NOTIFICATIONS BY GOVERNMENT SCHOOL EDUCATION DEPARTMENT ISSUANCE OF NOTIFICATION UNDER SECTION 7 OF AADHAAR (THE TARGETED DELIVERY OF FINANCIAL AND OTHER SUBSIDIES, BENEFITS AND SERVICES) ACT, 2016. Notification of mandating use of Aadhaar Authentication by the beneficiaries under the Welfare Schemes for School Education Department as per the provisions of section 7 of the Aadhaar (The Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (Central Act 18 of 2016). For Aadhaar enrolment and enabling the authentication services School Education Department has issued the following Government orders (i) G.O (Ms) No.72, School Education (SSA2) Department, Dated: 11.03.2024, (ii) G.O (Ms) No.544, School Education (SSA2) Department, Dated: 18.10.2024. WHEREAS, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables the beneficiaries to get their entitlements directly in a convenient and seamless manner and Aadhaar obviates the need to produce multiple documents to prove one’s identity: AND WHEREAS, School Education Department (hereinafter referred to as the Department), is administering the following schemes through the Directorate of School Education or Directorate of Elementary Education or Directorate of Private Schools (hereinafter referred to as the Implementing Agency).- 1. Distribution of various Educational kits such as Text Book, Note Book, Atlas, Colour Pencil, Crayons etc. In addition, benefits such as School Bag, Footwear, Shoes and Socks, Uniform, Bi-cycle, etc. whichever deems to be followed at the time. 2. Support for implementation of various initiatives of Health and Family Welfare Department for improvement of Student health. Ex-II-1(338) [ 1 ]2 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 3. Services to School students under other Departmental convergence initiatives such as Puratchi Thalaivar M.G.R. Nutritious Meal Program, Chief Minister Breakfast Scheme. 4. Support for Ensuring Targeted Delivery of various Scholarships Schemes through Direct Benefit Transfer for Education Scholarship such as Pre Matric and Post Matric provided by various departments such as,- a) Adi Dravidar and Tribal Welfare Department b) Backward Classes Welfare, Most Backward Classes Welfare and Denotified Communities Welfare Department c) Minorities Welfare Department d) Sports Development, Special Programme Implementation Department e) Transport Department f) Welfare of Differently Abled Persons Department. 5. Ensuring Targeted Delivery on identifying right beneficiaries for Direct Benefit Transfer such as Bread winning Scheme, Accident Relief Scheme, Government to Student enhancement Services and other services to the Staff. AND WHEREAS, Under the Schemes, Listed Above (hereinafter referred to as the benefit) is given to eligible students/staff (hereinafter referred to as the beneficiaries) by the implementing Agency as per the Scheme guidelines as follows: 1. The informed consent of the Student / Parent / Guardian / Staff shall be obtained for the purpose of authentication in terms of section 29 of the said Act. The purposes for which the Aadhaar number and related information is being sought must be communicated clearly to the Student/Parent/Guardian/Staff. Specifically, the manner in which the Aadhaar number will be collected, stored and used shall be clearly communicated to the residents. 2. The consent and purpose of collecting Aadhaar has been explained to Beneficiaries in English and local language. The Department has informed to beneficiaries that Aadhaar shall not be used for any purpose other than mentioned above. 3. The Department, shall ensure that provisions of clauses (2) and (3) of section 8 of the said Act, relating to Aadhaar authentication of children are strictly adhered to without fail. 4. There shall not be a denial of any service/benefit to a student on account of failure of Aadhaar based authentication. 5. The Student / Parent / Guardian / Staff shall be informed of the alternate mechanism of identification/ verification as the instant usage of Aadhaar authentication is permitted purely on a voluntary basis. 6. There shall not be display of Aadhaar number anywhere in system and wherever required only last 4 digits of the Aadhaar number may be displayed. 7. The Aadhaar number shall be stored securely in Aadhaar Data Vault and in accordance with directions provided vide Unique Identification Authority of Indias (UIDAI) Circular dated 25-07-2017 in this regard. Any sharing of Aadhaar number shall be done in an encrypted and secured manner and only in accordance with provisions of section 29 of the said Act. 8. Complete details of the e-KYC information of the student shall not be displayed on the screen, instead only necessary demographic details such as first name, year of birth etc, may be displayed. 9. Bio-metric authentication of beneficiaries shall be performed only by the persons/agencies authorized for this purpose by the Department, Government of Tamil Nadu. 10. The Department shall get its software applications used for this purpose audited by a CERT-IN empanelled IS Auditor and submit the report to the Unique Identification Authority of India. Any subsequent suggestion made by the Unique Identification Authority of India (UIDAI) may also be complied with. 11. The Department may encourage use of Face/Iris/ Fingerprint/OTP-based biometric authentication, wherever required. 12. The Department shall comply with all the relevant provisions of the said Act, its associated regulations and other instructions issued by Unique Identification Authority of India from time to time.TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 3 13. The Department shall separately notify the alternate methods of identification in case any of the Student / Parent / Guardian / Staff does not intend. authenticate using his Aadhaar. AND WHEREAS, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of the State of Tamil Nadu; NOW, THEREFORE, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (Central Act 18 of 2016) (hereinafter referred to as the said Act), the Government of Tamil Nadu hereby notifies the following, namely,- 1) An individual eligible for receiving the benefits under the Scheme be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication. 2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act and such individuals shall visit any Aadhaar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar. 3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar, and in case there is no Aadhaar enrolment centre located in the respective Block or Taluk or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves: 1) Provided that till the time Aadhaar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents in original, namely:- (a) if he or she has enrolled, his or her Aadhaar Enrolment Identification slip; and (b) Any one of the following documents, namely:- (i) Bank or Post office Passbook with photo; or (ii) Birth Certificate; or (iii) Community Certificate; or (iv) Mark sheet / Certificate issued by recognized Board of Education; or (v) Minor Permanent Account Number (PAN) card issued by the Income Tax Department; or (vi) Permanent Account Number (PAN) card issued by the Income Tax Department; or (vii) Voter Identity card; or (viii) Driving license issued by the Licensing Authority under the Motor Vehicles act, 1988 (Central act 59 of 1988), or (ix) Passport, or (x) Ration Card; or (xi) School Leaving Certificate (SLC)/ School Transfer Certificate (TC); or (xii) Certificate of Identity having photo of such person issued by a Gazetted Officer Tahsildar on an official letter head, or (xiii) Government Photo ID card; or (xiv) Disability Identity Card/Certificate of Disability issued under Rights of Persons with Disabilities Rules, 2017; or (c) Any other document specified by the State Government. 2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the department through its Implementing Agency shall make all the required arrangements to ensure wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement. 3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely,- (a) in case the biometric authentication through fingerprints is not successful, wherever feasible and admissible, authentication shall by Aadhaar One Time Password or Time-Based One-Time Password with limited time validity, as the case may be, be offered and (b) in all other cases where biometric or Aadhaar One Time Password or Time-Based One-Time Password Authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar Card in original and4 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY necessary arrangement of (Quick Response) Code reader shall be provided at the convenient locations by the Department through its Implementing Agency; 4. In addition to the above in order to ensure that no bonafide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall follow the exception-handling mechanism as outlined in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India, dated the 19th of December 2017. 5.
