प्रारंभ– (1) इि जियमों का संजिप्त िाम जर्जधक मापजर्ज्ञाि (पैकेि म ें रखी र्स्ट्तुए)ं संिोधि जियम, 2023 ह।ै (2) िैसा अन्यथा उपबंजधत ह ैइसके जसर्ाय, य े जियम 1 ििर्री 2024 स े प्रर्ृत्त होंगे। 2. जर्जधक मापजर्ज्ञाि (पैकेि म ें रखी र्स्ट्तुए)ं जियम, 2011 म,ें (जिसे इसम ें इसके पश्चात ् उि जियम कहा गया ह)ै जियम 2 म,ें खंड (ट) के पश्चात ्जिम्नजलजखत खडं अंतर्र्वष्ट दकया िाएगा, अथातव ्:- (ट, क) "संयोिि पैकेि" स े खुिरा जबक्री के जलए पैकेि, जिसम ें जभन्न र्स्ट्तओंु के िो या अजधक, अलग-अलग पैकेि, या अलग-अलग र्स्ट्तुए ंहोती ह,ैं अजभप्रेत ह;ै 6329 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] िष्टृ ांत: पैकेि जिसम ें चम्मच, चाकू, कांटे, कप, िैपदकि या इसी तरह की अन्य अलग-अलग र्स्ट्तुए ं अंतर्र्वष्ट ह,ैं र्ाला एक संयोिि पैकेि ह;ै (ट, ख) "ग्रुप पैकेि" स े खुिरा जबक्री के जलए एक पैकेि, जिसम ें िो या िो स े अजधक अलग-अलग पैकेि, या अलग-अलग टुकडे, समरूप ह,ै लेदकि एक समाि (चाह े मात्रा या आकार म)ें र्स्ट्तुए ंिहीं ह,ै अजभप्रेत ह।ै स्ट्पष्टीकरण: र्स्ट्तुए ं िो आम तौर पर समाि होती ह ैं लेदकि र्िि, माप या मात्रा, दिखार्ट या गुणर्त्ता म ें जभन्न होते ह,ै समाि होते ह,ैं लेदकि एक समाि र्स्ट्त ु िहीं होती ह।ैं िष्टृ ांत: (i) एक पैकेि म ेंजिजहत िो स्ट्पॉि-100 एमएम x 75 एमएम x 20 एमएम एक स्ट्पॉि -100 एमएम x 100 एमएम x 30 एमएम चार स्ट्पॉि-100 एमएम x 50 एमएम x 15 एमएम एक ग्रुप पैकेि ह;ै (ii) र्गीकृत जबस्ट्कुट र्ाला पैकेि एक ग्रुप पैकेि ह;ैं (iii) र्गीकृत ब्ांड की समाि र्स्ट्तुओं र्ाला एक पैकेि एक ग्रुप पैकेि ह;ै (ट ग) "मल्टी पीस पैकेि" स े एक पैकेि जिसम ें िो या िो स े अजधक अलग-अलग पैक दकए गए या समाि मात्रा के समाि र्स्ट्तुओं के लेबल र्ाले टुकडे होते ह,ैं िो खुिरा जबक्री के जलए अलग-अलग टुकडों म ेंया परू े पकै ेि म ें होते ह,ैं अजभप्रेत ह:ै परंत ु खाद्य सामग्री र्ाले पैकिों के जलए, खाद्य सुरिा और मािक अजधजियम, 2006 (2006 का 34) के उपबंधों तथा उसके अधीि बिाए गए जियम लाग ू होंगे। िष्टृ ांत: (i) एक पैकेि जिसम ें“20 ग्राम प्रत्येक और 100 ग्राम कुल िुद्ध र्िि के 5 प्रसाधि साबुि” एक बहु-टुकडा पैकेि ह;ै 3. उि जियम म,ें जियम 6 के, उपजियम (i) म,ें तीसरे परंतुक के पश्चात ् खंड (घ) म,ें जिम्नजलजखत को अंत: स्ट्थाजपत दकया िाएगा, िो अप्रलै 2024 के प्रथम दिि स े प्रर्ृत्त होगा, अथातव ्:- परंत ु यह भी दक इस खडं म ें अन्तर्र्वष्ट दकसी बात के होत े हुए, र्ारंटी के साथ सर्र्वससंग के प्रयोिि स े उपयोग दकए िािे र्ाले स्ट्पेयर पार्टसव एर् ं सहायक उपकरणों और अंजतम ग्राहक को जर्क्रय िहीं दकए िाि े पर लाग ू होंगे। परंतु यह भी दक इलेक्रॉजिक उत्पािों, स्ट्पेयर पार्टसव और सहायक उपकरणों के जलए जर्जिमावण के मास और र्र् व की घोर्णा खुिरा पैकेि पर जर्जिष्टत: कहीं भी ि‍ृ यमाि और स्ट्पष्ट रूप स े सुपाठ्य रूप म ेंहोिी चाजहए। स्ट्पष्टीकरण: इस खडं के प्रयोिि के जलए, “स्ट्पेयर पार्टसव और सहायक उपकरण म ें कोई भी “भाग”, “घटक” या “सहायक उपकरण िो दकसी मिीि, उपकरण या उपस्ट्कर के प्रमुख या मुख्य उत्पाि के पूरक ह”ैं चाह े दकसी भी िाम स े पुकारा िाए, इसम ें र्े पार्टसव भी िाजमल होंग े िो दक मिीि, उपकरण या उपस्ट्कर के इजछित प्रचालि या िजतग्रस्ट्त या जघस-े जपटे जहस्ट्स े को समर्थवत करिे या बिलि े के जलए उपयोग करि े के जलए पथृ क रूप से जर्क्रय दकए िाते ह।ैं ” 4. उि जियम म,ें जियम 6 म,ें उप-जियम (11) म,ें िसू रे परंतकु के पश्चात,् जिम्नजलजखत परंतकु अतं :स्ट्थाजपत दकया िाएगा, अथावत:्- परंत ु यह भी दक इि जियमों या तत्समय प्रर्ृत्त दकसी अन्य जर्जध के अधीि पठरभाजर्त संयोिि पैकेि या ग्रुप पैकेि या मल्टीपीस पैकेि के जलए यूजिट जबक्री मूल्य की घोर्णा की आर्‍यकता िहीं ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 5. उि जियमों म,ें जियम 26 म,ें खंड (च) म,ें प्रथम परंतुक के पश्चात, मि (iii) के स्ट्थाि पर जिम्नजलजखत परंतुक को अंतःस्ट्थाजपत दकया िाएगा, अथावत्:- (iii) सेंटीमीटर या मीटर के संिभ व मीठरक अंकि म ें उत्पाि का आकार िैसा भी मामला हो या के साथ अतं रावष्ट्रीय स्ट्तर पर पहचािे िािे योग्य आकार संकेतकों िैसे दक एस, एम, एल, एक्सएल, एक्सएक्सएल और एक्सएक्सएक्सएल के साथ सेंटीमीटर या मीटर के संिभव म,ें या िैसा भी मामला हो मीठरक अंकि म ें जर्र्रण के साथ हो सकता ह।ै 6. उि जियमों म,ें जियम 26 म,ें खंड (च) के पश्चात, जिम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथातव ्:- “(ि) इसम ें ई-कॉमसव चैिलों के माध्यम स े ऑडवर की गई खुली र्स्ट्तुए ं िाजमल ह,ै िहां उपभोिा ऑडवर की गई र्स्ट्तु, उसके प्रकार और मात्रा के बारे म ेंिािते ह;ैं परंत ु ऐसी र्स्ट्तओंु को जिम्नजलजखत िािकारी र्हि करिी होगी, अथावत्:- (i) आयात दकए गए उत्पािों के मामले म ें मलू ििे या जर्जिमावण ििे के साथ जर्जिमावता या जर्पणक या ब्ांड के माजलक या आयातक या जर्क्रेता का िाम और पता; (ii) कन््यूमर केयर ई-मेल आईडी और फोि िम्बर; (iii) भारतीय मुद्रा म ेंसभी करों सजहत पैकेि का अजधकतम खुिरा मल्ू य; और (iv) िुद्ध मात्रा, बाट या माप की मािक इकाई के संिभव म,ें या िहां र्स्ट्तु संख्या, र्स्ट्तु की संख्या द्वारा जर्क्रय की िाती ह।ै 7. उि जियमों म,ें चौथी अिुसचू ी म,ें क्रम संख्या (11) के सामि,े स्ट्तम्भ 3 म ें प्रजर्जष्ट के स्ट्थाि पर “र्िि या आयति और यदि िुद्ध मात्रा आयति द्वारा घोजर्त की िाती ह ै तो िुद्ध मात्रा र्िि द्वारा भी घोजर्त की िाएगी’’ प्रजर्जष्ट को रखा िाएगा। [फा. स.ं आई-10/22/2021 डब्लल्य ू एडं एम] जिजध खरे, जर्िेर् 2023 द्वारा अंजतम बार संिोजधत दकए गए थे। MINISTRY OF CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION (Department of Consumer Affairs) NOTIFICATION New Delhi, the 6th October, 2023 G.S.R. 722(E).—In exercise of the powers conferred by sub-section (1), read with clauses (j) and (q) of sub- section (2) of section 52 of the Legal Metrology Act, 2009 (1 of 2010), the Central Government hereby makes the following rules further to amend the Legal Metrology (Packaged Commodities) Rules, 2011, namely:- 1. Short title and commencement. – (1) These rules may be called the Legal Metrology (Packaged Commodities) Amendment Rules, 2023. (2) Save as otherwise provided, these rules shall come into force on the 1st day of January, 2024. 2. In the Legal Metrology (Packaged Commodities) Rules, 2011 (hereinafter referred to as the said rules), in rule 2, after clause (k), the following clauses shall be inserted, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] ‘(ka) "combination package" means a package intended for retail sale, containing two or more individual packages, or individual pieces, of dissimilar commodities; Illustration: A package containing dissimilar commodities such as, spoons, knives, forks, cups, napkins, or the like is a combination package; (kb) "group package" means a package intended for retail sale, containing two or more individual packages, or individual pieces, of similar, but not identical (whether in quantity or size) commodities. Explanation: Commodities which are generally the same but differ in weight, measure or volume, appearance or quality are similar, but not identical commodities. Illustrations: (i) A package containing,- Two sponges -100 mmx 75 mm x 20 mm One sponge -100 mmx 100 mm x 30 mm Four sponges -100 mmx 50 mm x 15 mm is a group package; (ii) A package containing assorted biscuits is a group package; (iii) A package containing similar commodities of different brands is a group package; (kc) "multi-piece package" means a package containing two or more individual packaged or labelled pieces of the same commodities of identical quantity, intended for retail sale, either in individual pieces or the package as a whole: Provided that for packages containing food articles, the provisions of the Food Safety and Standards Act, 2006 (34 of 2006) and the rules made thereunder shall apply. Illustration: (i) A package containing "5 toilet soap cakes of net weight 20g each and total net weight of 100 g" is a multi-piece package;’; 3. In the said rules, in rule 6, in sub-rule (1), in clause (d) after the third proviso, the following shall be inserted with effect from the 1st day of April, 2024, namely:- “Provided also that nothing contained in this clause shall apply to spare parts and accessories used for the purpose of servicing with a warranty and not sold to end customers: Provided also that for electronic products, spare parts and accessories, the declaration of month and year of manufacture shall be specified anywhere on the retail package in a visible and clearly legible manner. Explanation: For the purpose of this clause, “spare parts and accessories shall include any “part”, “component”, or “accessories that are complementary to the main or core product” of a machine, device or equipment, by whatever name called, including parts that are sold separately for use in support or replacement of a damaged or worn-out part, in order to have intended operation or functioning of the machine, device or equipment.". 4. In the said rules, in rule 6, in sub-rule (11), after the second proviso, the following proviso shall be inserted, namely:- “Provided also that declaration of unit sale price is not required for a combination package or a group package or a multi-piece package, under these rules or under any other law for the time being in force.”. 5. In the said rules, in rule 26, in clause (f), in the first proviso, for item (iii), the following item shall be substituted, namely:- “(iii) size of the product in metric notation in terms of cm or m, as the case may be, or with internationally recognizable size indicators such as S, M, L, XL, XXL and XXXL along with details in metric notation in the terms of cm or m, as the case may be;”. 6. In the said rules, in rule 26, after clause (f), the following clause shall be inserted, namely:- “(g) it contains loose commodities ordered through e-commerce channels, where consumers are aware of the ordered commodity, its type and quantity: Provided that such commodities shall bear the following information, namely:- (i) name and address of manufacturer or marketer or brand owner or importer or seller with the country of origin or manufacture in the case of imported products; (ii) consumer care email id and phone number;[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 (iii) retail sale price of the package inclusive of all taxes in the Indian currency; and (iv) net quantity, in terms of the standard unit of weight or measure, or where the commodity is sold by number, the number of the commodity. 7. In the said rules, in the FOURTH SCHEDULE, against serial number (11), for the entry in column 3, the entry “weight or volume and if the net quantity is declared by volume, the net quantity shall also be declared by weight” shall be substituted.
