NOTIFICATION Whereas, the draft of the Karnataka Motor Vehicle (Amendment) Rules, 2025 was published as required by sub-section (1) of section 212 of the Motor Vehicle Act, 1988 (Central Act 59 of 1988) in notification No.TD 358 TCO 2023, dated:09.09.2025 in part IV-A of the Karnataka Gazette Extra Ordinary, (No.558) dated:09.09.2025 inviting objections and suggestions from all the persons likely to be affected thereby within thirty days from the date of its publication in the Official Gazette. And Whereas, the said Gazette was made available to public on 09.09.2025 And Whereas, objections and suggestions received in this behalf have been considered by the State Government. Now, therefore in exercise of the powers conferred by sections 95 & 96 read with section 67 and 212 of the Motor Vehicle Act, 1988 (Central Act 59 of 1988), the Government of Karnataka hereby makes the following rules further to amend the Karnataka Motor Vehicle Rules, 1989, namely; RULES 1. Title and commencement.- (1) These rules may be called the Karnataka Motor Vehicle (Amendment) Rules, 2025. (1)2 (2) They shall come into force from the date of their publication in the Official Gazette. 2. Insertion of new Chapter VA.- In the Karnataka Motor Vehicle Rules, 1989, after Chapter V and entries relating thereunder, the following shall be inserted, namely:- Chapter VA 135A. Constitution of Committee.- (1) The State Government shall constitute a Committee called the Public Transport Fare Regulatory Committee which shall consist of Chairman and two members. (2) The Chairman shall be a retired Additional Chief Secretary to Government or retired Judge of Hon'ble High court of Karnataka. (3) Out of the two members one shall be a retired Principal Secretary or Secretary to Government who is possessing educational qualification of Law. The other member may be an Industry expert or a financial expert who has no vested interest in the private passenger transport system either directly or indirectly. (4) The Managing Director, Karnataka State Road Transport Corporation (KSRTC) shall be the Member-secretary. 135B. Functions of the Committee.- The Committee shall perform the following functions, namely: - (i) The Committee shall study the financial conditions of the Road Transport Corporations and suggest revision of various fares from time to time, to the respective Road Transport Corporation; and (ii) The Committee may suggest to impose various surcharges, fees on the fares to improve the financial and operational efficacy of the Road Transport Corporations. 135C. Term of office of Committee.- (1) The Chairman and member shall subject to the pleasure of the State Government, hold office for a period not exceeding three years from the date of his nomination or till the reconstitution of the Authority whichever is earlier. (2) No member shall be eligible for re-nomination. 135D. Resignation.- (1) The Chairman and members may resign their office by a letter in writing addressed to the State Government.3 (2) The seat of such a member shall fall vacant from the date on which his resignation is accepted or on the expiry of thirty days from the date of receipt of intimation of resignation, whichever is earlier. (3) The power to accept the resignation shall vest in the State Government. 135E. Manner of filling vacancies.- When a vacancy occurs or is likely to occur in the membership of the Committee, the Member-Secretary shall report to the State Government and on receipt of such report, the State Government may, by notification, nominate a person to fill the vacancy and the person so nominated shall hold office for the remaining term of office of the member in whose place he is nominated. 135F. Salary and Allowance of members.- (1) The Chairman and members shall be payable a remuneration equal to their last drawn salary of the previous office, including any pension drawn. (2) The travelling allowance of the Chairman and members shall be governed by the rules applicable to them for journey performed by them on official duties and shall be paid by the authority paying his salary. 135G. Disposal of business.- (1) All Road Transport Corporations may submit a proposal for fare revision or imposing surcharge fees for the Committee consideration. (2) The Committee shall consider the proposal and examine it and suggest the revised fares or surcharge or fees. (3) The respective Boards of Road Transport Corporation Shall adopt the recommendations. 135H. Meeting.- (1) The Committee shall meet at such place and at such time as may be decided by the Chairperson but shall meet at least once in three months. (2) The Chairperson shall preside over every meeting of the Committee in which he is present and, in his absence, he may nominate a member of the Committee to preside over such meeting in his place and in the absence of such nomination by the Chairperson, the members of the Committee present in such meeting may choose one member from amongst to preside over the meeting. 135I. Notice of meetings.- (1) Ordinarily two weeks' notice shall be given to the members of the Committee of a proposed meeting. (2) No business except which is included in the list of business for a meeting of the Committee shall be considered at the meeting without the permission of the Chairperson.R.N.I. No. RNP/KA/BGS/2202/2017-19 Licensed to post without prepayment WPP No. 297 4 (3) The Member-Secretary may request for a special meeting of the Committee in case of any urgency, after informing the members in advance about the subject-matter of discussion and the reason of urgency. The Chairperson shall convene a meeting upon request from Member-Secretary. 135J. Quorum.- (1) No meeting shall be held by the Committee with less than two members, excluding Member-Secretary. (2) The State Government may prohibit any member, other than Member- Secretary, from taking part in the meeting if,- (a) the member absents himself from three consecutive meetings of the Committee without written information and consent of the Chairperson; or (b) the member, in the opinion of the State Government, has ceased to represent the interest which he purports to represent on the Committee. 135K. Annual reports.- The Committee shall submit a copy of the recommendations given to the Road Transport Corporations, to the Government for laying before the both houses of the State legislature as soon as may be, after the 1st of April every year and not later than 31st day of December, as an Annual report.
