सा.का.जन. 58(अ).—केंद्रीय सरकार, जिद्युत अजधजनयम, 2003 (2003 का 36) की धारा 176 द्वारा प्रित्त
िजियों का प्रयोग करते हुए और उि अजधजनयम की धारा 83 के अनुसरण में, जनम्नजलजखत जनयम बनाती ह,ै अर्ाात ्
1. संजिप्त नाम और प्रारंभ - (1) इन जनयमों का संजिप्त नाम िम्म-ू कश्मीर संघ राज्य िेत्र और लद्दाख संघ राज्य िेत्र
के जलए संयिु जिद्युत जिजनयामक आयोग (िार्षाक ररपोर्ा तैयार करना) जनयम, 2023 ह ै
(2) ये रािपत्र म ेंप्रकािन की तारीख को प्रिृत्त होंगे।
2. पररभाषाएँ - (1) इन जनयमों में, िब तक दक संिभ ा से अन्यर्ा अपेजित न हो, -
(क) 'अजधजनयम' स े जिद्युत अजधजनयम, 2003 अजभप्रेत ह;ै
(ख) 'संयुि आयोग' स े अजधजनयम की धारा 83 के अधीन गरित िम्म-ू कश्मीर संघ राज्य िेत्र और लद्दाख सघं राज्य
ित्रे के जलए संयुि जिद्युत जिजनयामक आयोग अजभप्रेत ह;ै और
(ग) 'अनुसूची' स े इन जनयमों स े उपाबद्ध अनुसूची अजभप्रेत ह।ै

(2) उन िब्िों और पिों के, िो इन जनयमों म ें प्रयुि ह ैं और पररभाजषत नहीं ह,ैं दकन्त ु जिद्युत अजधजनयम, 2003,
(2003 का 36) म ेंपररभाजषत ह,ैं िही अर् ाहोंगे िो अजधजनयम में क्रमिः उनके ह।ैं
3. िार्षका ररपोर् ा तयै ार करना- (1) संयिु आयोग प्रत्येक िष ा अनुसूची म ें उपबंजधत प्ररूप म ें एक िार्षाक ररपोर् ा
तैयार करेगा, जिसमें आगामी िषा के 1 अप्रलै स े आरंभ होने िाले पूि ा िष ा स े 31 माचा तक के िौरान अपन े दक्रयाकलापों का
सार अंतर्िाष्ट होगा।
(2) िार्षाक ररपोर्ा में पूिा जित्तीय िषा के िौरान के दक्रयाकलापों का जििरण दिया िाएगा, जिसमें अन्य बातों
के सार्-सार् जनम्नजलजखत अतं र्िाष्ट होगा, -
(क) संयुि आयोग के लक्ष्य और उद्देश्यों का जििरण;
(ख) खंड (क) की पष्ठृ भूजम में जिजभन्न दक्रयाकलापों के जलए जनयत दकए गए िार्षाक लक्ष्यों सजहत उन लक्ष्यों के प्रजत
जनिेि से िास्ट्तजिक जनष्पािन का संजिप्त पुनिालोकन और जिसमें जिजिष्टतः िषा के िौरान संयुि आयोग के समि
फाइल दकए गए मामलों की सख्ं या, जनपर्ाए गए मामलों की संख्या, मामल े के जनपर्ान म ें लगे समय और लंजबत
मामलों की संख्या की ररपोर्ा सजम्मजलत ह;ै
(ग) संयुि आयोग के जिजनयमों में महत्िपूणा पररिधान या पररितना ;
(घ) राज्य सलाहकार सजमजत के कायाकरण की रीजत और पणधाररयों के सार् अन्य परामि;ा
(ङ) आपूर्ता औसत लागत-औसत रािस्ट्ि िसूली अंतर तर्ा सकल तकनीकी एिं िाजणजज्यक हाजनयों की प्राजस्ट्र्जत और
इन्ह ेंकम करने के जलए प्रस्ट्ताजित उपाय;
(च) महत्िपूणा मानिंडों िैसे पूंिीगत लागत, जिद्युत की लागत, नए जिजनधान, ििता अजभलाभों की प्रिृजत्तयां;
(छ) उन मामलों की संख्या और ब्यौरे जिनमें आयोग के आिेिों या जिजनयमों को न्यायालयों या अपील अजधकरण म ें
चुनौती िी गई र्ी और ऐसे मामलों का पररणाम;
(ि) जििािों का समाधान जिसके अंतगात िषा के अतं म ेंलंजबत जििाि भी ह।ैं
(झ) लागत प्रजतबबंजबत होन े पर र्ैररफ स े कोई जिचलन, सहायकी प्रिान करन े के जलए अजधजनयम की धारा 65 का
अनुपालन, खुली पहुचँ का कायाान्ियन, निीकरणीय क्रय बाध्यता का अनुपालन और उि अजधजनयम के कोई भी
अन्य उपबंध।
(ञ) अजधजनयम के सुसगं त उपबंध के अधीन समुजचत सरकार द्वारा दिए गए दकसी भी जनिेि का अनुपालन।
4. िार्षका ररपोर्ा का प्रस्ट्ततु दकया िाना - संयुि आयोग द्वारा िार्षाक ररपोर्ा की प्रजतयां प्रत्येक िषा के अिूबर मास
के अंत तक केंद्रीय सरकार और भाग लने े िाल े संघ राज्य िेत्रों की सरकारों को अग्रेजषत की िाएंगी।

NOTIFICATION
New Delhi, the 27th January, 2023
G.S.R. 58(E).— In exercise of the powers conferred by section 176 of the Electricity Act, 2003 (36 of 2003)
and in pursuance of section 83 of the said Act, the Central Government hereby makes the following rules, namely: —
1. Short title and commencement. – (1) These rules may be called the Joint Electricity Regulatory Commission
for the Union territory of Jammu and Kashmir and Union territory of Ladakh (Preparation of Annual Report) Rules,
2023.
(2) They shall come into force from the date of publication in the Official Gazette.
2. Definitions. - (1) In these rules, unless the context otherwise requires, -
(a) ‘Act’ means the Electricity Act, 2003;
(b) ‘Joint Commission’ means the Joint Electricity Regulatory Commission for the Union territory of
Jammu and Kashmir and Union territory of Ladakh, constituted under section 83 of the Act; and
(c) ‘Schedule’ means the Schedule annexed to these rules.
(2) The words and expressions used and not defined in these rules but defined in the Electricity Act,
2003 (36 of 2003), shall have the same meanings respectively assigned to them in that Act.
3. Preparation of Annual Report. – (1) Every year, the Joint Commission shall prepare an Annual Report,
giving a summary of its activities during the previous year commencing from the 1st day of April to the 31st day of
March of the following year in the form provided in the Schedule.
(2) The Annual Report shall give an account of the activities during the previous financial year, containing, inter-
alia, —
(a) a statement of goals and objectives of the Joint Commission;
(b) annual targets set for various activities in the background of clause (a) together with a brief review of
actual performance with reference to those targets and including in particular a report on the number of
cases filed before the Joint Commission during the year, number of cases disposed of, time taken to
dispose of the cases and number of cases pending;
(c) important additions or changes in the regulations of the Joint Commission;
(d) the manner of functioning of the State Advisory Committees and other consultation with the
stakeholders;
(e) the status of Average Cost of Supply - Average Revenue Realised gap, and Aggregate Technical and
Commercial losses and the steps proposed to reduce these;
(f) the trends of important parameters such as capital cost, cost of electricity, new investment, efficiency
gains;
(g) the number and details of cases in which orders or regulations of the Commission were challenged in
Courts or Appellate Tribunal and the outcome of such cases;
(h) the resolution of disputes including the disputes pending at the end of the year;
(i) any departure from the tariff being cost reflective, compliance with section 65 of the Act for grant of
subsidy, implementation of Open Access, compliance of Renewable Purchase Obligation and any other

(j) the compliance of any direction given by the appropriate Government under relevant provision of the
Act.
4. Submission of Annual Report. – The copies of the Annual Report shall be forwarded by the Joint
Commission to the Central Government and to the Governments of Participating Union territories by the end of
October in each year.
