Building, Bengaluru, dated: 29.06.2021 NOTIFICATION Whereas The draft of the Karnataka Civil Services (Regulation of transfer of Teaching Staff of Department of Collegiate Education) (Amendment) Rules, 2021, was published as required by clause (a) of sub-section (2) of Section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), in Notification No. ED 151 DCE 2020, dated:30.04.2021 in part IV-A of the Karnataka Gazette Extraordinary No. 505 dated:30.04.2021 inviting objections and suggestions from all persons likely to be effected thereby within fifteen days from the date of its publication in the official Gazette. And whereas, the said Gazette was made available to public on 30.04.2021. And whereas the objections and suggestions received in this behalf have been considered by the Government. Now, therefore, in exercise of the powers conferred by sub-section (1) of section 3 read with section 8 of the Karnataka State Civil Services Act, 1978 (Karnataka Act 14 of 1990), the Government of Karnataka hereby make the following Rules, namely RULES 1. Title and commencement.- (1) These Rules may be called the Karnataka State Civil Services (Regulation of Transfer of Teaching Staff of Department of Collegiate Education) (Amendment) Rules, 2021. (2) They shall come into force from the date of their publication in the official Gazette. 2. Amendment of Rule 2.- In the Karnataka State Civil Services (Regulation of Transfer of Teaching Staff of Department of Collegiate Education) Rules, 2021 (hereinafter referred to as the said rules), in Rule 2, in sub-rule (1) of, clause (a), shall be omitted. Amendment of Rule 4.- In Rule 4 of the said rules, after sub - rule (1), the following proviso shall be inserted, namely:- “Provided that, in case of teaching staff belonging to categories 2, 3, 4 and 5 as specified in sub-rule (3), the minimum length of service to be completed at the place of present regular posting for the purpose of transfer may be extended by one year on the request of the concerned teaching staff.” 4. Amendment of Rule 5.- In Rule 5 of the said rules,- (i) For clause (a), the following shall be substituted, namely:- “(a) The priority lists of the teaching staff who have completed minimum length of service as prescribed in sub-rule(1)of Rule 4, and a separate list of teaching staff who have requested for transfer under sub-rule (2) of Rule 4 shall be prepared after calling application by the Competent Authority, Zone wise and category wise as given in the schedule based on the duration of service in the place of present regular posting: Provided that, if two or more teaching staff have served for the same duration in the place of present regular posting then seniority as per the list operated gradation list shall be considered for interse seniority in priority list.” (ii) Clause (c) and entries relating thereto shall be omitted. 5. Amendment of Rule 6.- In Rule 6 of the said rules, after sub-rule (4) the following sub- rule shall be inserted, namely:- “(4a) The final priority lists of teaching staff to be transferred by counselling in the interest of public service and on request shall be published as per the procedure prescribed in Rule 5”.
