(जिस े यहां आगे ‘‘आवेदक’’ भी कहा गया ह)ै िे जिर्दष्ा ट प्राजधकारी द्वारा चीि िि.गण., जवयतिाम और कोररया गण. के मूल के अथवा वहां से जियाजा तत ‘‘एल्य ूजमजियम एवं जिंक कोटेड फ्लैट उत् पाद’’ (जिसे आगे संबद्ध वस्ट् तु भी कहा गया ह)ै के आयातों पर जिश्य ात् मक पाटिरोधी िुल् क की जसफाररि करिे वाली ददिांक 21 फरवरी, 2020 की अजधसूचिा सं. 6/4/2019-डीिीटीआर द्वारा िारी अंजतम िाचं पररणाम में िाम में पररवतिा के जलए एक मध् यावजध 4275 GI/2020 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] समीषा आवेदि दायर दकया ह ै । आवेदक जवचाराधीि उत् पाद का एक जवदिे ी उत् पादक/जियाता क ह ै और कंपिी कोररया कामर्िायल कोड के अंतगात कोररया गणराज् य में अजधजियजमत ह ै । क. पृष्ठ भजू म 1. 1995 और उसके बाद यथासिं ोजधत सीमािुल्क टैररफ अजधजियम, 1975 (जिसे आगे अजधजियम भी कहा गया ह)ै और उसकी समय-समय पर यथा संिोजधत सीमािुल्क टैररफ (पारटत वस्ट्तुओं की पहचाि, उि पर पाटिरोधी िुल्क का आकलि और संग्रहण तथा षजतजिधाारण) जियमावली, 1995 (जिस े आग े जियमावली भी कहा गया है) के अिुसार जिर्दष्ा ट प्राजधकारी (जिन् ह ें आगे प्राजधकारी भी कहा गया ह)ै िे चीि िि.गण., जवयतिाम तथा कोररया गण. के मूल के अथवा वहां से जियााजतत ‘‘एल्य ूजमजियम एवं जिंक कोटेड फ्लैट उत् पाद’’ के आयातों पर जिश्य ात् मक पाटिरोधी िुल् क की जसफाररि करिे वाली ददिांक 21 फरवरी, 2020 की अजधसूचिा सं. 6/4/2019-डीिीटीआर द्वारा अपिे अंजतम िांच पररणाम िारी दकए थ े । 2. केन् द्र सरकार िे ददिांक 23 ििू , 2020 की सीमािुल् क अजधसूचिा सं. 16/2020-सीमािुल् क (एडीडी) के माध् यम से संबद्ध दिे ों के मलू की अथवा वहा ं स े जियाजा तत संबद्ध वस्ट् तु के आयातों पर जिश्च यात् मक पाटिरोधी िुल् क लगाया था । ख. जवचाराधीि उत्प ाद 3. उक् त िांच में जवचाराधीि उत् पाद (पीयूसी) चीि िि.गण., जवयतिाम और कोररया गण. के मूल के अथवा वहां स े जियााजतत ‘‘एल्य ूजमजियम एवं जिंक कोटेड फ्लैट उत् पाद’’ थे । आवेदि में जवचाराधीि उत् पाद, वही ह ै िो पूवावती िांचों अथाात ददिाकं 21 फरवरी, 2020 की अजधसचू िा सं. 6/4/2019- डीिीटीआर के माध् यम से िारी अंजतम िाचं पररणाम में था जिसे जिम्ि ािसु ार पीयूसी के प प म ें पररभाजषत दकया गया ह ै: ‘‘स्ट्ट ील के फ्लैट रोल् ड उत् पाद िो एल्य ूजमजियम एवं जिंक के जमरण ण से ‍ल ेटेड या कोटेड हों । एल्य ुजमजिय और जिंक के इस जमरण ण में एक या उससे अजध क अजतररक् त तत् व होत े ह िो अलग-अलग या संयुक् त प प से भार के अिुसार 3 प्रजतित से अजधक िहीं होंगे । इसके अलावा, जवचाराधीि उत् पाद कलयल के प प में या जबिा कलयल प प म ें हो सकता है, चाह े ‍ल िे , िालीदार या प्रोफाइल प प में हो अथवा िहीं । पीयूसी जस्ट्कि-पास्ट्ड /टेम् पर जमल पर प्रसंस्ट्क ृत या िलि जस्ट्ि पास्ट्ट हो सकता ह ै चाह े अजतररक्त गैर-धाजत्वक कोटटंड के साथ अथवा उसके जबिा सतह पर उपचाररत हो अथवा िहीं । पीयूसी को जवजभन् ि ्‍ यापाररक िामों में आपूर्ता दकया िा सकता ह ै जििम ें एलु जिंग, एल-िैडएि, जिंक एल्य ूजमजियम, एल्य ुजमजियम जिंक, जिंकालुमे, गलवालुमे आदद िाजमल ह परंतु यह इि तक सीजमत िहीं ह ै । यह भी िोट दकया िाता ह ै दक पीयूसी में िंग का प्रजतरोध होता ह ै और यह अिेक अिुप्रयोगों और षेत्रों में प्रयुक् त होता ह ै जििमें अवसरं चिा पररयोििाए,ं सौर जवद्यतु पररयोििाए,ं प फफंग, वलजलंग डफे कंग, क् लेजडगं और रेमेजमंग, ्‍ हाइट गुड और अिुप्रयोग, फिीचर और कलर कोटेड स्ट्ट ील के जलए सबस्ट् रेट िाजमल ह परंतु ये इि तक सीजमत िहीं ह ै । पीयूसी में जिम् िजलजखत उत् पाद िाजमल िहीं ह :- i. एल्य जुमजियम को िोड ेजबिा जिंक स ेकोटेड स्ट् टील के फ्लटै रोल् ड उत् पाद ii. जिंक को िोड ेजबिा एल् युजमजियम से कोटेड स्ट् टील के फ्लैट रोल् ड उत् पाद iii. पूवा पेंटेड या कलर कोटेड एल् यूजमजियम जिंक एललय कोटेड स्ट्ट ील िीटें (प्री कोटेड एसिीएल िीट)ें । ’’ 4. इस मध् यावजध समीषा के जलए जवचाराधीि उत् पाद अपररवर्तात रहगे ा ।[भाग I—खण् ड 1 भारत का रािपत्र : असाधारण 3 ग. िाजमल दिे 5. वतामाि समीषा िांच में िाजमल दिे कोररया गण. (जिसे संबद्ध दिे भी कहा गया ह)ै ह ै । घ. समीषा के जलए आधार 6. केिी डोंगबू स्ट्ट ील कं. जल.,ि े यह बतात े हुए एक मध् यावजध समीषा आवेदि दायर दकया ह ै दक कंपिी ि े केिी स्ट्ट ील के पष में 39.98 प्रजतित इदिटी िेयर िारी दकए ह, िो केसी समूह का सदस्ट् य ह ै तथा जिसके पास अब आवेदक के 39.98 प्रजतित िेयर ह िो आवेदक का प्रमुख िेयर धारक ह ै । इस आबंटि के पररणामस्ट् वप प कंपिी का िाम बदलकर केिी डोंगबू स्ट्ट ील कं. जल. हो गया ह ै । यह दावा दकया गया ह ै दक मूल कंपिी का िाम 2 अप्रैल, 2020 को के िी डोंगबू स्ट्ट ील कं. जल. से बदलकर डोंगबू स्ट्ट ील कंपिी जलजमटेड हो गया ह ै । उन् होंिे यह भी दावा दकया ह ै दक इसके मेिे िर उिके सभी जियाता केिी डोंगबू स्ट् टील कंपिी जलजमटेड के िाम स े होंगे और तनुिसु ार, डोंगबू स्ट् टील कंपिी जलजमटेड पर लागू िुल्क को केिी डोंगबू स्ट् टील कंपिी जलजमटेड पर लागू दकया िािा चाजहए क्य ोंदक यह कंपिी समाि ह ै । ड. िाचं िरुु आत 7. सीमािुल् क टैररफ अजधजियम और उिके अंतगात जिर्मात पाटिरोधी जिमावली में पाटिरोधी िुल् क को िारी रखिे की िप रत की प्राजधकारी द्वारा समय-समय पर समीषा दकया िािा अपेजषत ह ै । 8. आवेदक द्वारा कोररया गणराज् य से उत् पादक/जियाातक के िाम में पररवतिा तक सीजमत मध् यावजध समीषा की आवश् यकता दिािा े वाली पररवर्तात पररजस्ट्थजतयों संबंधी प्रदत्त सूचिा को ध् याि में रखते हुए जिर्दष्ा ट प्राजधकारी अब ददिांक 21 फरवरी, 2020 की अजधसूचिा सं. 6/4/2019-डीिीटीआर द्वारा अजधसूजचत अंजतम िांच पररणामों और संबंजधत पाटिरोधी जियमावली के जियम 23 के साथ परठत सीमा िुल् क टैररफ (संिोधि) अजधजियम, 1995 की धारा 9 क (5) के प्रावधािों के अिुसार ददिांक 23 िूि, 2020 की सीमािुल् क अजधसूचिा सं. 16/2020-सीमािुल् क (एडीडी) द्वारा लगाए गए जिश्च यात् मक पाटिरोधी िुल्क की मध् यावजध समीषा करिा उजचत समेते ह । वतामाि समीषा अंजतम िांच पररणाम अजधसूचिा सं. 6/4/2019-डीिीटीआर ददिांक 21 फरवरी, 2020 और सीमािुल् क अजधसूचिा सं. 16/2020-सीमािुल् क (एडीडी) ददिांक 23 िूि, 2020 के संबंध में मै. केिी डोंगबू स्ट्ट ील कं. जल. द्वारा दावा दकए गए िाम में पररवताि के पहलु तक सीजमत ह ै । च. िाचं की अवजध 9. चूंदक वतामाि समीषा िांच केवल िाम में पररवतिा तक सीजमत है, इसजलए प्राजधकरी समेत े ह दक िांच अवजध संगत िहीं ह ै । छ. प्रदिया 10. जियमावली के जियम 6 में यथाप्रदत् त जसद्धांतों का वतामाि िांच में पालि दकया िाएगा । सचू िा प्रस्ट्त तु करिा 11. कोजवड-19 महामारी स े उत् पन् ि जविेष पररजस्ट्थजतयों के मेिे र जिर्दष्ा ट प्राजधकारी को समस्ट्त पत्र ई-मेल पतों adg13-dgtr@gov.in और adv12-dgtr@gov.in पर ई-मेल के माध् यम से भेिे िाि े चाजहए और उसकी प्रजत ac11-dgtr@gov.in तथा dir12-dgtr@gov.in को भेिी िािी चाजहए । 12. संबद्ध दिे में ज्ञात उत् पादकों/ जियाता कों, भारत में उिके दतू ावास के िररए उिकी सरकार, भारत म ें संबद्ध वस्ट् तु से संबंजधत समेे िािे वाले आयातकों और प्रयोक्त ाओं तथा घरेलू उद्योग को िीचे जिधााररत की गई समय सीमा के भीतर जवजहत प्रपत्र में एवं ढंग से समस्ट्त संगत सचू िा प्रस्ट्त तु करिे के जलए अलग से सूजचत दकया िा रहा ह ै ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC. 1] 13. कोई अन् य जहतबद्ध पषकार भी िीचे दी गई समय सीमा के भीतर जवजहत प्रपत्र और ढंग से इस िांच से संगत अपिे अिुरोध प्रस्ट्त तु कर सकता ह ै । 14. प्राजधकारी के समष कोई गोपिीय अिुरोध करि े वाले दकसी पषकार को अन् य जहतबद्ध पषकारों को उपलब् ध कराए िाि े के जलए उसका एक अगोपिीय अंि प्रस्ट्त ुत करिा अपेजषत ह।ै 15. जहतबद्ध पषकारों को इस िांच के संबंध में दकसी भी अद्यति सूचिा के जलए जिर्दष्ा ट प्राजधकारी की आजधकाररक वैबसाइट http://www.dgtr.gov.in को जियजमत प प से दखे ि े की सलाह भी दी िाती ह ै । समय-सीमा 16 वतामाि िाचं से संबंजधत कोई सूचिा पाटिरोधी जियमावली के जियम 6(4) के अिुसार सूचिा की प्राजि की तारीख से 30 ददिों के भीतर ईमेल पतों adg13-dgtr@gov.in तथा adv12- dgtr@gov.in और उसकी प्रजत ac11-dgtr@gov.in तथा dir12-dgtr@gov.in पर ई- मेल के माध् यम से जिर्दष्ा ट प्राजधकारी को भेिी िािी चाजहए। तथाजप यह िोट दकया िाए दक उक् त जियम के स्ट्प ष्ट ीकरण के अिुसार सूचिा और अन् य दस्ट् तावेि मंगािे वाले िोरटस को जिर्दष्ा ट प्राजधकारी द्वारा उस े भेिे िािे की तारीख या जियाता क दिे के उजचत राििजयक प्रजतजिजध को ददए िाि े की तारीख से एक स‍त ाह के भीतर प्रा‍त हुआ माि जलया िाएगा । यदद जवजहत समय सीमा के भीतर कोई सूचिा प्रा‍त िहीं होती ह ै या प्रा‍त सूचिा अधूरी होती ह ै तो प्राजधकारी जियमावली के अिुसार ररकलड ा में उपलब् ध त्‍ यों के आधार पर अपिे िांच पररणाम दिा कर सकते ह। 17. सभी जहतबद्ध पषकारों को एतद्द्वारा वतामाि मामले में अपिे जहत (जहत के स्ट्व प प सजहत) की सूचिा दिे े और उपयुाक् त समय सीमा के भीतर प्रश्ि ावली का उत् तर दिे े की सलाह दी िाती ह ै । ट. गोपिीय आधार पर सचू िा प्रस्ट्ततु करिा 18. प्राजधकारी के समष कोई गोपिीय अिुरोध करिे या गोपिीय आधार पर सूचिा प्रस्ट्त ुत करिे वाले दकसी पषकार को जियमावली के जियम 7(2) और इस संबंध में िारी ्‍ यापार सूचिाओं के अिुसार उसका एक अगोपिीय अंि साथ में प्रस्ट्त ुत करिा अपेजषत ह ै । इसका पालि ि करिे पर उत् तर/अिरु ोध को अस वीकार दकया िा सकता ह ै । 19. प्रश्नावली के उत्तर सजहत प्राजधकारी के समष कोई अिुरोध (उससे संलग्न पररजिष्ट/अिुबंध सजहत) प्रस्ट्तुत करिे वाल े पषकारों को यदद उसके दकसी भाग के बारे में गोपिीयता का दावा दकया गया ह ै तो उसके 2 सैट प्रस्ट्त ुत करिा अपेजषत ह ै : क. गोपिीय प प में अंदकत एक सैट (िीषाक, पृष्ठ सं., सूची आदद सजहत), और ख. अगोपिीय प प में जचजन्हत दरू ा सैट (िीषाक, पृष्ठ सं., सूची आदद सजहत ) 20. ‘‘गोपिीय ’’ या ‘‘अगोपिीय ’’ अिुरोधों पर स्ट्पष्ट प प से प्रत्येक पृष्ठ पर ‘‘गोपिीय ’’ या ‘‘अगोपिीय ’’ अंदकत होिा चाजहए। ऐस े अकं ि के जबिा प्रस्ट्तुत सूचिा को प्राजधकारी द्वारा अगोपिीय मािा िाएगा और प्राजधकारी अन्य जहतबद्ध पषकारों को ऐसे अिुरोध का जिरीषण करिे की अिुमजत दिे े के जलए स्ट्वतंत्र होंगे।[भाग I—खण् ड 1 भारत का रािपत्र : असाधारण 5 21. गोपिीय पाठ में ऐसी समस्ट्त सूचिा होगी िो स्ट्वाभाजवक प प से गोपिीय ह ै और/अथवा ऐसी अन्य सूचिा जिसके ऐसी सूचिा के प्रदाता द्वारा गोपिीय होिे का दावा दकया गया ह।ै स्ट्वाभाजवक प प से गोपिीय होिे का दावा की गई सूचिा या अन्य कारणों से गोपिीयता का दावा की गई सूचिा के संबंध में सूचिा प्रदाता को प्रदत्त सूचिा के साथ ऐसे कारणों का जववरण प्रस्ट्तुत करिा होगा दक उस सूचिा का प्रकटि क्यों िहीं दकया िा सकता ह।ै 22. अगोपिीय प पांतरण को उस सूचिा, जिसके बारे में गोपिीयता का दावा दकया गया ह,ै पर जिभरा रहते हुए अजधमाित: सचू ीबद्ध या ररक्त छोडी गई (यदद सूचीबद्ध करिा व्यवहाया ि हो) और सारांिीकृत गोपिीय सूचिा के साथ गोपिीय प पातं रण की अिुकृजत होिा अपेजषत ह।ै अगोपिीय सारांि पयााि जवस्ट्तृत होिा चाजहए तादक गोपिीय आधार पर प्रस्ट्तुत की गई सूचिा की जवषय वस्ट्तु को तकासंगत ढंग से समेा िा सके। तथाजप, आपवाददक पररजस्ट्थजतयों में गोपिीय सचू िा प्रदाता पषकार यह इंजगत कर सकते ह दक ऐसी सूचिा का सारांि संभव िही ह ै और प्राजधकारी की संतुजष्ट के अिुसार इस आिय के कारणों का एक जववरण उपलब्ध कराया िािा चाजहए दक सारांिीकरण क्यों सभव िहीं ह।ै 23. प्रस्ट्तुत सूचिा के स्ट्वप प की िांच करिे के बाद प्राजधकारी गोपिीयता के अिुरोध को स्ट्वीकार या अस्ट्वीकार कर सकते ह। यदद प्राजधकारी इस बात से संतुष्ट ह दक गोपिीयता का अिुरोध अपेजषत िहीं ह ै अथवा सूचिा प्रदाता उक्त सूचिा को सावािजिक करिे या सामान्य प प में अथवा सारांि प प में उसके प्रकटि को प्राजधकृत करिे का अजिच्छुक ह ै तो वह ऐसी सूचिा की अिदखे ी कर सकते ह। 24. साथाक अगोपिीय प पांतरण के जबिा या गोपिीयता के दावे के बारे में यथोजचत कारण के जववरण के जबिा दकए गए दकसी अिुरोध को प्राजधकारी द्वारा ररकलड ा में िहीं जलया िाएगा। 25. प्रदत्त सूचिा की गोपिीयता की िप रत से संतुष्ट होिे और उसे स्ट्वीकार कर लेिे के बाद प्राजधकारी ऐसी सूचिा के प्रदाता पषकार के जवजिष्ट प्राजधकार के जबिा दकसी पषकार को उसका प्रकटि िहीं करेंगे। ठ. साविा जिक फाइल का जिरीषण 26. जियमावली के जियम 6(7) के अिुसार कोई जहतबद्ध पषकार उस सावािजिक फाइल का जिरीषण कर सकता ह ै जिसम ें अन्य जहतबद्ध पषकारों द्वारा प्रस्ट्तुत साक्ष्य के अगोपिीय प पातं रण रख े गए ह। इलैक् रलजिक प प में सावािजिक फाइल को रख े िाि े के तौर तरीके तैयार दकए िा रह े ह । ड. असहयोग 27. यदद कोई जहतबद्ध पषकार उजचत अवजध के भीतर आवश्यक सूचिा िुटािे से मिा करता ह ै अथवा उस े अन्यथा उपलब्ध िहीं कराता ह ै या िाचं में अत्यजधक बाधा डालता ह ै तो प्राजधकारी ऐस े जहतबद्ध पषकार को असहयोगी घोजषत कर सकते ह और अपिे पास उपलब्ध त्‍यों F. No. 7/25/2020-DGTR.—A Mid-Term Review application has been filed by M/s. KG Dongbu Steel Co., Ltd., Korea RP (formerly called Dongbu Steel Co., Ltd.), Korea RP (hereinafter also referred to as “Applicant”) for change in name in the Final Findings issued by Designated Authority vide Notification No. 6/4/2019-DGTR dated February 21, 2020 recommending definitive anti-dumping duty on the imports of Aluminium and Zinc coated flat products (hereinafter also referred to as the subject goods), originating in or exported from China PR, Vietnam and Korea RP. The Applicant is a foreign Producer/ Exporter of the product under consideration and the company is incorporated in the Republic of Korea, under the Korea Commercial Code. A. Background 1. 1. In accordance with Customs Tariff Act, 1975, as amended in 1995 and thereafter (hereinafter also referred to as the Act) and the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from time to time (hereinafter also referred to as the Rules), the Designated Authority (hereinafter also referred to as the Authority) had issued its final findings vide Notification No. 6/4/2019-DGTR dated February 21, 2020 recommending definitive anti-dumping duty on the imports of “Aluminium and Zinc coated flat products” originating in or exported from China PR, Vietnam and Korea RP. 2. The Central Government, vide Customs Notification No. 16/2020-Customs (ADD) dated June 23, 2020, had imposed definitive anti-dumping duty on the imports of the subject goods originating in or exported from the subject countries. B. Product under consideration 3. The product under consideration (PUC) in the said investigation was “Aluminium and Zinc coated flat products" originating in or exported from China PR, Vietnam and Korea RP. The product under consideration in the application is the same as the previous investigations i.e. final findings issued vide Notification No. 6/4/2019-DGTR dated February 21, 2020, which defined PUC as follows- “Flat rolled product of steel, plated or coated with alloy of Aluminium and Zinc. This alloy of Aluminium and Zinc may contain one or more additional elements which in individual or in combination shall not exceed 3% by weight. Further, the product under consideration may be in coil form or not in coil form whether or not plain, corrugated or in profiled form. PUC may be skin-passed / processed on tempermill or non- skin-passed whether or not surface treated with or without additional nonmetallic coating. PUC may be supplied in various trade names including but not limited to Alu-Zinc, Al-Zn, Zinc Aluminium, Aluminium Zinc, Zincalume, Galvalume etc. It is also noted that PUC offers resistance to corrosion and is used in many applications and sectors including but not limited to infrastructure projects, solar power projects, roofing, walling decking, cladding and framing, white[भाग I—खण् ड 1 भारत का रािपत्र : असाधारण 7 goods and appliances, furniture and substrate for colour coated steel. PUC does not include the following products: - i. Flat rolled steel products coated with Zinc without addition of Aluminium; ii. Flat rolled steel products coated with Aluminium without addition of Zinc; iii. Pre-painted or colour coated Aluminum Zinc alloy coated steel sheets (Pre-coated SGL sheets).” 4. The product under consideration for this mid-term review remains unchanged. C. Country Involved 5. The country involved in the present review investigation is Korea RP (also referred to as subject country). D. Grounds for Review 6. KG Dongbu Steel Co., Ltd. has filed a Mid-Term Review application stating that the company issued 39.98% equity shares in favour of KG Steel, a member of the KG Group, which now holds 39.98% shares of the Applicant as the major shareholder of the Applicant. Consequent to this allotment, the name of the company was changed to KG Dongbu Steel Co. Ltd. It has been claimed that the original company name has changed on 02 April 2020 from KG Dongbu Steel Co. Ltd. to Dongbu Steel Co. Ltd. They have further claimed that in view of the same, all their exports will be in the name of KG Dongbu Steel Co. Ltd., and accordingly, the duty applicable on Dongbu Steel Co. Ltd. must be made applicable to KG Dongbu Steel Co. Ltd. as the entity is the same. E. Initiation 7. The Customs Tariff Act, and the Anti-dumping Rules made thereunder, requires the Authority to review from time to time the need for continuance of anti-dumping duties. 8. Having regard to the information provided by the applicant indicating changed circumstances necessitating a mid-term review, limited to change of name of producer/exporter from Korea RP, the Designated Authority now considers it appropriate to conduct a Mid Term Review of the Final Findings notified vide Notification No. 6/4/2019-DGTR dated February 21, 2020 and the definitive anti-dumping duty imposed vide Customs Notification No. 16/2020-Customs (ADD) dated June 23, 2020, in terms of the provisions of Section 9A (5) of Customs Tariff (Amendment) Act 1995 read with Rule 23 of the anti-dumping Rules supra. The present review is limited to the aspect of name change claimed by KG Dongbu Steel Co. Ltd. with regard to the Final Findings Notification No. 6/4/2019-DGTR dated February 21, 2020 and Customs Notification No. 16/2020-Customs (ADD) dated June 23, 2020. F. Period of Investigation 9. Since the present review investigation is restricted to only change of name, the Authority considers that the period of investigation is not relevant. G. Procedure 10. Submission of Information 11. ln view of the special circumstances arising out of this COVID-19 pandemic, all communication should be sent to the Designated Authority via email at the email addresses adg13-dgtr@.gov.in and advl2-dgtr@gov.in with a copy to ac11-dgtr@gov.in and dir12-dgtr@gov.in . 12. The known producers/exporters in the subject country, their Government through their Embassy in India, the importers and users in India known to be concerned with the subject goods and the domestic industry are being informed separately to enable them to file all the relevant information in the form and manner prescribed within the time-limit set out below. 13. Any other interested party may also make its submissions relevant to the investigation in the prescribed form and manner within the time limit set out below. 14. Any party making any confidential submission before the Authority is required to make a non- confidential version of the same available to other interested parties. 15. Interested parties are further advised to keep a regular watch on the official website of the Designated Authority http://www.dgtr.gov.in/ for any updated information with respect to this investigation. I. Time Limit 16. Any information relating to the present investigation should be sent to the Designated Authority via email at the email addresses adg13-dgtr@gov.in and advl2-dgtr@gov.in with a copy to ac11- dgtr@gov.in and dir12-dgtr@gov.in within thirty days from the date of receipt of the notice as per Rule 6(4) of the Anti-Dumping Rules. It may, however, be noted that in terms of explanation of the said Rule, the notice calling for information and other documents shall be deemed to have been received within one week from the date on which it was sent by the Designated Authority or transmitted to the appropriate diplomatic representative of the exporting country. If no information is received within the prescribed time-limit or the information received is incomplete, the Authority may record its findings on the basis of the facts available on record in accordance with the Rules. 17. All the interested parties are hereby advised to intimate their interest (including the nature of interest) in the instant matter and file their questionnaire responses within the above time-limit. J. Submission of information on confidential basis 18. Any party making any confidential submission or providing information on confidential basis before the Authority, is required to simultaneously submit a non-confidential version of the same in terms of Rule 7(2) of the Rules and the Trade Notices issued in this regard. Failure to adhere to the above may lead to rejection of the response/submissions. 19. The parties making any submission (including Appendices/Annexures attached thereto), before the Authority including questionnaire response, are required to file the same in two separate sets, in case "confidentiality" is claimed on any part thereof: a. one set marked as Confidential (with title, number of pages, index, etc.), and b. the other set marked as Non-Confidential (with title, number of pages, index, etc.). 20. The "confidential" or "non-confidential" submissions must be clearly marked as "confidential" or "non-confidential" at the top of each page. Any submission made without such marking shall be treated as non-confidential by the Authority, and the Authority shall be at liberty to allow the other interested parties to inspect such submissions. 21. The confidential version shall contain all information which is by nature confidential and/or other information which the supplier of such information claims as confidential. For information which are claimed to be confidential by nature or the information on which confidentiality is claimed because of other reasons, the supplier of the information is required to provide a good cause statement along with the supplied information as to why such information cannot be disclosed.[भाग I—खण् ड 1 भारत का रािपत्र : असाधारण 9 22. The non-confidential version is required to be a replica of the confidential version with the confidential information preferably indexed or blanked out (in case indexation is not feasible) and summarized depending upon the information on which confidentiality is claimed. The non- confidential summary must be in sufficient detail to permit a reasonable understanding of the substance of the information furnished on confidential basis. However, in exceptional circumstances, the party submitting the confidential information may indicate that such information is not susceptible to summary, and a statement of reasons why summarization is not possible must be provided to the satisfaction of the Authority. 23. The Authority may accept or reject the request for confidentiality on examination of the nature of the information submitted. If the Authority is satisfied the request for confidentiality is not warranted or if the supplier of the information is either unwilling to make the information public or to authorize its disclosure in generalized or summary form, it may disregard such information. 24. Any submission made without a meaningful non-confidential version thereof or without good cause statement on the confidentiality claim shall not be taken on record by the Authority. 25. The Authority on being satisfied and accepting the need for confidentiality of the information provided, shall not disclose it to any party without specific authorization of the party providing such information. K. Inspection of Public File 26. In terms of Rule 6(7) or the Rules, any interested party may inspect the public tile containing non- confidential version of the evidence submitted by other interested parties. The modality of maintaining the public file in electronic mode is being worked out. L. Non-cooperation 27. In case any interested party refuses access to and otherwise does not provide necessary information within a reasonable period or significantly impedes the investigation, the Authority may declare such interested party as non-cooperative and record its findings on the basis of the facts available to it and make such recommendations to the Central Government as deemed fit.
