1. सजं िि नाम और प्रारंभ— (1) इन जवजनयमों के समुद्री राज्य जवकास पररषद जवजनयम, 2026 कहा िाएगा।

2. पररभाषाए—ं (1) इन जवजनयमों म,ें िब तक दक संदभ ग स े अन्यथा अपेजित न हो,— (क) ‘अजधजनयम’ स े भारतीय पत्तन अजधजनयम, 2025 (2025 का 27) अजभप्रेत ह;ै (ख) ‘सदस्ट्य’ स ेअजधजनयम की धारा 3 की उपधारा (2) के अनसु ार अजधसूजचत समुद्री राज्य जवकास पररषद के सदस्ट्य अजभप्रते ह।ैं

(2) उन िब्दों और पदों के, िो इन जवजनयमों म ेंप्रयुि ह ैंऔर पररभाजषत नहीं ह ैंककंतु अजधजनयम म ेंपररभाजषत ह,ैं वही अथ ग होंगे िो अजधजनयम म ेंक्रमिः उनके जलए जनयत दकए गए ह।ैं

3. पररषद की बिै कों म ें व्यजियों को आमजं त्रत करना— (1) अध्यि, बैिक की कायगसूची को ध्यान म ें रखते हुए, केंद्रीय सरकार, राज्य सरकारों, संघ राज्य िेत्रों, कानूनी प्राजधकरणों, पत्तन प्राजधकरणों के प्रजतजनजधयों, जविेषज्ञों, जहतधारकों अथवा ऐस ेदकसी अन्य व्यजि को, जिसकी उपजस्ट्थजत आवश्यक या समीचीन समझी िाए, पररषद की ऐसी बैिकों म ेंउपजस्ट्थत होने के जलए आमंजत्रत कर सकेगा।

(2) उप-जवजनयम (1) के अधीन आमंजत्रत व्यजि बैिक के ऐसे जवचार-जवमि ग म ें भाग लगे ा, िैसा दक आमंत्रण म ें उपदर्िगत दकया िाए।

(3) पररषद की बैिक म ेंउपजस्ट्थत होने का आमंत्रण अजधमानतः इलेक्रॉजनक माध्यम स ेअथवा अन्यथा जलजखत रूप म,ें ऐसी समय-सीमा के भीतर और ऐस ेप्रारूप म ेंिारी दकया िा सकेगा, िैसा सदस्ट्य सजचव अवधाररत करे।

(4) िहां दकसी राज्य सरकार स े कोई नामजनर्दगष्ट सदस्ट्य, दकसी जवजिष्ट बैिक म ें भाग नहीं ले पाता, पररषद की उस जवजिष्ट बैिक म ें भाग लने े के जलए दकसी अन्य मंत्री को नामजनर्दगष्ट दकया िाए।

4. पररषद की बिै कों म ेंकाय गका सचं ालन— (1) पररषद की बिै क, भौजतक, आभासी अथवा जमजश्रत रीजत सजहत, इतनी बार और ऐसे स्ट्थानों पर आयोजित की िाए िैसा अध्यि के अनुदिे ों के आधार पर सदस्ट्य सजचव अवधाररत करे।

(2) पररषद की बैिक के जलए गणपूर्तग, पररषद की कुल सदस्ट्य संख्या का एक-जतहाई होगी।

(3) पररषद की प्रत्येक बैिक की कायगवाही जलजखत रूप म ें अजभजलजखत की िाएगी और सदस्ट्य सजचव द्वारा अनुमोददत की िाएगी।

(4) पररषद की प्रत्येक जवत्तीय वषग म ें कम-स-े कम एक बैिक आयोजित की िाए।

5. अवजिष्ट िजिया—ं पररषद की बैिकों के संचालन या काय-ग संव्यवहार स े संबंजधत कोई ऐसा जवषय, जिसके जलए इन जवजनयमों म ें जवजनर्दगष्ट रूप स े उपबंध नहीं दकया गया ह,ै अध्यि द्वारा जवजनजश्चत दकया िाएगा और उसे जलजखत रूप म ें अजभजलजखत दकया िाएगा।

NOTIFICATION New Delhi, the 10th September, 2026 G.S.R. 807(E). — Draft regulations proposed to be made by the Maritime State Development Council in exercise of the powers conferred under sub-section (1) read with clauses (a) and (b) of sub-section

(2) of section 79 of the Indian Ports Act, 2025 (27 of 2025), are hereby published for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulations shall be taken into consideration after 9th October, 2026.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 Objections and suggestions, if any, may be addressed to Shri Naveen Kumar, Under Secretary to the Government of India, Ministry of Ports, Shipping and Waterways, Room No. 547, 5th Floor, Transport Bhawan, Parliament Street, New Delhi – 110001 or by email at (uspd-psw@gov.in and sopd1-psw@gov.in) on or before the 9th October, 2026.

The objections and suggestions which may be received from any person with respect to the said draft regulations before the expiry of the period specified above shall be duly considered before finalisation of the regulations.

1. Short Title and Commencement. — (1) These regulations may be called the Maritime State Development Council Regulations, 2026.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. — (1) In these regulations, unless the context otherwise requires—

(a) “Act” means the Indian Ports Act, 2025 (27 of 2025);

(b) “members” means the members of the Maritime State Development Council notified in accordance with sub-section (2) of section 3 of the Act.

(2) Words and expressions used in these regulations and not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Invitation of persons to meetings of the Council. — (1) The Chairperson may, having regard to the agenda of the meeting, invite such persons, including representatives of the Central Government, State Governments, Union territories, statutory authorities, port authorities, experts, stakeholders, or any other person whose attendance is considered necessary or expedient, to attend such meetings of the Council.

(2) A person invited under sub-regulation (1) shall participate in such deliberations of the meeting as indicated in the invitation.

(3) The invitation to attend a meeting of the Council may be issued preferably electronically or otherwise in writing, within such time and in such form as the Member Secretary may determine.

(4) Where a nominated Member from a State Government is unable to attend a particular meeting, another Minister may be nominated to attend that particular meeting of the Council.

4. Transaction of business at meetings of the Council. — (1) The Council shall meet at such times and places, including through physical, virtual, or hybrid modes, as the Member Secretary determines, based on the instructions of the Chairperson.

(2) The quorum for a meeting of the Council shall be one-third of the total membership of the Council.

(3) The proceedings of every meeting of the Council shall be recorded in writing and approved by the Member Secretary.

(4) The Council may meet at least once in every financial year.

5. Residuary powers. — Any matter relating to the conduct of meetings or transaction of business of the Council, not specifically provided for in these regulations, shall be decided by the Chairperson and shall be recorded in writing.
