land schedule in respect of Hassan Cherlapalli LPG Pipeline Project to be laid by Hindustan Petroleum Corporation Limited (HPCL) for acquisition of ROU in the State of Karnataka Mandal Hiriyur, District Chitradurga
## Policy Analysis Report: Acquisition of Right of User for LPG Pipeline
**1. Executive Summary:**
This report analyzes a notification issued by the Ministry of Petroleum and Natural Gas, Government of India, regarding the acquisition of the Right of User (RoU) for land in Hiriyur Taluk, Chitradurga District, Karnataka, for the purpose of laying an LPG pipeline by Hindustan Petroleum Corporation Limited (HPCL). This policy aims to facilitate the transportation of LPG from Hassan, Karnataka, to Cherlapalli, Telangana. The notification outlines the legal basis for the land acquisition, provides a schedule of affected land parcels, and specifies a process for landowners to raise objections. The key finding is that this notification sets in motion the process for acquiring land rights necessary for constructing the aforementioned pipeline.
**2. Introduction:**
This report provides an informative analysis of the notification published in the Gazette of India on December 14, 2021, concerning the acquisition of the Right of User for land for an LPG pipeline. The analysis is based solely on the provided text and aims to clarify the policy's objectives, provisions, and potential impact.
**3. Policy Overview:**
This is a *new* policy notification pertaining to land acquisition.
* **Core Objective(s):** The core objective, as stated explicitly within the text, is to enable the transportation of LPG from Hassan, Karnataka to Cherlapalli, Telangana by facilitating the acquisition of the Right of User (RoU) in the land required for laying a pipeline by Hindustan Petroleum Corporation Limited (HPCL). The text highlights that acquiring the RoU is deemed necessary in the "public interest".
**4. Background and Rationale:**
* Since this is a new policy notification for land acquisition, the policy likely addresses the need for infrastructure development to ensure efficient and reliable transportation of LPG. The "public interest" rationale suggests a broader goal of energy security and accessibility, potentially aiming to improve LPG supply to Telangana by establishing the pipeline from a supply center in Karnataka. This type of infrastructural project typically improves fuel transport capacity.
**5. Key Provisions / Changes:**
* As a new policy, the key provisions of the notification are:
* **Declaration of Intent:** The Central Government declares its intention to acquire the Right of User in the land described in the attached schedule.
* **Legal Basis:** The action is based on the powers conferred by subsection 1 of section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act, 1962 (50 of 1962).
* **Land Schedule:** A detailed schedule lists the specific land parcels affected, including the village name, survey number, and area (in Acres and Guntas) for each plot in Hiriyur Taluk, Chitradurga District, Karnataka.
* **Objection Mechanism:** A process is outlined where individuals with an interest in the listed land can object in writing to the acquisition within twenty-one days from the date the Gazette notification is made available to the general public.
* **Competent Authority:** The notification specifies the contact information for the Competent Authority (SLAO, Hassan-Cherlapalli LPG Pipeline Project, HPCL) to whom objections should be addressed.
* **Implementing Body:** Hindustan Petroleum Corporation Limited is identified as the entity responsible for laying the pipeline.
**6. Target Audience and Stakeholders:**
Based on the provided text, the primary target audience and stakeholders are:
* Landowners in Hiriyur Taluk, Chitradurga District, Karnataka, whose land is listed in the schedule. They are directly affected by the potential acquisition of RoU.
* Hindustan Petroleum Corporation Limited (HPCL), as the company responsible for laying the pipeline.
* The Competent Authority (SLAO, Hassan-Cherlapalli LPG Pipeline Project, HPCL), responsible for handling objections and presumably overseeing the land acquisition process.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The Central Government, through the Ministry of Petroleum and Natural Gas, is ultimately responsible for the policy's implementation. HPCL is responsible for the actual laying of the pipeline, and the Competent Authority oversees the objection process and likely the broader land acquisition.
* **Timelines:** The notification specifies a 21-day period for landowners to submit objections after the Gazette of India is made available to the general public. This suggests a time-bound process, although the overall timeline for the entire land acquisition and pipeline construction is not detailed in this specific text.
* **Procedures:** A written objection process is outlined, requiring individuals to submit their concerns to the specified Competent Authority within the given timeframe. Further procedures for handling objections, valuation of land, and compensation are not specified in the provided text.
**8. Expected Outcomes / Impact of Changes:**
* The expected outcome of this policy is the successful acquisition of the Right of User for the land required to lay the LPG pipeline. This, in turn, is intended to facilitate the efficient transportation of LPG from Hassan to Cherlapalli. The long-term impact is likely to be improved energy infrastructure, potentially leading to a more reliable and accessible LPG supply for the target region, in line with the stated "public interest."
**9. Conclusion:**
The notification issued by the Ministry of Petroleum and Natural Gas initiates the process of acquiring land rights for the Hassan-Cherlapalli LPG pipeline. The notification outlines the legal basis for the acquisition, identifies affected landowners, and establishes a mechanism for lodging objections. The successful implementation of this policy is crucial for enabling the pipeline's construction, which is expected to improve LPG transportation infrastructure and contribute to energy security in the region. The significance lies in its potential to benefit both the transporting company and the public through enhanced supply chain capabilities and improved energy access.
