NOTIFICATION-II Whereas the draft of the following rules further to amend the Karnataka Excise (General Conditions of Licences) Rules, 1967 was published as required by sub-section (1) of Section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966) in Notification-II No: FD 10 PES 2022, dated: 16.01.2023 in Part-IV A of the Karnataka Gazette (Extraordinary) No.25 dated: 16.01.2023 inviting objections and suggestions from all persons likely to be affected within thirty days from the date of its publication in the official Gazette. And, whereas the said Gazette was made available to the public on 16th January 2023. And, whereas objections and suggestions received in respect of the said draft by the State Government have been considered. Now, therefore, in exercise of the powers conferred by Section 71 of the Karnataka Excise Act, 1965 (Karnataka Act 21 of 1966), the Government of Karnataka hereby makes the following rules, namely:- (1)2 RULES 1. Title and commencement: - (1) These rules may be called the Karnataka Excise (General Conditions of Licences) (Amendment) Rules, 2024. (2) They shall come into force from the date of their final publication in the Official Gazette. 2. Amendment of Rule 17-A:- In the Karnataka Excise (General Conditions of Licences) Rules, 1967, (hereinafter referred to as the said rules), in rule 17-A, for the words “In the event of death of the licensee or the lessee”, the words and figures “In the event of death of the licensee or the lessee on or after 01-01-2000”, shall be substituted. 3. Amendment of Rule 23:- In rule 23 of the said rules, after the third proviso, the following proviso shall be inserted, namely:- “Provided also that, subject to rule 5, other restrictions specified in the first proviso shall not be applicable to the shifting of such discontinued CL-2 (Retail Shop) licences revalidated and renewed in the event of death of the licensee or the lessee on or after 01-01-2000”.
