्लघं न करता ह,ै पर्ाावरण अजधजनर्म की धारा 19 के अधीन पररवाि फाइल करन ेके जलए सक्षम होगा।
(6) मानीटरी सजमजत मुद्दा िर मुद्दा के आधार पर अपेक्षाओं पर जनभार रहत े हुए संबद्ध जवभागों के प्रजतजनजधर्ों र्ा जविेषज्ञों,
औद्योजगक संगमों र्ा संबद्ध पणधाररर्ों के प्रजतजनजधर्ों को अपने जवचार-जवमि ा म ेंसहार्ता के जलए आमंजत्रत कर सकेगी ।
(7) मानीटरी सजमजत प्रत्र्ेक वषा की 31 माचा तक के अपन े दक्रर्ाकलापों की वार्षाक कारावाई ररपोट ा संघ राज्र्क्षेत्र की
सरकार के मुख्र् वन् र्िीव वाडना को उपाबधं -V म ेंसंलग्न प्रोफामाा में उक्त वषा के 30 िून तक प्रस्ट्तुत करेगी ।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13
(8) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् मानीटरी सजमजत को अपन े कृत्र्ों के प्रभावी जनवाहन
के जलए ऐस ेजनिेि िे सकेगा, िो वह ठीक समझे ।
7. अजतररक्त उपार्.- इस अजधसूचना के उपबंधों को प्रभावी बनाने के जलए केंद्रीर् सरकार और संघ राज्र्क्षेत्र की सरकार,
अजतररक्त उपार्, र्दि कोई हों, जवजनर्िष्ा ट कर सकेंगी।

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE
NOTIFICATION
New Delhi, the 18th June, 2021
S.O. 2406(E).—In WHEREAS, a draft notification was published in the Gazette of India,
Extraordinary, vide notification of the Government of India in the Ministry of Environment, Forest and
Climate Change number S.O. 1874 (E), dated the 9th June, 2020, inviting objections and suggestions from all
persons likely to be affected thereby within the period of sixty days from the date on which copies of the
Gazette containing the said notification were made available to the public;
AND WHEREAS, copies of the Gazette containing the said draft notification were made available
to the public on the 12th June, 2020;
AND WHEREAS, no objections and suggestions were received from persons and stakeholders in
response to the aforesaid draft notification;
AND WHEREAS, Hirpora Wildlife Sanctuary lies between 33030’ & 33042’ North latitude and
74033’ & 74043’ East longitude located about 70 kilometers South of Srinagar city. Hirpora Wildlife
Sanctuary gets its name from the Village Hirpora, a small hamlet that lies on the North-Eastern out skirts of
the protected area and forms its gateway. The Sanctuary spread over the undulating terrain of the Pir Panjal
Mountains encompasses an area of around 341.25 square kilometers. The Sanctuary falls in the Shopian
District of the Kashmir Valley with the District Headquarter at a distance of 12 kilometers. The nearest
airport, Srinagar is 70 kilometers and the nearest railhead, Kakpora is 40 kilometers away;
AND WHEREAS, the Sanctuary came into existence through Government notification
No. FST/WL/San/Hirpora/87 (S.R.O.-153), dated the 19th March, 1987. While framing the organizational set
up of the Department of Wildlife Protection, the Government of Jammu and Kashmir vide its order No. 128-
F.S.T. of 1991 dated the 13th May, 1991, again notified the establishment of Hirpora Wildlife Sanctuary.
Later, the government through a notification issued under S.R.O. 424, and endorsed under No.
FST/WL/71/2007, dated the 18th December, 2007, extended the area of the sanctuary to 341.25 square
kilometers;
AND WHEREAS, the mountains range encompassing the Hirpora Wildlife Sanctuary are a part of
the Pirpanjal Range. The topography is mountainous with slopes of moderate to steep gradient broken by
rocky cliffs. The western and southern sides are steep while as the eastern mountainous ridge is more gentle
to moderate slope. The terrain is undulated, criss-crossed by gullies and numerous smaller mountain drains
or nars. The altitude varies from 2557 to 4745 meters above sea level;
AND WHEREAS, Hirpora Wildlife Sanctuary has different types of vegetation which formed
under the influence and control of various physical and biological factors like altitude, aspect, habitat
conditions and above all biotic interference. The dominating broad-leaved plant species in the riverine
(below 2300m) zone are Asculus indica and Juglans regia associated with Morus alba, Robinia
pseudoacacia, Rhus succedanea, Celtis australis, Ulmus villosa, Populus ciliata, Salix caprea, etc. The
dominating shrubs are Viburnum continifolium, Berberis lyceum, Parrotiopis jacquemontiana, Sorbaria
tomentosa, etc. The sliver fir and blue pine forests are the dominating sub-alpine (2300m-3000m)
vegetation. The dominant species includes Pinus griffithi associated with Rosa brunonii, Abies pindrow,
Betula utilis, Picea smithiana and Ulmus walliciana, etc. Other dominants shrub species include Indigofera
heterantha, Taxus walliciana and Isodo nrugosus, etc. The alpine scrub lands was dominated by Birch20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(Betula utilis) associated with Rhododendron companulatum and Juniperus spp. and the alpine pastures is
dominated by Fritillaria spp. and Polygonum spp. etc. The alpine (3000-3500m) vegetation is dominated by
Birch (Betula utilis), associated with Rhododendron companulatum and Juniperus spp. and the alpine
pastures, dominated by Fritillaria spp. and Polygonum spp. The ground cover comprises of the
dicotyledonous herbs like Rumex patientia, Corydalis spp. Primula spp, Pedicularis spp, Anemone spp. etc.
Rock faces (above 3500m) the rocky cliffs and hill tops are dominated by dwarf evergreen shrubs including
Juniperus recurva, Rhododendron anthopogon, etc. associated with herbs, Stachys sericea, Geum elatum
and Veronica melissaefolia, etc;
AND WHEREAS, the Hirpora forests also blessed with numerous plant species of great medicinal
value. Some medicinal plants growing in the area include Aconitum heterophyllum, Arnebia benthamii,
Artemisia absinthium, Berberis lyceum, Bergenia ciliata, Datura stramonium, Dioscorea deltoidea,
Lavatera cashmeriana, Saussurea costus and Taxus walliciana;
AND WHEREAS, Hirpora Wildlife Sanctuary has vast vegetative covers which provides an ideal
habitat for mammal and other faunal species. The dominating mammals recorded from the Sanctuary are
Kashmir markhor (Capra falconeri), Himalayan musk deer (Moschus Cupreus), Asiatic black bear (Ursus
thibetanus), Himalayan brown bear (Ursus arctos), common leopard (Panthera pardus), common langur
(Semnopithecus entellus), Rhesus macaque (Macaca mulatta), leopard cat (Prionailurus bengalensis), jungle
cat (Felis chaus), yellow-throated marten, (Martes flavigula), Himalayan palm civet (Paguma larvata),
Tibetan wolf (Canis himalayensis), etc;
AND WHEREAS, the Hirpora Wildlife Sanctuary is home for many migratory and residents birds
including species of vultures, raptors and passerines. The dominant species found in the Sanctuary are black
eared kite (Milvus migrans), Himalayan griffon vulture (Gyps himalayansis), Egyptian vulture (Neophron
percnopterus), bearded vulture (Gypaetus barbatus), Eurasian griffon (Gyps fulvus), monal pheasant
(Lophophorus impejanus), Himalayan snow cock (Tetragallus himalayansis), chukar partridge (Alectoris
chakur),Koklash pheasant (Pucrsia macrolopha), blue rock pigeon (Columba livia), Oriental turtle dove
(Streptopelia orientalis), Eurasian collared dove (S. decaota), Eurasian cuckoo (Cuculus canorus
telephones), alpine swift (Apus melba melba), European roller (Crociasgasrullus semenwi), common hoopoe
(Upopa epops epops), Kashmir flycatcher (Ficidula subrubra), streaked laughing thrush (Trocralopterum
linnactum), rock bunting (Emberiza cia), etc;
AND WHEREAS, the Sanctuary also provides habitat for the some rare, endangered and threatened
species like markhor (near threatened), Kashmir musk deer (endangered), common leopard (vulnerable),
Himalayan griffon vulture (near threatened), bearded vulture (near threatened), Kashmir flycatcher
(vulnerable). Therefore, the Sanctuary is rich in ecologically and biodiversity perspective;
AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of
Hirpora Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological,
environmental and biodiversity point of view and to prohibit industries or class of industries and their
operations and processes in the said Eco-sensitive Zone;
NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and
(xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of
1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of
the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area to an extent
varying from 0 (zero) to 1.0 kilometre around the boundary of Hirpora Wildlife Sanctuary, in Shopian
district in Jammu and Kashmir as the Eco-sensitive Zone (hereafter in this notification referred to as the[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 21
Eco-sensitive Zone) details of which are as under, namely: -
1. Extent and boundaries of Eco-sensitive Zone. – (1) The Eco-sensitive Zone shall be to an extent of 0
(zero) to 1.0 kilometre around the boundary of Hirpora Wildlife Sanctuary and the area of the Eco-
sensitive Zone is 120.56 square kilometres. The extent of Eco-sensitive Zone at different direction are
given below:

The Eco-sensitive zone around Hirpora Wildlife Sanctuary varies from zero to 1.0 Kilometre. The Eco-
sensitive zone of Hirpora Wildlife Sanctuary towards North-Western boundary (from point A8 to A9) has
been kept zero as this stretch of area touches the limits of Tata Kutti Wildlife Sanctuary.
(2) The boundary description of Hirpora Wildlife Sanctuary and its Eco-sensitive Zone is appended in
Annexure-I.
(3) The maps of the Hirpora Wildlife Sanctuary demarcating Eco-sensitive Zone along with boundary
details and latitudes and longitudes are appended as Annexure-IIA, Annexure-IIB, Annexure-IIC
and Annexure-IID.
(4) Lists of geo-coordinates of the boundary of Hirpora Wildlife Sanctuary and Eco-sensitive Zone are
given in Table A and Table B of Annexure-III.
(5) The list of villages falling in the proposed Eco-sensitive Zone along with their geo co-ordinates at
prominent points is appended as Annexure-IV.
2. Zonal Master Plan for Eco-sensitive Zone.- (1) The Union territory shall, for the purposes of the Eco-
sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of
this notification in the Official Gazette, in consultation with local people and adhering to the stipulations
given in this notification for approval of the competent authority of union territory.
(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the Union territory
Government in such manner as is specified in this notification and also in consonance with the
relevant Central and Union territory laws and the guidelines issued by the Central Government, if
any.
(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the
Union territory Government, for integrating the ecological and environmental considerations into the
said plan:—
(i) Environment;
(ii) Forest and Wildlife;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(iii) Agriculture;
(iv) Revenue;
(v) Urban Development;
(vi) Tourism;
(vii) Rural Development;
(viii) Irrigation and Flood Control;
(ix) Pollution Control Board;
(x) Municipal;
(xi) Panchayati Raj; and
(xii) Public Works Department.
(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use,
infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall
factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.
(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water
bodies, management of catchment areas, watershed management, groundwater management, soil
and moisture conservation, needs of local community and such other aspects of the ecology and
environment that need attention.
(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban
settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and
like places, horticultural areas, orchards, lakes and other water bodies with supporting maps giving
details of existing and proposed land use features.
(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited
and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly
development for security of local communities’ livelihood.
(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.
(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee
for carrying out its functions of monitoring in accordance with the provisions of this notification.
3. Measures to be taken by the Union territory Government.-The Union territory Government shall
take the following measures for giving effect to the provisions of this notification, namely:-
(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for
recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for
commercial or residential or industrial activities:
Provided that the conversion of agricultural and other lands, for the purposes other than that
specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation
of the Monitoring Committee, and with the prior approval of the competent authority under
Regional Town Planning Act and other rules and regulations of Central Government or Union
territory Government as applicable and vide provisions of this Notification, to meet the residential
needs of the local residents and for activities, such as:-
(i) widening and strengthening of existing roads and construction of new roads;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 23
(ii) construction and renovation of infrastructure and civic amenities;
(iii) small scale industries not causing pollution;
(iv) cottage industries including village industries; convenience stores and local amenities
supporting eco-tourism including home stay; and
(v) promoted activities given under paragraph 4:
Provided further that no use of tribal land shall be permitted for commercial and industrial
development activities without the prior approval of the competent authority under Regional Town
Planning Act and other rules and regulations of the Union territory Government and without
compliance of the provisions of Article 244 of the Constitution or the law for the time being in
force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest
Rights) Act, 2006 (2 of 2007):
Provided also that any error appearing in the land records within the Eco-sensitive Zone shall
be corrected by the Union territory Government, after obtaining the views of Monitoring
Committee, once in each case and the correction of said error shall be intimated to the Central
Government in the Ministry of Environment, Forest and Climate Change:
Provided also that the correction of error shall not include change of land use in any case
except as provided under this sub-paragraph.
(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation
and habitat restoration activities.
(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for
their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the
guidelines shall be drawn up by the Union territory Government in such a manner as to prohibit
development activities at or near these areas which are detrimental to such areas.
(3) Tourism or Eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism
activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-
sensitive Zone.
(b) the Eco-Tourism Master Plan shall be prepared by the Union territory Department of Tourism in
consultation with Union territory Departments of Environment and Forests;
(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;
(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-
sensitive Zone;
(e) the activities of eco-tourism shall be regulated as under, namely:-
(i) new construction of hotels and resorts shall not be allowed within one kilometre from the
boundary of the protected area or upto the extent of the Eco-sensitive Zone whichever is
nearer:
Provided that beyond the distance of one kilometre from the boundary of the protected
area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts
shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per
Tourism Master Plan;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive
Zone shall be in accordance with the guidelines issued by the Central Government in the
Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued
by National Tiger Conservation Authority (as amended from time to time) with emphasis on
eco-tourism, eco-education and eco-development;
(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing
tourism activities shall be permitted by the concerned regulatory authorities based on the
actual site specific scrutiny and recommendation of the Monitoring Committee and no new
hotel, resort or commercial establishment construction shall be permitted within Eco-
sensitive Zone area.
(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene
pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides,
cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their
preservation and conservation as a part of the Zonal Master Plan.
(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical,
architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and
heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.
(6) Noise pollution. -Prevention and control of noise pollution in the Eco-sensitive Zone shall be
complied in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules,
2000 under the Environment Act.
(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be compiled
in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of
1981) and the rules made thereunder.
(8) Discharge of effluents.- Discharge of treated effluent in Eco-sensitive Zone shall be in accordance
with the provisions of the General Standards for Discharge of Environmental Pollutants covered
under the Environment Act and the rules made thereunder or standards stipulated by the Union
territory Government whichever is more stringent.
(9) Solid wastes.-Disposal and Management of solid wastes shall be as under:-
(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in
accordance with the Solid Waste Management Rules, 2016, published by the Government of
India in the Ministry of Environment, Forest and Climate Change vide notification number S.O.
1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmental
acceptable manner at site identified outside the Eco-sensitive Zone;
(b) safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the
existing rules and regulations using identified technologies may be allowed within Eco-sensitive
Zone.
(10) Bio-Medical Waste.– Bio Medical Waste Management shall be as under:-
(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance
with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 25
the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343
(E), dated the 28th March, 2016;
(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the
existing rules and regulations using identified technologies may be allowed within the Eco-
sensitive Zone.
(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be
carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the
Government of India in the Ministry of Environment, Forest and Climate Change vide notification
number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.
(12) Construction and demolition waste management.- The construction and demolition waste
management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction
and Demolition Waste Management Rules, 2016 published by the Government of India in the
Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated
the 29th March, 2016, as amended from time to time.
(13) E-waste.- The e-waste management in the Eco-sensitive Zone shall be carried out as per the
provisions of the E-Waste Management Rules, 2016, published by the Government of India in the
Ministry of Environment, Forest and Climate Change, as amended from time to time.
(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly
manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till
such time as the Zonal Master plan is prepared and approved by the Competent Authority in the
Union territory Government, the Monitoring Committee shall monitor compliance of vehicular
movement under the relevant Acts and the rules and regulations made thereunder.
(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be in compliance with
applicable laws and efforts shall be made for use of cleaner fuels.
(16) Industrial units.– (i) On or after the publication of this notification in the Official Gazette, no new
polluting industries shall be permitted to be set up within the Eco-sensitive Zone.
(ii) Only non-polluting industries shall be allowed within Eco-sensitive Zone as per the
classification of Industries in the guidelines issued by the Central Pollution Control Board in
February, 2016, as amended from time to time, unless so specified in this notification, and in
addition, the non-polluting cottage industries shall be promoted.
(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-
(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be
permitted;
(b) construction shall not be permitted on existing steep hill slopes or slopes with a high degree of
erosion.
4. List of activities prohibited or to be regulated within Eco-sensitive Zone.- All activities in the Eco-
sensitive Zone shall be governed by the provisions of the Environment Act and the rules made
thereunder including the Coastal Regulation Zone, 2011 and the Environmental Impact Assessment
Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980),26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act, 1972 (53 of 1972), and
amendments made thereto and be regulated in the manner specified in the Table below, namely:-

11. Construction activities. (a) New commercial construction of any kind shall not be
permitted within one kilometer from the boundary of
the protected area or upto extent of the Eco-sensitive
Zone, whichever is nearer:
Provided that, local people shall be permitted to
undertake construction in their land for their use
including the activities mentioned in sub-paragraph (1)
of paragraph 3 as per building bye-laws to meet the
residential needs of the local residents.
Provided further that the construction activity related to
small scale industries not causing pollution shall be
regulated and kept at the minimum, with the prior
permission from the competent authority as per
applicable rules and regulations, if any.
(b) Beyond one kilometer it shall be regulated as per the
Zonal Master Plan.
12. Small-scale non-polluting industries. Non polluting industries as per classification of industries
issued by the Central Pollution Control Board in February,
2016, as amended from time to time, and non-hazardous,
small-scale and service industry, agriculture, floriculture,
horticulture or agro-based industry producing products from
indigenous materials from the Eco-sensitive Zone shall be
permitted by the competent Authority.
13. Air and vehicular pollution. Regulated as per the applicable laws.

5. Monitoring Committee for Monitoring the Eco-sensitive Zone Notification.- For effective
monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment
(Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising
of the following, namely:-

6. Terms of reference. – (1) The Monitoring Committee shall monitor the compliance of the provisions
of this notification.
(2) The tenure of the Monitoring committee shall be till further orders, provided that the non-official
members of the Committee shall be nominated by the Union territory Government from time to time.
(3) The activities that are covered in the Schedule to the notification of the Government of India in the
erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September,
2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the
Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the
actual site-specific conditions and referred to the Central Government in the Ministry of
Environment, Forest and Climate Change for prior environmental clearances under the provisions of
the said notification.
(4) The activities that are not covered in the Schedule to the notification of the Government of India in
the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14th September,
2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the
Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the
actual site-specific conditions and referred to the concerned regulatory authorities.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(5) The Member-Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s)
shall be competent to file complaints under section 19 of the Environment Act, against any person
who contravenes the provisions of this notification.
(6) The Monitoring Committee may invite representatives or experts from concerned Departments,
representatives from industry associations or concerned stakeholders to assist in its deliberations
depending on the requirements on issue to issue basis.
(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the
31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the Union
territory as per proforma appended at Annexure-V.
(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such
directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.
7. Additional Measures.-The Central Government and the Union territory Government may specify
additional measures, if any, for giving effect to provisions of this notification.
8. Supreme Court, etc. orders.- The provisions of this notification shall be subject to the orders, if any
passed or to be passed by the Hon’ble Supreme Court of India or the High Court or the National Green
Tribunal.
