NOTIFICATION
Whereas the draft of the following rules to amend the Karnataka Education Institutions
(Issue of No Objection Certificate and Control) Rules, 2022 which the Government of
Karnataka propose to make in exercise of the powers conferred by sub-section (1) of section
145 of the Karnataka Education Act, 1983 (Karnataka Act 01 of 1995), was published as
required by sub- section (1) of section 145 of the said Act, for the information of all persons
likely to be affected thereby and notice was thereby given that the said draft would be taken
into consideration after fifteen days from the date of its publication in the official Gazette.
And whereas the said Gazette was made available to public on 06.03.2024.
And whereas the objections and suggestions were not received from the
public.
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 145
of the Karnataka Education Act (Karnataka Act 1 of 1995) Government of Karnataka hereby
makes the following rules, namely:-
RULES
1. Title and Commencement.- (1) These rules may be called the Karnataka
Educational Institutions (Issue of No Objection Certificate and Control) (Amendment) Rules,
2024.
(2) They shall come into force from the date of their final publication in the official
Gazette.

2. Amendment of rule 3 :- In the Karnataka Education Institutions ( Issue of No
Objection Certificate and Control) Rules, 2022 (Hereinafter referred as said rules), In rule 3,
after sub-rule (4), the following shall be inserted, namely:-
“(5) Only those private educational institutions, which have been registered under
Section 30 and 31 and recognized under Section 36 of Karnataka Education Act 1983 are
eligible for issue of No objection Certificate under these rules.
(6) The private educational institution shall ensure that, land conversion of the
premises of such institution for educational purposes has been obtained from the concerned
competent authority.”
3. Amendment of rule 4. – In rule 4 of the said rules,-
(i) in sub rule (2), after the words, “shall be accompanied by a”, the words,
“non refundable”, shall be inserted.
(ii) after sub-rule (9), the following shall be inserted namely:-
"(10) In case application submitted under sub-rule (1), is rejected for non
compliance of any of the criteria fixed for recognition and non submission of
documents mentioned under sub-rule 3 of Rule 3, the non refundable processing
fee paid, under sub-rule (2), shall be valid for re-submission of application by the
Private Educational Institution maximum three times in the same year or in the
subsequent years or within 3 years from the date of making first application,
whichever is earlier.
(11) Where application of a private educational institution is rejected more than
three times, such educational institution shall apply afresh with a further non-
refundable fee of rupees two lakhs."
4. Amendment of rule 6.- In rule 6 of the said rules,-
(i) in sub-rule (2), for the words "Second or Third language", the words "First or
Second language", shall be substituted.
(ii) after sub-rule (6), the following shall be inserted, namely:-
"(7) The private educational institution shall lose State Board Affiliation and
must discontinue teaching of State Syllabus on grant of Affiliation of
concerned board."
5. Amendment of rule 8.- In rule 8 of the said rules, in item (f), for the words “after
getting an approval shall remit an amount", the words "shall submit application for

6. Amendment of Form-1.- In Form-1 to the said rules,-
(1) in serial number 3, the item (vi) and the entries relating thereto shall
be omitted.
(2) in serial number 8 for the words, "non-agricultural", the words, "educational
purpose", shall be substituted.
7. Amendment of Form-B.- In Form-B to the said rules, serial numbers 6, 23 and 24
and the entries relating thereto shall be omitted.
