में यह महसूस दकया ह ै दक अत्यंत प्रदिू णकारी स्रोतों अथाात ् पारंपररक डीजल जने रेटर (डीजी सेट) पर जनभरा ता को कम
करत े हुए द्वीप जनवाजसयों की ऊजाा संबंधी आवश्यकता को परू ा करन े के जलए आईपीजेड अजधसूचना म ें एक समथाकारी
उपबंध की व्यवस्ट्था करन े की आवश्यकता ह;ै
और सम्यक् जवचार-जवमिा करने के पश्चात् उक्त राष्ट्रीय तटीय जोन प्रबंध प्राजधकरण (एनसीजेडएमए) ने यह
जसफाररि की ह ै दक 200-500 मीटर बीच द्वीप तटीय जवजनयमन जोन-III क्षेत्र के भीतर गैस आधाररत जवद्यतु संयंत्र के
समावेिन पर जवचार दकए जाने की आवश्यकता ह ै;
और पयाावरण (संरक्षण) अजधजनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (2) के खंड (v) और खडं
(xiv) और उपधारा (3) के साथ परठत पयाावरण (संरक्षण) जनयम, 1986 के जनयम 5 के उपजनयम (3) की अपेक्षानुसार

और उसके द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए प्रारूप अजधसूचना, भारत के राजपत्र, असाधारण, भाग 2, खंड, 3
उपखंड (ii) में का.आ. स.ं 4790(अ) तारीख 18 नवंबर, 2021 में प्रकाजित की गई थी, जजसमें उन सभी व्यजक्तयों से जजनके
उससे प्रभाजवत होन े की संभावना थी, उस तारीख स े जजसको उक्त अजधसूचना वाल े राजपत्र की प्रजतयां जनता को उपलब्ध
करा दी गई थीं, साठ ददन की अवजध के भीतर आक्षेप और सझु ाव आमंजत्रत दकए गए थे;
और उक्त अजधसूचना की प्रजतयां 18 नवंबर, 2021 को जनता को उपलब्ध करा दी गई थीं;
और, ऊपर उजल्लजखत प्रारूप अजधसूचना के उत्तर में प्राप्त सभी आक्षेपों और सझु ावों पर केंरीय सरकार द्वारा
सम्यक् रूप से जवचार कर जलया गया ह;ै
अत:, अब केंरीय सरकार पयावा रण (संरक्षण) जनयम, 1986 के जनयम 5 के उपजनयम (3) के खंड (घ) के साथ
परठत पयाावरण (संरक्षण) अजधजनयम, 1986 (1986 का 29) की धारा 3 की उपधारा (1) और उसकी उपधारा (2) के खंड
(v) द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए, उक्त आईपीजडे अजधसूचना, 2011 में जनम्नजलजखत और संिोधन करती ह,ै
अथाात:्--
उक्त अजधसूचना में आईसीआरजेड III से संबंजधत पैरा 3 के उप पैरा (घ) के खंड (3) के उपखंड (ख) में, मद (viii)
के पश्चात ्जनम्नजलजखत मद अतं :स्ट्थाजपत की जाएगी, अथाात्:--
“(ix) गैस आधाररत जवद्युत संयत्रं की स्ट्थापना करना”।

NOTIFICATION
New Delhi, the 5th May, 2022
S.O. 2090(E).—Whereas, by notification of the Government of India in the Ministry of Environment,
Forest and Climate Change number S.O. 20(E), dated the 6th January, 2011 [hereinafter referred to as the
IPZ notification, 2011], the Central Government declared certain coastal stretches as Coastal Regulation
Zone and restrictions were imposed on the setting up and expansion of industries, operations and processes
in the said zone;
And whereas, the Central Government have received a proposal from Andaman and Nicobar
Coastal Zone Management Authority (ANCZMA) regarding inclusion of Gas based power plant within the
Island Coastal Regulation Zone area under the provisions of the IPZ notification, 2011;
And whereas, the National Coastal Zone Management Authority (NCZMA) in its 43rd meeting held
on the 16th August, 2021 has felt that there is a need to provide an enabling provision in the IPZ notification
to meet the energy requirement of the islanders while reducing the dependency on highly polluting sources
viz. conventional Diesel Generator (DG sets);
And whereas, after due deliberation the said NCZMA has recommended that inclusion of Gas
based power plant within Island Coastal Regulation Zone-III area between 200-500 m needs consideration;
And whereas, a draft notification, required under sub-rule (3) of rule 5 of the Environment
(Protection) Rules, 1986 and in exercise of the powers conferred by sub-section (1), read with clause (v)
and clause (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act,
1986 (29 of 1986) was published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii)
vide number S.O. 4790 (E), dated the 18th November, 2021 inviting objections and suggestions from all
persons likely to be affected thereby within a period of sixty days from the date on which the copies of

And whereas, copies of the said notification were made available to the public on 18th November,
2021;
And whereas, all objections and suggestions received in response to the above-mentioned draft
notification have been duly considered by the Central Government;
Now, therefore, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section
(2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with clause (d) of sub-rule (3)
of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby makes the following
further amendment in the said IPZ notification, 2011, namely:-
In the said notification, in paragraph III, in sub-paragraph (D); in clause 3relating to ICRZ-III, in
Sub-clause (b), after item (viii), the following item shall be inserted, namely: -
“(ix) Setting up of Gas based power plant”.
