The commodities specified in said Table shall comply with the qualitative specifications or standards of the AGMARK or Bureau of Indian Standards or Food Safety and Standards Authority of India: Provided that in case, standards of AGMARK or Bureau of Indian Standards or Food Safety and Standards Authority of India do not exist for these commodities, quality standards laid down by the Central Government or State Governments or Governmental bodies shall be applicable. 3. For the commodities requiring chemical or allied laboratory analysis, all AGMARK laboratories, all accredited laboratories notified by the National Accreditation Board for Testing and Calibration Laboratories and laboratories recognised by the Bureau of Indian Standards and Food Safety and Standards Authority of India are authorised for laboratory testing. 4. In addition, the Central Government or the State Government laboratories and other laboratories recognised by them may conduct testing of the said commodities JEETESH SHARMA, Director (Admin & Finance) [ADVT.-III/4/Exty./319/2023-24][भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 अजधसचू िा िई ददल्ली, 27 िुलाई, 2023 स.ं डब्ल्यडू ीआरए-टेक0ओपीएस(डब्ल्यएू च)/2/2021-तकिीकी.—भांडागारण (जिकास और जिजियमि) भांडागार पंिीकरण जियम, 2017 के जियम 19 के साथ पठित भांडागारण (जिकास और जिजियमि) अजधजियम, 2007 (2007 का 37) की धारा 35 की उप-धारा (2) के खंड (ि) द्वारा प्रदत्त िजियों का प्रयोग करते हुए भांडागारण जिकास और जिजियामक प्राजधकरण (जिसे यहां इसके पश् चात प्राजधकरण कहा गया ह)ै प्राजधकरण के साथ गैर कृजिगत िस्ट् तओंु को भंडाठरत करि े िाल े भाडं ागारों और गैर-कृजिगत एि ं कृजिगत दोिों िस्ट् तुओं को भंडाठरत करि े िाल े संयुि भांडागार के पंिीकरण के जलए प्रजतभूजत िमा की आिश्यकता हते ु जिम्नजलजखत प्रदक्रया अजधसूजचत करता हैःै — 1. प्राजधकरण के साथ अपि े भांडागारों का पंिीकरण का अिरु ोध करि े िाल े आिेदक भांडागार या भांडागार सेिा प्रदाता (डब्ल्यूएसपी), पंिीकरण प्रमाणपत्र िारी दकए िाि े से पूि व प्राजधकरण को प्रजतभूजत िमा प्रस्ट्तुत करेगा। इस प्रभाि में, प्राजधकरण स ेसूचिा िारी होि े के इक्क ीस कायव ददिसों के भीतर प्रजतभूजत िमा प्रस्ट्तुत करिी होगी। 2. यदद आिेदक उपयुविािुसार जिजिर्दवष्ट अिजध के भीतर प्रजतभूजत िमा प्रस्ट्तुत करि े में जिफल रहता ह ैआिेदि को जिरस्ट्त मािा िाएगा; परंत,ु प्राजधकरण का यह समाधाि होता ह ै दक आिेदक द्वारा इक्क ीस कायव ददिसों के उि अिजध के भीतर प्रजतभूजत िमा प्रस्ट्ततु ि करि े हते ु पयावप्त कारण मौिूद था, प्राजधकरण आिेदक को प्राजधकरण के जिणावयािुसार जिस्ट्ताठरत अिजध के भीतर प्रजतभूजत िमा प्रस्ट्तुत करि े की अिुमजत दे सकता ह।ै 3. यदद आिेदक िीचे जिजिर्दवष्ट प्ररूप और रीजत से प्रजतभूजत िमा प्रस्ट्तुत करता ह,ै प्राजधकरण भांडागारण (जिकास और जिजियमि) भाण्डागारण पंिीकरण जियम, 2017 की चौथी अिुसूची में जिजिर्दवष्ट प्रारूप में पांच कायव-ददिसों के भीतर आिेदक को भांडागार के संबंध में पंिीकरण प्रमाणपत्र िारी करेगा। 4. आिेदक या भांडागारपाल द्वारा प्रस्ट्ततु की िाि े िाली प्रजतभूजत िमा की राजि तथा रीजत का ब्यौरा जिम्नित हैःै (i) भांडागारपाल पंिीकरण की अिजध के दौराि प्राजधकरण द्वारा धाठरत प्रजतभूजत िमा का अिुरक्षण करेगा। प्रजतभूजत िमा के दो घटक ह,ैं अथावत- जस्ट्थर तथा गत्यात्मक प्रजतभूजत िमा। जस्ट्थर प्रजतभूजत िमा राजि भांडागारण जिकास एिं जिजियामक प्राजधकरण के साथ पंिीकृत भांडागारपाल स े संबंजधत प्रत्येक भांडागार के जलए है, िबदक गत्यात्मक प्रजतभूजत िमा पूिविती माह के दौराि दकसी ददि भाडं ागारपाल के सभी पंिीकृत भांडागारों की परक्राम्य तथा अपरक्राम्य भाडं ागार रसीदों (चाह ेिे इलेक्रॉजिक अथिा भौजतक दकसी रूप म ेंहो) के समेदकत बकाया के अजधकतम मूल्य का प्रजतित ह।ै (क) भाडं ागारपाल के जलए केिल गैर- कृजिगत िस्ट् तओंु के भंडारण के जलए जस्ट्थर प्रजतभूजत िमा 1,00,000 रुपए प्रजत भांडागार ह ै (भांडागारों के पंिीकरण के जलए िीचे सारणी (क) में जििरण ददया गया है), िबदक गत्यात्मक प्रजतभूजत िमा पूिविती माह के दौराि दकसी भी ददि भांडागारपाल के सभी पंिीकृत भांडागारों की परक्राम्य तथा अपरक्राम्य भांडागार रसीदों (चाह े ि े इलेक्रोजिक अथिा भौजतक दकसी रूप म ें हो) के समेदकत बकाया अजधकतम मूल्य का 0.3% ह,ै िो की िीचे दी गई सारणी 1 के स्ट्तम्भ (ख) में ‘टी’ के रूप म ेंजिजिर्दवष् ट दकया गया ह।ै सारणी- 1 क्र. सं. जस्ट्थर प्रजतभूजत िमा, प्रजत भांडागार गत्यात्मक प्रजतभूजत िमा इकाई (एफएसडी) (टी का प्रजतित) (डीएसडी) क ख 1. प्रजत भांडागार एक लाख रुपए टी का 0.3% जिसम ें ‘टी’ पूिविती माह के दौराि दकसी भी ददि भांडागारपाल के पंिीकृत भंडागार द्वारा िारी परक्राम्य और गरै - परक्राम्य भांडागार रसीदों का समेदकत उच्च माि ‘टी’ के रूप में जिजिर्दवष् ट ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख ) भांडागारपाल के जलए, गरै -कृजिगत और कृजिगत िस्ट् तओंु दोिों के भंडारण के जलए जस्ट्थर प्रजतभूजत िमा 1,00,000 रुपए प्रजत भांडागार ह,ै िबदक गत्यात्मक प्रजतभजू त िमा भडं ाठरत कृजिगत िस्ट् तुओं पर लागू गत्यात्मक प्रजतभूजत िमा राजि होगी और भडं ाठरत गैर-कृजिगत िस्ट् तओंु पर लागू गत्यात्मक प्रजतभूजत िमा िीचे सारणी-2 के अिुसार होगी। सारणी-2 क्र. सं. जस्ट्थर प्रजतभूजत िमा रुपए प्रजत गैर-कृजिगत िस्ट् तओंु के कृजिगत िस्ट् तओंु के संबंध डीएसडी की कुल भांडागार इकाई (एफएसडी) संबंध में गत्यात्मक प्रजतभूजत में गत्यात्मक प्रजतभूजत आिश्यकता िमा िमा (टी-1 का प्रजतित) (टी-2 का प्रजतित) (डीएसडी) (डीएसडी) क ख ग घ 1. 10,0000 रुपए प्रजत टी-1 का 0.3 प्रजतित 2000 टि से अजधक ख+ग भांडागार क्षमता के कृजिगत भांडागार पर लाग ूदर के समाि टी-1, भांडागार की क्षमता का जिचार दकए जबिा, पूिविती माह के दौराि दकसी ददि भांडागारपाल के सभी पंिीकृत भांडागारों के गरै -कृजिगत िस्ट् तओंु की परक्राम्य तथा अपरक्राम्य भांडागार रसीदों के समेदकत बकाया का अजधकतम मल्ू य होगा। टी-2, भांडागार की क्षमता का जिचार दकए जबिा, पूिविती माह के दौराि दकसी ददि भांडागारपाल के सभी पंिीकृत भांडागारों के कृजिगत िस्ट्त ुओं की परक्राम्य तथा अपरक्राम्य भांडागार रसीदों के समेदकत बकाया का अजधकतम मूल्य होगा। (ii) जस्ट्थर प्रजतभूजत िमा पंिीकरण अिजध स े अजधक छह माह की अिजध तक के जलए बिाए रखिी होगी, िबदक गत्यात्मक प्रजतभूजत िमा को प्रत्येक माह के अंत में अद्यति कर प्राजधकरण को प्रस्ट्तुत दकया िाएगा, जिसकी प्राजधकरण द्वारा जिजधित रुप स े पािती दी िाएगी। गत्यात्मक प्रजतभूजत िमा की िैधता कम से कम छह महीिे के जलए रखी िा सकती ह ै जिससे इस अिजध के दौराि प्रजतभूजत िमा की आिश्यकताओं में दकन्हीं पठरितविों को ध्याि में रखा िा सके; (iii) प्राजधकरण अपि े जििेकािुसार भांडागारपाल द्वारा पहले से िमा प्रजतभूजत को ितवमाि प्रजतभूजत िमा के रूप में प्रस्ट्तुत की िािे िाली अपेजक्षत राजि के जिरुद्ध समायोजित कर सकता ह।ै (iv) प्रजतभूजत िमा भांडागार पंिीकरण के समाजप्त के पश्चात छह माह की अिजध हते ु अिुसूची-1 में ददए गए प्रारूप के अिुसार भांडागारण जिकास और जिजियामक प्राजधकरण के पक्ष में बैंक सािजध िमा या बैंक गारंटी के रूप में होगी। (V) प्राजधकरण संसद के दकसी अजधजियम या दकसी राज्य जिधािसभा के अधीि बिाए गए जिकाय को दसू री अिुसूची म ें ददए गए प्रारूप के अिुसार प्रजतभूजत िमा के रूप म ें अपेजक्षत राजि हते ु एक क्षजतपूर्त व बंधपत्र उपलब्ध करिािे की अिुमजत दे सकता ह।ै (VI) प्राजधकरण द्वारा क्षजतपूर्त व बंधपत्र प्रस्ट् तुत करिे के जलए अिुमजत प्राप् त कोई जिकाय पिं ीकरण हते ु अपिे आिेदि के साथ ऐसे क्षजतपूर्त वबंधपत्र को प्रस्ट् तुत करि े के जलए अपि ेजिदिे क मंडल स ेएक संकल्प प्रस्ट् तुत करेगा। (VII) प्रजतभूजत िमा को भांडागार के पंिीकरण की समाजप्त, जिरस्ट् तीकरण अथिा अभ् यपणव के पश् चात् 6 माह तक अथिा प्रजतभूजत िमा के प्रजत प्रत् येक दािे की संतुजष्ट होि े तक, िो भी बाद में हो, िारी िहीं दकया िाएगा। (VIII) प्राजधकरण दकसी भंडागार की प्रजतभूजत िमा िापस करेगा, यदद— (क) भांडागार के पंिीकरण के ििीकरण हते ु दकसी आिेदि को जिरस्ट् त कर ददया गया ह ै और यदद प्राजधकरण इसस े संतुष्ट ह ैदक भांडागारपाल िे अपि े दाजयत् िों को इि जियमों के अिुसार जिष्प ाददत दकया ह;ै (ख) कोई भांडागारपाल अपि े पंिीकरण प्रमाणपत्र का अभ्य पवण करता ह ै और प्राजधकरण ऐसे अभ् यपणव को स्ट् िीकार कर लेता ह;ै अथिा (ग) दकसी भांडागार के पंिीकरण के प्रमाणपत्र को जिरस्ट् त कर ददया गया ह ै और प्राजधकरण इससे संतुष्ट ह ै दक भांडागारपाल ि े अपिे दाजयत् िों का जििवहि इि जियमों की अपक्षे ा के अिुसार दकया ह।ै[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (IX) उपयुवक् त (1) तथा (2) म ें जिर्दवष् ट दकए अिुसार प्रजतभूजत िमा के ऐस े दकसी पुिर्िलव ोकि के होते हुए भी, यदद कोई ह,ै भांडागारपाल उन् ह ेंिारी परक्राम् य भांडागार रसीदों की िैध अिजध में िमाकतावओं को देय प्रभारों में िृजद्ध िहीं करेगा। प्रथम अिसु चू ी (भाडं ागारपाल द्वारा प्रस्ट्त ुत की िाि ेिाली प्रजतभजू त िमा भगु ताि हते ुबकैं गारंटी का प्रारूप) जिदेिक (प्रिासि एिं जित् त) भांडागारण जिकास और जिजियामक प्राजधकरण (डब् ल् यडू ीआरए) एिसीयूआई भिि (चौथा तल), 3, सीरी इन् स्ट् टीट्यिू िल एठरया, अगस्ट्त क्रांजत मागव, हौि खास, िई ददल्ल ी- 110016 (यथा लाग ूस्ट् टाम् प िुल् क के साथ) हमारी गारंटी पत्र स.ं- ……………………………… 1. भांडागारण जिकास और जिजियामक प्राजधकरण, जिसका कायावलय एिसीयूआई पठरसर (चौथा तल), 3, इन् स्ट् टीट्यूििल एठरया, अगस्ट्त क्रांजत मागव, हौि खास, ददल्ल ी- 110016 (भारत) (जिसे इसम ेंइसके पश् चात ‘’डब् ल् यडू ीआरए’’ कहा गया ह,ै िब तक अंतिवस्ट्तु या अथ व के जिपरीत ि हो इसके सभी उत् तराजधकारी, प्रिासक और जिष्प ादक सजम्मजलत होंगे) म ें अिजस्ट्थत ह ै और जिसिे मैससव ................................... से संबंजधत भांडागारों अथिा इस अिुसूची के साथ संलग् ि सूची के अिुसार (बैंक द्वारा जिजधित रूप स े पृष्ि ादं कत) भांडागारों का पंिीकरण प्रदाि करिे पर जिचार दकया ह/ैप्रदाि दकया ह,ै (जिसे इसमें इसके पश् चात ‘’भांडागारपाल’’ कहा गया ह,ै िब तक अंतिवस्ट्त ु या अथ व के जिपरीत ि हो इसके सभी उत् तराजधकारी, प्रिासक और जिष्प ादक िाजमल होंगे)। 2. भांडागारपाल भाडं ागारण (जिकास और जिियमि) भांडागार पंिीकरण जियम, 2017 (जिस े इसमें इसके पश् चात जियम कहा गया ह)ै में ददए गए जिबंधि एिं ितों के अिुसार भांडागार कारबार के संचालि को स्ट्प ष्ट रूप से स्ट् िीकार दकया ह ै और डब्ल् यूडीआरए के साथ पूणव पंिीकरण के जिश् िसिीय जिष्प ादि हते ु ..................... रुपए (................................... रुपए मात्र) के जलए बैंक गारंटी के रूप में प्रजतभूजत िमा डब्ल् यडू ीआरए को प्रस्ट् तुत करिे पर सहमत हुआ ह,ै हम .......................... The applicant warehouse or Warehouse Service Provider (WSP) seeking registration of their warehouse with the Authority shall submit a security deposit to the Authority before issue of a registration certificate. The security deposit shall be required to be submitted within twenty-one working days after issue of a communication by the Authority to this effect. 2. If the applicant fails to submit the security deposit within the period specified as above, the application shall be deemed to have been rejected; Provided that the Authority may, if it is satisfied that the applicant was prevented by sufficient cause from submitting the security deposit within the said period of twenty-one working days, allow them to submit the security deposit within such extended time as may be decided by the Authority. 3. If the applicant submits the security deposit in the form and manner specified below, the Authority shall issue a certificate of registration to the applicant in respect of the warehouse within five working days in the form specified in the Fourth Schedule of the Warehousing (Development and Regulation) Registration of Warehouses Rules, 2017. 4. Details of the amount and manner of security deposit to be furnished by the applicant or the warehouseman are given as under: (i) The warehouseman shall maintain a security deposit to be held by the Authority during period of registration. The security deposit has two components, i.e. fixed and dynamic security deposit. The fixed security deposit amount is per warehouse belonging to the warehouseman registered with Warehousing Development & Regulatory Authority, whereas, the dynamic security deposit is a percentage of the maximum value of negotiable and non-negotiable warehouse receipts (whether in electronic or physical form) put together outstanding consolidatively in all the registered warehouses of the warehouseman on any day during the preceding month, (a) For warehouseman, storing only non- agricultural commodities the fixed security deposit is Rs. 1,00,000/- per warehouse (as detailed in the column A below for registration of warehouses), whereas, the dynamic Security Deposit is 0.3% (zero point three percent) of the maximum value of negotiable and non-negotiable warehouse receipts (whether in electronic or physical form put together) outstanding consolidatively in all the registered warehouses of the warehouseman on any day during the preceding month, referred as ‘T’, as mentioned in column B of Table 1 below.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] TABLE 1 S. (ii) The fixed security deposit shall be maintained for a period of six months beyond the registration period whereas the dynamic security deposit shall be updated at the end of each month and submitted to the Authority which shall be duly acknowledged. The validity of dynamic security deposit can be kept for a period of minimum six months so as to take care of any changes in the requirement of security deposit during this period; (iii) The Authority may, at its discretion, adjust the security deposit already furnished by the warehouseman against the amount required to be furnished; (iv) The security deposit shall be in the form of Bank Fixed Deposits or in form of Bank Guarantee, favouring Warehousing Development & Regulatory Authority as per the format given in First Schedule for a period of six months beyond the expiry of registration; (v) The Authority may allow any entity created under an Act of Parliament or of State legislature to provide, an Indemnity Bond for the amount required as security deposit, as per format given in the Second Schedule; (vi) An entity allowed by the Authority to submit an Indemnity Bond shall submit, along with application for registration, a resolution from the Board of Directors authorising to furnish such Indemnity Bond; (vii) The security deposit shall not be released until six months after expiry, cancellation or surrender of the registration of the warehouse or until after satisfaction of every claim against the security deposit, whichever is later; (viii) The Authority shall refund the security deposit in respect of a warehouse, if–[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 11 (a) an application for renewal of registration of the warehouse has been rejected and if the Authority is satisfied that the warehouseman has discharged his obligations as per the requirements of the rules; (b) a warehouseman surrenders the certificate of registration and the Authority accepts such surrender; or (c) the certificate of registration of a warehouse is cancelled and the Authority is satisfied that the warehouseman has discharged his obligations as per the requirements of the rules. (ix) Notwithstanding such revision of the security deposit as specified at (i) and (ii) above, if any, the warehouseman shall not increase the charges payable by the depositors within the period of validity of negotiable warehouse receipts issued to them. Every person desirous of commencing or carrying business of maintaining a warehouse issuing negotiable warehouse receipts is required to be registered and for that purpose an application has to be made to the Authority under the said Act. (b) Every applicant warehouse/Warehouse Service Provider (WSP) seeking registration of their warehouse shall be required to submit security deposit to the Authority within twenty-one days of the communication by the Authority. (c) The value of security deposit in the form of bank guarantee in favour of Warehousing Development and Regulatory Authority to be deposited by warehouseman having warehouses storing non- agricultural commodities and to be maintained during the period of registration and to be updated at the end of each month is as follows:— S. Where ‘T2’ will be the maximum value of negotiable and non-negotiable warehouse receipts of agricultural commodities, outstanding consolidatively, in all the registered warehouses of the warehouseman on any day during the preceding month, irrespective of the capacity of the warehouse. (e) The Authority may at its discretion, adjust the security deposit already furnished by warehouseman against the amount required as security deposit. The security deposit shall not be released until six months after cancellation, rejection or surrender of the registration of the warehouse or until after satisfaction of every claim against security deposit whichever is later. The Authority reserves its rights to revise the amount of security deposit. (f) As the Authority may allow any entity created under an Act of the Parliament or State Legislative and carrying business of maintaining warehouse (s) and issuing negotiable warehouse receipt, to submit Indemnity Bond in lieu of security deposit and the entity allowed by the Authority to submit an Indemnity Bond shall submit, along with application for registration, a resolution from Board of Directors authorising the furnishing of such Indemnity Bond.
