(48 of 1956) read with the Rule (3) of the National Highways Fee (Determination of Rates and Collection)
Rules, 2008, the Central Government by notification no. S.O. 1098 dated 24.04.2015 of the Government of
India authorized Authority for levying and collecting fee on mechanical vehicles for use of four lane section
from km 342.000 to km 358.750 (Edapally – Vytilla - Aroor Section) of National Highway No. 66 (formerly
as NH-47) in the State of Kerala under transition from Fee Rules 1997 to Fee Rules 2008 as amended.
And whereas, pursuant to the provision of section 14 of the National Highways Authority of India
Act, 1988 (68 of 1988), the Authority has entered into an Agreement on April 28, 2015 (hereinafter referred
to as “said agreement”) with M/s Kochi Aroor Tollways Private Limited, having registered office at Aqua
Point, Old A.B. Road Umaria, Mhow-453446, Madhya Pradesh, India (hereinafter referred to as the
“Concessionaire”), for the bids submitted on 26.02.2015 for the Operation & Maintenance of Edapally –
Vytilla – Aroor section from km 342.000 to km 358.750 on National Highway No. 66 (formerly as NH-47) in
the State of Kerala (hereinafter referred to as the “said section”) on Operate, Maintain and Transfer (OMT)
basis.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act,
1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection)
Rules, 2008 published vide G.S.R. 838(E) dated 5th December, 2008 and amended vide G.S.R 950(E) dated
3rd December, 2010, G.S.R 15(E) dated 12th January, 2011, G.S.R 756(E) dated 12th October, 2011, G.S.R
778(E) dated 16th December, 2013, G.S.R 26(E) dated 16th January, 2014 & G.S.R. 831(E) dated 21st
November, 2014 (hereinafter referred to as the “ said Rules”) and in supersession of the notification number
S.O. 1098 (E) dated 24.04.2015, except as respects things done or omitted to be done before such
supersession, the Central Government, having regard to the expenditure involved in building, maintenance,
management and operation of the said section, interest on the capital invested, reasonable return, the volume
of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby
notifies that there shall be levied and collected fees on mechanical vehicles for the use of four or more lane of
the said section having net road length of 15.113 km and for 16.370 km equivalent length of structure (having
1.637 km of structure length of more than 60 m length) at the rates specified in columns (2) of the Table 1
(hereinafter referred to as “base rate”) on the Type of Vehicles specified in column (1) of the Table 1 below,
and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial
operation declared by the Authority or publication of this notification in the Official Gazette, whichever is
later, till the termination date as per the said agreement;

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza, at the
base rates specified in Table 1 above, for the distance specified for such Toll Plaza:

2. In addition to above, the following fee shall also be due and payable for the use of the following
structures having length more than 60m at the following Toll Plaza(s), by converting the length of structures
into an equivalent length of highway by multiplying the length of such structures by an equalization factor of
10:

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial
purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 230.00 (Rupees Two
Hundred Thirty only) for the year 2015-16, and is subject to revision every year as per the provisions of the
National Highways Fee (Determination of Rates and Collection) Rules, 2008.
4. For multiple journey on the highway section, passes shall be issued at the following rates, namely:

5. Fee for commercial vehicle (excluding vehicles plying under national permit) registered in the district
where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service
road or alternative road is available for use of such commercial vehicle.
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the
Rules, shall not be permitted to use the National Highway or crossing the Toll Plaza until the excess load has
been removed from such mechanical vehicle. The driver or owner or a person in charge of such overloaded
mechanical vehicle shall be liable to pay fee, for entering the overloaded vehicle on the National Highway to
the Toll Collecting agency, equal to 10 times of the fee applicable to such category of mechanical vehicles

7. All definitions including category of mechanical vehicles, its permissible load, category of exempted
vehicles, service road, alternative road etc. shall be as per definitions specified in the said Rules.
8. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said
Rules.
9. The increase in the actual amount of user fee to be charged from the mechanical vehicles shall in no
case be more than 25% of the fee applicable in the immediately preceding year.
10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the
actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the
Authority. The same shall be got published by the Authority in at least one newspaper, each in English and
vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5
of the said Rules and provisions of the Concession Agreement and will be published provided, that no
revision shall be effected within a period of 6 (six) months from the date of the preceding revision of fee.
11. The Capital Cost of the Project to be recovered from the date of COD is Rs. 154.99 Crore. From the
Commercial Operations Date (COD) toll shall be collected by the Concessionaire at the applicable rates
provided under National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide
G.S.R. 838(E) dated 5th December, 2008 and further amended till bid due date. After the day on which the
Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of the rate being charged.
