र्ि और िलर्ाय ु पररर्तिव मंत्रालय, भारत सरकार ि े पयावर्रण (संरक्षण) अजधजियम, 1986 (1986 का 29) (जिसे इसके पश्चात ् उक्त अजधजियम कहा गया ह)ै की धारा 3, 6 और 25 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए, अजधसूचिा संख्या का.आ. 1357 (अ), तारीख 8 अप्रलै , 2016 द्वारा ठोस अपजिष्ट प्रबंधि जियम, 2016 अजधसूजचत दकए। और िबदक, उक्त ठोस अपजिष्ट प्रबंधि जियम, 2016 अन्य बातों के साथ-साथ, प्रत्येक िहरी स्ट्थािीय जिकाय, बढ़ते िहरी समूहों, भारत के महारजिस्ट्रार एर् ं ििगणिा आयक्तु द्वारा घोजित ििगणिा कस्ट्बों, अजधसूजचत क्षेत्रों, अजधसूजचत औद्योजगक टाउिजिप, भारतीय रेल, हर्ाई अड्डों, एयरबेस, बंिरगाहों एर् ं पत्तिों, रक्षा स्ट्थापिों, जर्िेि आर्थवक क्षेत्रों, राज्य और केन्रीय सरकार के संगठिों के जियंत्राधीि क्षेत्रों, तीथ व स्ट्थलों, धार्मवक और संबंजधत राज्य सरकार द्वारा समय-समय पर यथा अजधसूजचत ऐजतहाजसक महत्र् के स्ट्थलों और औद्योजगक अपजिष्ट, खतरिाक अपजिष्ट, खतरिाक रसायि, िैर् जचदकत्सा अपजिष्ट, ई-अपजिष्ट, लडै एजसड बैटरी तथा रेजडयो-सदिय अपजिष्ट के अजतररक्त प्रत्येक घरेलू, संस्ट्थागत, र्ाजणजज्यक और दकसी अन्य गरै -आर्ासीय ठोस अपजिष्ट उत्पाद्य क्षेत्रों पर लागू होंगे, िो उक्त अजधजियम के अधीि अलग से बिाए गए जियमों के अंतगवत आते ह;ैं 4716 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] और िबदक, ठोस अपजिष्ट प्रबधं ि जियम, 2016 के जियम 15 का खंड (ड) स्ट्थािीय प्राजधकाररयों को उक्त जियमों की अजधसूचिा की तारीख से एक र्ि व के भीतर उपजर्जध बिाि ेहते ु बाध्य करता है; अत: अब, लखिऊ छार्िी बोडव ठोस अपजिष्ट प्रबंधि जियम, 2016 के जियम 15 के साथ परठत छार्िी अजधजियम, 2006 (2006 का 41) की धारा 348 द्वारा प्रित्त िजक्तयों का प्रयोग करते हुए जिम्नजलजखत प्रारूप उपजर्जधयां बिािे का प्रस्ट्तार् प्रस्ट्तुत करता ह ै िो छार्िी अजधजियम, 2006 की धारा 350 की उप-धारा (1) की अपक्षे ा अिुसार, इसस े प्रभाजर्त होि े र्ाले सभी व्यजक्तयों की िािकारी हते ु प्रकाजित दकया गया ह ैऔर सूजचत दकया िाता ह ै दक केन्रीय सरकार द्वारा उक्त प्रारूप उपजर्जधयों पर उस तारीख से तीस दिि की समाजि पश्चात जर्चार दकया िाएगा जिस दिि भारत के रािपत्र में प्रकाजित इस अजधसूचिा की प्रजतयां ििता को उपलब्ध कराई िाएंगी; इि प्रारूप उपजर्जधयों पर आपजत्तयां या सुझार्, यदि कोई हो, मुख्य अजधिासी अजधकारी, खड़की छार्िी बोड व को प्रेजित दकए िा सकत े ह;ैं उक्त प्रारूप उपजर्जधयों के संबंध में दकसी भी व्यजक्त से उपरोक्त अर्जध की समाजि से पहल ेप्राि होिे र्ाली दकसी भी आपजत्त या सुझार् पर केन्रीय सरकार द्वारा जर्चार दकया िाएगा। लखिऊ छार्िी बोड वठोस अपजिष्ट प्रबधं ि उपजर्जधयां, 2024 अध्याय I सामान्य 1. सजं क्षि िाम और प्रारंभ- (1) इि उपजर्जधयों का संजक्षि िाम लखिऊ छार्िी बोडव ठोस अपजिष्ट प्रबंधि उपजर्जधयां, 2024 ह।ै (2) य ेरािपत्र म ेंउिके प्रकािि की तारीख से प्रर्ृत्त होंगे। 2. लाग ूहोिा - य ेउपजर्जधयां लखिऊ छार्िी की क्षेत्राजधकार सीमाओं के भीतर लाग ूहोगी। 3. पररभािाए-ं (1) इि उपजर्जधयों में िब तक दक संिभव से अन्यथा अपेजक्षत ि हो, - (क) “अजधजियम” स ेछार्िी अजधजियम, 2006 (2006 का 41) अजभप्रेत ह;ै (ख) “बोडव” से लखिऊ छार्िी बोड वअजभप्रेत ह;ै (ग) "उद्याि और बागर्ािी अपजिष्ट का ढेर” स े पाकों तथा बगीचों से अपजिष्ट का ढेर, जिसम ें घास की कतरि, खरपतर्ार, ‘ब्राउि' काबवि युक्त सामग्री िैसे छंटाई, िाखाए,ं टहजिया,ाँ लकड़ी की छीलि, पआु ल (स्ट्रा), सूखे पत्ते, पेड़ों की कांट-छांट और ऐस े अन्य अपजिष्ट िाजमल ह,ैं जिन्ह ें िैजर्क अपजिष्ट के जलए िैजिक संग्रहण प्रणाली में समायोजित िहीं दकया िा सकता अजभप्रेत है; (घ) "ढेर अपजिष्ट उत्पाद्य" स े र्ही अजभप्रेत ह ै िो ठोस अपजिष्ट प्रबंधि जियम, 2016 के जियम 3 के उप जियम (1) के खडं 8 के में दिया गया ह ै और मुख्य कायवकारी अजधकारी द्वारा समय-समय पर अजधसूजचत कोई अन्य अपजिष्ट उत्पाद्य ह;ै (ङ) "सग्रं हण" स े अपजिष्ट उत्पाद्य के स्रोत, सग्रं हण स्ट्थल या दकसी अन्य स्ट्थाि स े ठोस अपजिष्ट को उठािा तथा हटािा अजभप्रेत ह;ै (च) "सक्षम प्राजधकारी" स े बोड व का मुख्य कायवकारी अजधकारी या उसके द्वारा अजधकृत अन्य व्यजक्त अजभप्रेत ह;ै[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 3 (छ) "जिमाणव और जर्ध्र्सं अपजिष्ट" से र्ही अपजिष्ट अजभप्रेत होगा जिसे जिमावण और जर्ध्र्ंस अपजिष्ट जियम, 2016 के जियम 3 के उप जियम (1) के खडं (ग) के अंतगवत समिुिेजित दकया गया ह;ै (ि) "स्ट्र्च्छ क्षत्रे " स े दकसी पररसर के सामिे या उसके चारों ओर या उससे लगा हुआ कबव साइड तक जर्स्ट्ताररत और िाल,े पगडडं ी तथा स्ट्र्च्छ कबव और इि उपजर्जधयों के अिुसार अिुरजक्षत सार्विजिक स्ट्थाि अजभप्रेत ह;ै (झ) "सामिु ाजयक अपजिष्ट भडं ारण जडब्बा" स े बोड व या एक या इससे अजधक पररसरों के स्ट्र्ाजमयों या अजधभोजगयों, िैसा भी मामला हो, द्वारा अपि े पररसरों में सामूजहक रूप से सड़क के दकिारे या ऐसे दकसी एक स्ट्र्ामी या अजधभोगी के पररसर में पृथक्कृत ठोस अपजिष्ट के भंडारण हते ु सक्षम प्राजधकारी द्वारा अजधकृत दकसी एक पररसर म ेंस्ट्थाजपत की गई भडं ारण सुजर्धा (जिसे इसमें इसके पश्चात ढलार् कहा गया) अजभप्रेत ह;ै (ञ) "कंटेिर रूपी हथठेला" से ठोस अपजिष्ट स्ट्थलों से उसके संग्रहण के जलए बोडव या उसके द्वारा जियुक्त एिेंसी या एिेंट द्वारा प्रिाि दकया गया हथठेला अजभप्रेत है; (ट) "पररिाि" से बोड व के कमवचारी या बोडव द्वारा जियुक्त, अजधकृत या लाइसेंस प्राि दकसी अन्य व्यजक्त या बोडव द्वारा अजधकृत अथर्ा लाइसेंस प्राि दकसी एिेंसी को दकसी भी श्रेणी के ठोस अपजिष्ट को सौंपिा या उसे बोडव द्वारा ऐसा करिे के जलए प्रित्त दकसी र्ाहि में िमा करिा अजभप्रेत है; (ठ) "ई-अपजिष्ट" स े र्ही अजभप्रेत ह ै िो ई-अपजिष्ट (प्रबंधि) जियम, 2016 के जियम 3 के उप जियम (1) के खंड (ि) में समिुिेजित ह;ै (ड) "दिक्सड कॉम्पक्े टर अतं रण स्ट्टेिि" स े पथृ क्कृत ठोस अपजिष्ट को िबाि े हते ु बिाई गई और प्रचालि के िौराि जस्ट्थर रहिे र्ाली सचं ाजलत मिीि तथा प्रचालि के िौराि कॉम्पेक्टर गजतिील भी रह सकता है, जिसे मोबाइल स्ट्थािातं रण स्ट्टेिि कहा िाएगा, अजभप्रेत ह;ै (ढ) "कूड़ा" स े इि उपजर्जधयों के अधीि यथा जिजिद्ध समस्ट्त अर्जिष्ट और इसम ें सजम्मजलत िेंका गया या िमा दकया गया कोई भी अन्य अपजिष्ट पिाथव, िो दकसी भी व्यजक्त, िािर्र, पयावर्रण या सार्विजिक स्ट्र्ास्ट््य, सुरक्षा एर्ं कल्याण के जलए बाधा या खतरा उत्पन्न कर सकता ह,ै अजभप्रेत ह;ै (ण) "कूड़ा िेंकिा" से दकसी भी कूड़े का ढेर लगािा जिससे कूड़ा जगरे, जखसके, उड़े, धलु े, टपके अथर्ा उसके िेि रहिे अथर्ा जगरिे, िैलिे, उड़ि,े धुलिे, टपकिे की संभार्िा हो या दकसी खुले या सार्विजिक स्ट्थाि पर कूड़ा डालि,े रखिे, िबािे की अिुमजत िेिा अजभप्रेत ह;ै (त) "स्ट्र्ामी" स े दकसी भी भर्ि, या भूजम या उसके दकसी भाग पर माजलकािा अजधकारों का प्रयोग करिे र्ाला कोई भी व्यजक्त अजभप्रेत ह;ै (थ) "अजधभोगी" स े दकसी भी प्रयोिि से दकसी भूजम या भर्ि या उसके दकसी भाग का अजधभोग या कब्िा करि े र्ाला व्यजक्त िो दकसी भी प्रयोिि स े ऐसी भूजम, भर्ि या उसके दकसी भाग का उपयोग कुछ समय के जलए िसू रे व्यजक्त के साथ जमलकर करता है, अजभप्रते ह;ै (ि) "गोली बिािा" स े र्ह प्रदिया अजभप्रेत ह ै जिसमें ठोस अपजिष्ट से छोटी घि या बेलिाकार टुकड़े र्ाली गोली बिाई िाती ह,ै इसम ेंईंधि गोली भी िाजमल ह ैंजिन्ह ेंअर्जिष्ट िजित ईंधि भी कहा िाता है; (ध) "सार्िव जिक स्ट्थल" स े ििता के उपयोग और मिोरंिि के जलए खलु ा स्ट्थाि, चाह े र्ह ििता द्वारा र्ास्ट्तर् में उपयोग दकया िाए या इसे मिोरंिि हते ु प्रयोग दकया िाए अथर्ा िहीं दकया िाए, ऐसा कोई भी4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] स्ट्थाि अजभप्रेत ह;ै (ि) "भडं ारण" स े ठोस अपजिष्ट का अस्ट्थाई समाजर्ष्ट इस प्रकार दकया िािा अजभप्रते ह ै जिससे कूड़ा िेंकिा, रोगर्ाहक कीटाणुओं, आर्ारा पिओंु और अत्यजधक िगु ंध से बचार् संभर् हो; (प) "सिाई कमचव ारी" से ठोस अपजिष्ट के एकत्रण या उसे हटािे या चकराता छार्िी क्षत्रे में िाजलयों की सिाई के जलए बोड वअथर्ा इसके द्वारा अजधकृत एिेंसी द्वारा जियुक्त व्यजक्त अजभप्रेत है; (ि) "अिसु चू ी" स ेइि उपजर्जधयों में उपाबद्ध अिुसूची अजभप्रते ह;ै (ब) "उपयोक्ता िीस या प्रभार" स े समय-समय पर सक्षम प्राजधकारी के सामान्य या जर्िेि आििे द्वारा ठोस अपजिष्ट सग्रं हण, ढुलाई, प्रसंस्ट्करण और जिपटाि सेर्ाओं हते ु पूण व या आंजिक लागत को पूरा करि े के जलए अपजिष्ट उत्पािकों पर समय-समय पर बोडव द्वारा लगाई गई िीस या प्रभार अजभप्रते हैं; और (भ) "खाली प्लॉट" से तात्पयव दकसी व्यजक्त या प्राइर्ेट एिेंसी या सरकारी एिेंसी या सरकारी जर्भाग या सार्विजिक उपिम के प्रबंधिाधीि या उसके पास कोई भूजम या खुला स्ट्थाि ह ै जिस पर कोई कब्िा िहीं है, अजभप्रेत ह;ै (2) यहााँ प्रयुक्त िब्ि और अजभव्यजक्तयां जिन्ह ें पररभाजित िहीं दकया गया है, उिका र्ही अथव होगा िो छार्िी अजधजियम, 2006, ठोस अपजिष्ट प्रबंधि जियम, 2016 तथा जिमावण और जर्ध्र्ंस अपजिष्ट प्रबंधि जियम, 2016 में िी गई पररभािा म ेंसमिुिेजित ह।ै अध्याय 2 ठोस अपजिष्ट का पथृ क्करण और प्राथजमक भडं ारण 4. स्रोत पर ठोस अपजिष्ट का पथृ क्करण और भडं ारण- (1) सभी अपजिष्ट उत्पािकों का यह कतवव्य होगा दक र्े अपि े स्ट्थािों से जियजमत रूप स ेजिकलि ेर्ाले ठोस अपजिष्ट का तीि चरणों में पथृ क्करण और भंडारण करें, अथावत:- (क) अिैजर्क या सूखा अपजिष्ट; (ख) िैजर्क या गीला अपजिष्ट; (ग) घरेलू खतरिाक अपजिष्ट और इसे ढके हुए कूड़ािािों में जिक्षपे करिा, और बोडव द्वारा समय-समय पर िारी दििाजििेिों के अिुसार पृथक्कृत अपजिष्ट को जिर्िष्टव अपजिष्ट सग्रं ाहकों को सौंपिा। (2) प्रत्येक ढेर अपजिष्ट उत्पाद्य को अपि े स्ट्थािों स े जिकलि े र्ाल े ठोस अपजिष्ट का तीि चरणों में पथृ क्करण तथा भडं ारण करिा होगा, अथावत:- (क) अिैजर्क या सूखा अपजिष्ट; (ख) िैजर्क या गीला अपजिष्ट; (ग) खतरिाक अपजिष्ट को उपयक्तु कूड़ािािों और पथृ क्कृत अपजिष्ट को अजधकृत अपजिष्ट संग्रहण एिेंसी के माध्यम से बोडव द्वारा समय-समय पर जिर्िष्टव ढुलाई िीस के भुगताि सजहत अजधकृत अपजिष्ट प्रसंस्ट्करण या जिपटाि सुजर्धाओं या जिक्षपे (जडपॉजिट) केंरों को सौंपिा। (3) पृथक्कृत अपजिष्ट के भडं ारण के जलए िैजर्क अपजिष्ट के कूड़ािािों का रंग हरा, अिैजर्क या सूख े अपजिष्ट के कूड़ािािों रंग िीला और घरेलू खतरिाक अपजिष्ट के कूड़ािािों का रंग काला होगा।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 5 (4) सभी रेिीडेंट र्ल्े िेयर और बािार संघ बोडव के साथ सहभाजगता से उत्पािकों द्वारा स्रोत पर अपजिष्ट का पृथक्करण सुजिजश्चत करेंगे, पथृ क्कृत अपजिष्ट के संग्रहण हते ु अलग-अलग सुजर्धा प्रिाि करेंगे, ररसाइदकल योग्य सामग्री को अजधकृत कूड़ा बीिि े र्ाले या अजधकृत ररसाइदकल प्रदिया करिे र्ालों को सौंपेंगे। (5) िहां तक संभर् हो, िैजर्क कूड़े का प्रसंस्ट्करण, उपचार और जिपटाि पररसर के भीतर कंपोजिटटंग या िैर्-जमथेिीकरण के माध्यम से दकया िाएगा तथा अर्जिष्ट कचरा बोड व द्वारा जििेजित अपजिष्ट सग्रं ाहक या एिेंसी को प्रिाि दकया िाएगा। (6) सभी गेटबंि कम्युजिटी और 5,000 र्गवमीटर स े अजधक क्षेत्रिल र्ाल े संस्ट्थाि बोड व के साथ सहभाजगता से उत्पािकों द्वारा स्रोत पर अपजिष्ट का पथृ क्करण सुजिजश्चत करेंगे; पृथक्कृत अपजिष्ट के सग्रं हण हते ु अलग-अलग सुजर्धा प्रिाि करेंग,े ररसाइदकल योग्य सामग्री अजधकृत कूड़ा बीिि े र्ाले या अजधकृत ररसाइदकल प्रदिया करि े र्ालों को सौंपेंगे। (7) िहां तक संभर् हो, िैजर्क कूड़े का प्रसंस्ट्करण, उपचार और जिपटाि पररसर के भीतर कंपोजिटटंग या िैर्- जमथेिीकरण के माध्यम से दकया िाएगा तथा अर्जिष्ट कचरा बोडव द्वारा जििेजित अपजिष्ट सग्रं ाहक या एिेंसी को प्रिाि दकया िाएगा। (8) सभी होटल और रेस्ट्तरां बोड व के साथ सहभाजगता से उत्पािकों द्वारा स्रोत पर अपजिष्ट का पृथक्करण सुजिजश्चत करेंग,े पृथक्कृत अपजिष्ट के संग्रहण के जलए अलग-अलग सुजर्धा प्रिाि करेंग,े ररसाइदकल योग्य सामग्री को अजधकृत कूड़ा बीिि ेर्ाले या अजधकृत ररसाइदकल प्रदिया करिे र्ालों को सौपेंगे। (9) िहां तक संभर् हो, िैजर्क अपजिष्ट का प्रसंस्ट्करण, उपचार और जिपटाि पररसर के भीतर कंपोजिटटंग या िैर्-जमथिे ीकरण के माध्यम स े दकया िाएगा तथा अर्जिष्ट अपजिष्ट बोड व द्वारा जििेजित अपजिष्ट सग्रं ाहक या एिेंसी को प्रिाि दकया िाएगा। (10) कोई भी व्यजक्त जिधावररत उपयोक्ता िीस के भगु ताि सजहत कम स े कम तीि कायव दिर्स पहल े प्रथम अिुसूची में जर्जिर्िवष्ट उपयोक्ता िीस के भुगताि सजहत बोड वको ऑिलाइि अथर्ा भौजतक रूप से सूजचत दकए बगैर लाइसेंस प्राि दकए जबिा, दकसी भी स्ट्थाि पर सौ से अजधक व्यजक्तयों को इकट्ठा करते हुए समारोह या कायविम आयोजित िहीं करेगा और ऐसा व्यजक्त या ऐसे समारोह के आयोिक स्रोत पर अपजिष्ट का पृथक्करण सुजिजश्चत करेगा तथा बोड वद्वारा जिर्िवष्ट अपजिष्ट संग्राहक या एिेंसी को पृथक्कृत अपजिष्ट सौंपेगा। (11) प्रयुक्त स्ट्र्च्छता अपजिष्ट को इि उत्पािों के जिमावताओं या ब्रांड स्ट्र्ाजमयों द्वारा उपलब्ध कराए गए पाउच या समाचारपत्र या उपयक्तु िैजर्क रैपपगं सामग्री में सरु जक्षत तरीके से लपेटा िाता ह ै और इसे अिैजर्क या सूखे अपजिष्ट के जलए रखे हुए कूड़ािािों में डाला िाता ह।ै (12) प्रत्येक िेरीर्ाला अपिी गजतजर्जधयों िैसे खाद्य अपजिष्ट, त्याज्य (जडस्ट्पोिेबल) प्लेट, कप, कैि, रैपर, िाररयल के खोल,े िेि बचा भोिि, सजब्ियां या िल स े उत्पाद्य पृथक्कृत अपजिष्ट के भंडारण हते ु उपयुक्त कूड़ािाि रखगे ा और ऐस े अपजिष्ट को बोड व द्वारा अजधसूजचत अपजिष्ट भंडारण जडपो या कंटेिर या र्ाहि में जिक्षपे दकया िाएगा। (13) उद्यािों के उत्पाद्य और पररसरों से उत्पन्न बागर्ािी उत्पाद्य अपजिष्ट को पररसर स्ट्र्ामी स्ट्र्यं अपि े पररसर में अलग-अलग भंडाररत करेगा और बोडव द्वारा समय-समय पर िारी जििेिों अिसु ार इसका जिपटाि करेगा। (14) घरेलू खतरिाक अपजिष्ट का भंडारण दकया िाएगा और प्रत्येक अपजिष्ट उत्पािक द्वारा इसे बोडव या इसके द्वारा अजधकृत दकसी अन्य एिेंसी या उत्तराखंड राज्य सरकार या उत्तराखंड राज्य प्रििू ण जियंत्रण बोड व द्वारा अजधकृत ऐस े अपजिष्ट के संग्रहण हते ु समय-समय पर प्रित्त संग्रहण र्ाहि को सौंपा िाएगा, या ऐस े अपजिष्ट6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] का जिपटाि संग्रहण के जलए जिर्िवष्ट केंर म ेंउत्तराखंड राज्य सरकार या उत्तराखंड राज्य प्रििू ण जियंत्रण बोड वद्वारा जििेजित रीजत अिुसार दकया िाएगा। (15) जिमावण और जर्ध्र्ंस अपजिष्ट प्रबंधि जियम, 2016 के उपबंध अिुसार जिमाणव और जर्ध्र्ंस अपजिष्ट को अलग स ेसंग्रहीत करके भडं ारण तथा पररिाि दकया िाएगा। (16) दकसी भी अिुपचाररत िैर्-जचदकत्सा अपजिष्ट, ई-अपजिष्ट, खतरिाक रसायि और औद्योजगक अपजिष्ट को ठोस अपजिष्ट के साथ जमजश्रत िहीं दकया िाएगा। ऐसे अपजिष्ट का जिपटाि पयावर्रण (संरक्षण) अजधजियम, 1986 (1986 का 29) के उपबधं ों तथा उसके अतं गवत जिर्मवत जियमों या जर्जियमों के अिुसार दकया िाएगा। (17) जिर्िवष्ट बूचड़खािों और बािार के अजतररक्त दकसी भी पररसर के प्रत्येक स्ट्र्ामी या अजधभोगी, िो दकसी भी व्यार्साजयक गजतजर्जध के पररणामस्ट्र्रूप मगु ी पालि, मछली और बूचड़खािा अपजिष्ट के उत्पािक हैं, उन्ह ें ऐसा अपजिष्ट अलग स े बंि, स्ट्र्च्छ जस्ट्थजत में संग्रहीत करिा होगा तथा इसे एक जिर्िवष्ट समय पर बोडव द्वारा िैजिक आधार पर इस प्रयोिि हते ु प्रित्त संग्रहण र्ाहि को सौंपा िाएगा: परंतु ऐसे अपजिष्ट को दकसी भी सामुिाजयक अपजिष्ट के कूड़ािाि में िहीं डाला िाएगा और इस प्रकार कूड़ा डालिा जििेध ह।ै (18) यदि उत्पािक पृथक्कृत िैजर्क ठोस अपजिष्ट से खाि िहीं बिाता ह ै तो इसे उसके पररसर के अंिर सग्रं जहत दकया िाएगा और बोडव के कमवचारी या र्ाहि; या कूड़ा बीििे र्ाले या अपजिष्ट संग्रहकताव या ऐसे समय बहुतायत िैजर्क अपजिष्ट उत्पन्न करिे र्ाल े जिर्िवष्ट र्ाजणजज्यक उत्पाद्यों हते ु िैजर्क अपजिष्ट के संग्रहण हते ु प्रित्त र्ाहि में इसकी जडलीर्री सुजिजश्चत की िाएगी िैसा दक बोडव द्वारा समय-समय पर अजधसूजचत दकया िाएगा। अध्याय 3 ठोस अपजिष्ट सग्रं हण 5. ठोस अपजिष्ट का सग्रं हण– (1) ठोस अपजिष्ट प्रबंधि जियम, 2016 के अिुपालि म,ें बोडव के सभी क्षेत्रों या र्ाडों, स्ट्लम एर्ं अिौपचाररक बजस्ट्तयों सजहत प्रत्येक घर से िैजिक आधार पर अपजिष्ट एकत्रण हते ु घर-घर िाकर संग्रहण की अिौपचाररक प्रणाली को बोडव संग्रहण प्रणाली के साथ एकीकृत करके प्रत्येक घर िाकर पृथक्कृत ठोस अपजिष्ट के सग्रं हण को लागू दकया िाएगा। (2) प्रत्येक घर से कूड़ा एकजत्रत करिे हते ु, क्षेत्रर्ार जर्जिष्ट समय स्ट्लॉट तैयार दकए िाएंग े और उस क्षेत्र के जर्जिष्ट स्ट्थािों तथा बोडव की र्ेबसाइट पर प्रकाजित दकया िाएगा। (3) घर-घर िाकर अपजिष्ट संग्रहण का समय प्रातः 6 स ेप्रातः 11 बिे तक जियत दकया िाएगा। (4) व्यापाररक स्ट्थापिों, व्यार्साजयक क्षेत्रों की िकु ािों या दकसी अन्य संस्ट्थागत अपजिष्ट उत्पािकों से अपजिष्ट संग्रहण का समय प्रातः 7 बिे स ेिोपहर 12 बिे तक होगा। (5) घरों, संस्ट्थािों और र्ाजणजज्यक इकाइयों द्वारा अपजिष्ट सग्रं हक को कूड़ा सौंपा िाएगा। (6) ढेर अपजिष्ट उत्पािकों से अर्जिष्ट ठोस अपजिष्ट के सग्रं हण की व्यर्स्ट्था की िाएगी, िो अपजिष्ट को स्ट्र्- स्ट्थािे संसाजधत कर रह ेह।ैं (7) सब्िी, िल, िूल, मांस, मुगी और मछली बािार स ेअर्जिष्ट ठोस अपजिष्ट को दिि- प्रजतदिि आधार पर एकजत्रत दकया िाएगा। (8) बागर्ािी तथा उद्याि अपजिष्ट को अलग से एकजत्रत करके सिाह में जिधावररत एक या िो दिि में उसका जिपटाि दकया िाएगा।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 7 (9) िल एर्ं सब्िी मंडी, मांस एर् ं मछली बािार, थोक बागर्ािी एर्ं उद्याि अपजिष्ट के िैजर्क अपजिष्ट का इष्टतम उपयोग करिे और संग्रहण एर्ं ढुलाई की लागत को कम करिे हते ु ऐसे अपजिष्ट को उस क्षेत्र के अंिर संसाजधत या उपचाररत दकया िाएगा िहााँ से यह अपजिष्ट उत्पन्न होता ह।ै (10) कंटेिरों में अपजिष्ट की मैिुअल हडैं पलगं जिजिद्ध होगी और; यदि अप्रत्याजित बाधाओं के कारण ऐसा करिा अपररहायव हुआ, तो श्रजमकों की संरक्षा हते ु उजचत माििंडों सजहत उपयक्तु सरु क्षा के अंतगवत मैिअु ल हडैं पलगं की िाएगी। (11) अपजिष्ट उत्पािक बोडव या अजधसूजचत अजधकृत अपजिष्ट सग्रं ाहक द्वारा तिै ात ऑटो- रटप्पसव या ररक्िा आदि को अपिा पृथक्कृत अपजिष्ट सौंपि े के जलए जिम्मेिार होंगे। (12) बहु-मंजिला इमारतों, अपाटवमटें ों, हाउपसंग कॉम्प्लेक्स से पथृ क्कृत अपजिष्ट को प्रर्ेि द्वार या सक्षम प्राजधकारी द्वारा जििेजित दकसी अन्य जिर्िवष्ट स्ट्थाि स ेएकजत्रत दकया िाए। (13) समय-समय पर सग्रं हण उपस्ट्करों और र्ाहिों के चयि हते ु प्रौद्योजगकी की पररर्र्तवत आर्श्यकताओं तथा समुन्नत रूपों को ध्याि में रखा िाएगा। (14) ऑटो-रटप्पर या हाइड्रॉजलक रूप से संचाजलत हॉपर सजहत जर्जिष्ट क्षमता र्ाल ेहूटर लग ेर्ाहिों, जििम ें िैजर्क एर्ं अिैजर्क अपजिष्ट के जलए छत से ढके हुए िो अलग-अलग कूड़ािािों की व्यर्स्ट्था होती ह,ै को अपजिष्ट संग्रहण के जलए तैिात दकया िाएगा। (15) अपजिष्ट संग्राहकों द्वारा आर्ाि ररकॉडव दकया गया स्ट्र्चाजलत उपकरण, घंटी या हॉिव या अन्य उपयुक्त उपकरण, जिसमें ध्र्जि का स्ट्तर अिुमत से अजधक िहीं हो, प्रयोग में लाए िा रह े प्रत्येक अपजिष्ट संग्रहण र्ाहि पर लगाया िाएगा। (16) बोडव या अजधसूजचत अजधकृत अपजिष्ट संग्राहक द्वारा प्रत्येक प्राथजमक संग्रहण और ढुलाई र्ाहि के जलए मागव योििाएं (रूट प्लाि) तैयार की िाएंगी। (17) बोडव द्वारा अिुमोदित सारणीबद्ध (टेबलु र) और भौगोजलक सूचिा प्रणाली मािजचत्र प्ररूप म ें इि मागों के प्रारम्भ स्ट्थाि, आरंजभक समय, प्रतीक्षा स्ट्थाि, माग व पर प्रतीक्षा समय, अंजतम स्ट्थाि और जिर्िवष्ट रूट के अंजतम समय का उल्लेख दकया िाएगा। (18) बोडव या अजधसूजचत अजधकृत अपजिष्ट संग्राहक प्रत्येक गली में एक ‘बोडव’ लगाएगा जिस पर र्हााँ के जिर्ाजसयों को जिधावररत समय पर इस सुजर्धा का लाभ उठािे हते ु प्राथजमक संग्रहण तथा ढुलाई र्ाहिों की समय- सारणी प्रिर्िवत की िाएगी और ऐसी िािकारी बोड व की र्ेबसाइट पर भी अपलोड की िाएगी। (19) संकरी गजलयों में, िहां ऑटो रटपर या र्ाहि द्वारा सेर्ा प्रिाि िहीं की िा सकती, र्हााँ मोबाइल स्ट्थािांतरण स्ट्टेिि सुसंगत जतपजहया र्ाहि या हाइड्रॉजलक रूप से संचाजलत हॉपर सजहत छोटा मोटर चाजलत हूटर लगा र्ाहि तिै ात दकया िाएगा, जिसमें छत से ढके हुए गील े एर्ं सूखे अपजिष्ट के जलए िो अलग-अलग कूड़ािािों की व्यर्स्ट्था होती ह।ै (20) व्यस्ट्त और संकरी गजलयों में, िहां जतपजहया र्ाहि या दकसी भी उपयुक्त छोटे र्ाहि द्वारा सेर्ा प्रिाि िहीं की िा सकती, र्हााँ साइदकल ररक्िा या दकसी अन्य प्रकार का उपयक्तु उपस्ट्कर तैिात दकया िाएगा। (21) छोटी, संकरी या व्यस्ट्त गजलयों या लेिों िहााँ जतपजहया र्ाहि या ररक्िा या अन्य प्रकार का कोई उपयुक्त र्ाहि भी िहीं चल सकता ह,ै र्हााँ मोहल्ला या गली के आरंजभक स्ट्थाि पर सुजर्धा पबंिओंु का जिधावरण करके संग्रहण र्ाहि खड़ा दकया िाएगा और र्ाहि का हल्े पर या ड्राइर्र अपिे पास एक सीटी रखगे ा तथा ठोस अपजिष्ट के एकत्रण हते ु र्ाहि के आगमि की घोिणा करिे हते ु इलाके में घूमगे ा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (22) ऐसी संग्रहण प्रणाली के जलए समय-सारणी सूचिा पट्ट पर प्रिर्िवत की िाएगी और बोड व की र्ेबसाइट पर अपलोड की िाएगी। (23) प्रत्येक घर यह सुजिजश्चत करिे हते ु जिम्मेिार होगा दक अलग दकया हुआ अपजिष्ट अजभजहत स्ट्थाि पर संग्रहकताव को प्रिाि कर दिया गया ह।ै (24) इस सेर्ा में तैिात ऑटो रटपर, जतपजहया र्ाहि, ररक्िा तथा अन्य दकस्ट्म का कोई भी सग्रं हण र्ाहि केर्ल घरों से ही अपजिष्ट एकजत्रत करेंगे और दकसी अन्य स्रोत िैसे ढलार्ों, खुल े स्ट्थाि, मैिाि, कूड़ािािों या िाल े से अपजिष्ट एकजत्रत िहीं करेंगे। (25) बोडव या इसके अजधसूजचत अजधकृत अपजिष्ट संग्राहक प्रत्येक िोि की सभी गजलयों या लिे ों से ठोस अपजिष्ट का प्राथजमक सग्रं हण करिे के जलए उत्तरिायी होंगे। अध्याय 4 ठोस अपजिष्ट का जद्वतीयक भडं ारण 6. जद्वतीयक भडं ारण स्ट्थलों पर ठोस अपजिष्ट का भडं ारण– (1) घर-घर िाकर एकजत्रत दकए गए ठोस अपजिष्ट को अपजिष्ट भडं ारण जडपो, सामुिाजयक भंडारण कूड़ािािों या दिक्स्ट्ड अथर्ा मोबाइल स्ट्थािातं रण स्ट्टेििों या बोड व द्वारा जद्वतीयक भंडारण हते ु जिर्िवष्ट स्ट्थलों पर ल ेिाया िाएगा। (2) ऐसे जद्वतीयक भंडारण स्ट्थलों पर अलग-अलग भंडारण के जलए ढके हुए, जिर्िष्टव रंग र्ाले, जिम्नजलजखत कंटेिर होंग,े अथातव :- (क) अिैजर्क या सूखा अपजिष्ट; (ख) िैजर्क या गीला अपजिष्ट; (ग) घरेलू खतरिाक अपजिष्ट। (3) बोडव द्वारा सीमांदकत क्षेत्रों में पथृ क्कृत अपजिष्ट डालि े हते ु जर्जभन्न रंगीि कंटेिरों का उपयोग जिम्नजलजखत तरीके स ेदकया िाएगा, अथातव :- (क) िैजर्क अपजिष्ट के जलए हरा रंग; (ख) अिैजर्क अपजिष्ट के जलए िीला रंग; (ग) घरेलू खतरिाक अपजिष्ट के जलए काला रंग। (4) ठोस अपजिष्ट प्रबंधि जियम 2016 के उपबंधों के अधीि बोड व जर्जभन्न प्रकार के ठोस अपजिष्ट के भंडारण तथा जर्तरण हते ु जिधावररत पात्रों की अजिर्ाय व कलर कोपडगं तथा अन्य जर्िेि जर्र्रण के जलए अलग स े समय- समय पर जर्जििेि अजधसूजचत करेगा, जिससे दक बगैर दकसी जमश्रण या अपजिष्ट के ररसार् से सुरजक्षत और आसाि संग्रहण संभर् हो और जर्जभन्न अपजिष्ट उत्पाद्यों को इिका पालि करिा होगा। (5) बोडव स्ट्र्यं अपिे या आउटसोर्संग एिेंजसयों के माध्यम से ठोस अपजिष्ट के भंडारण स्ट्थलों का रखरखार् ऐसे तरीके से करेगा जिससे इिके आस-पास अस्ट्र्च्छता तथा गिं गी िहीं िैल पाए। (6) बोडव या इसकी दकसी अजधकृत एिेंसी द्वारा जद्वतीयक भंडारण जडपो म ें जर्जभन्न आकार और इि उपजर्जधयों में उजल्लजखत जर्जभन्न रंगों के कंटेिर उपलब्ध कराए िाएंगे।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 9 (7) भंडारण स्ट्थलों का जिमावण और स्ट्थापिा दकसी जिधावररत क्षेत्र म ेंअपजिष्ट उत्पािि की मात्रा तथा ििसंख्या घित्र् को ध्याि म ेंरखते हुए की िाएगी और ऐसी भंडारण सुजर्धाएं उपयोक्ता के अिुकूल होंगी तथा इन्ह ें इस तरह से जडिाइि दकया िाएगा दक ये सुजिजश्चत हो दक अपजिष्ट का संघिि (कॉम्पैक्िि) दकया िाए एर् ं संग्रहीत अपजिष्ट खुल ेर्ातार्रण के संपकव में िहीं आ पाए। (8) सभी हाउपसंग सहकारी सजमजतयों, संगमों, कॉलोजियों, आर्ासीय एर्ं र्ाजणजज्यक स्ट्थापिों या गेट लगी कम्युजिटी की यह जिम्मेिारी होगी दक र्े अपिे कॉम्प्लेक्स में उपयुक्त स्ट्थािों पर इि उपजर्जधयों में जिधावररत रंग के स्ट्र्यं द्वारा खरीिे गए साि-सुथरे एर्ं अच्छी जस्ट्थजत र्ाले कूड़ािाि पयावि संख्या में रखें, जिससे दक र्हााँ उत्पन्न िैजिक अपजिष्ट को यथोजचत जिक्षेप दकया िा सके। (9) बोडव या उसके िर्ारा अजधकृत एिेंसी जियजमत रूप स े सभी कूड़ािािों की धुलाई और उिका कीटाणुिोधि करेगी। 7. सखू े (अिजै र्क) अपजिष्ट हते ुररसाइदकल केंर- (1) बोडव आर्श्यकतािुसार अपि ेमौिूिा ढलार्ों को पररर्र्तवत कर िेगा या 'ररसाइकपलगं केंर' के जलए जर्जिष्ट स्ट्थािों का पता लगाएगा जिसका प्रयोग गजलयों या घर-घर िाकर अपजिष्ट एकत्रण सेर्ा के माध्यम से प्राि सूखे अपजिष्ट के पृथक्करण हते ु दकया िाएगा। (2) सूखे अपजिष्ट की प्राि मात्रािुसार ररसाइदकल केंन्रों की संख्या बढ़ाई िाएगी। (3) गजलयों या घर-घर िाकर अपजिष्ट संग्रहण प्रणाली और र्ाजणजज्यक संस्ट्थापिाओं से प्राि सूख े (अिैजर्क) अपजिष्ट को केर्ल इन्हीं जिर्िष्टव ‘ररसाइदकल केंरों’ म ें स्ट्थािातं ररत दकया िाएगा और य े जिर्िवष्ट केंर केर्ल सूखा अपजिष्ट ही प्राि करेंगे। (4) घरों के जलए प्रार्धाि होगा दक र्े इि ररसाइदकल केंरों पर अपि े ररसाइदकल योग्य अपजिष्ट को पूर्व- जिधावररत िरों पर बोड व के अजधकृत एिेंटों या अजधकृत अपजिष्ट डीलरों को सीध े जिक्षेप या बेच सकते ह।ैं (5) इस प्रयोिि हते ु डीलर प्रत्येक ररसाइपक्लंग इकाई में अिुमत स्ट्थाि पर तौल पैमािा तथा एक काउंटर स्ट्थाजपत करेंगे। (6) ठोस अपजिष्ट प्रबंधि जियम, 2016 के उपबंधों के अिुरूप अजधकृत एिेंटों अजधकृत अपजिष्ट डीलरों, िैसा भी मामला हो, को केर्ल जद्वतीयक बािार या ररसाइदकल इकाइयों म ेंररसाइदकल योग्य अपजिष्ट के जिपटाि या जबिी की अिुमजत होगी। (7) अजधकृत एिेंट या अजधकृत अपजिष्ट डीलर ही जबिी की र्सूली करि े हते ु हकिार होंगे। 8. जर्जिर्िष्टव घरेल ू खतरिाक अपजिष्ट हते ु जिक्षपे केंर-(1) घरेल ू खतरिाक अपजिष्ट के सग्रं हण एर् ं जिर्िवष्ट घरेल ू खतरिाक अपजिष्ट को प्राि करिे के जलए उपयुक्त स्ट्थाि पर एक जिक्षेप (जडपोिीिि) केंर स्ट्थाजपत दकया िाएगा। सरकार द्वारा जिजश्चत दििाजििेिों अिुसार ऐसी सजु र्धा प्रत्येक र्ाडव में प्रिाि की िाएगी और ऐस े अपजिष्ट की प्राजि का समय अजधसूजचत दकया िाएगा। (2) बोडव दकसी अजधकृत एिेंट या ररयायती संस्ट्था को भी सभी अपजिष्ट उत्पाद्यों से पथृ क्कृत घरेलू खतरिाक अपजिष्ट को एकजत्रत करि े की जिम्मेिारी ि े सकता ह ै और ऐसा अपजिष्ट सरकार द्वारा स्ट्थाजपत खतरिाक अपजिष्ट जिपटाि सुजर्धा स्ट्थल पर अलग से ले िाया िाएगा। अध्याय 5 ठोस अपजिष्ट की ढुलाई 9. ठोस अपजिष्ट की ढुलाई- ठोस अपजिष्ट की ढुलाई जिम्नजलजखत तरीके स ेकी िाएगी, अथावत:् -10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (i) अपजिष्ट की ढुलाई के जलए प्रयक्तु र्ाहिों को इस प्रकार स े कर्र दकया िाएगा दक एकजत्रत दकया हुआ अपजिष्ट खुल े र्ातार्रण के सपं कव में िहीं आ पाए। र्ाहिों में बोडव द्वारा प्रौद्योजगकी के जर्कल्प के आधार पर कॉम्पैक्टर तथा मोबाइल स्ट्थािांतरण स्ट्टेिि भी सजम्मजलत दकए िाएंगे; (ii) बोडव द्वारा स्ट्थाजपत भंडारण स्ट्थलों को अपजिष्ट हटािे के पश्चात प्रजतदिि साि दकया िाएगा और जिस स्ट्थाि पर कूड़ािाि या कंटेिर रखे िाते हैं, उसके आसपास के क्षेत्रों की भी साि-सिाई की िाएगी; (iii) आर्ासीय और अन्य क्षेत्रों से एकजत्रत पृथक्कृत िैजर्क अपजिष्ट को प्रसंस्ट्करण संयंत्रों िैस े खाि संयंत्र, बायो-जमथेिीकरण संयंत्र या ऐसे दकसी भी अन्य सुजर्धा स्ट्थल तक ढककर अंतररत दकया िाएगा; (iv) िैजर्क अपजिष्ट के जलए, िहा ं भी लाग ू हो, स्ट्थल पर ही (ऑि-साइट) ऐस े अपजिष्ट के प्रसंस्ट्करण को प्राथजमकता िी िाएगी; (v) एकजत्रत अिैजर्क अपजिष्ट को संबंजधत प्रसंस्ट्करण स्ट्थल या जद्वतीयक भंडारण के स्ट्थाि तक पहुचाँ ाया िाएगा; (vi) जिमावण और जर्ध्र्ंस अपजिष्ट प्रबंधि जियम, 2016 के उपबंधों के अिुसार जिमावण और जर्ध्र्सं अपजिष्ट की ढुलाई की िाएगी; (vii) बोडव समुजचत रीजत से इिर्टसव (inerts) की ढुलाई के जलए व्यर्स्ट्था करेगा। कायव समाि होते ही गजलयों की सिाई से उत्पन्न अपजिष्ट और िाली की हटि े योग्य गाि को तुरंत हटा दिया िाएगा; (viii) ढुलाई र्ाहिों को इस प्रकार से जडजाइि दकया िाएगा दक अंजतम जिपटाि स ेपहल े अपजिष्ट की बार- बार हडैं पलगं से बचा िा सके; (ix) ढुलाई कायों म ेंतैिात संग्रहण र्ाहि केर्ल मोबाइल स्ट्थािांतरण स्ट्टेिि या दिक्स्ट्ड कॉम्पेक्टर स्ट्थािांतरण स्ट्टेिि, िहा ंकहीं भी प्रित्त ह,ैं में ही अपजिष्ट जिक्षेप या स्ट्थािांतररत करेंग;े (x) यदि दकसी कारण से उस समय जिर्िवष्ट स्ट्थाि पर मोबाइल स्ट्थािांतरण स्ट्टेिि या दिक्स्ट्ड कॉम्पेक्टर स्ट्थािांतरण स्ट्टेिि अर्जस्ट्थत िहीं ह,ै तो 'भरा हुआ र्ाहि' मोबाइल स्ट्थािांतरण स्ट्टेिि या दिक्स्ट्ड कॉम्पेक्टर स्ट्थािांतरण स्ट्टेिि के अगल ेजिर्िवष्ट स्ट्थाि या बोडव द्वारा जर्जिर्िवष्ट स्ट्थल पर अपजिष्ट खाली करेगा; (xi) दिक्स्ट्ड कॉम्पेक्टर स्ट्थािांतरण स्ट्टेिि की ढुलाई हुक लोडर के माध्यम से की िाएगी; (xii) मोबाइल स्ट्थािांतरण स्ट्टेिि या दिक्स्ट्ड कॉम्पेक्टर स्ट्थािांतरण स्ट्टेिि अपजिष्ट की ढुलाई सीध े खाि संयंत्र अपजिष्ट से, ऊिाव संयंत्र या बोडव द्वारा जिर्िष्टव दकसी अन्य स्ट्थल या संयंत्र पर करेगा; (xiii) अपजिष्ट की ढुलाई के िौराि जर्जभन्न स्रोतों से प्राि अपजिष्ट को आपस में जमजश्रत िहीं दकया िाएगा; (xiv) गजलयों स ेअपजिष्ट सग्रं हण और अपजिष्ट ढुलाई की सेर्ाएं प्रजतदिि प्रिाि की िाएंगी; (xv) इस सेर्ा में तैिात मोबाइल स्ट्थािांतरण स्ट्टेिि केर्ल जिर्िवष्ट ऑटो रटपर, थ्री व्हीलस व या र्ाहि या गली स्ट्तर पर प्रचालि स ेसंग्रहीत अपजिष्ट के कूड़ािािों स ेही अपजिष्ट प्राि करेंगे; (xvi) गली स्ट्तर पर तिै ात, जतपजहया र्ाहि या ररक्िा से अपजिष्ट प्राि करिे के जलए जिर्िष्टव स्ट्थािों पर समर्पवत मोबाइल स्ट्थािांतरण स्ट्टेिि की तैिाती की िाएगी और स्ट्र्ीकृत मागव योििा के अिुसार घर-घर िाकर घरों एर्ं व्यार्साजयक स्ट्थापिों से ठोस अपजिष्ट का सग्रं हण दकया िाएगा;[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 11 (xvii) मोबाइल स्ट्थािांतरण स्ट्टेिि या दिक्स्ट्ड कॉम्पेक्टर स्ट्थािांतरण स्ट्टेिि का जडिाइि इस प्रकार से तैयार दकया िाएगा जिससे प्राथजमक संग्रहण र्ाहिों से अपजिष्ट को कम समय में तथा जबखेरे बगैर खाली करि े म ें सहायता जमले; (xviii) ठोस अपजिष्ट को स्ट्थािांतररत करते समय, मोबाइल स्ट्थािांतरण स्ट्टेिि या दिक्स्ट्ड कॉम्पेक्टर स्ट्थािांतरण स्ट्टेिि के आसपास जबखरा हुआ अपजिष्ट साि दकया िाएगा जिससे दक ऐसा कोई अपजिष्ट िेि िहीं बचे। साि-सिाई के पश्चात उस स्ट्थाि पर कीटाणुिािक का प्रयोग दकया िाएगा; (xix) बोडव या इसका प्राजधकृत एिेंट या एिेंसी सभी जद्वतीयक भंडारण स्ट्थलों पर क्लोि सर्कवट टेलीजर्जि कैमरे (सीसीटीर्ी) स्ट्थाजपत करेगा। अध्याय 6 ठोस अपजिष्ट का प्रसस्ट्ं करण (प्रोसपे सगं ) 10. ठोस अपजिष्ट का प्रसस्ट्ं करण- (1) बोडव ठोस अपजिष्ट प्रसंस्ट्करण स्ट्थलों और समबद्ध अर्संरचिाओं के जिमावण, संचालि तथा अिरु क्षण को यजु क्तयुक्त प्रौद्योजगकी को अगं ीकार करत े हुए ठोस अपजिष्ट के जर्जभन्न घटकों के अिुकूलतम उपयोग हते ु स्ट्र्यं या दकसी अजभकरण के माध्यम से सुकर बिाएगा, जिसके अंतगतव जिम्न तकिीकें सजम्मजलत ह,ैं िो केन्रीय सरकार के िहरी जर्कास मंत्रालय द्वारा समय-समय पर िारी दििाजििेिों और केंरीय प्रििू ण जियंत्रण बोड वद्वारा जिधावररत मािकों का पालि करती हैं:- (क) ढुलाई लागत और पयावर्रणीय प्रभार्ों को कम करिे हते ु जर्केन्रीकृत प्रसंस्ट्करण िैसे बायो- जमथेिीकरण, सूक्ष्मिीर् खाि, र्मी-खाि, अर्ायर्ीय पाचि या िैजर्क अपजिष्ट के िैर्-जस्ट्थरीकरण के जलए दकसी अन्य उपयुक्त प्रसंस्ट्करण को र्रीयता िी िाएगी; (ख) केंरीकृत स्ट्थलों पर मध्यम या बड़े खाि संयंत्र या बायो-जमथेिीकरण संयंत्रों के माध्यम से; (ग) अपजिष्ट के िहििील अंि के जलए अर्जिष्ट से प्राि ईंधि द्वारा ऊिाव प्रदियाओं के जलए अपजिष्ट के माध्यम से या ठोस अपजिष्ट आधाररत जबिली संयंत्रों को िीडस्ट्टॉक के रूप में आपूर्तव; (घ) जिमावण और जर्ध्र्ंस अपजिष्ट प्रबंधि संयंत्रों के माध्यम से; और (ड़) िहां तक संभर् होगा, अपजिष्ट से प्राि ईंधि की खपत के जलए एक माकेट तैयार करिे के सभी प्रयास करेगा। (2) प्रत्यक्ष भस्ट्मीकरण द्वारा ऊिाव संयंत्र में अपजिष्ट प्रिाि करिे के जलए पूणव पथृ क्करण अजिर्ाय व होगा और सुसंगत संजर्िाओं के जिबंधिों एर्ं ितों का जहस्ट्सा होगा। (3) बोडव का प्रयास रहगे ा दक पुिचिव रण योग्य र्स्ट्तुएं िैसे कागि, प्लाजस्ट्टक, धात,ु कांच और र्स्त्र अजधकृत ररसाइकलसव के पास पाँहुच पाए।ं 11. ठोस अपजिष्ट के प्रसस्ट्ं करण हते ु अन्य दििाजििेि– (1) बोडव सभी जिर्ासी कल्याण संगठिों, ग्रुप हाउपसंग सोसायरटयों, बािारों, सिस्त्र बलों के भोििालयों एर्ं अन्य अजभकरणों, गेटबंि कम्युजिटी और 5000 र्गव मीटर से अजधक क्षेत्र रखि े र्ाले संस्ट्थािों, सभी होटलों और रेस्त्राओं, बेंक्वेट हालों और इस तरह के अन्य स्ट्थलों पर यथासंभर् कम्पोपस्ट्टंग या बायो-जमथेिेिि के माध्यम से िैजर्क अपजिष्ट के उत्सिवि होिे के स्ट्थाि पर ही प्रसंस्ट्करण करि े की व्यर्स्ट्था करेगा तथा अपजिष्ट उत्सिवि करिे र्ाल े अन्य अपजिष्ट उत्सिवकों को भी िैजर्क अपजिष्ट के स्ट्र्-स्ट्थािे प्रसंस्ट्करण को र्रीयता िी िायगी। (2) बोडव यह प्रर्ृत्त करेगा दक सब्िी, िल, िूल, मांस, कुक्कुट और मछली व्यापार मंजडयों द्वारा अपिे िैजर्क अपजिष्ट का प्रसंस्ट्करण करत े समय स्ट्र्च्छ जस्ट्थजतयां बिाए रखी िाएं।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (3) बोडव यह प्रर्ृत्त करेगा दक बागर्ािी पाको और उद्यािों स े उत्सर्िवत अपजिष्ट का जिपटाि अलग स े यथासंभर् पाको और उद्यािों म ेंदकया िाए। (4) बोडव अपजिष्ट प्रबंधि म ें समुिायों को िाजमल करि े और घर पर ही कम्पोपस्ट्टंग, बॉयोगसै उत्पािि सामुिाजयक स्ट्तर पर अपजिष्ट के जर्केंरीकृत प्रसंस्ट्करण को प्रोत्साजहत करेगा परंतु, ऐसा करत े समय बिबू को जियंजत्रत रखिा और तत्संबधी सुजर्धा स्ट्थल के आसपास स्ट्र्च्छता जस्ट्थजत बिाए रखिा अजिर्ायव होगा। अध्याय 7 ठोस अपजिष्ट का जिपटाि 12. ठोस अपजिष्ट का जिपटाि- (1) बोड वअर्जिष्ट कचरे और गजलयों में झाडू लगािे से उत्सर्िवत कचरे तथा िाजलयों स े जिकलि े र्ाली गाि का जिपटाि ठोस अपजिष्ट प्रबंधि जियम, 2016 म ें प्रित्त रीजत और तत्समय प्रर्ृत्त दकसी अन्य कािूि द्वारा लागू दकए गए दकसी अन्य िाजयत्र् के अिरूु प रीजत से स्ट्र्ंय या दकसी अन्य अजभकरण के माध्यम से सेजिटरी लडैं दिल और संबद्ध ढाचं े का जिमावण, प्रचालि और रखरखार् करेगा। (2) उप-पैरा (1) म ें अतं र्र्वष्ट दकसी बात के होत े हुए भी, बोड व अपि े उत्तरिाजयत्र् र्ाल े क्षेत्र में अर्जिष्ट अपजिष्ट, गजलयों में झाडु लगािे से उत्सर्िवत अपजिष्ट, िाजलयों से जिकलि े र्ाली गाि और अन्य स्रोतों स े उत्सर्िवत अपजिष्ट को लैंडदिल में जिपटाि के जलए दकसी भी अन्य िगर जिकाय या िगर जिकाय समूहों के साथ करार कर सकता है, ऐसे िगर जिकाय तथा िगर जिकाय समहू जिन्होंिे संबद्ध अर्संरचिात्मक ढांचा का जिमावण, संचालि तथा रखरखार् दकया ह।ैं अध्याय 8 उपयोक्ता िीस और िाजस्ट्त 13. ठोस अपजिष्ट का सग्रं हण, ढुलाई और जिपटाि हते ु उपयोक्ता िीस- (1) अपजिष्ट उत्सिवकों से अपजिष्ट सग्रं हण, ढुलाई और जिपटाि हते ु सेर्ाएं प्रिाि करिे के जलए बोड व द्वारा उपयोक्ता िीस जिधावररत की िाएगी। उपयोक्ता िीस की िरें प्रथम अिुसूची म ेंजर्जिर्िवष्ट की गई ह।ैं (2) अपजिष्ट उत्पािकों से यथा जियत उपयोक्ता िीस का संग्रह बोडव या इस जिजमत्त सामान्य या जर्िेि आिेि से सक्षम प्राजधकारी द्वारा प्राजधकृत अजभकरण या दकसी प्राजधकृत व्यजक्त द्वारा दकया िाएगा। (3) बोडव इि उपजर्जधयों की अजधसूचिा की तारीख स े छह महीिे के भीतर, उपयोक्ता िीस लगाि े के प्रयोिि हते ु अपजिष्ट उत्सिवकों का डाटाबेस तैयार करेगा और उपयोक्ता िीस की जबपलंग या संग्रहण या र्सूली के जलए समुजचत व्यर्स्ट्था जर्कजसत करेगा और डाटाबेस को जियजमत रूप से अद्यति दकया िाएगा। (4) बोडव ऑिलाइि भुगताि सजहत उपयोक्ता िीस की र्सूली हते ु जर्जभन्न पद्धजतयां अपिा सकेगा। ऐस े उपयोक्ता िीस के संग्रहण के जलए महीि े में जर्िेि दिि जिधावररत दकए िाएंगे, जिसमें प्रत्येक महीिे के पहल े सिाह को र्रीयता िी िाएगी। (5) र्ार्िवक अथर्ा छमाही भगु ताि की भी प्रणाली अपिाई िाएगी। (6) यदि उपयोक्ता िीस सम्पूणव र्िव के जलए अजग्रम अिा दकया िाता है, तो बारह महीिे की बिाए िस महीिे की राजि ली िाएगी। इसी प्रकार, उपयोक्ता िीस छह महीिे का अजग्रम भगु ताि दकया िाता है, तो िीस की मांग की रकम छह महीि े के बिाए साढे पांच महीि े के जलए र्सूल की िाएगी। (7) उपयोक्ता िीस के भगु ताि में चूक होिे के मामल े में सक्षम प्राजधकारी अजधजियम की धारा 101, धारा 102 और धारा 324 के उपबंधों के अधीि उसकी र्सूली चूककताव से कर की बकाया राजि के रूप म ेंकर सकेगा। 14. जियमों के उल्लघं ि के जलए िाजस्ट्त- (1) ठोस अपजिष्ट प्रबंधि जियम, 2016 या इि उपजर्जधयों के दकसी भी उपबंधों के उल्लंघि या अिुपालि करि े में जर्िलता के जलए जद्वतीय अिुसूची में यथाजर्जिर्िवष्ट िाजस्ट्त अजधरोजपत की िाएगी।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 13 (2) उप-पैरा (1) म ें यथा उजल्लजखत उल्लघिं िारी रखि े या गैर-अिुपालि की जस्ट्थजत म ें ऐसी प्रत्येक चूक के जलए प्रजतदिि आधार पर िाजस्ट्त लगाई िाएगी जिसे पााँच सौ रुपए तक बढ़ाया िा सकता ह।ै अध्याय 9 जहतधारकों के िाजयत्र् 15. अपजिष्ट उत्सिकव ों के िाजयत्र् - (1) कूड़ा िैलाि ेपर प्रजतबधं :- (क) अजधकृत सार्विजिक या जििी कूड़िािों के जसर्ाय कोई व्यजक्त दकसी सार्विजिक स्ट्थल पर कूड़ा िहीं िैलाएगा। कोई भी व्यजक्त इि जर्िेि प्रयोििों के जलए उपबंध दकए गए ऐस े सार्विजिक सुजर्धाओं के जसर्ाय दकसी सार्विजिक स्ट्थल पर र्ाहिों की मरम्मत, बतवि या कोई अन्य उपकरण धोिे या साि करिे का कायव िहीं करेगा या दकसी प्रकार का संग्रहण िहीं करेगा। (ख) अजधकृत जििी या सार्विजिक कूड़ेिािों के जसर्ाय कोई व्यजक्त दकसी खुली या खाली पड़ी सम्पजत्त पर कूड़ा िहीं डालगे ा। (ग) दकसी र्ाहि के ड्राइर्र या यात्री के रूप में कोई भी व्यजक्त दकसी गली, सड़क, िुटपाथ, खेल के मैिाि, उद्याि, रैदिक आइलडैं या अन्य सार्विजिक स्ट्थाि पर कूड़ा िहीं िेंकेगा। (घ) कोई व्यजक्त तब तक दकसी रक या अन्य मालर्ाहक र्ाहि को िहीं चलाएगा, िब तक की ऐसे र्ाहि का जिमावण और लिाि इस प्रयोिि के जलए अजधकृत िा दकया गया हो तादक सड़क, िुटपाथ, खेल के मैिाि, उद्याि, रैदिक आइलैंड या अन्य सार्विजिक स्ट्थलों पर कोई लोड, पिाथव या गंिगी डालिे या िमा करिे स ेरोका िा सके। (ड़) कुत्ता, जबल्ली सजहत या ऐसे अन्य दकसी पालत ू िािर्रों के स्ट्र्ाजमयों का यह भी उत्तरिाजयत्र् होगा दक गली या दकसी सार्विजिक स्ट्थल पर ऐसे िािर्र द्वारा उत्सर्िवत दकसी प्रकार की गंिगी को तत्काल उठाएगा या साि करेगा तथा इस तरह उत्सर्िवत अपजिष्ट के उजचत जिपटाि हते ु समजु चत उपाय करेगा, जििमें स्ट्र्यं की सीर्ेि प्रणाली स ेजिपटाि को र्रीयता िी िाएगी। (च) कोई व्यजक्त दकसी िाली, ििी, खुले तालाब या िल जिकायों म ेंकूड़ा िहीं डालेगा। (2) अपजिष्ट को िलािा:- सार्विजिक स्ट्थािों पर या दकसी जििी स्ट्थाि पर या सार्विजिक सम्पजत्त पर ठोस अपजिष्ट के दकसी भी प्रकार को िला कर जिपटाि करिा पणू वतया जिजिद्ध ह।ै (3) स्ट्र्च्छ क्षत्रे :- (क) प्रत्येक व्यजक्त यह प्रयास करेगा दक िुटपाथ और खलु ी िाजलयां अथर्ा गटर तथा सड़क दकिारे सजहत उसके स्ट्र्ाजमत्र् या कब्िे र्ाले पररसर के सामिे कोई भी सार्विजिक स्ट्थाि या आसपास का क्षेत्र दकसी भी तरह के ठोस या तरल अपजिष्ट स ेमुक्त रहकर स्ट्र्च्छ रह।े (ख) सार्विजिक सभाओं और दकसी कारण (िलु ूस, प्रििवि, सकवस, मेल,े राििीजतक रैजलयां, र्ाजणजज्यक, धार्मवक, सामाजिक-सांस्ट्कृजतक कायविमों, जर्रोध प्रििविों और प्रििविों आदि सजहत) स े सार्विजिक स्ट्थलों पर आयोजित की िािे र्ाली गजतजर्जधयों, िहां यथाजस्ट्थजत, पुजलस जर्भाग या बोडव स े अिुमजत अपेजक्षत हो, के मामल े में ऐसी गजतजर्जधयों या सभा के आयोििकताव का यह िाजयत्र् होगा दक र्ह उस क्षेत्र और आसपास के क्षेत्रों की स्ट्र्च्छता सुजिजश्चत करें। (ग) कायविम आयोिक स े बोड व द्वारा यथा अजधसूजचत प्रजतिाय योग्य स्ट्र्च्छता धरोहर राजि कायविम की अर्जध के जलए प्राजधकृत अजधकारी द्वारा प्राि की िाएगी।14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (घ) यह िमा राजि कायविम परू ा होिे के पश्चात प्रजतिाय की िाएगी लेदकि उसस े पहल े यह िाचं की िाएगी दक उक्त सार्विजिक स्ट्थल की स्ट्र्च्छता बहाल कर िी गई है, और कायविम के पररणामस्ट्र्रूप उत्सर्िवत अपजिष्ट एकत्र करके अजभजहत स्ट्थलों तक पहुचं ा दिया गया ह।ै (ड़) बोडव द्वारा संग्रहीत यह धरोहर राजि केर्ल सार्विजिक स्ट्थल की स्ट्र्च्छता अिरु क्षण के जलए होगी और इसमें सम्पजत्त को पहुचं ाई गई दकसी प्रकार की क्षजत का हिाविा िाजमल िहीं होगा। यदि आयोििकताव कायविम के आयोिि के पररणामस्ट्र्रूप उत्सर्िवत अपजिष्ट की सिाई, संग्रहण और ढुलाई में बोडव की सेर्ाएं प्राि करिा चाहते हों, तो उन्ह ें बोड व के संबजं धत जर्भाग या अिुभाग को आर्ेिि करिा होगा तथा इस प्रयोिि के जलए सक्षम प्राजधकारी द्वारा तय दकए गए अपेजक्षत प्रभारों का भगु ताि करिा होगा। (च) खाली प्लाट पर ठोस अपजिष्ट डालिा तथा गैर-अजभजहत स्ट्थािों पर जिमाणव और जर्ध्र्सं अपजिष्ट डाले िाि े की जस्ट्थजतयों से बोडव जिम्नजलजखत रीजत स ेजिपटेगा, अथावत :- (i) बोडव दकसी पररसर के स्ट्र्ामी या अजधयोगी को िोरटस भेि सकेगा जिससे ऐसे स्ट्र्ामी या अजधभोगी से उक्त पररसर पर डाले गए दकसी भी प्रकार के अपजिष्ट को िोरटस में यथा जर्जिर्िवष्ट रीजत तथा समय के भीतर साि करिा अपेजक्षत होगा। (ii) यदि िोरटस पािे र्ाला व्यजक्त िोरटस में र्र्णवत अजधरोजपत अपेक्षाएं परू ी करिे म ें जर्िल रहता ह ै तो ऐसा व्यजक्त सक्षम प्राजधकारी के आििे या उपरोक्त प्रयोिि के जलए सक्षम प्राजधकारी द्वारा िाजमत कमवचारी के आिेि से समय-समय पर जिधावररत िाजस्ट्त का िायी होगा। (iii) उपयुवक्त िोरटस पाि े र्ाला व्यजक्त िाजस्ट्त भुगताि के अजतररक्त यदि िोरटस म ें र्र्णवत अपेक्षाएं पणू व करिे म ें जर्िल रहता है, तो सक्षम प्राजधकारी या उसके द्वारा िाजमत व्यजक्त ऐसे पररसर में प्रर्ेि कर अपजिष्ट को साि कर सकेगा तथा इस प्रयोिि में अजधभोगी से अपजिष्ट साि करिे पर दकए गए व्यय की र्सूली कर सकेगा। 16. जिपटाि योग्य उत्पािों और सजे िटरी िपे दकि तथा डायपस व के जर्जिमातव ाओं या ब्राडं स्ट्र्ाजमयों के कतव्यव - (1) जिपटाि योग्य उत्पािों िैसे रटि, कांच, प्लाजस्ट्टक पैकेपिंग आदि के सभी जर्जिमावताओं या बोडव की अजधकाररता में आिे र्ाल े बािारों म ें ऐसे उत्पाि प्रारंभ करि े र्ाले ब्रांड स्ट्र्ाजमयों को अपजिष्ट प्रबंधि प्रणाली की स्ट्थापिा के जलए बोड वको आर्श्यक जर्त्तीय सहायता प्रिाि करिी होगी। (2) बोडव इि उपबंधों के कायावन्र्यि के जलए केंरीय सरकार और उत्तर प्रिेि राज्य सरकार के सबं द्ध जर्भागों के साथ भी समन्र्य स्ट्थाजपत करेगा। (3) ऐसे सभी ब्रांड स्ट्र्ाजमयों को िो गरै - िैर्अपघटिीय पैकेपिंग सामग्री में अपिे उत्पाि बेचते या जर्पणि करते ह,ैं उन्ह ें ऐसी प्रणाली कायम करिी होगी, जिसमें उिके उत्पािि के कारण उत्सर्िवत पैकेपिंग अपजिष्ट को र्ापस जलया िा सके। (4) सेजिटरी िेपककंस और डायपसव जर्जिमावता या ब्रांड स्ट्र्ामी या जर्पणि कंपजियां इस बात की संभार्िाओं का पता लगाएंगी दक उिके उत्पािों में सभी पुिवचिण योग्य पिाथों का प्रयोग दकया िाए या र्े अपिे सेजिटरी उत्पािों के पैकेट के साथ एक ऐसा पाउच या रैपर उपलब्ध कराएं जििमें ऐस े िेपदकि या डायपर का जिपटाि दकया िा सके। (5) ऐसे सभी जर्जिमावताओं, ब्रांड स्ट्र्ाजमयों या जर्पणि कंपजियों की यह जिम्मेिारी होगी दक र्े अपि े उत्पािों की रैपपंग और जडस्ट्पोिल के जलए ििता को जिजक्षत करें। (6) ईधि प्रयोग करि े र्ाली और ठोस अपजिष्ट आधाररत प्लांट के एक सौ दकलोमीटर के िायरें म ें जस्ट्थत सभी औद्योजगक इकाइया ं अपिी ईधि की िरूरत का कम स े कम पााँच प्रजतित भाग इस प्रकार उत्पादित ररफ्यूज्ड डेराइव्ड फ्यूल से परू ा करेंगी।[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 15 17. बोड व के िाजयत्र्- (1) बोड व अपिे अजधकार क्षेत्र म ें आि े र्ाल े भू-भाग म ें सभी समाि क्षेत्रों, यथा गजलयों या सड़कों, सार्विजिक स्ट्थलों, अस्ट्थायी बजस्ट्तयों, स्ट्लम क्षेत्रों, बािारों, स्ट्र्यं के उद्यािों, बागों या िाजलयों आदि की सिाई की जियजमत प्रणाली सुजिजश्चत करिे के जलए उत्तरिायी होगा। र्ह इसके जलए मािर् संसाधि और मिीिें लगाएगा तथा घोजित सग्रं हण कंटेिरों स े अपजिष्ट एकत्र करि े और उसे प्रजतदिि बंि र्ाहिों में अंजतम जिपटाि स्ट्थल तक पहुचं ािे के जलए बाध्य होगा, जिसके जलए बोडव अपिे सिाई कमवचारीर्ृंि और र्ाहिों के अलार्ा, संजर्िा के आधार पर जििी पक्षों या अजभकरणों को काम पर लगा सकेगा या सरकारी-जििी भागीिारी व्यर्स्ट्था लाग ू कर सकेगा। अपि े स्ट्र्य ं के सिाई कमवचारीर्ृंि तथा र्ाहिों के अजतररक्त बोड व सभी र्ाजणजज्यक क्षत्रे ों की पहचाि करेगा िहां दिि में िो बार झाडू लगािे की आर्श्यकता हो। (2) बोडव या उसके द्वारा अजधकृत कोई अजभकरण सार्विजिक सड़कों, रेलर्े स्ट्टेििों, बस अड्डों, धार्मवक स्ट्थलों और र्ाजणजज्यक क्षेत्रों आदि के आसपास पयावि संख्या में और पयावि आकार के कूड़ेिािों, यदि आर्श्यक हो, की व्यर्स्ट्था तथा रखरखार् करेगा। (3) सक्षम प्राजधकारी जर्केंरीकृत और जियजमत रीजत से ठोस अपजिष्ट प्रबंधि गजतजर्जधयों के प्रयोिि के जलए प्रत्येक र्ाड व में एक कार्मवक या कमवचारी िाम जिर्िवष्ट करेगा, तादक र्ह कंटेिरों, सार्विजिक िौचालयों, सामुिाजयक िौचालयों या सार्विजिक स्ट्थािों पर बि े पिे ाबघरों, सार्विजिक अपजिष्ट के जलए बिाए गए स्ट्थािांतरण स्ट्टेिि, लडैं दिल प्रसंस्ट्करण यूजिटों आदि स्ट्थलों का पयवर्ेक्षण कर सके। (4) सक्षम प्राजधकारी ठोस अपजिष्ट के पथृ क्ककरण, संग्रहण, ढुलाई, प्रसंस्ट्करण और जिपटाि कायों की प्रगजत पर जिगरािी रखि े के जलए पयावि संख्या म ें र्ररष्ठ अजधकाररयों को िोडल अजधकारी जियक्तु करेगा, िो सहायक सिाई जिरीक्षक के रैंक या समकक्ष से िीचे का अजधकारी िहीं होगा। (5) प्रत्येक र्ाडव जिधावररत माििडं के आधार पर बुहारि े के हलके में जर्भाजित दकया िाएगा और उसम ें तििुरूप स्ट्र्यं के कार्मवक या आउटसोसव द्वारा तैिात दकए िाएंगे या र्तवमाि तैिाती को युजक्तसंगत बिाया िाएगा तथा अद्यति प्रौद्योजगकी का प्रयोग करत े हुए उिके काय व पर जिगरािी रखी िाएगी तथा बोड व उपयुक्त समझ े तो र्ह अपि े क्षेत्राधीि सीमा के दकसी भाग में उक्त प्रयोिि के जलए सार्विजिक जििी साझेिारी के जलए अिुबंध कर सकेगा। (6) पयवर्ेक्षण पिधाररयों द्वारा प्रत्येक हलके का जिरीक्षण समय-समय पर दिए गए दििा-जिििे ों अिुसार िैजिक आधार पर दकया िाएगा। (7) बोडव अद्यति सड़क या गली साि करिे र्ाली मिीिों, यांजत्रक झाड़ूकिों या अन्य उपकरणों का इस्ट्तेमाल करेगा, जिससे झाडू लगाि े तथा िाजलयों की सिाई की सक्षमता में सुधार होगा। (8) बोडव सूचिा, जिक्षा और संप्रेिण अजभयाि के माध्यम से िागरूकता तथा संर्ेिििीलता पैिा करेगा और अपजिष्ट उत्सिवकों एर्ं अन्य जहतधारकों को ठोस अपजिष्ट प्रबंधि जियम, 2016 और इि उपजर्जधयों के जर्जभन्न उपबंधों के बारे म ें जिजक्षत करेगा जिसम ें उपयोक्ता िीस और िाजस्ट्त संबंधी उपबंधो की िािकारी पर जर्िेि बल दिया िाएगा। (9) बोडव अपजिष्ट उत्सिवकों को इस बात के जलए प्रोत्साजहत करेगा दक र्े गीले अपजिष्ट को स्रोत पर ही जिपटाए और र्ह जर्केंरीकृत तकिीकों िैसे बायो-जमथेिेिि, कम्पोपस्ट्टंग आदि अपिाि े के जलए प्रोत्साहि िेि े पर भी जर्चार करेगा। (10) इि प्रोत्साहिों में पररर्ारों, जिर्ासी कल्याण संगठिों और संस्ट्थािों आदि को परु स्ट्कार, प्रमाण-पत्र एर् ं सम्माि प्रिाि करिा, उिके िाम संबद्ध र्ेबसाइटों पर प्रकाजित करिा या सम्पजत्त कर में छूट प्रिाि करिा, आदि िाजमल होंगे।16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (11) बोडव स्ट्र्यं द्वारा रखरखार् दकए िा रह े सभी पाको, उद्यािों और िहा ं कहीं संभर् हो, अपिे अजधकार क्षेत्र र्ाले अन्य स्ट्थािों पर कम्पोस्ट्ट का उपयोग करेगा। (12) अिौपचाररक अपजिष्ट पुिवचिण सेक्टर द्वारा दकए िािे र्ाले पिु वचिण उपायों के जलए प्रोत्साहि भी प्रिाि दकए िाएंगे। (13) बोडव ठोस अपजिष्ट प्रबंधि प्रणाजलयों को सुचारू और औपचाररक बिािे के उपाय करेगा और यह प्रयास करेगा दक अपजिष्ट प्रबंधि में अिौपचाररक क्षेत्र के श्रजमकों (कूड़ा बीििे र्ालों) को र्रीयता िी िाए, तादक उिकी कायवजस्ट्थजत को उन्नत बिाया िा सके और उन्ह ें ठोस अपजिष्ट प्रबंधि की औपचाररक प्रणाली में समाजहत एर् ं एकीकृत दकया िा सके। (14) बोडव यह सुजिजश्चत करेगा दक स्ट्र्च्छता सेर्ा के सुजर्धा प्रिाता द्वारा अपि े उि सभी श्रजमकों को व्यजक्तगत सुरक्षा उपकरण सजहत र्िी, फ्लोरेसेंट िैकेट, िस्ट्ताि,े रैिकोट, समुजचत िुटजर्यर और मास्ट्क प्रिाि दकए िाए,ं िो ठोस अपजिष्ट पररचालि का कायव करते ह ैंऔर यह भी दक ऐसे श्रजमकों द्वारा इि र्स्ट्तुओं का प्रयोग दकया िाए। (15) बोडव कचरे के संग्रहण, पररर्हि और पररचालि में िाजमल स्ट्र्यं के और बाहरी अजभकरण के कमवचारीर्ृंि की व्यार्साजयक सुरक्षा सुजिजश्चत करेगा और इसके जलए उन्ह ें व्यजक्तगत संरक्षा के उपयुक्त तथा समुजचत उपकरण प्रिाि करेगा। (16) दकसी ठोस अपजिष्ट प्रसंस्ट्करण या उपचार या जिपटाि केंर या लडैं दिल स्ट्थल पर कोई िघु वटिा होिे की जस्ट्थजत म,ें उस केंर का प्रभारी अजधकारी तत्काल बोडव को ररपोटव करेगा, िो जस्ट्थजत की समीक्षा करिे के पश्चात उस केंर के प्रभारी अजधकारी को आर्श्यक जििेि, यदि कोई हो, िारी करेगा। (17) मुख्य अजधिासी अजधकारी या उिके द्वारा प्राजधकृत कोई अन्य अजधकारी र्ाडव के जर्जभन्न भागों और ठोस अपजिष्ट के सग्रं हण, ढुलाई, प्रसस्ट्ं करण और जिपटाि स े संबंजधत अन्य स्ट्थािों की जियजमत िांच करेगा तथा ठोस अपजिष्ट प्रबंधि जियम, 2016 और इि उपजर्जधयों के जर्जभन्न उपबंधों के अिुपालि का पयवर्ेक्षण करेगा । (18) बोडव अपिे मुख्यालय म ेंकॉल सेंटर की स्ट्थापिा द्वारा िि जिकायत जिर्ारण प्रणाली जर्कजसत करेगा। (19) इस िि जिकायत जिर्ारण प्रणाली में एसएमएस आधाररत सेर्ा, मोबाइल एजप्लकेिि या र्बे आधाररत सेर्ाएं िाजमल हों सकेंगी। (20) बोडव ठोस अपजिष्ट प्रबंधि जियम, 2016 और इि उपजर्जधयों के कायावन्र्यि स े संबद्ध कमवचाररयों की उपजस्ट्थजत ििव करि े और उस पर मॉजिटटरंग हते ु अपि े मुख्यालय, सभी िोिल कायावलयों और र्ाड व कायावलयों म ें बॉयो-मेररक या स्ट्माटव काडव तकिीकों या सूचिा एर्ं 2016; And, whereas, the said Solid Waste Management Rules, 2016, inter alia, shall be applicable to every urban local body, outgrowths in urban agglomerations, census towns as declared by the Registrar General and Census Commissioner of India, notified areas, notified industrial townships, areas under the control of Indian Railways, airports, airbases, Ports and harbours, defence establishments, special economic zones, State and Central Government organisations, places of pilgrims, religious and historical importance as may be notified by respective State Government from time to time and to every domestic, institutional, commercial and any other non-residential solid waste generator situated in the areas except industrial waste, hazardous waste, hazardous chemicals, bio medical wastes, e-waste, lead acid batteries and radio-active waste, that are covered under separate rules framed under the said Act; And, whereas, clause (e) of rule 15 of the Solid Waste Management Rules, 2016, duty bounds the local authorities to frame bye-laws within one year from the date of notification of the said rules; Now, therefore, the following draft bye-laws, which the Lucknow Cantonment Board proposes to make in exercise of the powers conferred by section 348 of the Cantonments Act, 2006 (41 of 2006) read with rule 15 of the[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 21 Definitions.–– (1) In these bye-laws, unless the context otherwise requires,–– (a) “Act” means the Cantonments Act, 2006 (41 of 2006); (b) “Board” means the Lucknow Cantonment Board; (c) “bulk garden and horticultural waste” means bulk waste from parks and gardens including grass clippings, weeds, woody brown carbon-rich material such as pruning, branches, twigs, wood chipping, straw, dead leaves, tree trimmings and such other waste, which cannot be accommodated in the daily collection system for bio-degradable waste; (d) “bulk waste generator” shall have the same meaning as assigned to it in clause 8 of sub-rule (1) of rule 3 of the Solid Waste Management Rules, 2016 and any other waste generator notified by the Chief Executive Officer from time to time; (e) “collection” means lifting and removal of solid waste from source of waste generation,collectionpoints or any other location; (f) “competent authority” means the Chief Executive Officer of the Board or any other person authorised by him; (g) “construction and demolition waste” shall have the same meaning as assigned to it in clause (c) of sub-rule (1) of rule 3 of the Construction and Demolition Waste Rules, 2016; (h) “clean area” means the public place in front of and all around or adjacent to any premises extending to the kerbside and including the drain, foot path and kerb cleaned and so maintained in accordance with these bye-laws; (i) “community waste storage bin” means any storage facility set up and maintained by the Board or collectively by owners or occupiers, as the case may be, of one or more premises for storage of solid waste in a segregated manner on the roadside or in the premises of any one of such owners or occupiers or in their common premises as authorised by the competent authority (hereafter referred to as the dhalao); (j) “containerised hand cart” means the hand cart provided by the Board or the agency or the agent appointed by it for point-to-point collection of solid waste; (k) “delivery” means handing over any category of solid waste to worker of the Board or any other person appointed, authorised or licensed by the Board for taking delivery of such waste or depositing the same in any vehicle provided by it or by any other authorised agency or licensed by the Board to do so;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (l) “e-waste” shall have the same meaning as assigned to it in clause (r) of sub-rule (1) of rule 3 of the E-Waste (Management) Rules, 2016; (m) “fixed compactor transfer station” means a powered machine which is designed to compact segregated solid waste and remains stationary when in operation and the compactor may also be mobile when in operation, which may be called mobile transfer station; (n) “litter” means all refuse and includes any other waste material which, if thrown or deposited as prohibited under these bye-laws, tends to create nuisance or danger to any person, animal, environment or public health, safety and welfare; (o) “littering” means causing, putting, burying, permitting or allowing litter in such a location that it falls, descends, blows, is washed, percolates or otherwise escapes or is likely to fall, descend, blow, be washed, percolate or otherwise escape into or onto any open or public place; (p) “owner” means any person who exercises the rights of an owner of any building, or land, or part thereof; (q) “occupier or occupant” means any person who is in occupation of or in possession and includes any person who for the time being is using, any land or building or part thereof, for any purpose whatsoever; (r) “pelletisation” means a process whereby pellets are prepared which are small cubes or cylindrical pieces made out of solid waste and includes fuel pellets which are also referred as refuse derived fuel; (s) "public place” means any place which is open to the use and enjoyment of the public, whether it is actually used or enjoyed by the public or not; (t) "storage" means the temporary containment of solid waste in a manner so as to prevent littering, attraction to vectors, stray animals and excessive foul odor; (u) “sanitary worker” means a person employed by the Board or the agency authorised by it for collecting or removing solid waste or cleansing the drains in the Chakrata Cantonment areas; (v) “Schedule" means the Schedule annexed to these bye-laws; (w) “user fee or charges” means fees or charges imposed by the Board, through general or special order of the competent authority from time-to-time, on the waste generator to cover full or part cost of providing solid waste collection, transportation, processing and disposal services; and (x) “vacant plot” means any land or open space, belonging to or under the management of any person or private agency or Government agency or Government department or public undertaking, which is not occupied. (2) The words and expressions used but not defined herein shall have the same meaning as respectively assigned to them in the Cantonments Act, 2006, the Solid Waste Management Rules, 2016, and the Construction and Demolition Waste Management Rules, 2016. CHAPTER II SEGREGATION AND PRIMARY STORAGE OF SOLID WASTE 4. Segregation and storage of solid waste at source.–– (1) It shall be the duty of all waste generators to separate and store the solid waste coming out of their respective places regularly into three streams, namely:–– (a) non-biodegradable or dry waste; (b) biodegradable or wet waste; (c) domestic hazardous waste and deposit it into covered waste bins, and handover segregated waste to designated waste collectors as directed by the Board from time to time. (2) Every bulk waste generator is to separate and store the solid waste coming out of their own places into three streams, namely:–– (a) non-biodegradable or dry waste; (b) biodegradable or wet waste;[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 23 (c) hazardous waste in suitable bins and handover segregated waste to authorised waste processing or disposal facilities or deposition centres through the authorised waste collection agency by paying the carrying charges specified by the Board from time to time. (3) The colour of bins for storage of segregated waste shall be green for biodegradable waste, blue fornon-biodegradable or dry waste and black for domestic hazardous waste. (4) All resident welfare and market associations shall, in partnership with the Board, ensure segregation of waste at source by the generators, facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorised waste pickers or the authorised recyclers. (5) The biodegradable waste shall be processed, treated and disposed off through composting or bio- methanation within the premises as far as possible and the residual waste shall be given to the waste collectors or agency as directed by the Board. (6) All gated communities and institutions with more than 5,000 square meters area shall, in partnership with the Board, ensure segregation of waste at source by the generators; facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorised waste pickers or the authorised recyclers. (7) The biodegradable waste shall be processed, treated and disposed off through composting or bio- methanation within the premises as far as possible and the residual waste shall be given to the waste collectors or agency as directed by the Board. (8) All hotels and restaurants shall, in partnership with the Board, ensure segregation of waste at source, facilitate collection of segregated waste in separate streams, handover recyclable material to either the authorised waste pickers or the authorised recyclers. (9) The biodegradable waste shall be processed, treated and disposed off through composting or bio- methanation within the premises as far as possible and the residual waste shall be given to the waste collectors or agency as directed by the Board. (10) No person shall organise an event or gathering of more than one hundred person at any unlicensed place without intimating the Board, either by physically or through online, along with payment of user fee as specified in the First Schedule, at least three working days in advance and such person or the organiser of such event shall ensure segregation of waste at source and handing over of segregated waste to waste collector or agency as directed by the Board. (11) Used sanitary waste are to be securely wrapped as and when generated in the pouches provided by the manufacturers or brand owners of these products or in a newspaper or suitable biodegradable wrapping material and place the same in the bin meant for non- biodegradable waste or dry waste. (12) Every street vendor shall keep suitable containers for storage of segregated waste generated during the course of his activity such as food waste, disposable plates, cups, cans, wrappers, coconut shells, leftover food, vegetables or fruits, and shall deposit such waste at waste storage depot or container or vehicle as notified by the Board. (13) Waste generator of garden and horticulture waste generated from his premises shall store such waste separately in his own premises and dispose of the same as per the directions of the Board from time to time. (14) Domestic hazardous waste shall be stored and delivered by every waste generator to the collection vehicle which shall be provided periodically by the Board or any other agency authorised by it or the Government of Uttrakhand or the Uttrakhand Pollution Control Board for collection of such waste, or to a centre designed for collection of such waste for disposal in such manner as may be directed by the Government of Uttrakhand or the Uttrakhand Pollution Control Board. (15) Construction and demolition waste shall be stored and delivered separately as provided under the Construction and Demolition Waste Management Rules, 2016. (16) No untreated bio-medical waste, e-waste, hazardous chemicals and industrial waste shall be mixed with solid waste and such waste shall be disposed of in accordance with the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules or regulations made thereunder. (17) Every owner or occupier of any premises other than designated slaughter houses and markets, who generates poultry, fish and slaughter waste as a result of any commercial activity, shall store the same separately in closed, hygienic condition and deliver it at a specified time, on a daily basis to the collection vehicle provided by the Board for this purpose:24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] Provided that there shall not be any depositing of such waste in any community waste bin and such deposition is strictly prohibited. (18) Segregated bio-degradable solid waste if not composted by the generators, shall be stored by them within their premises and its delivery shall be ensured to the worker of the Board or vehicle; or waste picker or waste collector or to the waste collection vehicle provided for specified commercial generators of bulk biodegradable waste at such times as may be notified by the Board from time to time. CHAPTER III SOLID WASTE COLLECTION 5. Collection of solid waste.–– (1) In compliance with the Solid Waste Management Rules, 2016, door to door collection of segregated solid waste shall be implemented in all areas or wards of the Board, to collect garbage from every house, including slums and informal settlements on a daily basis by integrating the informal door to door collection system with Boards collection system. (2) In order to collect garbage from every house, area-wise specific time slot shall be set and published at conspicuous parts of that area and on the website of the Board. (3) The time for house to house garbage collection shall be set from 6 am to 11 am. (4) For collection of garbage from trading establishments, shops in commercial areas or any other institutional waste generators, commonly the time shall be from 7 am to 12 noon. (5) The household, institution and commercial entities shall hand over the garbage to waste collector. (6) Arrangements shall be made for collection of residual solid waste from bulk waste generators, which are processing waste in-situ. (7) Residual solid waste from vegetable, fruit, flower, meat, poultry and fish market shall be collected on day to day basis. (8) Horticulture and garden waste shall be separately collected and disposed of once or twice in a week. (9) To make optimum use of biodegradable waste from fruits and vegetable markets, meat and fish markets, bulk horticulture and garden waste and to minimise the cost of collection and transportation, such waste shall be processed or treated within the area where waste is generated. (10) Manual handling of waste in the containers shall be prohibited and if it is unavoidable due to unexpected constraints, manual handling shall be carried out under proper protection with due care for safety of workers. (11) Waste generators shall be responsible to deposit their segregated waste in the auto-tippers or rickshaws deployed by the Board or by the notified authorised waste collector. (12) Segregated waste from multi-storied buildings, apartments, housing complexes may be collected from the entry gate or any other designated location as directed by the competent authority. (13) Changing needs and advances in technology shall be taken into consideration for selection of collection equipment and vehicles from time to time. (14) Auto-tippers or vehicles of specific capacity with-hydraulically operated hopper covering mechanism from top having two compartments for carrying biodegradable and non-biodegradable waste separately with a hooter shall be deployed for collection of waste. (15) Automatic voice recorded device, bell or horn or other suitable device having sound not more than the permissible noise level shall be installed on every garbage collection vehicle used by the waste collectors. (16) Route plans for each primary collection and transportation vehicle shall be provided by the Board or by the notified authorised waste collector. (17) These route plans in tabular as well as geographical information system map form, duly approved by the Board shall mention starting point, starting time, waiting points, waiting time on route, end point and end time of the specified route. (18) The Board or the notified authorised waste collector shall provide a display board at each street to display the time-table of primary collection and transportation vehicles to allow residents avail the facility at specified time and such information shall also be uploaded on the website of the Board.[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 25 (19) In narrow streets where it is not possible to provide service by auto tipper or the vehicle, a three- wheeler or smaller motorised vehicle with hydraulically operated hopper covering mechanism from top having two compartments for carrying wet and dry waste separately with a hooter, compatible with mobile transfer station shall be deployed. (20) In congested and narrower streets where it is not possible to provide service by a three-wheeler or any suitable smaller vehicle, cycle rickshaws or any other type of suitable equipment shall be deployed. (21) Smaller, narrow or congested streets or lanes where even a three-wheeler or rickshaw or any other type of suitable vehicles may not be in a position to deploy, vantage points shall be designated at the start of the locality or street, where the collection vehicle shall be parked and the helper or driver of the vehicle shall carry a whistle and walk in the locality to announce arrival of the vehicle for collecting solid waste. (22) Time table for such collection system shall be displayed at the display board and uploaded on the website of the Board. (23) Every household shall be responsible to ensure to handover segregated waste to the collector at the designated place. (24) Auto tippers, three-wheelers, rickshaws and any other type of collection vehicles engaged in the service shall collect waste only from households and not from any other source, such as, dhalaos, open sites, ground, bins or drains. (25) The Board or its notified authorised waste collectors shall be responsible to cover all the streets or lanes of each zone for the primary collection of solid waste. CHAPTER IV SECONDARY STORAGE OF SOLID WASTE 6. Storage of solid waste in the secondary storage points.––(1) Segregated solid waste collected from doorsteps shall be taken to waste storage depots, community storage bins or fixed mobile transfer stations or the locations specified by the Board for secondary storage of waste. (2) The secondary storage points shall have covered containers, of specified colour, for separate storage of the following, namely:–– (a) non-biodegradable or dry waste; (b) biodegradable or wet waste; (c) domestic hazardous waste. (3) Different coloured containers shall be used in the areas demarcated by the Board to keep segregated waste in the following manner, namely:–– (a) green for biodegradable waste; (b) blue for non-biodegradable waste; (c) black for domestic hazardous waste. (4) The Board shall, from time to time, notify mandatory colour coding and other specifications of containers as provided in the Solid Waste Management Rules, 2016 for storage and delivery of different types of solid waste to enable safe and easy collection without any mixing or spillage of waste, which generators of different types of solid waste shall adhere to. (5) The Board on its own or through outsourcing agencies shall maintain the storage facilities for solid waste in a manner that does not create unhygienic and unsanitary conditions around it. (6) Containers of various sizes in the secondary storage depots shall be provided by the Board or any agency authorised by it in different colours as specified in these bye-laws. (7) Storage facilities shall be created and established by taking into account quantities of waste generation in a given area and the density of population and such storage facilities shall be user friendly and shall be so designed to ensure compaction of waste and not exposed to open atmosphere. (8) All the housing co-operative societies, associations, colonies, residential and commercial establishments or gated communities shall have the responsibility to put colored bins as specified in these bye-laws and to keep adequate number of containers in clean and good condition in appropriate places in their own complexes at their own cost, so that the daily waste generated there can be properly deposited.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (9) The Board or the agency authorised by it shall carry out washing and disinfection of all the bins on a regular basis. 7. Recycling centres for dry waste (Non-biodegradable waste).–(1) The Board shall convert its existing dhalaos or identify specific locations as per requirement, as ‘recycling centres’ which shall be used for segregation of dry waste received through street or door to door waste collection service. (2) Recycling centres may be increased depending on the quantity of dry waste received. (3) Dry (non-biodegradable) waste collected through street or door- to-door collection system and from commercial establishments shall be transferred to the designated recycling centres and such designated centres shall receive only dry waste. (4) The households may also directly deposit or sell their recyclable dry waste to the authorised agents or authorised waste dealers, as the case may be, of the Board at these recycling centres at pre-notified rates. (5) The dealers shall maintain weighing scale and a counter at a permitted place at each recycling unit for this purpose. (6) The authorised agents or, as the case may be, the authorised waste dealers shall be allowed to dispose of or sell the recyclable waste to the secondary market or recycling units only in consonance with the provisions of the Solid Waste Management Rules,2016. (7) The authorised agents or authorised waste dealers shall be entitled to retain sales realisation thereof. 8. Deposition centre for specified domestic hazardous waste.–– (1) For the collection of domestic hazardous waste, a deposition centre shall be set up at a suitable location for receiving the specified domestic hazardous waste and such facility shall be set-up in each ward in such manner as may be decided by the Government and notify the timing of receiving of such waste. (2) The Board may also give the responsibility to authorised agent or concessionaire to collect domestic hazardous waste from all waste generators in segregated manner and such waste shall be transported separately to the hazardous waste disposal facility set up by the Government. CHAPTER V TRANSPORTATION OF SOLID WASTE 9. Transportation of solid waste.–– The transportation of solid waste shall be done in the following manner, namely:–– (i) vehicles used for transportation of waste shall be covered in such manner that the collected waste is not exposed to open environment and the vehicles may also include compactors and mobile transfer stations depending upon choice of technology by the Board; (ii) the storage facilities set up by the Board shall be attended daily for clearing waste and the areas surrounding the place where the bins or containers are kept shall also be cleaned; (iii) the collected and segregated bio-degradable waste from residential and other areas shall be transferred to the processing plants like compost plants, bio- methanation plants or any such other facilities in a covered manner; (iv) wherever applicable, for biodegradable waste, preference shall be given for on-site processing of such waste; (v) collected non-bio-degradable waste shall be transported to the respective processing facilities or secondary storage facilities; (vi) construction and demolition waste shall be transported as per the provisions of the Construction and Demolition Waste Management Rules, 2016; (vii) the Board shall make arrangements for transportation of inserts in a proper manner. The street sweeping waste and removable drain silt shall be removed immediately after the work is over; (viii) transportation vehicles shall be so designed that multiple handling of waste, prior to final disposal, is avoided; (ix) the collection vehicles engaged for transportation purpose shall deposit or transfer the waste only at the mobile transfer station or fixed compactor transfer station wherever provided;[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 27 (x) in case mobile transfer station or fixed compactor transfer station are not stationed at the designated location at that point of time for any reason, then the loaded vehicle shall go to the next designated location of the mobile transfer station or fixed compactor transfer station or the site specified by the Board to unload the waste; (xi) fixed compactor transfer station shall be transported through hook loader; (xii) the mobile transfer station or fixed compactor transfer station shall transport the waste directly to compost plant, waste to energy plant or any other site or plant as may be designated by the Board; (xiii) there shall not be any inter-mixing of waste from various sources during the transportation of waste; (xiv) the services of street level collection and transportation of waste shall be provided every day; (xv) the mobile transfer station engaged in this service shall receive waste only from designated auto tippers, three-wheelers or vehicles or bins collecting waste from street level operations; (xvi) the dedicated mobile transfer station shall be deployed at specified locations to receive waste from the auto-tippers, three-wheelers or rickshaws engaged in street-level and door-to-door collection of solid waste from households and commercial establishments as per the approved route plans; (xvii) the design of mobile transfer station or fixed compactor transfer station shall allow unloading of waste from primary collection vehicles by consuming minimum time and without littering waste; (xviii) the garbage spilled near mobile transfer station or fixed compactor transfer station, while transferring the solid waste, shall be cleaned so that no spillage is left. Disinfectant shall be used after cleaning process at that location; (xix) the Board or its authorised agent or agency shall install closed circuit television cameras at all secondary storage facilities. CHAPTER VI PROCESSING OF SOLID WASTE 10. Processing of solid waste.–– (1) The Board shall facilitate construction, operation and maintenance of solid waste processing facilities and associated infrastructure on its own or through any agency for optimum utilisation of various components of solid waste adopting suitable technology including the following technologies and adhering to the guidelines issued by the Central Government in the Ministry of Urban Development from time to time and standards prescribed by the Central Pollution Control Board, namely:– (a) to minimise transportation cost and environmental impacts, preference shall be given to decentralised processing such as bio-methanation, microbial composting, vermi-composting, anaerobic digestion or any other appropriate processing for bio-stabilisation of biodegradable waste; (b) through medium or large composting or bio-methanation plants at centralised locations; (c) through waste to energy processes by refuse derived fuel for combustible fraction of waste or supply as feedstock to solid waste-based power plants; (d) through construction and demolition waste management plants; and (e) to make all endeavours to create a market for consumption of refuse derived fuel to the extent it is possible. (2) In waste to energy plant by direct incineration, absolute segregation shall be mandatory and be part of the terms and conditions of the relevant contracts. (3) The Board shall endeavour that recyclables such as paper, plastic, metal, glass, or textile material go to authorised recyclers. 11. Other guidelines for processing of solid waste.– (1) The Board shall enforce processing of bio-degradable waste on site of generation of such waste through composting or bio-methanation, as far as possible, at resident welfare associations, group housing societies, markets, messes of armed forces and other agencies, gated communities and institutions with more than 5000 square metres. areas, all hotels and restaurants, banquet halls and places of such nature and preference shall be given for on-site processing of biodegradable waste generated by other waste generators as well. (2) The Board shall enforce that markets dealing with vegetables, fruits, flowers, meat, poultry and fish waste while processing bio-degradable waste ensure hygienic conditions.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (3) The Board shall enforce processing of horticulture, parks and garden waste separately in the parks and gardens as far as possible. (4) The Board shall take all steps to involve communities in waste management and promote home composting, bio-gas generation, decentralised processing of waste at community level, subject to control of odor and maintenance of hygienic conditions around the facility. CHAPTER VII DISPOSAL OF SOLID WASTE 12. Disposal of Solid waste.–– (1) The Board shall undertake on its own or through any other agency, the construction, operation and maintenance of sanitary landfill and associated infrastructure for disposal of residual waste and inert street sweepings and silt from surface drains in such manner as may be provided in the Solid Waste Management Rules, 2016, and any other obligation imposed by any other law for the time being in force. (2) Notwithstanding anything contained in sub-paragraph (1), the Board may enter into agreement with any other municipal body or group of municipal bodies so as to get the residual waste, inert street sweeping waste, silt from surface drains and others generated within the area of responsibility of the Board are disposed in landfill and associated infrastructure constructed, operated and maintained by such municipal body or group of municipal bodies. CHAPTER VIII USER FEE AND PENALTY 13. User fee for collection, transportation and disposal of solid waste.–– (1) There shall be a user fee fixed for providing services for garbage collection, transportation and disposal from waste generators by the Board. The rates of user fee are as specified in the First Schedule. (2) The Board shall collect the user fee so fixed from waste generators or the authorised agency or any person authorised by the competent authority by a general or special order in this behalf. (3) The Board shall prepare the database of all the waste generators for the purpose of levying user fee, and evolve appropriate mechanism for billing or collection or recovery of such user charges, within six months from the date of notification of these bye-laws and the database shall be updated regularly. (4) The Board may adopt different methods for collection of user fee including online payment, on particular days in a month, preferably in first week of each month, shall be fixed for collection of such user fee. (5) There shall also be a system of yearly or half yearly payment. (6) In case the user fee is paid in advance for the entire year, then amount for ten months shall be charged instead of twelve months. Similarly, for six months advance payment, five and half months demand amount shall be charged instead of six months. (7) In case of default of payment of user fee, the competent authority may recover the same from the defaulter as an arrears of tax under sections 101,102 and 324 of the Act. 14. Penalty for contravention.– (1) Whosoever contravenes or fails to comply with any of the provisions of the Solid Waste Management Rules, 2016 or these bye-laws shall be imposed with penalty as specified in the Second Schedule. (2) In case of contravention continues or non-compliance as mentioned in sub-paragraph (1) for every such default, penalty which may extend to five hundred rupees shall be imposed on per day basis. CHAPTER IX RESPONSIBILITIES OF STAKEHOLDERS 15. Responsibilities of waste generators. –– (1) Prohibition of littering:–– (a) no person shall litter in any public place except in authorised public or private litter receptacles. No person shall repair vehicles, wash or clean utensils or any other object or keep any type of storage in any public place, open or vacant space, except in such public facilities or conveniences specifically provided for any of these purposes.[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 29 (b) no person shall litter on any open or vacant property except in authorised private or public receptacles. (c) no person, whether a driver or passenger in a vehicle, shall litter upon any street, road, sidewalk, playground, garden, traffic island or other public place. (d) no person shall drive or move any truck or other goods vehicle unless such vehicle is so constructed and loaded as to prevent any load, contents or litter from being blown off or deposited upon any road, sidewalks, traffic island, playground, garden or other public place. (e) it shall be the responsibility of the owner of any pet animal including dog, cat or such other animal to promptly scoop or clean up any litter created by such pet on the street or any public place and take adequate steps for the proper disposal of such waste preferably by their own sewage system. (f) no person shall litter in any drain, river, open pond or in water bodies. (2) Burning of waste:–– Disposal by burning of any type of solid waste at public places or at any private or public property is strictly prohibited. (3) Clean Area:–– (a) every person shall endeavour that any public place in front of or adjacent to any premises owned or occupied by him including the footpath and open drain or gutter and kerb is free of any waste, either in solid or liquid form; (b) for public gatherings and events organised in public places for any reason (including for processions, exhibitions, circuses, fairs, political rallies, commercial, religious, socio-cultural events, protests and demonstrations, etc.,) where permission from the police department or from the Board, as the case may be, is required, it shall be the responsibility of the organiser of the event or gathering to ensure the cleanliness of that area as well as all appurtenant areas; (c) refundable cleanliness deposit, as notified by the Board, shall be collected by the authorised officer for the duration of the event from the organiser. (d) the deposit shall be refunded on the completion of the event after it is noted that the said public place has been restored back to a clean state, and any waste generated as a result of the event has been collected and transported to designated sites. (e) the deposit collected by the Board is only for maintenance of cleanliness of the public place and does not cover any damage to property. In case the organisers of the event wish to avail of the services of the Board for the cleaning, collection and transport of waste generated as a result of that event, they may request by making an application to the concerned department or section in the Board and pay the necessary charges as may be fixed by the competent authority for this purpose. (f) dumping of solid waste on vacant plot and depositing construction and demolition waste at non-designated locations shall be dealt with by the Board in the following manner, namely:–– (i) the Board may serve a notice on the owner or occupier of any premises, requiring such owner or occupier to clear any waste on such premises in such manner and within such time as may be specified in such notice; (ii) if, the person on whom the notice has been served fails to comply with the requirements imposed by the notice, such person shall be liable to pay penalty for each such failure, as ordered by the competent authority or by an employee as designated by the competent authority for the said purpose; (iii) apart from paying the penalty on whom the aforementioned notice is served fails to comply with the requirement imposed by such notice, the competent authority or a person designated by him may, enter on the premises and clear the waste and recover from the occupier the expenditure incurred in having do so. 16. Duty of manufacturers or brand owners of disposable products and sanitary napkins and diapers.– (1) All manufacturers of disposable products such as, tin, glass, plastic packaging, etc., or brand owners who introduce such products in the market within the jurisdiction of the Board shall provide necessary financial assistance to the Board for establishment of waste management system.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC.4] (2) The Board may also coordinate with the concerned departments in the Central Government and with the Government of Uttar Pradesh for implementation of these provisions. (3) All such brand owners who sell or market their products in such packaging materials which are non-biodegradable shall put in place a system to collect back the packaging waste generated due to their production. (4) Manufacturers or brand owners or marketing companies of sanitary napkins and diapers shall explore the possibility of using all recyclable materials in their products or they shall provide a pouch or wrapper for disposal of each napkin or diapers along with the packet of their sanitary products. (5) It shall be the responsibility of all such manufacturers, brand owners or marketing companies to educate the masses for wrapping and disposal of their products. (6) All industrial units using fuel and located within one hundred kms’ from a solid waste based refuse derived fuel plant shall make arrangements to replace at least five per cent of their fuel requirement by refused derived fuel so produced. 17. Responsibility of Board.– (1) The Board shall, within its territorial area, be responsible for ensuring regular system of surface cleaning of all common areas, such as streets or roads, public places, temporary settlements, slum areas, markets, parks owned by it, gardens or drains by employing human resources and machines and shall be bound to collect the garbage from the declared storage containers, and transport it every day to the final disposal point in closed vehicles for which the Board may engage private parties or agencies on contract or public private partnership mechanism, apart from its own cleaning staff and vehicles and the Board shall also identify all the commercial areas for carrying out sweeping twice a day, if needed. (2) The Board or any agency authorised by it shall provide and maintain sufficient number of community litter bins of proper size on public roads, in surroundings of railway stations, bus stops, religious places and in commercial areas, if found necessary. (3) The competent authority shall, for the purpose of managing solid waste activities in decentralised and regular manner, designate one official or an employee in every ward to supervise the spots of containers, public toilets, community toilets or urinals in public places, transfer station for public garage, landfill processing units, etc. (4) The competent authority shall designate adequate number of senior officials, preferably not below the rank of Assistant Sanitary Inspector or equivalent, as Nodal Officers to monitor the progress of segregation, collection, transportation, processing and disposal of solid waste. (5) Each ward shall be divided into sweeping beats based on the prescribed parameter and deploy its own or outsourced manpower accordingly or rationalise the existing deployment and monitor their work by using latest and suitable technology and the Board may also enter into public private partnership for the said purpose as it deems fit for a portion of its area of responsibility. (6) Each beat shall be inspected by the supervising officials on daily basis as per the directions given from time to time. (7) The Board shall employ latest road or street cleaning machines, mechanical sweepers or other equipment which improves the efficiency of sweeping and drainage cleaning. (8) The Board shall create awareness and sensitisation through information, education and communication campaign and educate the waste generators and other stakeholders about the various provisions of the Solid Waste Management Rules, 2016 and this bye-laws with special emphasis on user fee and penalties. (9) The Board shall encourage waste generators to treat wet waste at source and it may consider creating systems for incentives for adoption of decentralised technologies such as bio-methanation, composting, etc. (10) Incentives may be like awarding and recognising the households, Resident Welfare Associations and institutions, etc., by giving certificates, by publishing their names on respective websites or rebate in property tax, etc. (11) The Board shall undertake use of compost in all parks, gardens maintained by it and wherever possible, in other places under its jurisdiction. (12) Incentives may be provided to recycling initiatives by informal waste recycling sector. (13) The Board shall make efforts to streamline and formalise solid waste management systems and make all endeavour that the informal sector workers in waste management (waste pickers) are given[भाग II—खण् ड 4] भारत का रािपत्र : असाधारण 31 priority to upgrade their work conditions and are enumerated and integrated into the formal system of solid waste management. (14) The Board shall ensure that the operator of a facility provides personal protection equipment including uniforms, fluorescent jackets, hand gloves, raincoats, appropriate foot wear and masks to all workers handling solid waste and the same are used by the workforce. (15) The Board shall ensure occupational safety of its own staff and staff of outsourced agency involved in collection, transport and handling of waste by providing appropriate and adequate personal protective equipments. (16) In case of an accident at any solid waste processing or treatment or disposal facility or landfill site, the officer- in- charge of the facility shall report to the Board immediately which shall review and issue instructions, if any, to the in- charge of the facility. (17) The Chief Executive Officer or any other officer authorised by him shall conduct regular checks in various parts of the wards and other places of collection, transportation, processing and disposal of solid waste and supervise compliance of various provisions of the Solid Waste Management Rules, 2016 and this bye-laws. (18) The Board shall develop a public grievance redressal system by setting up of call centre at its headquarter. (19) The public grievance redressal system may include short message service based service, mobile application or web based services. (20) The Board shall install bio-metric or smart card technologies or Information and Communication Technology System for tracking and recording attendance of employees associated with the working of the Solid Waste Management Rules, 2016 and the bye-laws at their headquarters, all zonal offices and ward offices and shall make an endeavor to integrate such system with wages or remuneration, as the case may be. (21) To ensure greater transparency and public accessibility, the Board shall provide all necessary information through its website. (22) The Board shall perform all other functions and discharge all other duties provided under Solid Waste Management Rules, 2016, which have not been specifically mentioned in this bye-laws. CHAPTER-X MISCELLANEOUS 18. Miscellaneous.– The Board shall co-ordinate with all other government agencies and authorities, to ensure compliance of these bye-laws within areas under the jurisdiction or control of such bodies.
