* आवेदि की गई मात्रा का जववरण (मदवार और दिे वार), लदाि का पत्ति और प्रस्ट्ताजवत लदाि अिुसूची; * पुजि दकए गए जियावत आदेिों/अिुबंधों की प्रजतयां, िहाूँ भी उपलब्ध हो, * गेह ूँ (घरेलू) की उपलब्धता, पीडीएस/ स्ट्टॉक-सीजमत चिै लों स े कोई जवचलि िहीं, और सभी लाग ू कािूिों के अिुपालि के संबंध म ेंस्ट्वघोषणा। * ईओय/ू एसईिेड//एए धारक के मामले म ें आयजतत गेह ूँ की उपलब्धता का जववरण, साथ ही एए धारक के मामले म ेंअजिम प्राजधकार पत्र का जववरण।[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 3 * एक वैध सीए प्रमाण-पत्र िो आवेदक के जपछल े पाूँच जवत्तीय वषों के कुल टिओव वर को प्रमाजणत करता हो, िहाूँ भी लाग ू हो। (च) आवदे ि के जलए पात्रता मािदंड: आवेदि करत े समय आवेदक को जिम्नजलजखत पात्रता मािदंडों को परू ा करिा होगा, िैसे: * अधरू े आवेदि या ई-मले या डाक द्वारा प्राि आवेदि पर जवचार िहीं दकया िाएगा। * रेड किेक्ट ई-प्लेटफाम व (www.trade.gov.in) पर सोसव फॉम व इंजडया सुजवधा पर सूचीबध्द करि े के जलए पात्र सभी आवेदकों को यह सुजिजित करिा होगा दक वे प्लटे फाम व पर सूचीबध्द ह,ै ऐसा ि करि े पर उिके आवेदि पर दकसी भी आवंटि के जलए जवचार िहीं दकया िाएगा। * दकसी भी गलत घोषणा करिे के मामल े में, आवेदक पर अगल े तीि वषों तक दकसी भी आवंटि के जलए जवचार िहीं दकया िाएगा। (छ) अहस्ट्तातं रणीय: प्राजधकार पत्र पूरी तरह स े अहस्ट्तांतरणीय होंगे और इिका उपयोग केवल आवंटि आइईसी धारक द्वारा ही दकया िाएगा। 1.1. 2500 मीठरक टि स े कम मात्रा के जियावत के आवेदि पर आवंटि के जलए जवचार िहीं दकया िाएगा। 1.2 ये कायवरीजतयां एचएस कोड 1101 के तहत आि े वाले गेह ूँ के आटे और संबंजधत उत्पादों के जियावत पर लाग ू होंगी, िो उपयिुव अजधसचू िा के माध्यम स े बिाई गई क्ांठटटेठटव ववंडो के तहत ‘घरेल ू गेह’ूँ का उपयोग करके भारत म ें जवजिर्मवत दकए गए ह।ैं 1.3 अजधसूचिा स.ं 39/2015-20 ददिांक 14 अिूबर, 2022 के अिुसार अजिम प्राजधकार पत्र के तहत या ईओयू या एसईिडे इकाइयों द्वारा केवल आयाजतत गेह ूँ का उपयोग करके गेह ूँ के आटे का जियावत उस अजधसूचिा द्वारा जियंजत्रत होगा और अजधसूचिा स.ं 55 ददिांक 16 ििवरी, 2026 के तहत अिुमत जियावत हते ु िहीं जगिा िाएगा। 2. आवटं ि तत्रं और आवं टि/पिु : आवटं ि के मािदंड: प्रत्येक आवेदि हते ु अिुमत जियावत की मात्रा इस उद्देश्य के जलए गठित एक जविषे एजक्सम सुजवधा सजमजत (ईएफसी) द्वारा तय की िाएगी। 2.1 इस संबंध में जविेष ईएफसी की बैिक सामान्यत: महीिे म ेंएक बार होगी। 2.2 आवेदिों की िांच करते समय, जविेष ईएफसी अन्य बातों के साथ-साथ जिम्नजलजखत मािंदडों को ध्याि म ें रखेगा, िैस े :- * आवेदक का पूव व जियावत इजतहास; * जवजिमावता जियावतक या सहायक जवजिमावता (ओं) की प्रसंस्ट्करण िमता, िैसा भी मामला हो; * व्यापारी जियावतक और सहायक जवजिमावता (ओं) के बीच वैध अिुबंधों का अजस्ट्तत्व। 2.3 जविेष ईएफसी के पास दकसी आइईसी धारक को आवंठटत मात्रा को दकसी अन्य आवेदक को पुि: आवंठटत करि े का अजधकार भी होगा, िो ऐसे अइईसी धारक के जिष्पादि की आवजधक समीिा पर आधाठरत होगा। 3. ठरपोर्टिंग की ित:व जिि जियावतकों को एचएस कोड 1101 के तहत गेह ूँ के आटे और संबंजधत उत्पादों का कोटा आंवांठटत दकया गया ह,ै आंवठटत कोटा के तहत जियावत की खेप पूरी होिे के 30 ददिों के भीतर जविेष ईएफसी के जवचाराथ व sefc-wheatflourdgft@gov.in पर ई-मले द्वारा लैंजडग प्रमाणपत्र प्रस्ट्तुत करिा होगा। अजतठरि दस्ट्तावेिों की आवश्यकता होिे पर जविेष ईएफसी द्वारा जियावतक को सूजचत दकया िा सकता ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] इस साविव जिक सचू िा का प्रभाव: समय-समय पर यथा संिोजधत अजधसूचिा संख्या 55 ददिांक 16 ििवरी, 2026 के अतं वगत अजधसूजचत आइटीसी एचएस कोड 1101 के तहत गेह ूँ के आटे और संबंजधत उत्पादों के जियावत हते ु प्राजधकार पत्रों के जलए आवेदि आमंजत्रत दकए िाएंगे और इस सावविजिक सूचिा म ें उजल्लजखत कायवरीजतयों के अिुसार उि पर कारववाई की िाएगी। लव अिवाल, महाजिदिे क जवदिे व्यापार एव ं पदेि अपर सजचव MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) Directorate General of Foreign Trade Vanijya Bhawan PUBLIC NOTICE New Delhi, the 16th January, 2026 No. 44/2025-26 Subject: Modalities for export of Wheat Flour and related products under HS Code 1101 – regarding. F. No. 01/91/180/032/AM22/Pt. I/EC/E-32553.—In exercise of powers conferred under paragraph 1.03 and 2.04 of the Foreign Trade Policy, 2023, the Directorate General of Foreign Trade hereby notifies the following modalities for eligibility, receipt and processing of applications for issuance of authorizations for export of wheat flour and related products under HS Code 1101 as notified by the Government of India vide Notification No. 55/2025-26 dated January 16, 2026, as amended from time to time: 1. Submission of Applications: (a) Online Applications: All applicants seeking export authorization may apply online by navigating to the DGFT website (https://www.dgft.gov.in)-> Services-> Export Management Systems-> License for Restricted Exports. (b) Time-period for filing online applications: The first set Applications shall be invited during January 21, 2026 to January 31, 2026. Thereafter, the applications shall be invited during the last ten days of each month till such time the quantity of export permitted vide the aforesaid notification, as amended from time to time, are available. (c) Validity: The Export Authorization shall be valid for a period of six months from the date of its issuance. Any request for extension of the validity period shall be considered by the special EFC, as constituted in terms of Para 2 of this Public Notice, on a case-by-case basis. (d) Eligible exporters: The following categories of entities shall be eligible to apply: • Flour mills/processing units having valid IEC and FSSAI licence for manufacture of wheat flour and related products falling under HS Code 1101, functioning as manufacturer exporters; • Merchant exporters having valid IEC and FSSAI license as well as valid tie-ups / supply agreements with flour mills functioning as supporting manufacturer(s); • EOUs / SEZ units / Advanced Authorisation (AA) holders seeking allocation over and above their existing imported wheat entitlements. (e) Required documents: The following documents shall inter alia be submitted by the applicant at the time of filing the application, namely:- • Valid IEC. • Category of exporter (manufacturer exporter / merchant exporter / EOU / SEZ / AA holder). • Details of the Status Holder Certificate/AEO. • Installed capacity and average monthly production of wheat flour/related products in the case of manufacturer exporter or the supporting manufacturer (s), as the case may be.[भाग I—खण् ड 1] भारत का रािपत्र : असाधारण 5 • Details of the FSSAI license and the factory address of the manufacturer, exporter or the supporting manufacturer (s), as the case may be. • Details of the FSSAI license of the merchant exporter, wherever applicable. • Past export performance (including in the three years prior to the Financial Year in which the item was prohibited), wherever available; • Details of quantity applied for (item-wise and country-wise), port(s) of loading, and proposed shipment schedule; • Copies of confirmed export orders/contracts, wherever available, • Self-declaration regarding availability of wheat (domestic), no diversion from PDS/stock-limited channels, and compliance with all applicable laws. • Details of imported wheat availability in case of EOU/SEZ/AA Holder, as well as details of Advance Authorisation in case of AA Holder. • A valid CA certificate certifying the overall turnover of the preceding five financial years of the applicant, wherever applicable. (f) Eligibility Criteria of Applications: The applicant shall be required to meet the following eligibility criteria while submitting the applications, namely: • Deficient applications or applications received through e-mail or by post will not be considered. • All applicants eligible for listing on the ‘Source from India’ facility on the Trade Connect ePlatform (www.trade.gov.in) shall ensure that they are listed on the platform, failing which their application shall not be considered for any allocation. • In case of any misdeclaration, the applicant shall not be considered for any allocation for the next three years. (g) Non-transferability: Authorizations shall strictly be non-transferable and must be used by the allottee IEC holder only. 1.1. Applications seeking exports for quantities less than 2500 MT shall not be considered for allocation. 1.2. These modalities shall apply to exports of wheat flour and related products falling under HS Code 1101, which have been manufactured in India using “domestic wheat” under the quantitative window created vide the aforesaid Notification. 1.3. Exports of wheat flour under Advance Authorisation or by EOUs or SEZ units using only imported wheat in terms of Notification No. 39/2015-20 dated October 14, 2022, are governed by that Notification and shall not be counted against the export allowed vide Notification No. 55 dated January 16, 2026. 2. Allocation mechanism and criteria of allocation/re-allocation: The quantity of exports permitted against each application shall be decided by a Special Exim Facilitation Committee (EFC) constituted for this purpose. 2.1. The Special EFC shall ordinarily meet once every month in this regard. 2.2. The Special EFC shall, while examining the applications, inter alia, take into consideration the following criteria, namely:- • Previous export history of the applicant; • Processing capacity of the manufacturer exporter or the supporting manufacturer(s), as the case may be; • Existence of valid contracts between the merchant exporter and the supporting manufacturer(s). 2.3. The Special EFC shall also have the authority to re-allocate the quantity allocated to an IEC holder to another applicant, based on periodic review of the performance of such IEC holder. 3. Reporting condition: The exporters who have been allocated the quota of wheat flour and related products under HS Code 1101 shall submit the landing certificate within 30 days of completion of export of the consignment within the allocated quota for the consideration of the Special EFC at the e-mail id sefc- wheatflour-dgft@gov.in.
