NOTIFICATION Whereas, the draft Rules further to amend the Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions Rules, 2006 was published in Notification No: ED 147 TEC 2020 Dated: 01.10.2020 in part-IV A of the Karnataka Gazette extraordinary dated 01.10.2020, inviting objections and suggestions from all persons likely to be affected within 15 days from date of publications of the said the notification in the official gazette. And whereas said gazette was made available to the public on 01.10.2020 And whereas objections and suggestions were received within this stipulated period and examined. Now therefore, in exercise of the powers conferred under Section 23 of Karnataka Professional Educational Institutions (Regulation of Admission And Determination of Fee) Act, 2006 (Karnataka Act 8 of 2006) the Government of Karnataka hereby makes the following rules, further to amend the Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions Rules, 2006 namely; RULES 1. Title and Commencement:- (1) These rules may be called the Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions (Amendment) Rules, 2020. (2) They shall come into force from the date of their publication in the Official Gazette. (1)R.N.I. No. KARBIL/2001/47147 POSTAL REGN. No. RNP/KA/BGS/2202/2017-19 Licensed to post without prepayment WPP No. 297 2 2.Amendment of Rule 12:- In the Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions Rules, 2006 (herein after referred to as the said rules), in rule 12 ,- (i) In sub rule (2), following proviso shall be inserted, namely:- “Provided that, if a Candidate who has been allotted a seat in any discipline in an Engineering College or Institution under sub-rule (4) of rule 10 surrenders the seat after completion of respective Casual Vacancy Round, the Executive Director shall forfeit the entire fee paid and the candidate shall be liable to pay a penalty of five times of the fee.” (ii) in sub-rule (5), following proviso shall be inserted, namely:- “Provided that, if a candidate does not surrender the allotted a seat in any discipline in an Engineering College or Institution under sub-rule (4) of rule 10 or fail to join the allotted college even after the completion of the Casual Vacancy Round, the Executive Director, Karnataka Examinations Authority shall forfeit the entire fee amount paid by the candidates and the candidate shall be liable to pay a penalty of five times of the fee.” 3. Amendment of Rule 13:- In rule 13 of the said rules, after the sub-rule (3), the following shall be inserted namely:- “(4) (a) Any Engineering College or Institution shall collect the original documents of the candidates at the time of admission and shall release the original documents after obtaining the permission of Karnataka Examinations Authority. The Karnataka Examinations Authority shall ascertain candidate wise, penalty if any to be collected for violation of sub-rule (2) of rule 12 and sub- rule (5) of rule 12. The Engineering College or Institutions shall collect the penalty as specified in proviso to sub-rule (2) of rule 12 and sub-rule (5) of rule 12. The penalty so collected by the Engineering Colleges or Institutions shall be transferred to the Karnataka Examinations Authority within a week after receipt of penalty. If the Engineering Colleges or Institutions fail to adopt the above procedure, then the colleges shall liable to pay the penalty wherever applicable.” (b) The Engineering Colleges or Institutions shall report to the Karnataka Examinations Authority regarding the status of admission of the candidates that remained unfilled or candidates desirous to surrender the seats, well in time to the Karnataka Examinations Authority so that, necessary action can be taken to fill up the seats. Because of the non reporting by Engineering Colleges or Institutions, if the seats remain unfilled, then the concerned Engineering Colleges or Institutions shall pay penalty of five times of the fee.” By order and in the name of the Governor of Karnataka (M.G.
