NOTIFICATION The draft of the following rules further to amend the Karnataka Educational Institutions (Recognition of Primary and Secondary Schools) Rules, 1999, which the Government of Karnataka proposes to make in exercise of the powers conferred by section 145 of the Karnataka Education Act, 1983 (Karnataka Act 1 of 1995), was thereby published as required by sub-section (1) of section 145 of the said Act, for the information of all persons likely to be affected thereby within fifteen days from the date of its publication in the Official Gazette. Whereas, the said Gazette was made available to the public on 11.06.2024. And, whereas, the objections and suggestions received in this behalf have been considered by the State Government. Now, therefore, in exercise of the powers conferred by sub-section (1) of section 145 Karnataka Education Act, 1983 (Karnataka Act 1 of 1995), of the Government of Karnataka hereby makes the following rules, namely:- RULES 1. Title and commencement.- (1) These rules may be called the Karnataka Educational Institutions (Recognition of Primary and Secondary Schools) (Amendment) Rules, 2024. Amendment of rule 3.- In Karnataka Educational Institutions (Recognition of Primary and Secondary Schools) Rules, 1999 (hereinafter referred as said rules), in rule 3, after sub-rule (4), and entries related thereunder the following shall be inserted. namely:- "(4(a) In case the application with processing fee for recognition is rejected the processing fee shall be valid for maximum three times for recognition in the same academic year. (b) Where an application by a private educational institution is rejected three times in the same academic year, such institution shall submit a fresh application with a further non-refundable fee as specified in sub-rule (2) of rule 3." 3. Amendment of rule 4.- In rule 4 of the said rules, in sub-rule(3), for the words "and shall be for minimum period of ten years", the words "and shall be for period of ten years for the first time renewal and permanent for the next time subject to provisions of sections 36 and 39 of the Act," shall be substituted.
