Whereas it is expedient further to amend the Karnataka Land Revenue Act, 1964 (Karnataka Act 12 of 1964) for the purposes hereinafter appearing; Be it enacted by the Karnataka State Legislature in the Seventy fifth year of the Republic of India, as follows:- 1. Short title and commencement.-(1) This Act may be called the Karnataka Land Revenue (Amendment) Act, 2024. (2) It shall come into force at once. 2. Amendment of Section 94-A:- In Section 94-A of Karnataka Land Revenue Act, 1964 (Karnataka Act 12 of 1964),- (i) after sub-section (1) the following proviso shall be inserted, namely:- “Provided that (i) if the member of the Legislative Assembly of the respective Assembly Constituency has indicated in writing that they are unable or unwilling to be a member of the Committee, or (ii) if the position of the Member of Legislative Assembly for that constituency is vacant, the State Government shall nominate any person as a member of the Committee of such Assembly Constituency.” (ii) for sub-section (2) , the following shall be substituted, namely:- “The State Government shall appoint the Tahsildar of the taluk constituting the major part of that constituency on the basis of population as the Secretary of the committee.” (iii) in sub-section (2A),- (a) for the word “taluk” the word “constituency” shall be substituted; (b) the words “and another as the Secretary of the committee.” Shall be omitted; and (c) for the words “Deputy Commissioner” the words “State Government” shall be substituted. (iv) in sub-section (4), the words “or any portion thereof” shall be omitted. (v) in the first proviso to sub-section (4), for the word “person” the word “family” shall be substituted.6 STATEMENT OF OBJECTS AND REASONS The present provision of 94A(1) of the Act provides that the member of the assembly to be one of the member of the committee formed to regularize the unauthorized cultivation of agriculture land concerned to the respective assembly constituency. (Bagar Hukum Committee) But in some cases if the member of the concerned assembly constituency is not willing to be a member of the committee or if the seat of the member of the assembly is vacant then constituting the committee is delayed. The Hon'ble High Court has taken the serious note to remove the encroachment of the government land and directed to form the committee immediately. Therefore, it is considered necessary to amend the section 94-A of the Karnataka Land Revenue Act, 1964 to make a provision for nomination of any person in the said committee by the State Government. Regularisation of certain cases of unauthorised occupation by constituting committee etc.- (1) Subject to such rules as may be prescribed, the State Government shall, by notification, constitute for each constituency of the Legislative Assembly a committee consisting of such number of members not exceeding five of whom one shall be a member of Legislative Assembly for the purpose of grant of land under sub-section (4). (2) The Tahsildar of the concerned taluk shall be the Secretary of the committee. (2A) The State Government may, if it is of the opinion that it is necessary, constitute one or more additional committees for a taluk for the purpose of grant of land under sub-section (4) consisting of such number not exceeding five, as may be prescribed and the State Government shall nominate from among the members one of them as the Chairman and another as the Secretary of the committee. When an additional committee is constituted, the Deputy Commissioner shall determine the jurisdictions of the committee and the additional committee and transfer the pending applications to the respective committee. (3) The committee or additional committee shall follow such procedure as may be prescribed.
