L.-33004/99 सी.जी.-डी.एल.-अ.-27092023-249027 xxxGIDHxxx CG-DLxx-xEG-I2D7E0x9x2x0 23-249027 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4077] नई ददल्ली, बुधवार, जसतम्ब र 27, 2023/आजश्व न 5 , 1945 No. 4077] NEW DELHI, WEDNESDAY, SEPTEMBER 27, 2023/ ASVINA 5, 1945 वस्ट्र मरं ालय आदेि नई ददल्ली, 27 जसतम्बर, 2023 का.आ. 4247(अ).—भारतीय मानक ब्यरू ो अजधजनयम, 2016 (2016 का 11) की धारा 17 और धारा 25 की उपधारा (3) के साथ पठित धारा 16 की उपधारा (1) और (2) द्वारा प्रदत्त िजियों का प्रयोग करत े हुए, केंद्र सरकार की राय ह ै दक सावविजनक जहत में ऐसा करना आवश् यक ह ै और भारतीय मानक ब्यूरो से परामिव करने के बाद, एतद्द्वारा जनम्नजलजखत आदिे दकया िाता है, अथावत्: - 1. संजिप्त िीर्कव और प्रारंभ – (1) इस आदेि को मेडीकल टेक्सटाइल्स (गुणवत् ता जनयंरण) आदेि, 2023 कहा िा सकता ह।ै (2) यह रािपर म ें इसके प्रकािन की तारीख से, इस आदेि स े िुडी अनुसूची - ए और अनुसूची - बी के कॉलम (5) म ें आइटम-वार जनर्दष्टव अवजध के तुरंत बाद लागू होगा। 2. आवदे न - यह आदेि उि अनुसजू चयों के कॉलम (2) में जनर्दष्टव वस्ट्तुओं या सामानों पर लाग ू होगा, परंत ु जनयावत स े संबंजधत ऐसी वस्ट्तुओं या सामानों और इस आदेि की अनुसूची ए में जनर्दष्टव वस्ट्तओंु िो स्ट्वयं सहायता समूहों (एसएचिी) द्वारा जनर्मवत ह,ैं पर लाग ूनहीं होगा । [स्ट्पष्टीकरण - इस परै ा के प्रयोिन के जलए, --- स्ट्वयं सहायता समूह (एसएचिी) का आिय ह ै 10 से 20 व्यजियों का छोटा अनौपचाठरक समूह, िो सामाजिक और आर्थवक पष्ठृ भूजम के संबंध में सिातीय ह ैं और सदस्ट्यों के बीच बचत की आदत को बढावा देने और समूह 6152 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सदस्ट् यों के लाभ के जलए संसाधन िुटाने और प्रबंजधत करन े के एक सामान्य उद्देश्य के जलए स्ट्वेच्छा से एक साथ आते ह।ैं तथाजप, पहाडी इलाकों या िेरों और मख्ु य रूप से आददवासी बाहुल् य िेरों में िहां समुदाय जबखरे हुए ह,ैं न्यूनतम 5 सदस्ट्यों के छोटे समूह भी स्ट्वयं सहायता समूहों (एसएचिी) में बनाए िात े ह।ैं ] 3. मानक जचह्न का अजनवाय व उपयोग - उि अनुसूची के कॉलम (2) म ें जनर्दष्टव सामान या वस्ट्तु उसके कॉलम (3) म ें जनर्दष्टव तदनरूप भारतीय मानक के अनरूु प होगी और भारतीय मानक ब्यूरो (अनरूु पता मूल्यांकन) जवजनयम, 2018 की अनुसूची-II की योिना-I के अनुसार भारतीय मानक ब्यूरो से लाइसेंस के तहत मानक जचह्न धारण करेगी। 4. प्रमाणन और प्रवतनव प्राजधकारी - भारतीय मानक ब्यरू ो उि अनुसूची – क और अनुसूची ख के कॉलम (2) म ें जनर्दष्टव सामानों या वस्ट्तओंु के संबंध में प्रमाणन और प्रवतवन प्राजधकारी होगा। 5. उल्लघं न के जलए िमु ानव ा - िो भी व्यजि, इस आदेि के प्रावधानों का उल्लंघन करता ह,ै वह भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) के प्रावधानों के अनसु ार दंडनीय होगा। अनसु चू ी-ए क्र.स.ं सामान या वस्ट्त एु ं भारतीय मानक(आईएस) भारतीय मानक का दक्रयान्व यन के जलए िीर्कव समयसीमा (1) (2) (3) (4) (5) 1 सेनेटरी नेपदकन आईएस 5405:2019 सेनेटरी नैपदकन - लघ ु और सक्ष्ू म उद्यमों जवजिष्टता (दसू रा (एसएमई) के जलए - संिोधन) 1 अक्टूबर 2024 2 बेबी डायपर आईएस 17509:2021 जडस्ट्पोिेबल बेबी डायपर – जवजिष्टता अन्य के जलए – 3 पुन: प्रयोज्य आईएस 17514:2021 पुन: प्रयोज्य सेनेटरी 1 अप्रलै 2024 सेनेटरी पैड पैड/सेनेटरी सेनेटरी नैपदकन नैपदकन/पीठरयड पैंटी - पीठरयड पैंटी जवजिष्टता अनसु चू ी-बी क्र.स.ं सामान या वस्ट्त एु ं भारतीय मानक(आईएस) भारतीय मानक का दक्रयान्व यन के जलए िीर्कव समयसीमा (1) (2) (3) (4) (5) मेडीकल टेक्स टाइल् स-िू कवसव - 1 अप्रलै , 2024 1 िू कवसव आईएस 17349:2020 जवजिष्टता मेडीकल टेक्स टाइल् स-डेंटल 2 डेंटल जबब/नेपदकन आईएस 17354:2020 जबब या नेपदकन- जवजिष्टता बेडिीट एवं जपलो मेडीकल टेक्स टाइल् स-बेड िीट 3 आईएस 17630:2021 कवर एवं जपलो कवर- जवजिष्टता नोट : अनुसूची – ए और अनसु ूची – बी के प्रयोिनों के जलए, यह स्ट्पष्ट दकया िाता ह ै दक भारतीय मानक ब्यरू ो द्वारा भारतीय मानक अजधजनयम, 2016 (2016 का 11) की धारा 2 के खंड (17) के प्रावधानों के अनुसार समय-समय पर स्ट्थाजपत और प्रकाजित भारतीय मानकों का नवीनतम संस्ट्करण, ऐसे प्रकािन की तारीख स े प्रवृत् त होगा। [फा. स.ं 6/1/2021-आरएंडडी (पाट-व 4)] रािीव सक्सेना, संयक्ु त सजचव[भाग II—खण् ड 3(ii)] भारत का रािपर : असाधारण 3 MINISTRY OF TEXTILES ORDER New Delhi, the 27th September, 2023 S.O. 4247(E).—In exercise of the powers conferred by sub-sections (1) and (2) of section 16 read with section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government is of the opinion that it is necessary so to do in the public interest and after consulting the Bureau of Indian Standards, hereby makes the following Order, namely:- 1. Short title and commencement. – (1) This Order may be called the Medical Textiles (Quality Control) Order, 2023. (2) It shall come into force immediately after such periods, as specified item-wise in column (5) of the Schedule - A and Schedule - B annexed to this Order, from the date of its publication in the Official Gazette. 2. Application. – This Order shall apply to goods or articles specified in column (2) of the said Schedules, but shall not apply to such goods or article meant for export and items specified in Schedule A to this order that are manufactured by Self Help Groups (SHGs). [Explanation. — For The purpose of This para, — Self Help Groups (SHGs) means small informal group of 10 to 20 individuals, who are homogenous with respect to social and economic background and come together voluntarily for promoting savings habit among members and for a common cause to raise and manage resources for the benefit of group members. However, in hilly tracts or regions and predominantly tribal dominated areas where communities are dispersed, smaller groups of minimum 5 members are also formed into Self Help Groups (SHGs).] 3. Compulsory use of Standard Mark. – The goods or article specified in column (2) of the said Schedule shall conform to the corresponding Indian Standard specified in column (3) thereof and shall bear the Standard Mark under a license from the Bureau of Indian Standards in accordance with Scheme – I of Schedule – II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. 4. Certifying and enforcement authority. – The Bureau of Indian Standards shall be the certifying and enforcing authority in respect of the goods or article specified in column (2) of the said Schedule - A and Schedule - B. 5. Penalty for contravention.– Any person, who contravenes the provisions of this Order, shall be punishable in accordance with the provisions of the Bureau of Indian Standards Act, 2016 (11 of 2016).
