3. का.आ. 3085(अ), तारीख 28 नवंबर, 2014 ; 4. का.आ. 383(अ), तारीख 4 फरवरी, 2015 ; 5. का.आ. 556(अ), तारीख 17 फरवरी, 2015 ; और 6. का.आ. 938(अ), तारीख 31 माच,(cid:29) 2015 ।¹Hkkx IIµ[k.M 3 (ii)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 25thJune, 2015 S.O. 1741(E).—The following draft of the notification which the Central Government proposes to issue, in exercise of the powers conferred by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Act, 1986, further to amend the notification of the Government of India in the erstwhile Ministry of Environment and Forest dated the 6th January, 2011 published in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (ii) vide S.O. 19(E), dated the 6th January, 2011, for the information of the public likely to be affected thereby and notice is hereby given that the said notification will be taken into consideration by the Central Government on or after the expiry of sixty days from the date of publication of the said notification in the Official Gazette. Objections or suggestions, if any, may be addressed to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jor Bagh Road, Aliganj, New Delhi – 110003 or be send electronically through email at bsinha92@gmail.com; The objections and suggestions, which may be received from any person with respect to the said draft of the notification before the expiry of the period specified above, shall be considered by the Central Government. Draft Notification In the notification of the Government of India in the erstwhile Ministry of Environment and Forests, dated the 6th January, 2011 published in the Gazetted of India, Extraordinary, Part II, Section 3, Sub-section (ii) vide S.O. 19(E), dated the 6th January, 2011 – (A) in paragraph 3, in sub-paragraph (iv), for item (a), the following item shall be substituted, namely:- “(a) required for setting up, construction or modernisation or expansion of foreshore facilities like ports, harbours, jetties, wharves, quays, slipways, bridges, sealink, road on stilt, road on reclaimed surface without affecting tidal flow of water, and such as meant for defence and security purpose and for other facilities that are essential for activities permissible under the notification: Provided that such roads shall not be taken as authorised road for permitting development on landward side of such roads till existing High Tide Line.”; (B) In paragraph 4, in sub-paragraph (i), after item (f), the following item shall be inserted, namely:- “(g) construction of road by way of reclamation in Coastal Regulation Zone area shall be only in exceptional cases, to be recommended by the concerned Coastal Zone Management Authority and approved by the Ministry of Environment, Forest and Climate Change; and in case the construction of such road is passing through mangroves or likely to damage the mangroves, three times the number of mangroves destroyed or cut during the construction process shall be replanted.”.
