(1) इन जनयमस का संजक्षप्त नाम केंद्रीय मोटर यान (दसू रा संिोधन) जनयम, 2023 ह । (2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त हसग े। 2. केन्द्द्रीय मोटर यान जनयम, 1989 के जनयम 115 म,ें उप-जनयम (18) म,ें - 2019 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (क) सारणी 2 के अधीन ददए गए रटप् पण म ें खंड (i) म,ें प रा (19) के स्ट् थान पर जनम्न जलजखत पर ा रखा िाएगा, अथागत ् :- "(19) (क) 1अप्रल , 2020 स े सीओपी लाग ू होन े और टाइप अनुमोदन के दौरान आंकड़े एकजत्रत करन े के जलए पीईएमएस का प्रयोग करत े हुए ररयल वल् डग ्ाइिंवग साइकल उत्सिगन का माप जलया िाएगा। 1 अप्रल 2023 को या उसके पश् चात् जवजनमितमत एम और एन रेणणे ी के यानस, जिनका सकल यान भार 3500 दकलोग्राम स े अजधक नहीं ह, के सभी मॉडलस के जलए पीईएमएस का प्रयोग करत े हुए ररयल वल् ग ड ्ाइिंवग साइकल उत्सिगन माप के दौरान अनुरूपता कारक एआईएस 137 में अजधकजथत और समय समय पर यथा संिोजधत प्रदिया के अनुसार लाग ू होगा । (ख) टाइप अनुमोदन के दौरान, अनुरूपता कारक (सीएफ), नीचे दी गई सारणी के अनुसार होगा:- सारणी: अनरूु पता कारक (सीएफ) प्रदषू क सीएफ प्रदषू क 1 + मामितिन (3)एनओ ए‍स एनओ ए‍ स मामितिन के साथ एनओ = 0.43 ए‍स 1 + मामितिन (3) पीएन पीएन (1) मामितिन के साथ पीएन = 0.5 सीओ (2) - (1) के जलए लागू: केवल पॉजिरटव इजििन (डाइरे‍ट इंिे‍िन) इंिन और संपीड़न इजििन इंिन (2) सीओ उत्सिगन को आरडीई परीक्षणस में मापा और दि गदकया िाएगा। (3) पीईएमएस उपकरण द्वारा प्रस्ट्त ुत की गई अजतररत म माप अजनजततता क को यायान म ें रखत े हुए मामितिन एक मानदंड ह। (ख) सारणी 2 के अधीन ददए गए रटप् पणस म,ें खंड (ii) म,ें पर ा 12 म,ें, - (i) खडं (क) के स्ट्थ ान पर, जनम्न जलजखत खंड अतं :स्ट्थ ाजपत दकया िाएगा, अथागत् :- "(क) 1अप्र ल, 2020 से सीओपी लाग ू होन े और टाइप अनुमोदन के दौरान आंकड़े एकजत्रत करने के जलए पीईएमएस का प्रयोग करत े हुए यानस के उत्सिगन का माप सड़क पर जलया िाएगा और 1 अप्रल , 2023 को या उसके पश् चात ् जवजनमितमत एम और एन रेणणे ी के यानस, जिनका सकल यान भार 3500 दकलोग्राम से अजधक ह , के सभी मॉडलस के जलए पीईएमएस का प्रयोग करत े हुए ररयल वल् डग ्ाइिंवग साइकल उत्सिगन माप के दौरान, इन-समितवस अनुरूपता कारक एआईएस 137 म ें अजधकजथत और समय समय पर यथा संिोजधत प्रदिया के अनुसार लाग ूहोगा ।” ; (ii) खंड (ग) के पश् चात,् जनम्नजलजखत परंतुक अंत:स्ट् थाजपत दकया िाएगा, अथागत:् - "इन-समितवस पीईएमएस उत्सिगन परीक्षण के जलए अजधकतम अनुमत अनरूु पता कारक (सीएफ), नीचे दी गई सारणी के अनुसार हसग:े - सारणी : इन-समितवस अनरूु पता उत्सिनग परीक्षण के जलए अजधकतम अनज्ञु ात अनरूु पता कारक (सीएफ) मानदंड अजधकतम अनमु त अनरूु पता कारक (सीएफ) सीओ 1.5 टीएचसी(1) 1.5 एनएमएचसी(2) 1.5 सीएच (2) 1.5 4 एनओ 1.5 ए‍ स[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (1) सपं ीड़न इजििन इंिन के जलए (2) पॉजिरटव इजििन इंिन के जलए” [सं. आरटी-11036/78/2016-एमवीएल] महमूद अहमद, अपर सजचव रटप्पण : मूल जनयम, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में अजधसूचना संखया सा.का.जन. 590(अ), तारीख 02 िून, 1989 द्वारा प्रकाजित दकए गए थ े ओर अजधसूचना संखयांक सा.का.जन. 29(अ), तारीख 16 िनवरी, 2023 द्वारा अंजतम बार संिोजधत दकए गए । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 27th March, 2023 G.S.R. 226(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R 112(E), dated the 17th February, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 20th February, 2023; And whereas, no objections and suggestions were received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- (1) These rules may be called as the Central Motor Vehicles (Second Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989, in rule 115, in sub-rule (18),— (a) in clause (i), in the Notes given under Table 2, for paragraph (19), the following shall be substituted, namely:- “(19) (a) During type approval and COP applicable from 1st April, 2020, real world driving cycle emission measurement using PEMS shall be carried out for data collection and for vehicles of category M and N having gross vehicle weight not exceeding 3500 kgs, manufactured on or after 1st April, 2023, for all models, during real world driving cycle emission measurement using PEMS, Conformity factor shall be applicable as per the procedure laid down in AIS 137 and as amended from time to time. (b) During the type approval, the Conformity factor (CF), shall be as per the Table below:- Table: Conformity Factor (CF) Pollutant CF pollutant 1 + margin (3) NOx NOx With margin NOx = 0.43 1 + margin (3) PN PN (1) With margin PN = 0.5 CO (2) -4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (1) Applicable for: Positive Ignition (Direct Injection) engines and Compression Ignition Engines only (2) CO emissions shall be measured and recorded at RDE tests. (3)Margin is a parameter taking into account considering the additional measurement uncertainties introduced by the PEMS equipment.”; (b) in clause (ii), in the Notes given under Table 2, in paragraph (12),- (i) for clause(a), the following shall be substituted, namely:- “(a) During type approval and COP applicable from 1st April, 2020, emission measurement on vehicles using PEMS shall be carried out on road for data collection and for category M and N vehicles having gross vehicle weight exceeding 3500 kgs, manufactured on or after 1st April, 2023, for all models, during real world driving cycle emission measurement using PEMS, in-service Conformity factor shall be applicable as per the procedure laid down in AIS 137 and as amended from time to time.”; (ii) after clause (c), the following proviso shall be inserted, namely:– “Provided that the Maximum Allowed Conformity factors (CF) for in-service PEMS Emission Testing, shall be as per the Table below:- Table : Maximum Allowed Conformity Factors (CF) for in-service Conformity Emission Testing Parameter Maximum Allowed Conformity Factor (CF) CO 1.5 THC (1) 1.5 NMHC (2) 1.5 CH (2) 1.5 4 NOx 1.5 (1) For Compression Ignition Engines (2) For Positive Ignition engines.”.
