The said Guidelines provided a regulatory framework for State Governments to issue licences and regulate aggregators in the road transport sector. Since 2020, India’s shared mobility ecosystem has undergone rapid and significant change. The rise in demand for diverse and flexible mobility solutions including bike-sharing, introduction of electric vehicles (EVs), and auto-rickshaw rides, has widened the consumer base. As the travel preferences evolve, aggregators have expanded their services to meet these new demands through innovative models. The Motor Vehicle Aggregator Guidelines 2020 have been revised to keep the regulatory framework up to date with the developments in the motor vehicles aggregator ecosystem. The new guidelines attempt to provide a light-touch regulatory system while attending to issues of safety & security of the user and the welfare of the driver. State Governments may adopt these revised guidelines within three (3) months from date of their issue and may include provisions in addition to the ones specified herein. 2 Motor Vehicle Aggregator Guidelines 2025Who this report might be relevant 3 Motor Vehicle Aggregator Guidelines 2025Motor Vehicles Aggregator Guidelines 2025 1. Definitions 1.1 In these Guidelines, unless the context otherwise requires,- i) “Act” means the Motor Vehicles Act, 1988. ii) "Aggregator" shall have the meaning ascribed to it under sub section (1A) of Section 2 of the Act. iii) "App" means a digital application developed and maintained by an aggregator. iv) “Application fee” means the charges in respect of an application under Clause 4 of these guidelines. v) “Apportioned Fare” means such part of the fare as is retained by the aggregator. vi) "Competent Authority" means such authority of the State Government to issue licence under Section 93 of the Act. vii) "Contract" means the agreement between the aggregator and the driver specifying the rights and obligations of both parties for providing services to a passenger through the App of such aggregator. viii) “Designated Portal” means the portal established and notified as such under Clause 3 of these guidelines. ix) “Driver Fare” means such part of the fare payable by aggregator to the driver for the services rendered to the passenger through the App in undertaking a journey, including any cost of toll(s) and parking fee(s) paid by the driver. x) "Dynamic pricing" means the output of the fare algorithm of the fare of the aggregator, which raises the price of a journey when demand for trips exceeds supply of. xi) "Fare" means the total charges payable by the passenger to the driver or the aggregator, as the case may be, pursuant to the passenger availing the transportation services on the aggregator platform through the App for a journey, including the cost of toll(s), the tax(es) and parking fee(s), as may be applicable. xii) "Form" means a form appended to these guidelines. 4 Motor Vehicle Aggregator Guidelines 2025xiii) “Grievance Officer” means a person appointed by the aggregator for redressal of grievance of any passenger or driver. xiv) “Induction Training Programme” means the induction training program referred to in Clause (10) of these guidelines. xv) “Journey” means a trip whether undertaken or not, on a specified date and time from the place of departure, to the destination, and may include the type or class of the motor vehicle being used to undertake the travel plan. xvi) "Licence" means the licence issued to an aggregator under Section 93 of the Act. xvii) “Licence Fee” means the fee payable under Clause 5 of these guidelines. xviii) "On-Board" together with its grammatical variations, means the process of registering drivers and vehicles on the digital platform by the aggregator. xix) "Off-Board" together with its grammatical variations, means the process of deregistering the driver and vehicle on the digital platform by the aggregator. xx) "Passenger" means a person who uses the app of the aggregator to undertake a journey. xxi) "Rating" means an assessment of the quality of a journey undertaken by a passenger, basis the parameters specified by the aggregator. xxii) "Refresher Training Programme and Assessment" means a training session for drivers integrated with the aggregator, for a period of at least forty eight (48) hours and for a duration of 10 hours in one continuous session, delivered in-person and in virtual training sessions. xxiii) "Security Deposit" means the amount that is payable by an aggregator, to be submitted along with licence fee, furnished in the form of a bank guarantee or an insurance surety bond. 1.2 Words and expressions as defined and mentioned under these guidelines shall have the same meaning as ascribed under the Act. 5 Motor Vehicle Aggregator Guidelines 20252. Applicability of the Guidelines 2.1 The applicability of these guidelines extends to any aggregator operating within a State. 2.2 These guidelines shall not be applicable to entities that limit themselves to the provision of an interoperable network to aggregators licensed by the Competent Authority and do not directly undertake onboarding of drivers or motor vehicles or both. 2.3 These guidelines shall not be applicable to entities that are engaged in the sale of tickets for travel by public service vehicles. 3. Designated Portal by the Central Government The Central Government shall develop and designate a portal to enable for single window clearance of application for licence as aggregator including receipt of appropriate application fee, license fee and security deposit: Provided that till such time this portal is developed and operationalized, the State Governments shall process applications for license, in accordance with the extant guidelines. 4. Application for grant or renewal of Licence and matters connected therewith 4.1 An application for grant of Licence shall be made on the designated portal under clause 3 above, in Form I, by any person eligible under the criteria mentioned under clause 8 below. This application shall be accompanied by proof of online payment of an application fee, as may be determined by the State Government by way of a notification. 4.2 One application shall be made by an aggregator for all or any types or classes of motor vehicles on-boarded by it. 4.3 One licence shall be granted by the Competent Authority for issue of the Licence throughout the territorial jurisdiction of the State. 4.4 An application made under sub-clause (4.1) shall be decided by the Competent Authority within a period of ninety (90) days from the date of such application in Form I. 4.5 If the applicant does not comply with any of the conditions for grant of licence specified under these guidelines, as may be determined by the Competent Authority, he may reject such application with reasons to be recorded in writing after giving a hearing to the aggregator. 6 Motor Vehicle Aggregator Guidelines 20254.6 On being satisfied that the applicant has complied with all the conditions specified for grant of a licence under these guidelines, the Competent Authority shall direct the applicant to pay the appropriate licence fee and security deposit within a period of thirty (30) days. 4.7 On payment of the licence fee and security deposit, the Competent Authority shall grant a licence to the applicant in Form III appended to these guidelines, within the period of fifteen (15) days from the date of payment. 4.8 The licence issued by the Competent Authority under these guidelines shall be uploaded and updated by the Competent Authority on the designated portal. 5. Licence fee The licence fee payable by the aggregator shall be as follows: Sr. Particulars Amount in Rupees No. 1. Grant of Licence to aggregator 5,00,000 2. Renewal of Licence 25,000 3. For noting change of address of the licencee 25,000 6. Security Deposit The security deposit to be provided by the aggregator shall be as follows: Sr. Particulars Amount in Rupees No. 1. Up to 100 buses or 1000 other motor vehicles 10,00,000 2. Up to 1000 buses or 10000 other motor vehicles 25,00,000 3. More than 1000 buses or 10000 other motor 50,00,000 vehicles 7. Validity of Licence, its renewal and matters connected therewith 7.1 A licence shall be valid for a period of five (5) years from the date of its issue. 7.2 Pursuant to an application in Form II, appended to these guidelines, a Licence may be renewed by the Competent Authority, for a period of five (05) years, subject to compliance with conditions for renewal. For the purposes of such renewal, the Competent Authority shall examine: i) the aggregator’s records of compliance with these guidelines, and 7 Motor Vehicle Aggregator Guidelines 2025ii) the punitive actions taken against the aggregator, in the State where application is made. 8. Eligibility for obtaining a Licence 8.1 The applicant shall be a company registered under the Companies Act, 2013 or a limited liability partnership under the Limited Liability Partnership Act, 2008 or a co-operative society formed by an association of drivers or motor vehicle owners and registered under the Co-operative Societies Act, 1912. 8.2 The applicant shall comply with the applicable law, including but not limited to, the Act or rules and regulations made under the Act, the Digital Personal Data Protection Act, 2023, the Consumer Protection Act, 2019 and the Information Technology Act, 2000 and intermediary guidelines issued thereunder. 9. Conditions for Grant of Licence An aggregator submitting an application for obtaining a licence shall ensure compliance with the following: 9.1 The aggregator shall conduct or cause to be conducted an Induction Training Programme as detailed under Clause 10 before on-boarding a driver and also for those drivers on-boarded prior to issuance of these guidelines. 9.2 The aggregator shall provide a written intimation of the commencement of services to the Competent Authority and the same shall be updated within a period of six (6) months from the date of grant of Licence, failing which the Licence may be cancelled by the Competent Authority. 9.3 Seventy two (72) hours prior to commencement of services, the aggregator shall intimate the competent authority, and the said intimation shall be uploaded on the designated portal by the competent authority. 9.4 The guidelines, if any, issued by the Central Government or the respective State Government in respect of health or public safety shall be followed by the aggregator and the on-boarded drivers. 9.5 The aggregator shall ensure a minimum amount of Rs. 5 Lakh as insurance for passenger. 9.6 The aggregator shall not prohibit or restrict the on-boarded drivers from operating with multiple aggregators. 8 Motor Vehicle Aggregator Guidelines 20259.7 The aggregator shall develop a mechanism in the App for both, the driver and the passenger, to rate the quality of overall experience of a journey. 9.8 The aggregator shall permit a motor vehicle with a valid contract carriage permit and willing to get on-boarded, to be on-boarded with the aggregator, subject to compliance with the relevant clauses of these guidelines. 9.9 The aggregator should not have had its license cancelled in the past one year. 9.10 A Grievance Officer shall be appointed by the aggregator who shall resolve all the grievances received and provide the details of the grievances received by it, to the Competent Authority through an online process. The details of the Grievance Officer i.e. the name, e-mail address, and telephone number(s) shall be made available by the aggregator on its App and website. 10. lnduction Training Programme 10.1 The lnduction Training Programme shall be of a duration of at least forty (40) hours for the drivers comprising a combination of in-person and virtual training sessions. The broad details of the course of this program shall be made available online by the aggregator. The course shall train the drivers: i) to use the App of the aggregator; ii) the relevant provisions of the related Acts and rules; iii) Motor Vehicles (Driving) Regulations 2017; iv) first responder training for at least six (6) hours to respond to emergencies and provide assistance in case of road accidents; v) on careful driving, traffic rules, motor vehicle maintenance, fuel efficient driving, conduct and behavior; vi) on familiarization with the routes; vii) on the terms and conditions of the agreement between the driver and the aggregator; viii) special training on gender sensitivity and Divyangjan sensitivity and mobility needs; ix) such other training as the State Government may require. 10.2 The aggregator shall upload details of the induction training structure on the designated portal. 9 Motor Vehicle Aggregator Guidelines 202511. Compliances with regard to drivers 11.1 For the purposes of on-boarding drivers, the aggregator shall ensure that the following conditions are complied with, namely: i) That the driver holds a valid proof of any identity on the basis of any document listed under Rule 4 of the Central Motor Vehicle Rules, 1989 (“CMVR”); ii) That the driver holds a valid driving licence for the concerned vehicle type or class within which the respective vehicle falls throughout the period of onboarding; iii) That the driver has the required experience mandated under sub- section (1) of section 7 of the Act; iv) That the driver has a valid bank account in his name; v) That the driver has not been convicted within the past three (3) years, for any of the following offence, namely: (i) the offence of driving under the influence of drugs or alcohol, and (ii) any cognizable offence under the Bharatiya Nagarik Suraksha Sanhita, 2023 and the Bharatiya Nyaya Sanhita, 2023 (as may be applicable) including fraud, sexual offences, use of a motor vehicle to commit a cognizable offence, a crime involving property damage or theft, acts of violence, acts of terror or acts constituting nuisance or danger to public; vi) That the driver undergoes a medical examination for fitness, including an eye check-up, by a hospital or medical institution identified by the aggregator; vii) That the driver undergoes a psychological analysis conducted by the aggregator to determine whether they are fit to be on-boarded; viii) That the character and antecedents of the driver are verified by the Police at least seven (7) days prior to on-boarding and the aggregator shall maintain a written record of such verification; ix) That a valid contract is executed between the aggregator and the driver, including in the language of the State, specifying the terms and conditions applicable for on-boarding and operating vehicles. The standard terms and conditions shall be made available online by the aggregator on its website. Provided that the compliance with above conditions for the entire period shall be co-terminus with the licence held by the aggregator. 10 Motor Vehicle Aggregator Guidelines 202511.2 For the welfare of drivers, the aggregator shall ensure compliance with the following conditions, namely: i) Ensure a health insurance for not less than Rs. 5 Lakh for each driver on-boarded, which shall be increased each year by such percentage each driver as notified by the Central Government. ii) Ensure a term insurance for not less than Rs. 10 Lakh for each driver on-boarded, which shall be increased each year by such percentage as notified by the Central Government. iii) Provided that the provisions made under Social Security Code, 2020 will prevail upon being notified and implemented with respect to sub-clause (i) and sub-clause (ii) above. iv) Conduct annual Refresher Training Programme as a combination of in-person and virtual training sessions through either in-house resources or collaboration with other institutions and maintaining the records of such refresher training. v) Provided that the drivers whose rating falls below 5 percentile from amongst all drivers who are placed similarly in terms of the duration of engagement with the aggregator, shall compulsorily undergo Refresher Training Programme every quarter, in absence of which the driver shall not continue to provide services through the aggregator. vi) In the event a complaint is registered against the driver for violation of provisions of the Act, rules or these Guidelines, from a passenger, an inquiry is conducted by the aggregator within a period of three (3) days from the day on which such complaint is made and appropriate action against the driver is only taken after completion of such inquiry. The aggregator shall inform the passenger of outcome of the said inquiry upon its completion. 11.3 The aggregator shall maintain a digital record of the following documents pertaining to the on-boarded drivers, duly authenticated from SARATHI portal and such other documents as the aggregator may deem fit, including i) A photograph; ii) Physical copy of the Driving licence; iii) Present residential address along-with acceptable documents for proof of address as specified in CMVR; iv) Verified bank account details; 11 Motor Vehicle Aggregator Guidelines 2025v) Names and addresses with contact information of two emergency contacts. 12. Permit The aggregator shall ensure that all the motor vehicles attached with on- boarded drivers have an appropriate permit under applicable provisions of the Act. 13. Compliances with regard to vehicles 13.1 An aggregator shall ensure that the motor vehicles attached with on- boarded drivers comply with the following conditions: i) Have a valid registration; ii) Have a valid Certificate of Fitness as per the Act; iii) Display the registration mark as specified in the CMVR; iv) Have a valid third-party insurance policy; v) Have a valid pollution-under-control certificate required under the Central Motor Vehicles Rules, 1989. vi) Such emission norms as may be specified by the State Government for the State or any urban area in the State, as the case may be; vii) City specific fuel norms; viii) Have paid the applicable motor vehicle taxes and other dues; ix) Does not have any unpaid challans related to offences and contraventions under the Act imposed on the motor vehicle; x) Display a copy of driver’s licence and the motor vehicle permit (if applicable) inside the motor vehicle (except motorcycles). The said display shall be on the back side of the front seat next to the driver in such manner as shall be clearly visible to the passengers in the motor vehicle; xi) Are fitted with a functional Vehicle Location Tracking Device or System, compliant with AIS 140, along-with a panic button, as mandated under Rule 125H of the CMVR and connected to the control room of the aggregator with the electronic feed from vehicle location tracking device available at integrated command and control centre established by the State/ UT Government; xii) Have disabled child lock mechanism (except for three-wheelers, motorcycles and buses) as per applicable law; 12 Motor Vehicle Aggregator Guidelines 2025xiii) Have enabled manual override for the central locking system (except for three-wheeled vehicles, motor cycles, buses, as per applicable law); xiv) Have a fire extinguisher of suitable capacity placed inside the motor vehicle (except for motor cycles); xv) Have a first-aid kid placed inside the motor vehicle. 13.2 An aggregator shall not onboard vehicles which have been registered for more than a period of eight years from the date of initial registration of the vehicle and shall ensure that all vehicles onboarded by it should not have exceeded eight years since the date of initial registration of the vehicle. 13.3 An aggregator shall verify and maintain the following documents and records of all motor vehicles on-boarded by it and shall authenticate this data on a real-time basis on the VAHAN portal: i) Certificate of Registration; ii) Certificate of Fitness as per the Act; iii) Chassis and engine numbers; iv) Third-party insurance policy; v) Pollution-under-control certificate; and vi) The number of pending e-challans prior to on-boarding and their clearance before on-boarding. 14. Compliance with regard to Website, App and technology 14.1 The aggregator shall develop and maintain a website disclosing details of its ownership, registered address, fare structure, contact information for customer services, e-mail address, services offered by it and other relevant details. 14.2 The App shall be developed in a manner that it is compliant with the applicable law. 14.3 The App shall be accessible in English, Hindi, along-with the official language of the State/ UT where the official language is not Hindi. 14.4 The vulnerabilities and the cyber safety of the App of the aggregator shall be certified by a cyber security firm recognised and empaneled by CERT-In. 14.5 The data, including but not limited to, the details of journey, details of passengers and the fare, shall be generated on the App of the aggregator 13 Motor Vehicle Aggregator Guidelines 2025and stored as per the applicable law, including the Digital Personal Data Protection Act, 2023. 14.6 The proportion of the share of the fare and incentives provided to the driver, particulars of the driver fare and apportioned fare and other information as may be notified by the State Government, shall be ensured by the aggregator through up-to-date disclosures on its website and in the App. 14.7 The App shall include a feature enabling the passengers to share their live location and status of the journey till the journey is completed whereafter the live location sharing feature shall be unavailable. 14.8 The App shall include special features which make it accessible for Divyangjans. 14.9 The App shall display a clear and high-resolution picture of the driver on- boarded on the App of the aggregator. 14.10 The aggregator shall formulate and implement a zero-tolerance policy for use of drugs or alcohol for on-boarded drivers while they are on duty. The aggregator shall upload its policy and the procedure to report a complaint in this regard on their website and on their App. The aggregator shall immediately and forthwith Off-Board the driver upon receipt of a complaint alleging violation of its zero-tolerance policy pending inquiry. The suspension shall continue during the period of investigation by the aggregator. 14.11 The contact information of the driver undertaking journey shall be available to the passenger, through the App, for at least seven (7) days from the end of the journey; 14.12 The aggregator shall establish a control room with 24x7 operations and ensure that all the motor vehicles onboarded maintain an uninterrupted contact with the control room. The control room shall monitor the movements of motor vehicles and the on-boarded drivers. 14.13 Aggregator shall establish a call centre with an active telephone number and e-mail address, displayed clearly on its website and on the App, which shall be operational 24x7, providing assistance in English and along-with the official language of the State. These call centres shall be responsible for: i) enabling the passenger and/or the driver or any other person to contact the call centre regarding issues related to the journey or the on-boarded driver etc.; ii) ensuring redressal of the passenger grievances. 14 Motor Vehicle Aggregator Guidelines 202514.14 The aggregator shall cooperate with lawfully authorised authorities investigating an accident or incident involving motor vehicle or driver on-boarded by the aggregator. 15. Compliances to ensure safety of passengers The aggregator shall ensure compliance with the following conditions related to safety of the passengers, namely: 15.1 that the Vehicle Location and Tracking Devices installed in motor vehicles, as applicable, functions properly and the feed is received by it as well as linked to the integrated Command and Control Centre of the State Government. Explanation: For the purposes of these guidelines, Vehicle Location Tracking Devices shall include the in-App location tracking for all motor vehicles, including motorcycles and three-wheelers. 15.2 that the driver follows the route indicated in the App. through an in-built mechanism and in case of any deviation, the App shall signal the control room, which shall then connect with the driver and the passenger immediately. 15.3 that the safety of the passengers especially children, women and divyangjan passengers and compliance with the applicable law is ensured. 15.4 that a mechanism is provided on the App to verify whether the identity of the driver undertaking a journey is same as the one registered and verified by Police during the on-boarding process. 15.5 that regular checks by personnel authorized by the aggregator of motor vehicles on-boarded are conducted. 16. Non-discrimination policy to be followed by the aggregator The aggregator shall treat the motor vehicles owned by drivers on-boarded or any third party providing motor vehicles to such on-boarded drivers, at parity with the motor vehicles owned by it. 17. Regulation of Fare 17.1 The fare notified by the State Government for the respective category or class of motor vehicles, shall be the base fare chargeable to passengers availing services from the aggregator. 17.2 The base fare chargeable shall be for a minimum of three (3) kilometers to compensate for dead mileage including the distance travelled without a 15 Motor Vehicle Aggregator Guidelines 2025passenger and the distance travelled and fuel utilized for picking up the passenger(s). 17.3 The aggregator shall be permitted to charge a minimum of 50% lower than the base fare and a maximum dynamic pricing of two times the base fare specified under sub-clause (17.1) above. 17.4 The driver onboarded along-with the motor vehicle with the aggregator shall receive at least 80% of the fare applicable including all cost under driver’s fare and the remaining charges may be retained as the Apportioned Fare by the aggregator. The payment may be settled daily, weekly or fortnightly but not later as per the agreement between the driver and the aggregator. 17.5 With respect to motor vehicles owned by the aggregator the on-boarded driver shall receive at least 60% of the fare applicable, including all costs specified in Driver Fare and the remaining charges shall be retained as the Apportioned Fare. 17.6 With respect to any other scenario not covered under sub-clause (17.4) or (17.5) above, the driver shall receive the payment as per his agreement with the aggregator. 17.7 In States where the fare has not been determined by the State Government, the base fare may be notified to the State Government by the aggregator for the purposes of fare regulation and shall be followed till such time as the State Government determines the fare. Similarly, fixation for other classes of vehicles, permitted for aggregation in the State, shall be done by the State Government. 17.8 No passenger shall be charged for dead mileage except when the distance for availing the ride is less than three (3) kilometres as mentioned under sub-clause (17.2) above and the fare shall be charged only from the point of origin of the journey to the point of destination where the passenger is dropped off. 18. Cancellation of Rides 18.1 On cancellation of a booking by a driver after accepting a journey on the App, a penalty of 10% of the Fare not exceeding Rs. 100, shall be imposed where such cancellation is made without a reason identified as valid by the aggregator and duly and specifically mentioned on its website and App. 18.2 On cancellation of a booking by passenger after booking a journey on the App, a fee of 10% of the fare not exceeding Rs. 100, shall be collected, when such cancellation is made without a valid reason and duly and specifically mentioned on the website and App of the Aggregator. Such 16 Motor Vehicle Aggregator Guidelines 2025fare amount shall be divided between the driver and the aggregator in the same proportion as stated under Clause 15 of these guidelines. 19. Penalty The penalty, if any, as provided under clause 18 above, imposed on the driver or the aggregator, shall be deducted from the respective share specified in under clause 17 of the driver or the aggregator. 20. Sustainable Fleet Management by aggregators The State Government may direct aggregators to incrementally on an annual basis increase the percentage of electric, alternate fuel or zero emission vehicles in their fleet. 21. Inclusion of Divyangjan Fleet The State Government shall determine an adequate number of Divyangjan friendly motor vehicles required in the State and direct aggregators to proportionately include such vehicles within their fleet. 22. Conversion to Electric Mobility The aggregator shall mandatorily adhere to the targets fixed for inclusion of electric vehicles in their fleet. The targets shall be fixed by an appropriate Government organization responsible for regulating air quality or by the State Government. 23. Aggregation of non-transport motorcycles by aggregators 23.1 The State Government may allow aggregation of non-transport motorcycles for journey by passengers as shared mobility through aggregators resulting in reduced traffic congestion and vehicular pollution, along-with providing inter alia affordable passenger mobility, hyperlocal delivery, creating livelihood opportunities. 23.2 The State Government may, in exercise of its powers under sub-section (3) of Section 67 of the Act, permit aggregation of non-transport motorcycles for journey by passengers. 23.3 The State Government may, under sub-section (3) of Section 67 of the Act, impose fees on the aggregator for issuance of authorizations permitting non-transport motorcycles to undertake journeys through such aggregator, on a daily/ weekly/ fortnightly basis, as may be determined by the State Government. 23.4 On-boarding of drivers by the aggregator under this clause shall satisfy the compliances stipulated under these guidelines. 17 Motor Vehicle Aggregator Guidelines 202524. Suspension of aggregator Licence 24.1 The Licence granted to an aggregator may be suspended for reasons in writing (“Suspension Order”), by the Competent Authority either on its own or on receipt of a complaint against the aggregator after an inquiry conducted by the Competent Authority. 24.2 The period of suspension may extend to three (3) months. 24.3 The Suspension Order shall be passed by the Competent Authority after providing the aggregator a hearing within ten (10) days from receipt of such complaint or initiation of action. 24.4 The following grounds, amongst others, shall be considered as grounds for suspension of Licence: i) Failure of aggregator to ensure safety of the passenger and/or the driver, including through by a reasoned analysis of the quarterly rating parameters determined by the State Government; or ii) Frequent instances with regard to the fares charged to passengers, unjustified imposition of dynamic pricing, non-compliance with the guidelines for proportionate division of fare between the drivers and aggregator, imposition of unsubstantiated charges on drivers ; or iii) Failure of aggregator to comply with the obligations contained in the contract with the drivers; or iv) Failure of aggregator to comply with these guidelines; v) Jeopardizing the safety of passenger and/or well-being of drivers; vi) Violation of safety standards by the aggregator resulting in road accidents; vii) Severity of financial irregularities as obtained through audit of accounts of the aggregator; and viii) Any other parameters as the Competent Authority may deem fit and appropriate. Provided that if the Competent Authority is of the opinion that it would not be expedient or feasible to suspend the License of the aggregator, it may determine and impose upon such aggregator, a penalty which shall be up to Rupees One (1) Crore but not be less than Rupees One (1) Lakh depending upon the quantum and severity of the alleged infraction. 24.5 When a Licence is suspended, the aggregator shall immediately stop all operations under the Licence till the time such suspension is revoked or the period of suspension ends. 18 Motor Vehicle Aggregator Guidelines 2025i) Before expiry of the period of suspension, the aggregator shall, by way of an undertaking in writing, undertake that the grounds for its suspension, specified under the Suspension Order, stand resolved. ii) The competent Authority shall thereafter pass another order acknowledging resolution of the grounds for passing of the Suspension Order and receipt of the undertaking by the aggregator. iii) Thereafter, the aggregator shall resume operations for a period that shall not be less than two (2) months but may extend to six (6) months, ("Probationary Period") during which period, the aggregator shall continue operations and ensure compliance with these guidelines and any infractions during this period that may occasion action for suspension of license may lead directly to cancellation of the license under clause (25). 25. Cancellation and Surrender of aggregator Licence 25.1 Where the aggregator, i) has had its Licence suspended within a duration of three financial years and has committed another infraction under clause 24 that may occasion action for suspension; or ii) has committed or cause to be committed a violation of these guidelines of such a grievous nature so as to endanger the safety or security of the passenger or the driver. the Competent Authority shall issue a notice to such aggregator to show cause as to why the Licence granted to them should not be cancelled. 25.2 The Competent Authority may, within ten (10) days of issuing the show cause notice under clause (25.1) above, provide an opportunity of a hearing to the aggregator and thereafter take a decision on cancelling the Licence or otherwise, through a reasoned order and bring such cancellation to the notice of other States and the Central Government. 25.3 Where a licence is cancelled, the aggregator shall immediately stop all operations under the Licence. 25.4 Without prejudice to the order of cancellation passed by the Competent Authority, the Security Deposit shall stand forfeited. 25.5 The aggregator may, at any time, voluntarily surrender the Licence and on such surrender, the Security Deposit shall be returned to the aggregator after deductions on account of outstanding dues, if any. 19 Motor Vehicle Aggregator Guidelines 202526. Appeal 26.1 The aggregator aggrieved by any order of suspension or cancellation passed by the Competent Authority may, within thirty (30) days of receipt of such order, appeal to the notified appellate authority designated by the State Government for hearing appeal against the impugned order. 26.2 An appeal shall be in the form of a memorandum, disclosing the grounds for appeal and shall be accompanied by the requisite fee for appeal determined by the State Government and the copy of the order passed by the Competent Authority. 26.3 The appellate authority shall provide an opportunity of hearing to the aggregator and decide the appeal within a period of 60 days from the date of filing the appeal. 26.4 While deciding the appeal, appellate authority shall pass such orders as he deems fit. 27. Powers of the State Government 27.1 The State Government shall be empowered to call for such information documents or records from the aggregator, as it deems fit to ensure compliance by the aggregator with these guidelines, through a written notice. "आवदे न श(cid:227)ु क" इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के खडं 4 के अंतगत(cid:91) आवेदन के संबधं म(cid:581) (cid:292)भार से अ(cid:871)भ(cid:292)ते है। (ङ) "(cid:874)वभािजत (cid:873)कराया" (cid:873)कराये के उस भाग से अ(cid:871)भ(cid:292)ते है, जो ए(cid:274)ीगेटर (cid:622)वारा तय (cid:873)कया जाता है। (च) "स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547)" रा(cid:207)य सरकार के ऐसे दोन(cid:585) प(cid:162)(cid:585) के अ(cid:876)धकार(cid:585) और दा(cid:467)य(cid:215)व(cid:585) को (cid:467)न(cid:465)द(cid:91)(cid:231)ट (cid:873)कया जाता है। (ज) "नाम (cid:467)न(cid:465)द(cid:91)(cid:231) ट पोट(cid:91)ल" इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के खडं 3 के अतं गत(cid:91) (cid:232)था(cid:874)पत और अ(cid:876)धसू(cid:876)चत पोट(cid:91)ल से (cid:467)नय(cid:200)ु त (cid:229)यि(cid:200)त से अ(cid:871)भ(cid:292)ेत है। (ढ) "(cid:292)रे ण (cid:292)(cid:871)श(cid:162)ण काय(cid:272)(cid:91) म" इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के खंड (10) म(cid:581) (cid:467)न(cid:465)द(cid:91)(cid:231)ट (cid:292)ेरण (cid:292)(cid:871)श(cid:162)ण काय(cid:272)(cid:91) म से अ(cid:871)भ(cid:292)ेत है। (ण) "या(cid:287)ा" से (cid:292)(cid:232)थान के (cid:232)थान से गंत(cid:229)य तक (cid:467)न(cid:465)द(cid:91)(cid:231)ट तार(cid:547)ख और समय पर क(cid:551) गई या(cid:287)ा से अ(cid:871)भ(cid:292)ते है, (cid:873)फर चाहे वह या(cid:287)ा क(cid:551) गई हो या नह(cid:547)ं और इसम(cid:581) या(cid:287)ा योजना के (cid:871)लए उपयोग (cid:873)कए जा रहे मोटर यान का (cid:292)कार या (cid:302)ेणी शा(cid:871)मल होगी। (त) "लाइसस(cid:581) " अ(cid:876)ध(cid:467)नयम क(cid:551) धारा 93 के अंतगत(cid:91) ए(cid:274)ीगेटर को जार(cid:547) (cid:873)कया गया लाइसस(cid:581) से अ(cid:871)भ(cid:292)ते है। (थ) "लाइसस(cid:581) शु(cid:227)क" इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के खंड 5 के अंतगत(cid:91) देय शु(cid:227)क से अ(cid:871)भ(cid:292)ेत है। (द) "ऑन-बोड"(cid:91) से इसके (cid:229)याकर(cid:872)णक (cid:510)पांतर(cid:585) स(cid:465)हत ए(cid:274)ीगेटर (cid:622)वारा (cid:875)डिजटल (cid:220)लेटफॉम (cid:91) पर (cid:284)ाइवर(cid:585) और वाहन(cid:585) को पजं ीकृत करन े क(cid:551) (cid:292)(cid:873)(cid:272)या से अ(cid:871)भ(cid:292)ेत है। (ध) "ऑफ-बोड"(cid:91) इसके (cid:229)याकर(cid:872)णक (cid:510)पांतर(cid:585) स(cid:465)हत ए(cid:274)ीगेटर (cid:622)वारा (cid:875)डिजटल (cid:220)लेटफॉम (cid:91) पर (cid:284)ाइवर और वाहन का पजं ीकरण (cid:467)नर(cid:232)त करने क(cid:551) (cid:292)(cid:873)(cid:272)या से अ(cid:871)भ(cid:292)ेत है। 6 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(न) "या(cid:287)ी" ऐसे (cid:229)यि(cid:200)त से अ(cid:871)भ(cid:292)ते है जो या(cid:287)ा करने के (cid:871)लए ए(cid:274)ीगेटर के ऐप का उपयोग करता है। (ऩ) "रे(cid:465)टगं " ए(cid:274)ीगेटर (cid:622)वारा (cid:467)न(cid:465)द(cid:91)(cid:231)ट मापदंड(cid:585) के आधार पर या(cid:287)ी (cid:622)वारा क(cid:551) गई या(cid:287)ा क(cid:551) गुणव(cid:419)ा के मू(cid:227)यांकन से अ(cid:871)भ(cid:292)ेत है। (प) "पनु (cid:230)चया(cid:91) (cid:292)(cid:871)श(cid:162)ण काय(cid:91)(cid:272)म और मू(cid:227)यांकन" ए(cid:274)ीगेटर के साथ एक(cid:551)कृत (cid:284)ाइवर(cid:585) के (cid:871)लए (cid:229)यि(cid:200)तगत (cid:510)प से और आभासी (cid:292)(cid:871)श(cid:162)ण स(cid:287)(cid:585) म(cid:581) (cid:465)दया गया कम स े कम अड़ताल(cid:547)स (48) घंटे क(cid:551) अव(cid:876)ध का (cid:292)(cid:871)श(cid:162)ण स(cid:287) और 10 घंटे क(cid:551) अव(cid:876)ध के एक (cid:467)नरंतर स(cid:287) से अ(cid:871)भ(cid:292)ते है। (फ) "(cid:292)(cid:467)तभ(cid:467)ू त जमा" उस रा(cid:871)श से अ(cid:871)भ(cid:292)ेत है, जो ए(cid:274)ीगेटर (cid:622)वारा देय है, िजसे लाइसस(cid:581) श(cid:227)ु क के साथ बक(cid:583) गारंट(cid:547) या बीमा जमानत बांड के (cid:510)प म(cid:581) (cid:292)(cid:232)ततु (cid:873)कया जाना है। 1.2. इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के अतं गत(cid:91) प(cid:464)रभा(cid:874)षत और उि(cid:227)ल(cid:872)खत श(cid:222)द(cid:585) और अ(cid:871)भ(cid:229)यि(cid:200)तय(cid:585) का वह(cid:547) ता(cid:215) पय (cid:91) होगा जो अ(cid:876)ध(cid:467)नयम म(cid:581) (cid:465)दया गया है। 2. (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) क(cid:551) (cid:292)यो(cid:207)यता 2.1. ये (cid:465)दशा(cid:467)नद(cid:566)श (cid:873)कसी भी रा(cid:207)य के भीतर संचा(cid:871)लत (cid:873)कसी भी ए(cid:274)ीगेटर पर लाग ू ह(cid:585)गे। 2.2. ये (cid:465)दशा(cid:467)नद(cid:566)श उन स(cid:232)ं थाओं पर लागू नह(cid:547)ं ह(cid:585)गे जो (cid:232)वयं को स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा लाइसस(cid:581) (cid:292)ा(cid:220)त ए(cid:274)ीगेटस(cid:91) के (cid:871)लए एक अंतर-संचालनीय नेटवक(cid:91) के (cid:292)ावधान तक सी(cid:871)मत रखते ह(cid:583) और (cid:284)ाइवर(cid:585) या मोटर वाहन(cid:585) या दोन(cid:585) को सीधे तौर पर शा(cid:871)मल नह(cid:547)ं करते ह(cid:583)। 2.3. ये (cid:465)दशा(cid:467)नद(cid:566)श उन स(cid:232)ं थाओं पर लागू नह(cid:547)ं ह(cid:585)गे जो सावज(cid:91) (cid:467)नक सेवा वाहन(cid:585) (cid:622)वारा या(cid:287)ा करने क(cid:551) (cid:465)टकट(cid:585) क(cid:551) (cid:466)ब(cid:272)(cid:551) का काय (cid:91) करती ह(cid:583)। 7 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 20253. क(cid:581)(cid:289) सरकार (cid:622)वारा नाम (cid:467)न(cid:465)द(cid:91)(cid:231) ट पोट(cid:91)ल क(cid:581)(cid:289) सरकार लाइसस(cid:581) के (cid:871)लए आवेदन क(cid:551) एकल (cid:872)खड़क(cid:551) अनुमोदन के (cid:871)लए एक पोट(cid:91)ल (cid:874)वक(cid:871)सत और ना(cid:871)मत करेगी, िजसम(cid:581) उ(cid:876)चत आवेदन श(cid:227)ु क, लाइसस(cid:581) शु(cid:227)क और (cid:292)(cid:467)तभू(cid:467)त जमा क(cid:551) (cid:292)ाि(cid:220)त शा(cid:871)मल होगी: बशत(cid:566) (cid:873)क जब तक यह पोट(cid:91)ल (cid:874)वक(cid:871)सत और चालू नह(cid:547)ं हो जाता, तब तक रा(cid:207)य सरकार(cid:581) मौजदू ा (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के अनुसार लाइसस(cid:581) के (cid:871)लए आवेदन(cid:585) पर कार(cid:91)वाई कर(cid:581)गी। 4. लाइसस(cid:581) (cid:292)दान करने या उनके नवीनीकरण के (cid:871)लए आवेदन और उसस े संब(cid:876)ं धत मामले 4.1. लाइसस(cid:581) (cid:292)दान करने के (cid:871)लए आवेदन, नीचे खडं 8 के अंतगत(cid:91) उि(cid:227)ल(cid:872)खत मानदंड(cid:585) के अतं गत(cid:91) पा(cid:287) (cid:873)कसी भी (cid:229)यि(cid:200)त (cid:622)वारा उपरो(cid:200)त खडं 3 के अतं गत(cid:91) (cid:467)न(cid:465)द(cid:91)(cid:231)ट पोट(cid:91)ल पर, (cid:292)प(cid:287) 1 म(cid:581) (cid:873)कया जाएगा। इस आवेदन के साथ आवेदन शु(cid:227)क के ऑनलाइन भुगतान का (cid:292)माण संल(cid:202)न करना होगा, जसै ा (cid:873)क रा(cid:207)य सरकार (cid:622)वारा अ(cid:876)धसूचना के मा(cid:218)यम से (cid:467)नधा(cid:91)(cid:464)रत (cid:873)कया जाएगा। 4.2. ए(cid:274)ीगेटर (cid:622)वारा उसके (cid:622)वारा संचा(cid:871)लत सभी या (cid:873)कसी भी (cid:292)कार या वग(cid:91) के मोटर वाहन(cid:585) के (cid:871)लए एक ह(cid:547) आवेदन (cid:873)कया जाएगा। 4.3. रा(cid:207)य के स(cid:224)पूण (cid:91) (cid:292)ादे(cid:871)शक (cid:162)े(cid:287)ा(cid:876)धकार म(cid:581) लाइसस(cid:581) जार(cid:547) करने के (cid:871)लए स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा एक लाइसस(cid:581) (cid:292)दान (cid:873)कया जाएगा। 4.4. उप-ख(cid:214)ड (4.1) के अतं गत(cid:91) (cid:873)कए गए आवेदन पर स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा (cid:292)प(cid:287)-1 म(cid:581) ऐसे आवेदन क(cid:551) तार(cid:547)ख से न(cid:222)ब े (90) (cid:465)दन क(cid:551) अव(cid:876)ध के भीतर (cid:467)नणय(cid:91) (cid:871)लया जाएगा। 4.5. य(cid:465)द आवेदक इन (cid:465)दशा-(cid:467)नद(cid:566)श(cid:585) के अतं गत(cid:91) (cid:467)न(cid:465)द(cid:91)(cid:231)ट लाइस(cid:581)स (cid:292)दान करने क(cid:551) (cid:873)कसी भी शत (cid:91) का अनुपालन नह(cid:547)ं करता है, जसै ा (cid:873)क स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा (cid:467)नधा(cid:91)(cid:464)रत (cid:873)कया जा सकता है, तो वह ए(cid:274)ीगेटर का प(cid:162) सुनने के बाद (cid:871)ल(cid:872)खत (cid:510)प म(cid:581) दज (cid:91) (cid:873)कए जाने वाले कारण(cid:585) के साथ ऐसे आवेदन को अ(cid:232)वीकार कर सकता है। 4.6. इस बात से संत(cid:231)ु ट होने पर (cid:873)क आवेदक ने इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के अंतगत(cid:91) लाइस(cid:581)स (cid:292)दान करने के (cid:871)लए (cid:467)न(cid:465)द(cid:91)(cid:231)ट सभी शत(cid:607) का अनुपालन (cid:873)कया है, स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) आवदे क को तीस (30) (cid:465)दन(cid:585) क(cid:551) अव(cid:876)ध के भीतर उ(cid:876)चत लाइसस(cid:581) शु(cid:227)क का भगु तान और (cid:292)(cid:467)तभू(cid:467)त जमा करने का (cid:467)नद(cid:566)श देगा। 8 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 20254.7. लाइसस(cid:581) श(cid:227)ु क के भुगतान और (cid:292)(cid:467)तभू(cid:467)त जमा होने पर, स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) भुगतान क(cid:551) तार(cid:547)ख से प(cid:289)ं ह (15) (cid:465)दन(cid:585) क(cid:551) अव(cid:876)ध के भीतर, इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के साथ संल(cid:202)न (cid:292)प(cid:287) III म(cid:581) आवेदक को लाइस(cid:581)स (cid:292)दान करेगा। 4.8. इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के अतं गत(cid:91) स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा जार(cid:547) लाइस(cid:581)स को स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा नाम (cid:467)न(cid:465)द(cid:91)(cid:231)ट पोट(cid:91)ल पर अपलोड और अ(cid:622)यतन (cid:873)कया जाएगा। 5. लाइसस(cid:581) शु(cid:227)क ए(cid:274)ीगेटर (cid:622)वारा देय लाइस(cid:581)स शु(cid:227)क (cid:467)न(cid:224)नानुसार होगा: (cid:272).सं. (cid:874)ववरण धनरा(cid:871)श (cid:509)पए म(cid:581) 1 ए(cid:274)ीगेटर को लाइस(cid:581)स (cid:292)दान करना 5,00,000 2 लाइसस(cid:581) का नवीनीकरण 25,000 3 लाइसस(cid:581) धार(cid:547) के पते म(cid:581) प(cid:464)रवतन(cid:91) को नोट करने के (cid:871)लए 25,000 6. (cid:292)(cid:467)तभू(cid:467)त जमा रा(cid:871)श ए(cid:274)ीगेटर (cid:622)वारा (cid:292)दान क(cid:551) जाने वाल(cid:547) (cid:292)(cid:467)तभू(cid:467)त जमा रा(cid:871)श (cid:467)न(cid:224)नानुसार होगी: (cid:272).सं. (cid:874)ववरण धनरा(cid:871)श (cid:509)पए म(cid:581) 1 100 बस(cid:581) या 1000 अ(cid:219)य मोटर यान तक 10,00,000 2 1000 बस(cid:581) या 10000 अ(cid:219)य मोटर यान तक 25,00,000 3 1000 से अ(cid:876)धक बस (cid:581) या 10000 अ(cid:219)य मोटर यान 50,00,000 7. लाइसस(cid:581) क(cid:551) वधै ता, उसका नवीनीकरण और उससे सबं ं(cid:876)धत मामले 7.1. कोई भी लाइस(cid:581)स इसके जार(cid:547) होने क(cid:551) तार(cid:547)ख से पांच (5) वष (cid:91) क(cid:551) अव(cid:876)ध के (cid:871)लए वधै होगा। 7.2. इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के साथ संल(cid:202)न (cid:292)प(cid:287) II म(cid:581) आवेदन के अनुसार, नवीनीकरण क(cid:551) शत(cid:607) के अनुपालन के अ(cid:218) यधीन, स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा पांच (05) वष (cid:91) क(cid:551) अव(cid:876)ध के (cid:871)लए लाइस(cid:581)स का नवीनीकरण (cid:873)कया जा सकता है। ऐसे नवीनीकरण के (cid:292)योजनाथ,(cid:91) स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत क(cid:551) जांच करेगा: (क) इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के अनुपालन के संबंध म(cid:581) ए(cid:274)ीगेटर का (cid:464)रकॉड,(cid:91) और 9 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(ख) िजस रा(cid:207)य म(cid:581) आवेदन (cid:873)कया गया है, वहा ं ए(cid:274)ीगेटर के (cid:874)व(cid:509)(cid:622)ध क(cid:551) गई दंडा(cid:215)मक कार(cid:91)वाई। 8. लाइसस(cid:581) (cid:292)ा(cid:220)त करने क(cid:551) पा(cid:287)ता 8.1. आवदे क, कंपनी अ(cid:876)ध(cid:467)नयम, 2013 के तहत पंजीकृत कंपनी या सी(cid:871)मत देयता भागीदार(cid:547) अ(cid:876)ध(cid:467)नयम, 2008 के तहत सी(cid:871)मत देयता भागीदार(cid:547) या (cid:284)ाइवर(cid:585) या मोटर वाहन मा(cid:871)लक(cid:585) के सघं (cid:622)वारा ग(cid:465)ठत सहकार(cid:547) स(cid:871)म(cid:467)त होगी और सहकार(cid:547) स(cid:871)म(cid:467)त अ(cid:876)ध(cid:467)नयम, 1912 के अंतगत(cid:91) पजं ीकृत कंपनी होगी। 8.2. आवदे क को लागू कानून का अनुपालन करना होगा, िजसम(cid:581) अ(cid:876)ध(cid:467)नयम या अ(cid:876)ध(cid:467)नयम के अंतगत(cid:91) बनाए गए (cid:467)नयम और (cid:874)व(cid:467)नयम, (cid:875)डिजटल (cid:229)यि(cid:200)तगत डटे ा संर(cid:162)ण अ(cid:876)ध(cid:467)नयम, 2023, उपभो(cid:200)ता सरं (cid:162)ण अ(cid:876)ध(cid:467)नयम, 2019 और सूचना (cid:292)ौ(cid:622)यो(cid:876)गक(cid:551) अ(cid:876)ध(cid:467)नयम, 2000 और इसके आतं गत(cid:91) जार(cid:547) म(cid:218)य(cid:232)थ (cid:465)दशा(cid:467)नद(cid:566)श शा(cid:871)मल ह(cid:583), ले(cid:873)कन इ(cid:219)ह(cid:547)ं तक सी(cid:871)मत नह(cid:547)ं ह(cid:583)। 9. लाइसस(cid:581) (cid:292)दान करने क(cid:551) शत (cid:591) लाइसस(cid:581) (cid:292)ा(cid:220)त करने के (cid:871)लए आवेदन (cid:292)(cid:232)तुत करन े वाले ए(cid:274)ीगेटर को (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत का अनुपालन स(cid:467)ु नि(cid:230)चत करना होगा: 9.1. ए(cid:274)ीगेटर (cid:873)कसी (cid:284)ाइवर को (cid:467)नयु(cid:200)त करने से पहले तथा इन (cid:465)दशा-(cid:467)नद(cid:566)श(cid:585) के जार(cid:547) होने से पहले (cid:467)नय(cid:200)ु त (cid:873)कए गए (cid:284)ाइवर(cid:585) के (cid:871)लए भी खडं 10 के अंतगत(cid:91) (cid:874)व(cid:232)ततृ (cid:510)प से बताए गए अनसु ार एक प(cid:464)रचया(cid:215)मक (cid:292)(cid:871)श(cid:162)ण काय(cid:272)(cid:91) म आयोिजत करेगा या करवाएगा। 9.2. ए(cid:274)ीगेटर को स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) को सेवाओं के (cid:292)ारंभ क(cid:551) (cid:871)ल(cid:872)खत सूचना देनी होगी और लाइसस(cid:581) (cid:292)दान (cid:873)कए जाने क(cid:551) तार(cid:547)ख से छह (6) मह(cid:547)ने क(cid:551) अव(cid:876)ध के भीतर इसे अ(cid:622)यतन करना होगा, अ(cid:219)यथा स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा लाइस(cid:581)स (cid:467)नर(cid:232) त (cid:873)कया जा सकता है। 9.3. सेवाए ं (cid:292)ारंभ होने स े बह(cid:419)र (72) घंटे पहले, ए(cid:274)ीगेटर स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) को स(cid:876)ू चत करेगा और उ(cid:200)त सचू ना स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा (cid:467)न(cid:465)द(cid:91)(cid:231)ट पोट(cid:91)ल पर अपलोड क(cid:551) जाएगी। 10 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 20259.4. (cid:232)वा(cid:232)(cid:216)य या जन सुर(cid:162)ा के संबधं म(cid:581) क(cid:581)(cid:289) सरकार या संब(cid:876)ं धत रा(cid:207)य सरकार (cid:622)वारा जार(cid:547) (cid:465)दशा(cid:467)नद(cid:566)श(cid:585), य(cid:465)द कोई ह(cid:585), का ए(cid:274)ीगेटर और ऑन-बोड (cid:91) (cid:284)ाइवर(cid:585) (cid:622)वारा अनुपालन (cid:873)कया जाएगा। 9.5. ए(cid:274)ीगेटर को या(cid:466)(cid:287)य(cid:585) के (cid:871)लए (cid:219)यूनतम 5 लाख (cid:509)पये क(cid:551) बीमा रा(cid:871)श सु(cid:467)नि(cid:230)चत करनी होगी। 9.6. ए(cid:274)ीगेटर ऑन-बोड(cid:566)ड (cid:284)ाइवर(cid:585) को कई ए(cid:274)ीगेटर(cid:585) के साथ संचालन करने से रोकेगा नह(cid:547)ं या (cid:292)(cid:467)तबं(cid:876)धत नह(cid:547)ं करेगा। 9.7. ए(cid:274)ीगेटर को ऐप म(cid:581) (cid:284)ाइवर और या(cid:287)ी दोन(cid:585) के (cid:871)लए एक कायत(cid:91) ं(cid:287) (cid:874)वक(cid:871)सत करना होगा, िजससे या(cid:287)ा के सम(cid:274) अनुभव क(cid:551) गुणव(cid:419)ा का म(cid:227)ू यांकन (cid:873)कया जा सके। 9.8. ए(cid:274)ीगेटर, वधै अनुबधं कै(cid:464)रज पर(cid:871)मट वाले और ऑन-बोड (cid:91) होने के इ(cid:205)छुक मोटर यान को ए(cid:274)ीगेटर के साथ ऑन-बोड (cid:91) होने क(cid:551) अनुम(cid:467)त देगा, बशत(cid:566) (cid:873)क इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के (cid:292)ासं(cid:876)गक खंड(cid:585) का अनुपालन (cid:873)कया जाए। 9.9. (cid:874)वगत एक वष (cid:91) म(cid:581) ए(cid:274)ीगेटर का लाइसस(cid:581) (cid:467)नर(cid:232) त नह(cid:547)ं हुआ होना चा(cid:465)हए। 9.10. एक (cid:871)शकायत (cid:467)नवारण अ(cid:876)धकार(cid:547) (cid:467)नय(cid:200)ु त (cid:873)कया जाएगा, जो (cid:292)ा(cid:220)त सभी (cid:871)शकायत(cid:585) का समाधान करेगा और (cid:292)ा(cid:220)त (cid:871)शकायत(cid:585) का (cid:874)ववरण ऑनलाइन (cid:292)(cid:873)(cid:272)या के मा(cid:218)यम से स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) को उपल(cid:222)ध कराएगा। (cid:871)शकायत (cid:467)नवारण अ(cid:876)धकार(cid:547) का (cid:874)ववरण अथा(cid:91)त ् नाम, ई-मेल पता और टेल(cid:547)फोन नंबर ए(cid:274)ीगेटर (cid:622)वारा अपने ऐप और वेबसाइट पर उपल(cid:222)ध कराया जाएगा। 10. (cid:292)ेरण (cid:292)(cid:871)श(cid:162)ण काय(cid:272)(cid:91) म 10.1. (cid:284)ाइवर(cid:585) के (cid:871)लए यह (cid:292)(cid:871)श(cid:162)ण काय(cid:272)(cid:91) म कम से कम चाल(cid:547)स (40) घंटे क(cid:551) अव(cid:876)ध का होगा, िजसम(cid:581) (cid:229)यि(cid:200)तगत और वचअु(cid:91) ल (cid:292)(cid:871)श(cid:162)ण स(cid:287)(cid:585) का सयं ोजन शा(cid:871)मल होगा। इस काय(cid:91)(cid:272)म के पा(cid:619)य(cid:272)म का (cid:874)व(cid:232)ततृ (cid:874)ववरण ए(cid:274)ीगेटर (cid:622)वारा ऑनलाइन उपल(cid:222)ध कराया जाएगा। इस पा(cid:619)य(cid:272)म म(cid:581) (cid:284)ाइवर(cid:585) को (cid:467)न(cid:224) न(cid:871)ल(cid:872)खत (cid:292)(cid:871)श(cid:162)ण (cid:465)दया जाएगा: (क) ए(cid:274)ीगेटर के ऐप का उपयोग करना; (ख) संब(cid:876)ं धत अ(cid:876)ध(cid:467)नयम(cid:585) और (cid:467)नयम(cid:585) के (cid:292)ासं(cid:876)गक (cid:292)ावधान; (ग) मोटर यान (चालन) (cid:874)व(cid:467)नयम 2017; 11 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(घ) सड़क दघु ट(cid:91) नाओं के मामल े म(cid:581) आपात ि(cid:232)थ(cid:467)त म(cid:581) कार(cid:91)वाई करने और सहायता (cid:292)दान करने के (cid:871)लए कम से कम छह (6) घंटे का (cid:292)थम (cid:292)(cid:467)त(cid:873)(cid:272)याकता (cid:91) (र(cid:547)(cid:232) पांडर) (cid:292)(cid:871)श(cid:162)ण; (ङ) सावधानीपूवक(cid:91) (cid:284)ाइ(cid:874)वगं , यातायात (cid:467)नयम, मोटर यान का रखरखाव, (cid:579)धन कुशल (cid:284)ाइ(cid:874)वगं , आचरण और (cid:229)यवहार पर; (च) माग(cid:607) से प(cid:464)र(cid:876)चत होने पर; (छ) (cid:284)ाइवर और ए(cid:274)ीगेटर के बीच सहम(cid:467)त क(cid:551) शत(cid:607) पर; (ज) ल(cid:876)(cid:583) गक संवदे नशीलता और (cid:465)द(cid:229)यांगजन के (cid:292)(cid:467)त संवदे नशीलता और ग(cid:467)तशीलता आव(cid:230)यकताओं पर (cid:874)वशेष (cid:292)(cid:871)श(cid:162)ण; (झ) ऐसा अ(cid:219)य (cid:292)(cid:871)श(cid:162)ण िजसक(cid:551) रा(cid:207)य सरकार अपे(cid:162)ा करे। 10.2. ए(cid:274)ीगेटर को (cid:467)न(cid:465)द(cid:91)(cid:231)ट पोट(cid:91)ल पर (cid:292)ेरण (cid:292)(cid:871)श(cid:162)ण सरं चना का (cid:874)ववरण अपलोड करना होगा। 11. (cid:284)ाइवर(cid:585) के सबं ंध म(cid:581) अनुपालन 11.1. (cid:284)ाइवर(cid:585) को शा(cid:871)मल करने के (cid:292)योजनाथ,(cid:91) ए(cid:274)ीगेटर को यह सु(cid:467)नि(cid:230)चत करेगा (cid:873)क (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत शत(cid:607) का अनुपालन (cid:873)कया जाए, अथा(cid:91)त:् (क) (cid:873)क चालक के पास क(cid:581)(cid:289)(cid:547)य मोटर यान (cid:467)नयमावल(cid:547), 1989 (सीएमवीआर) के (cid:467)नयम 4 के अंतगत(cid:91) सचू ीब(cid:622)ध (cid:873)कसी भी द(cid:232)तावेज़ के आधार पर (cid:873)कसी भी पहचान का वैध (cid:292)माण हो; (ख) (cid:873)क चालक के पास सबं ं(cid:876)धत यान के (cid:292)कार या (cid:302)ेणी के (cid:871)लए वधै (cid:284)ाइ(cid:874)वगं लाइसस(cid:581) हो, िजसके अंतगत(cid:91) सबं (cid:876)ं धत वाहन ऑनबो(cid:875)डग(cid:589) अव(cid:876)ध के दौरान आता हो; (ग) (cid:873)क चालक के पास अ(cid:876)ध(cid:467)नयम क(cid:551) धारा 7 क(cid:551) उप-धारा (1) के अंतगत(cid:91) अप(cid:879)े (cid:162)त अनुभव हो; (घ) (cid:284)ाइवर के नाम पर वधै बक(cid:583) खाता हो; 12 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(ङ) (cid:874)वगत तीन (3) वष(cid:607) के भीतर चालक को (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत म(cid:581) से (cid:873)कसी भी अपराध के (cid:871)लए दोषी नह(cid:547)ं ठहराया गया है, अथा(cid:91)त:् (i) मादक पदाथ(cid:607) या शराब के नशे म(cid:581) वाहन चलाने का अपराध, और (ii) भारतीय नाग(cid:464)रक सरु (cid:162)ा स(cid:465)ं हता, 2023 और भारतीय (cid:219)याय स(cid:465)ं हता, 2023 (जसै ा लागू हो) के तहत कोई भी सं(cid:163)ेय अपराध,िजसम(cid:581) धोखाधड़ी, यौन अपराध, स(cid:163)ं ेय अपराध करने के (cid:871)लए मोटर वाहन का उपयोग, संप(cid:874)(cid:419) को नुकसान पहुंचाने या चोर(cid:547) करने वाला अपराध, (cid:465)हसं ा के कृ(cid:215)य, आतंक के कृ(cid:215)य या उप(cid:289)व या जनता के (cid:871)लए खतरा पैदा करने वाले कृ(cid:215)य शा(cid:871)मल ह(cid:583); (च) (cid:873)क चालक ए(cid:274)ीगेटर (cid:622)वारा पहचाने गए अ(cid:232)पताल या (cid:876)च(cid:873)क(cid:215)सा स(cid:232)ं थान (cid:622)वारा ने(cid:287) जांच स(cid:465)हत (cid:873)फटनेस के (cid:871)लए (cid:876)च(cid:873)क(cid:215)सा पर(cid:547)(cid:162)ण करवाना; (छ) (cid:873)क ए(cid:274)ीगेटर (cid:622)वारा (cid:284)ाइवर का मनोवै(cid:163)ा(cid:467)नक (cid:874)व(cid:230)लेषण (cid:873)कया जाना, ता(cid:873)क यह (cid:467)नधा(cid:91)(cid:464)रत (cid:873)कया जा सके (cid:873)क वह ऑन बोड (cid:91) के (cid:871)लए (cid:873)फट है या नह(cid:547)ं; (ज) (cid:873)क ऑन-बो(cid:875)डग(cid:589) स े कम से कम सात (7) (cid:465)दन पहले (cid:284)ाइवर के च(cid:464)र(cid:287) और उसके पहले के जीवन को प(cid:871)ु लस (cid:622)वारा स(cid:215)या(cid:874)पत (cid:873)कया जाना और ए(cid:274)ीगेटर ऐसे स(cid:215)यापन का (cid:871)ल(cid:872)खत (cid:464)रकॉड (cid:91) रखगे ा; (झ) (cid:873)क ए(cid:274)ीगेटर और (cid:284)ाइवर के बीच एक वधै अनुबधं (cid:467)न(cid:231)पा(cid:465)दत करना, िजसम(cid:581) रा(cid:207)य क(cid:551) भाषा म(cid:581) ऑन बो(cid:875)डग(cid:589) और यान चलाने के (cid:871)लए लागू (cid:467)नयम और शत (cid:591) (cid:467)न(cid:465)द(cid:91)(cid:231)ट ह(cid:585)। ए(cid:274)ीगेटर (cid:622)वारा मानक (cid:467)नयम और शत (cid:591) अपनी वेबसाइट पर ऑनलाइन उपल(cid:222)ध कराई जाएगं ी। बशत(cid:566) (cid:873)क स(cid:224)पणू (cid:91) अव(cid:876)ध के (cid:871)लए उपरो(cid:200)त शत(cid:607) का अनुपालन ए(cid:274)ीगेटर (cid:622)वारा धा(cid:464)रत लाइसस(cid:581) क(cid:551) अव(cid:876)ध के साथ समा(cid:220)त हो जाएगा। 11.2. (cid:284)ाइवर(cid:585) के क(cid:227)याण के (cid:871)लए, ए(cid:274)ीगेटर को (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत शत(cid:607) का अनुपालन स(cid:467)ु नि(cid:230)चत करना होगा, अथा(cid:91)त:् (क) (cid:292)(cid:215)येक (cid:284)ाइवर के (cid:871)लए कम से कम 5 लाख (cid:509)पये का (cid:232)वा(cid:232)(cid:216)य बीमा सु(cid:467)नि(cid:230)चत (cid:873)कया जाएगा, िजसम(cid:581) (cid:292)(cid:215)येक (cid:284)ाइवर के (cid:871)लए (cid:292)(cid:467)त वष (cid:91) के(cid:219)(cid:289) सरकार (cid:622)वारा अ(cid:876)धसू(cid:876)चत (cid:292)(cid:467)तशत के अनुसार व(cid:622)ृ (cid:876)ध क(cid:551) जाएगी। 13 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(ख) (cid:292)(cid:215)येक (cid:284)ाइवर के (cid:871)लए कम से कम 10 लाख (cid:509)पये का आव(cid:876)धक बीमा स(cid:467)ु नि(cid:230)चत (cid:873)कया जाएगा, िजसम(cid:581) (cid:292)(cid:215)येक वष (cid:91) के(cid:219)(cid:289) सरकार (cid:622)वारा अ(cid:876)धस(cid:876)ू चत (cid:292)(cid:467)तशत के अनुसार व(cid:622)ृ (cid:876)ध क(cid:551) जाएगी। (ग) बशत(cid:566) (cid:873)क सामािजक सुर(cid:162)ा सं(cid:465)हता, 2020 के अतं गत(cid:91) बनाए गए (cid:292)ावधान उप- खंड (क) और उप-खडं (ख) के संबधं म(cid:581) अ(cid:876)धसू(cid:876)चत और काया(cid:91)ि(cid:219)वत होने पर यह लागू ह(cid:585)गे। (घ) आंत(cid:464)रक संसाधन(cid:585) या अ(cid:219)य स(cid:232)ं थाओं के सहयोग से (cid:229)यि(cid:200)तगत और आभासी (cid:292)(cid:871)श(cid:162)ण स(cid:287)(cid:585) के सयं ोजन के (cid:510)प म(cid:581) वा(cid:874)षक(cid:91) पुन(cid:230)चया(cid:91) (cid:292)(cid:871)श(cid:162)ण काय(cid:272)(cid:91) म आयोिजत करना और ऐसे पनु (cid:230)चया(cid:91) (cid:292)(cid:871)श(cid:162)ण का (cid:464)रकॉड (cid:91) रखना। (ङ) बशत(cid:566) (cid:873)क ए(cid:274)ीगेटर के साथ काय (cid:91) क(cid:551) अव(cid:876)ध के सदं भ (cid:91) म(cid:581) समान ि(cid:232)थ(cid:467)त वाले सभी (cid:284)ाइवर(cid:585) म(cid:581) से िजन (cid:284)ाइवर(cid:585) क(cid:551) रे(cid:465)टगं 5 (cid:292)(cid:467)तशत से कम है, उ(cid:219)ह(cid:581) (cid:292)(cid:215)येक (cid:467)तमाह(cid:547) म(cid:581) अ(cid:467)नवाय (cid:91) (cid:510)प से पुन(cid:230)चया(cid:91) (cid:292)(cid:871)श(cid:162)ण काय(cid:272)(cid:91) म म(cid:581) शा(cid:871)मल होना होगा, ऐसा नह(cid:547)ं करन े पर (cid:284)ाइवर, ए(cid:274)ीगेटर के मा(cid:218)यम से अपनी सवे ाएं (cid:292)दान नह(cid:547)ं कर सकेगा। (च) य(cid:465)द (cid:873)कसी या(cid:287)ी (cid:622)वारा अ(cid:876)ध(cid:467)नयम, (cid:467)नयम(cid:585) या इन (cid:465)दशा-(cid:467)नद(cid:566)श(cid:585) के (cid:292)ावधान(cid:585) के उ(cid:227)लंघन के (cid:871)लए चालक के (cid:874)व(cid:509)(cid:622)ध (cid:871)शकायत दज (cid:91) कराई जाती है, तो (cid:871)शकायत दज (cid:91) होने के (cid:465)दन से तीन (3) (cid:465)दन(cid:585) क(cid:551) अव(cid:876)ध के भीतर ए(cid:274)ीगेटर (cid:622)वारा जांच क(cid:551) जाए और ऐसी जांच परू (cid:547) होने के बाद ह(cid:547) चालक के (cid:874)व(cid:509)(cid:622)ध उ(cid:876)चत कार(cid:91)वाई क(cid:551) जाए। ए(cid:274)ीगेटर जांच परू (cid:547) होने पर या(cid:287)ी को उसके प(cid:464)रणाम के बारे म(cid:581) सू(cid:876)चत करेगा। 11.3. ए(cid:274)ीगेटर ऑन-बोडड(cid:566) (cid:284)ाइवर(cid:585) से संब(cid:876)ं धत द(cid:232)तावेज(cid:585), जो सारथी पोट(cid:91)ल से (cid:874)व(cid:876)धवत (cid:292)मा(cid:872)णत ह(cid:585)गे और ऐसे अ(cid:219)य द(cid:232)तावेज िज(cid:219)ह(cid:581) ए(cid:274)ीगेटर उ(cid:876)चत समझ े का (cid:875)डिजटल (cid:464)रकॉड (cid:91) रखगे ा, िजनम(cid:581) (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत शा(cid:871)मल ह(cid:583): (क) एक फोटो; (ख) (cid:284)ाइ(cid:874)वगं लाइस(cid:581)स क(cid:551) मूल (cid:292)(cid:467)त; (ग) सीएमवीआर म(cid:581) (cid:467)न(cid:465)द(cid:91)(cid:231)ट पते के (cid:292)माण के (cid:871)लए (cid:232)वीकाय (cid:91) द(cid:232)तावेज(cid:585) के साथ आवासीय पता (cid:292)(cid:232)ततु करना; (घ) बक(cid:583) खाते का स(cid:215)या(cid:874)पत (cid:874)ववरण; 14 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(ङ) दो आपातकाल(cid:547)न संपक(cid:91) स(cid:287)ू (cid:585) के नाम और पते के साथ संपक(cid:91) नंबर । 12. पर(cid:871)मट ए(cid:274)ीगेटर यह सु(cid:467)नि(cid:230)चत करेगा (cid:873)क सभी मोटर यान(cid:585) म(cid:581) चालक स(cid:465)हत अ(cid:876)ध(cid:467)नयम के लागू (cid:292)ावधान(cid:585) के अतं गत(cid:91) सम(cid:876)ु चत पर(cid:871)मट हो। 13. यान(cid:585) के संबधं म(cid:581) अनुपालन 13.1. ए(cid:274)ीगेटर यह सु(cid:467)नि(cid:230)चत करेगा (cid:873)क ऑन-बोडड(cid:566) (cid:284)ाइवर(cid:585) से संब(cid:622)ध मोटर यान (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत शत(cid:607) का अनुपालन करते ह(cid:585): (क) वधै पजं ीकरण हो; (ख) अ(cid:876)ध(cid:467)नयम के अनुसार वधै (cid:873)फटनेस (cid:292)माणप(cid:287) हो; (ग) सीएमवीआर म(cid:581) (cid:467)न(cid:465)द(cid:91)(cid:231)टानुसार पंजीकरण (cid:876)च(cid:233)न (cid:292)द(cid:871)शत(cid:91) करना; (घ) वधै ततृ ीय-प(cid:162) बीमा पॉ(cid:871)लसी हो ; (ङ) क(cid:581)(cid:289)(cid:547)य मोटर यान (cid:467)नयमावल(cid:547), 1989 के अंतगत(cid:91) आव(cid:230)यक वैध (cid:292)दषू ण (cid:467)नयं(cid:287)ण (cid:292)माणप(cid:287) हो। (च) ऐसे उ(cid:215)सजन(cid:91) मानदंड जो रा(cid:207)य सरकार (cid:622)वारा रा(cid:207)य या रा(cid:207)य के (cid:873)कसी शहर(cid:547) (cid:162)े(cid:287) के (cid:871)लए, जसै ा भी मामला हो, (cid:467)न(cid:465)द(cid:91)(cid:231)ट (cid:873)कए गए ह(cid:585); (छ) शहर (cid:874)व(cid:871)श(cid:231)ट (cid:579)धन मानदंड; (ज) लागू मोटर यान कर और अ(cid:219)य बकाया का भुगतान (cid:873)कया हो; (झ) मोटर यान पर अ(cid:876)ध(cid:467)नयम के अतं गत(cid:91) लगाए गए अपराध(cid:585) और उ(cid:227)लघं न(cid:585) से संब(cid:876)ं धत कोई भी बकाया चालान ना हो; (ञ) मोटर यान (मोटरसाइ(cid:873)कल(cid:585) को छोड़कर) के अदं र (cid:284)ाइवर के लाइस(cid:581)स और मोटर वाहन पर(cid:871)मट (य(cid:465)द लागू हो) क(cid:551) एक (cid:292)(cid:467)त (cid:292)द(cid:871)शत(cid:91) कर(cid:581)। उ(cid:200)त (cid:292)(cid:467)त (cid:284)ाइवर के बगल वाल(cid:547) अगल(cid:547) सीट के पीछे क(cid:551) ओर इस तरह से (cid:292)द(cid:871)शत(cid:91) होनी चा(cid:465)हए (cid:873)क मोटर यान म(cid:581) बैठे या(cid:466)(cid:287)य(cid:585) को (cid:232)प(cid:231)ट (cid:510)प से (cid:465)दखाई दे; 15 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(ट) सीएमवीआर के (cid:467)नयम 125ज के तहत अ(cid:467)नवाय(cid:91) (cid:510)प से एआईएस 140 के अनु(cid:510)प काया(cid:91)(cid:215)मक वाहन लोकेशन (cid:282)ै(cid:873)कंग (cid:875)डवाइस या (cid:871)स(cid:232)टम, एक प(cid:467)ै नक बटन के साथ ससु ि(cid:207)जत हो और रा(cid:207)य/सघं रा(cid:207)य (cid:162)े(cid:287) सरकार (cid:622)वारा (cid:232)था(cid:874)पत एक(cid:551)कृत कमांड और (cid:467)नयं(cid:287)ण क(cid:581)(cid:289) पर उपल(cid:222)ध वाहन लोकेशन (cid:282)ै(cid:873)कंग (cid:875)डवाइस से इले(cid:200)(cid:282)ॉ(cid:467)नक फ(cid:551)ड के साथ ए(cid:274)ीगेटर के (cid:467)नय(cid:287)ं ण क(cid:162) से जुड़ा हुआ हो; (ठ) लागू कानून के अनुसार चाइ(cid:227)ड लॉक मैके(cid:467)न(cid:207)म को (cid:467)नि(cid:231)(cid:272)य कर (cid:465)दया हो (तीन प(cid:465)हया वाहन(cid:585), मोटर साइ(cid:873)कल(cid:585) और बस(cid:585) को छोड़कर); (ड) क(cid:581)(cid:289)(cid:547)य लॉ(cid:873)कंग (cid:871)स(cid:232)टम के (cid:871)लए मनै ुअल ओवरराइड स(cid:873)(cid:272)य (cid:873)कया गया हो (लाग ू कानून के अनुसार तीन प(cid:465)हया वाहन(cid:585), मोटर साइ(cid:873)कल(cid:585), बस(cid:585) को छोड़कर); (ढ) मोटर यान (मोटर साइ(cid:873)कल(cid:585) को छोड़कर) के अंदर उपयु(cid:200)त (cid:162)मता का अि(cid:202)नशमन यं(cid:287) रखा गया हो; (ण) मोटर यान के अंदर एक (cid:292)ाथ(cid:871)मक (cid:876)च(cid:873)क(cid:215)सा (cid:873)कट रखी हो। 13.2. ए(cid:274)ीगेटर ऐसे वाहन(cid:585) को शा(cid:871)मल नह(cid:547)ं करेगा, जो वाहन के (cid:292)ारं(cid:871)भक पजं ीकरण क(cid:551) तार(cid:547)ख से आठ वष (cid:91) से अ(cid:876)धक समय से पजं ीकृत ह(cid:583) और यह सु(cid:467)नि(cid:230)चत करेगा (cid:873)क उसके (cid:622)वारा अपने वाहन म(cid:581) शा(cid:871)मल सभी वाहन(cid:585) को उनके (cid:292)ारं(cid:871)भक पजं ीकरण क(cid:551) तार(cid:547)ख से आठ वष (cid:91) से अ(cid:876)धक समय नह(cid:547)ं हुआ हो। 13.3. ए(cid:274)ीगेटर को अपने (cid:622)वारा संचा(cid:871)लत सभी मोटर वाहन(cid:585) के (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत द(cid:232)तावजे (cid:585) और अ(cid:871)भलेख(cid:585) का स(cid:215)यापन और रखरखाव करना होगा तथा वाहन पोट(cid:91)ल पर वा(cid:232)त(cid:874)वक समय के आधार पर इस डटे ा को (cid:292)मा(cid:872)णत करना होगा: (क) पजं ीकरण (cid:292)माणप(cid:287); (ख) अ(cid:876)ध(cid:467)नयम के अनुसार (cid:873)फटनेस (cid:292)माणप(cid:287); (ग) चे(cid:871)सस और इंजन नंबर; (घ) ततृ ीय-प(cid:162) बीमा पॉ(cid:871)लसी; (ङ) (cid:292)दषू ण (cid:467)नय(cid:287)ं ण (cid:292)माणप(cid:287); तथा (च) ऑन-बो(cid:875)डग(cid:589) से पहले ल(cid:466)ं बत ई-चालान(cid:585) क(cid:551) सं(cid:201)या और ऑन-बो(cid:875)डग(cid:589) से पहले उनका (cid:467)नपटान। 16 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202514. वेबसाइट, ऐप और (cid:292)ौ(cid:622)यो(cid:876)गक(cid:551) के सबं ंध म(cid:581) अनुपालन 14.1. ए(cid:274)ीगेटर अपने (cid:232)वा(cid:871)म(cid:215)व, पजं ीकृत पते, (cid:873)कराया सरं चना, (cid:274)ाहक सेवाओं के (cid:871)लए संपक(cid:91) क(cid:551) जानकार(cid:547), ई-मेल पता, इसके (cid:622)वारा द(cid:547) जाने वाल(cid:547) सेवाओं और अ(cid:219)य (cid:292)ासं(cid:876)गक (cid:874)ववरण(cid:585) को दशा(cid:91)ते हुए एक वेबसाइट को (cid:874)वक(cid:871)सत और इसका अनरु (cid:162)ण करेगा। 14.2. ऐप को इस तरह से (cid:874)वक(cid:871)सत (cid:873)कया जाएगा (cid:873)क यह लागू कानून के अनु(cid:510)प हो। 14.3. ऐप अ(cid:274)ं ेजी, (cid:465)हदं (cid:547) के साथ-साथ रा(cid:207)य/संघ रा(cid:207)य (cid:162)े(cid:287), जहां आ(cid:876)धका(cid:464)रक भाषा (cid:465)हदं (cid:547) नह(cid:547)ं है, वहां क(cid:551) आ(cid:876)धका(cid:464)रक भाषा म(cid:581) उपल(cid:222)ध होगा। 14.4. ए(cid:274)ीगेटर के ऐप क(cid:551) भ(cid:622)े यता और साइबर सुर(cid:162)ा को सीईआरट(cid:547)-इन (cid:622)वारा मा(cid:219)यता (cid:292)ा(cid:220)त और सूचीब(cid:622)ध साइबर सुर(cid:162)ा फम (cid:91) (cid:622)वारा (cid:292)मा(cid:872)णत (cid:873)कया जाएगा। 14.5. या(cid:287)ा का (cid:874)ववरण, या(cid:466)(cid:287)य(cid:585) का (cid:874)ववरण और (cid:873)कराया स(cid:465)हत परंतु इ(cid:219)ह(cid:547)ं तक सी(cid:871)मत न रहते हुए डटे ा ए(cid:274)ीगेटर के ऐप पर तैयार (cid:873)कया जाएगा और (cid:875)डिजटल (cid:229)यि(cid:200)तगत डटे ा संर(cid:162)ण अ(cid:876)ध(cid:467)नयम, 2023 स(cid:465)हत लाग ू (cid:467)नयम(cid:585) के अनुसार सं(cid:274)ह(cid:547)त (cid:873)कया जाएगा। 14.6. चालक को (cid:465)दए जाने वाले (cid:873)कराए और (cid:292)ो(cid:215)साहन(cid:585) के (cid:465)ह(cid:232)से का अनुपात, चालक (cid:873)कराया और (cid:874)वभािजत (cid:873)कराया (cid:874)ववरण और अ(cid:219)य जानकार(cid:547), जसै ा भी रा(cid:207)य सरकार (cid:622)वारा अ(cid:876)धस(cid:876)ू चत (cid:873)कया जाए, ए(cid:274)ीगेटर (cid:622)वारा अपनी वेबसाइट और ऐप म(cid:581) अ(cid:622)यतन जानकार(cid:547) सावज(cid:91) (cid:467)नक करते हुए सु(cid:467)नि(cid:230)चत (cid:873)कया जाएगा। 14.7. ऐप म(cid:581) एक ऐसी सु(cid:874)वधा शा(cid:871)मल होगी, जो या(cid:466)(cid:287)य(cid:585) को या(cid:287)ा पूर(cid:547) होने तक अपनी लाइव लोकेशन (अवि(cid:232)थ(cid:467)त) और या(cid:287)ा क(cid:551) ि(cid:232)थ(cid:467)त साझा करने म(cid:581) स(cid:162)म बनाएगी, उसके बाद लाइव लोकेशन साझा करने क(cid:551) सु(cid:874)वधा उपल(cid:222)ध नह(cid:547)ं होगी। 14.8. ऐप म(cid:581) (cid:874)वशेष सु(cid:874)वधाए ं शा(cid:871)मल ह(cid:585)गी, जो इसे (cid:465)द(cid:229)यांगजन(cid:585) के (cid:871)लए सलु भ बनाती ह(cid:583)। 14.9. ऐप ए(cid:274)ीगेटर के (cid:622)वारा ऐप पर ऑन-बोड (cid:91) (सवार) चालक क(cid:551) (cid:232)प(cid:231)ट और उ(cid:205)च- (cid:464)रज़ॉ(cid:227)यूशन वाल(cid:547) त(cid:232)वीर (cid:292)द(cid:871)शत(cid:91) करेगा। 17 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202514.10. ए(cid:274)ीगेटर (cid:620)यूट(cid:547) पर रहने के दौरान ऑन-बोड (cid:91) चालक(cid:585) के (cid:871)लए मादक पदाथ (cid:91) या अ(cid:227)कोहल के उपयोग के (cid:871)लए कठोर (जीरो टॉलर(cid:581)स) नी(cid:467)त तैयार करेगा और उसे लागू करेगा। ए(cid:274)ीगेटर अपनी नी(cid:467)त और इस संबधं म(cid:581) (cid:871)शकायत दज (cid:91) करने क(cid:551) (cid:292)(cid:873)(cid:272)या को अपनी वबे साइट और अपने ऐप पर अपलोड करेगा। ए(cid:274)ीगेटर अपनी कठोर (जीरो टॉलर(cid:581)स) नी(cid:467)त के उ(cid:227)लंघन के आरोप वाल(cid:547) (cid:871)शकायत (cid:292)ा(cid:220)त होने पर जांच लं(cid:466)बत रहने तक चालक को तुरंत और त(cid:215)काल ऑफ-बोड (cid:91) कर देगा। ए(cid:274)ीगेटर (cid:622)वारा जांच क(cid:551) अव(cid:876)ध के दौरान (cid:467)नलबं न जार(cid:547) रहेगा। 14.11. या(cid:287)ा करने वाले चालक क(cid:551) संपक(cid:91) संबधं ी जानकार(cid:547) या(cid:287)ा क(cid:551) समाि(cid:220)त से कम स े कम सात (7) (cid:465)दन(cid:585) के (cid:871)लए ऐप के मा(cid:218)यम से या(cid:287)ी को उपल(cid:222)ध होगी; 14.12. ए(cid:274)ीगेटर 24x7 संचालन के साथ एक (cid:467)नयं(cid:287)ण क(cid:162) (cid:232)था(cid:874)पत करेगा और यह सु(cid:467)नि(cid:230)चत करेगा (cid:873)क ऑनबोड (cid:91) (cid:873)कए गए सभी मोटर वाहन (cid:467)नय(cid:287)ं ण क(cid:162) के साथ (cid:467)नबा(cid:91)ध संपक(cid:91) बनाए रख(cid:581)। (cid:467)नयं(cid:287)ण क(cid:162) मोटर वाहन(cid:585) और उसम(cid:581) सवार चालक(cid:585) क(cid:551) ग(cid:467)त(cid:874)व(cid:876)धय(cid:585) पर नजर रखेगा। 14.13. ए(cid:274)ीगेटर एक स(cid:873)(cid:272)य टेल(cid:547)फोन नंबर और ई-मेल पते के साथ एक कॉल सट(cid:581) र (cid:232)था(cid:874)पत करेगा, जो इसक(cid:551) वेबसाइट और ऐप पर (cid:232)प(cid:231)ट (cid:510)प से (cid:292)द(cid:871)शत(cid:91) होगा, जो 24x7 चालू रहेगा और अ(cid:274)ं ेजी के साथ-साथ रा(cid:207)य क(cid:551) आ(cid:876)धका(cid:464)रक भाषा म(cid:581) सहायता (cid:292)दान करेगा। ये कॉल सट(cid:581) र (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत के (cid:871)लए िज(cid:224)मेदार ह(cid:585)गे: (क) या(cid:287)ी और/या चालक या (cid:873)कसी अ(cid:219)य (cid:229)यि(cid:200)त को या(cid:287)ा या सवार चालक आ(cid:465)द से सबं (cid:876)ं धत म(cid:622)ु द(cid:585) के बारे म(cid:581) कॉल स(cid:581)टर से संपक(cid:91) करने म(cid:581) स(cid:162)म बनाना; (ख) या(cid:287)ी क(cid:551) (cid:871)शकायत(cid:585) का (cid:467)नवारण सु(cid:467)नि(cid:230)चत करना। 14.14. मोटर वाहन या ए(cid:274)ीगेटर (cid:622)वारा (cid:465)दए गए सवार चालक से जुड़ी दघु ट(cid:91) ना या घटना क(cid:551) जांच करने वाले (cid:874)व(cid:876)धवत अ(cid:876)धकृत अ(cid:876)धका(cid:464)रय(cid:585) के साथ ए(cid:274)ीगेटर सहयोग करेगा। 18 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202515. या(cid:466)(cid:287)य(cid:585) क(cid:551) सुर(cid:162)ा सु(cid:467)नि(cid:230)चत करने के (cid:871)लए अनुपालन ए(cid:274)ीगेटर या(cid:466)(cid:287)य(cid:585) क(cid:551) सुर(cid:162)ा से सबं ं(cid:876)धत (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत शत(cid:607) का अनुपालन सु(cid:467)नि(cid:230)चत करेगा, अथा(cid:91)त:् 15.1. मोटर वाहन(cid:585) म(cid:581) स(cid:232)ं था(cid:874)पत वाहन क(cid:551) अवि(cid:232)थ(cid:467)त और (cid:282)ै(cid:873)कंग (cid:875)डवाइस, जसै ा भी लाग ू हो, ठ(cid:548)क से काय (cid:91) करते ह(cid:583) और इससे सचू ना (cid:292)ा(cid:220)त होती है और साथ ह(cid:547) रा(cid:207)य सरकार के इंटे(cid:274)ेटेड कमांड एडं कं(cid:282)ोल स(cid:581)टर से जुड़ी हुई हो। (cid:232)प(cid:231)ट(cid:547)करण: इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के (cid:292)योजन(cid:585) के (cid:871)लए, वाहन क(cid:551) अवि(cid:232)थ(cid:467)त (लोकेशन) का पता लगान े वाले उपकरण(cid:585) म(cid:581) मोटरसाइ(cid:873)कल और (cid:467)तप(cid:465)हया वाहन(cid:585) स(cid:465)हत सभी मोटर वाहन(cid:585) के (cid:871)लए इन-ऐप अवि(cid:232)थ(cid:467)त (cid:282)ै(cid:873)कंग शा(cid:871)मल होगी। 15.2. चालक ऐप म(cid:581) बताए गए माग (cid:91) का अनुसरण करेगा। एक अंत(cid:467)न(cid:91)(cid:465)हत काय (cid:91) तं(cid:287) के मा(cid:218)यम से और (cid:873)कसी भी (cid:874)वचलन के मामले म(cid:581), ऐप (cid:467)नयं(cid:287)ण क(cid:162) को संकेत देगा, जो तुरंत चालक और या(cid:287)ी से संपक(cid:91) करेगा। 15.3. या(cid:466)(cid:287)य(cid:585) क(cid:551) सुर(cid:162)ा, (cid:874)वशेष (cid:510)प से ब(cid:205)च(cid:585), म(cid:465)हलाओ ं और (cid:465)द(cid:229)यांग या(cid:466)(cid:287)य(cid:585) क(cid:551) सुर(cid:162)ा और लागू (cid:467)नयम(cid:585) का अनुपालन सु(cid:467)नि(cid:230)चत (cid:873)कया जाना। 15.4. ऐप पर एक काय (cid:91) तं(cid:287) (cid:465)दया जाए ता(cid:873)क यह स(cid:215)या(cid:874)पत (cid:873)कया जा सके (cid:873)क या(cid:287)ा करने वाले चालक क(cid:551) पहचान ऑन-बो(cid:875)डग(cid:589) (cid:292)(cid:873)(cid:272)या के दौरान पु(cid:871)लस (cid:622)वारा पजं ीकृत और स(cid:215)या(cid:874)पत क(cid:551) गई पहचान के समान है या नह(cid:547)ं। 15.5. ऑन-बोड (cid:91) (cid:873)कए गए मोटर वाहन(cid:585) क(cid:551) ए(cid:274)ीगेटर (cid:622)वारा अ(cid:876)धकृत क(cid:871)मय(cid:91) (cid:585) (cid:622)वारा (cid:467)नय(cid:871)मत जांच क(cid:551) जाती है। 16. ए(cid:274)ीगेटर (cid:622)वारा अपनाई जाने वाल(cid:547) गैर-भेदभाव नी(cid:467)त ए(cid:274)ीगेटर, ऑन-बोड (cid:91) (cid:873)कए गए चालक(cid:585) या ऐसे ऑन-बोड (cid:91) (cid:873)कए गए चालक(cid:585) को मोटर वाहन उपल(cid:222)ध कराने वाले (cid:873)कसी तीसरे प(cid:162) के (cid:232)वा(cid:871)म(cid:215)व वाले मोटर वाहन(cid:585) को अपने (cid:232)वा(cid:871)म(cid:215)व वाले मोटर वाहन(cid:585) के बराबर मानेगा। 19 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202517. (cid:873)कराये का (cid:874)व(cid:467)नयमन 17.1. मोटर वाहन(cid:585) क(cid:551) संबं(cid:876)धत (cid:302)ेणी या वग (cid:91) के (cid:871)लए रा(cid:207)य सरकार (cid:622)वारा अ(cid:876)धस(cid:876)ू चत (cid:873)कराया, ए(cid:274)ीगेटर से सेवाएँ (cid:292)ा(cid:220)त करने वाले या(cid:466)(cid:287)य(cid:585) से वसलू ा जाने वाला आधार (cid:873)कराया होगा। 17.2. (cid:466)बना या(cid:287)ी के या(cid:287)ा क(cid:551) गई दरू (cid:547) और या(cid:287)ा क(cid:551) दरू (cid:547) और या(cid:287)ी(ओं) को लेने के (cid:871)लए उपयोग (cid:873)कए गए (cid:579)धन स(cid:465)हत डडे माइलेज क(cid:551) भरपाई के (cid:871)लए (cid:219)यनू तम तीन (3) (cid:873)कलोमीटर के (cid:871)लए लगाया गया आधार (cid:873)कराया होगा। 17.3. ए(cid:274)ीगेटर को आधार (cid:873)कराए स े (cid:219)यूनतम 50% कम और उप-खंड (17.1) के तहत (cid:874)व(cid:467)न(cid:465)द(cid:91)(cid:231)ट आधार (cid:873)कराए का अ(cid:876)धकतम दो गुना ग(cid:467)तशील म(cid:227)ू य (cid:467)नधा(cid:91)रण करने क(cid:551) अनुम(cid:467)त होगी। 17.4. ए(cid:274)ीगेटर के साथ मोटर वाहन के साथ ऑनबोड (cid:91) (cid:873)कए गए चालक को चालक के (cid:873)कराए के तहत सभी लागत(cid:585) स(cid:465)हत लागू (cid:873)कराए का कम से कम 80% (cid:292)ा(cid:220)त होगा और शेष शु(cid:227)क ए(cid:274)ीगेटर (cid:622)वारा आब(cid:465)ं टत (cid:873)कराए के (cid:510)प म(cid:581) रखा जा सकता है। चालक और ए(cid:274)ीगेटर के बीच समझौते के अनुसार भुगतान दै(cid:467)नक, सा(cid:220)ता(cid:465)हक या पा(cid:879)(cid:162)क (cid:510)प से (cid:873)कया जा सकता है, ले(cid:873)कन बाद म(cid:581) नह(cid:547)ं। 17.5. ए(cid:274)ीगेटर के (cid:232)वा(cid:871)म(cid:215)व वाले मोटर वाहन(cid:585) के संबधं म(cid:581) ऑनबोड (cid:91) (cid:873)कए गए चालक को चालक (cid:873)कराए म(cid:581) (cid:874)व(cid:467)न(cid:465)द(cid:91)(cid:231)ट सभी लागत(cid:585) स(cid:465)हत लाग ू (cid:873)कराए का कम से कम 60% (cid:292)ा(cid:220)त होगा और शेष श(cid:227)ु क (cid:874)वभािजत (cid:873)कराए के (cid:510)प म(cid:581) रखा जाएगा। 17.6. उप-खडं (17.4) या (17.5) के तहत कवर नह(cid:547)ं (cid:873)कए गए (cid:873)कसी भी अ(cid:219)य प(cid:464)र(cid:506)(cid:230)य के संबधं म(cid:581), चालक को ए(cid:274)ीगेटर के साथ अपने समझौते के अनसु ार भगु तान (cid:292)ा(cid:220)त होगा। 17.7. उन रा(cid:207)य(cid:585) म(cid:581) जहां (cid:873)कराया रा(cid:207)य सरकार (cid:622)वारा (cid:467)नधा(cid:91)(cid:464)रत नह(cid:547)ं (cid:873)कया गया है, (cid:873)कराया (cid:874)व(cid:467)नयमन के (cid:292)योजन(cid:585) के (cid:871)लए ए(cid:274)ीगेटर (cid:622)वारा आधार (cid:873)कराया रा(cid:207)य सरकार को अ(cid:876)धसू(cid:876)चत (cid:873)कया जा सकता है और जब तक रा(cid:207)य सरकार (cid:873)कराया (cid:467)नधा(cid:91)(cid:464)रत नह(cid:547)ं करती है, तब तक इसका पालन (cid:873)कया जाएगा। इसी (cid:292)कार, रा(cid:207)य म(cid:581) ए(cid:274)ीगेशन के (cid:871)लए अनुमत अ(cid:219)य (cid:302)े(cid:872)णय(cid:585) के वाहन(cid:585) के (cid:871)लए (cid:467)नधा(cid:91)रण रा(cid:207)य सरकार (cid:622)वारा (cid:873)कया जाएगा। 20 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202517.8. (cid:873)कसी भी या(cid:287)ी से डडे माइलेज के (cid:871)लए श(cid:227)ु क नह(cid:547)ं (cid:871)लया जाएगा, (cid:871)सवाय इसके (cid:873)क सवार(cid:547) का लाभ उठाने क(cid:551) दरू (cid:547) उप-खडं (17.2) के तहत उि(cid:227)ल(cid:872)खत तीन (3) (cid:873)कलोमीटर से कम हो और (cid:873)कराया केवल या(cid:287)ा के आरंभ (cid:466)बदं ु से गंत(cid:229)य (cid:466)बदं ु तक (cid:871)लया जाएगा जहां या(cid:287)ी को छोड़ा जाता है। 18. या(cid:287)ा (cid:467)नर(cid:232)त करना 18.1. ऐप पर या(cid:287)ा (cid:232)वीकार करने के बाद चालक (cid:622)वारा ब(cid:873)ु कंग (cid:467)नर(cid:232)त करने पर, (cid:873)कराए का 10% जमु ा(cid:91)ना लगाया जाएगा जो 100 (cid:509)पये से अ(cid:876)धक नह(cid:547)ं होगा, बशत(cid:566) (cid:873)क ऐसा (cid:467)नर(cid:232)तीकरण ए(cid:274)ीगेटर (cid:622)वारा वैध कारण के (cid:466)बना (cid:873)कया गया हो और ए(cid:274)ीगेटर क(cid:551) वेबसाइट और ऐप पर (cid:874)व(cid:876)धवत और (cid:874)वशेष (cid:510)प से उ(cid:227)लेख (cid:873)कया गया हो। 18.2. ऐप पर या(cid:287)ा बकु करने के बाद या(cid:287)ी (cid:622)वारा ब(cid:873)ु कंग (cid:467)नर(cid:232)त करने पर, (cid:873)कराए का 10% जमु ा(cid:91)ना लगाया जाएगा जो 100 (cid:509)पये से अ(cid:876)धक नह(cid:547)ं होगा, बशत(cid:566) (cid:873)क ऐसा (cid:467)नर(cid:232)तीकरण ए(cid:274)ीगेटर क(cid:551) वेबसाइट और ऐप पर (cid:874)व(cid:876)धवत और (cid:874)वशेष (cid:510)प से उ(cid:227)लेख (cid:873)कए (cid:466)बना (cid:873)कया गया हो। ऐसी (cid:873)कराया रा(cid:871)श चालक और ए(cid:274)ीगेटर के बीच उसी अनुपात म(cid:581) (cid:874)वभािजत क(cid:551) जाएगी जैसा (cid:873)क इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के खडं 15 के तहत बताया गया है। 19. जमु ा(cid:91)ना य(cid:465)द कोई जमु ा(cid:91)ना, जसै ा (cid:873)क ऊपर खडं 18 के तहत (cid:292)ावधान (cid:873)कया गया है, चालक या ए(cid:274)ीगेटर पर लगाया जाता है, तो उसे चालक या ए(cid:274)ीगेटर के खंड 17 म(cid:581) (cid:874)व(cid:467)न(cid:465)द(cid:91)(cid:231)ट संब(cid:876)ं धत (cid:465)ह(cid:232)से से काट (cid:871)लया जाएगा। 20. ए(cid:274)ीगेटस (cid:91) (cid:622)वारा सतत (cid:221)ल(cid:547)ट (cid:292)बधं न रा(cid:207)य सरकार ए(cid:274)ीगेटस (cid:91) को (cid:467)नद(cid:566)श दे सकती है (cid:873)क वे अपने बेड़ े म(cid:581) इलेि(cid:200)(cid:282)क, वकै ि(cid:227)पक (cid:579)धन या श(cid:219)ू य उ(cid:215)सजन(cid:91) वाहन(cid:585) का (cid:292)(cid:467)तशत वा(cid:874)षक(cid:91) आधार पर (cid:272)(cid:871)मक (cid:510)प से बढ़ाएँ। 21. (cid:465)द(cid:229)यांगजन अनुकूल बड़े े को शा(cid:871)मल करना रा(cid:207)य सरकार रा(cid:207)य म(cid:581) आव(cid:230)यक (cid:465)द(cid:229)यांगजन अनुकूल मोटर वाहन(cid:585) क(cid:551) पया(cid:91)(cid:220)त स(cid:201)ं या (cid:467)नधा(cid:91)(cid:464)रत करेगी और ए(cid:274)ीगेटस (cid:91) को (cid:467)नद(cid:566)श देगी (cid:873)क वे अपने बेड़ े म(cid:581) आनुपा(cid:467)तक (cid:510)प से ऐसे वाहन(cid:585) को शा(cid:871)मल कर(cid:581)। 21 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202522. इलेि(cid:200)(cid:282)क मो(cid:466)ब(cid:871)लट(cid:547) म(cid:581) प(cid:464)रवतन(cid:91) ए(cid:274)ीगेटर को अपने बड़े े म(cid:581) इलेि(cid:200)(cid:282)क वाहन(cid:585) को शा(cid:871)मल करने के (cid:871)लए (cid:467)नधा(cid:91)(cid:464)रत ल(cid:234)य(cid:585) का अ(cid:467)नवाय (cid:91) (cid:510)प से पालन करना होगा। ल(cid:234)य वाय ु गुणव(cid:419)ा को (cid:874)व(cid:467)नय(cid:871)मत करने के (cid:871)लए िज(cid:224)मेदार एक उपयु(cid:200)त सरकार(cid:547) संगठन या रा(cid:207)य सरकार (cid:622)वारा तय (cid:873)कए जाएगँ े। 23. ए(cid:274)ीगेटस (cid:91) (cid:622)वारा गैर-प(cid:464)रवहन मोटरसाइ(cid:873)कल(cid:585) का एक(cid:287)ीकरण (ए(cid:274)ीगेशन) 23.1. रा(cid:207)य सरकार ए(cid:274)ीगेटस (cid:91) के मा(cid:218)यम से साझा मो(cid:466)ब(cid:871)लट(cid:547) के (cid:510)प म(cid:581) या(cid:466)(cid:287)य(cid:585) (cid:622)वारा या(cid:287)ा के (cid:871)लए गैर-प(cid:464)रवहन मोटरसाइ(cid:873)कल(cid:585) के एक(cid:287)ीकरण क(cid:551) अनुम(cid:467)त दे सकती है, िजसके प(cid:464)रणाम(cid:232)व(cid:510)प यातायात क(cid:551) भीड़भाड़ और वाहन (cid:292)दषू ण म(cid:581) कमी आएगी, साथ ह(cid:547) अ(cid:219)य बात(cid:585) के साथ-साथ वहनीय या(cid:287)ी मो(cid:466)ब(cid:871)लट(cid:547), हाइपरलोकल (cid:875)डल(cid:547)वर(cid:547) और आजी(cid:874)वका के अवसर उ(cid:215)प(cid:219)न ह(cid:585)गे। 23.2. रा(cid:207)य सरकार अ(cid:876)ध(cid:467)नयम क(cid:551) धारा 67 क(cid:551) उप-धारा (3) के तहत अपनी शि(cid:200)तय(cid:585) का (cid:292)योग करते हुए या(cid:466)(cid:287)य(cid:585) (cid:622)वारा या(cid:287)ा के (cid:871)लए गैर-प(cid:464)रवहन मोटरसाइ(cid:873)कल(cid:585) के ए(cid:274)ीगेशन क(cid:551) अनुम(cid:467)त दे सकती है। 23.3. रा(cid:207)य सरकार अ(cid:876)ध(cid:467)नयम क(cid:551) धारा 67 क(cid:551) उप-धारा (3) के तहत ए(cid:274)ीगेटर पर गैर- प(cid:464)रवहन मोटरसाइ(cid:873)कल(cid:585) को ऐसे ए(cid:274)ीगेटर के मा(cid:218)यम से या(cid:287)ा करने क(cid:551) अनुम(cid:467)त देने वाले (cid:292)ा(cid:876)धकरण जार(cid:547) करने के (cid:871)लए दै(cid:467)नक/सा(cid:220)ता(cid:465)हक/पा(cid:879)(cid:162)क आधार पर शु(cid:227)क लगा सकती है, जसै ा (cid:873)क रा(cid:207)य सरकार (cid:622)वारा (cid:467)नधा(cid:91)(cid:464)रत (cid:873)कया जा सकता है। 23.4. इस खडं के अतं गत(cid:91) ए(cid:274)ीगेटर (cid:622)वारा चालक(cid:585) क(cid:551) ऑन-बो(cid:875)डग(cid:589) इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) के अतं गत(cid:91) (cid:467)नधा(cid:91)(cid:464)रत अनुपालन को पूरा करेगी। 24. ए(cid:274)ीगेटर क(cid:551) लाईस(cid:581)स का (cid:467)नलंबन 24.1. ए(cid:274)ीगेटर को (cid:465)दये गए लाईसस(cid:581) को स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा (cid:871)ल(cid:872)खत कारण(cid:585) से ("(cid:467)नलबं न आदेश"), या तो (cid:232)वयं या ए(cid:274)ीगेटर के (cid:872)खलाफ (cid:871)शकायत (cid:292)ा(cid:220)त होने पर स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा क(cid:551) गई जांच के बाद (cid:467)नल(cid:466)ं बत (cid:873)कया जा सकता है। 24.2. (cid:467)नलंबन क(cid:551) अव(cid:876)ध तीन (3) मह(cid:547)ने तक बढ़ाई जा सकती है। 22 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202524.3. (cid:467)नलंबन आदेश स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा ए(cid:274)ीगेटर को ऐसी (cid:871)शकायत (cid:292)ा(cid:220)त होने या कार(cid:91)वाई श(cid:510)ु होने के दस (10) (cid:465)दन(cid:585) के भीतर सुनवाई (cid:873)कये जाने के बाद पा(cid:464)रत (cid:873)कया जाएगा। 24.4. अ(cid:219)य बात(cid:585) के साथ-साथ (cid:467)न(cid:224)न(cid:871)ल(cid:872)खत आधार(cid:585) को लाईस(cid:581)स के (cid:467)नलंबन के आधार के (cid:510)प म(cid:581) माना जाएगा: (क) रा(cid:207)य सरकार (cid:622)वारा (cid:467)नधा(cid:91)(cid:464)रत (cid:287)मै ा(cid:871)सक रे(cid:465)टगं मापदंड(cid:585) के तक(cid:91)संगत (cid:874)व(cid:230)लेषण के मा(cid:218)यम से या(cid:287)ी और/या चालक क(cid:551) सुर(cid:162)ा स(cid:467)ु नि(cid:230)चत करने म(cid:581) ए(cid:274)ीगेटर क(cid:551) (cid:874)वफलता; या (ख) या(cid:466)(cid:287)य(cid:585) से (cid:871)लए जाने वाले (cid:873)कराए के सबं ंध म(cid:581) लगातार मामले, डायना(cid:871)मक (cid:873)कराए को अनु(cid:876)चत (cid:510)प से लगाना, (cid:284)ाइवर(cid:585) और ए(cid:274)ीगेटर के बीच (cid:873)कराए के आनुपा(cid:467)तक (cid:874)वभाजन के (cid:871)लए (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) का अनुपालन न करना, (cid:284)ाइवर(cid:585) पर (cid:467)नराधार शु(cid:227)क लगाना; या (ग) (cid:284)ाइवर(cid:585) के साथ अनुबधं म(cid:581) (cid:467)न(cid:465)हत दा(cid:467)य(cid:215)व(cid:585) का अनुपालन करने म(cid:581) ए(cid:274)ीगेटर क(cid:551) (cid:874)वफलता; या (घ) इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) का अनुपालन करने म(cid:581) ए(cid:274)ीगेटर क(cid:551) (cid:874)वफलता; (ङ) या(cid:466)(cid:287)य(cid:585) क(cid:551) सुर(cid:162)ा और/या (cid:284)ाइवर(cid:585) के (cid:465)हत को खतरे म(cid:581) डालना; (च) ए(cid:274)ीगेटर (cid:622)वारा सुर(cid:162)ा मानक(cid:585) का उ(cid:227)लघं न िजसके प(cid:464)रणाम(cid:232)व(cid:510)प सड़क दघु ट(cid:91) नाएं होती ह(cid:583); (छ) ए(cid:274)ीगेटर के खात(cid:585) क(cid:551) लेखापर(cid:547)(cid:162)ा के मा(cid:218)यम से (cid:292)ा(cid:220)त (cid:874)व(cid:419)ीय अ(cid:467)नय(cid:871)मतताओं क(cid:551) गंभीरता; और (ज) कोई अ(cid:219)य परै ामीटर िजसे स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा उ(cid:876)चत और उपयु(cid:200)त समझना। बशत(cid:566) (cid:873)क य(cid:465)द स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) क(cid:551) राय है (cid:873)क ए(cid:274)ीगेटर का लाईस(cid:581)स (cid:467)नलं(cid:466)बत करना समीचीन या (cid:229)यवहाय (cid:91) नह(cid:547)ं होगा, तो वह ऐसे ए(cid:274)ीगेटर पर जमु ा(cid:91)ना (cid:467)नधा(cid:91)(cid:464)रत कर सकता है और जमु ा(cid:91)ना लगा सकता है, जो क(cid:876)थत उ(cid:227)लंघन क(cid:551) मा(cid:287)ा और गंभीरता के आधार पर एक (1) करोड़ (cid:509)पये तक होगा, ले(cid:873)कन एक (1) लाख (cid:509)पये से कम नह(cid:547)ं होगा। 23 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202524.5. जब लाईसस(cid:581) को (cid:467)नलं(cid:466)बत (cid:873)कया जाता है, तो ए(cid:274)ीगेटर लाईसस(cid:581) के तहत सभी प(cid:464)रचालन(cid:585) को तुरंत रोक देगा जब तक (cid:873)क (cid:467)नलंबन (cid:467)नर(cid:232)त नह(cid:547)ं हो जाता या (cid:467)नलंबन क(cid:551) अव(cid:876)ध समा(cid:220)त नह(cid:547)ं हो जाती। (क) (cid:467)नलंबन क(cid:551) अव(cid:876)ध समा(cid:220)त होने से पहले, ए(cid:274)ीगेटर (cid:871)ल(cid:872)खत (cid:510)प म(cid:581) वचनब(cid:622)धता के मा(cid:218)यम से यह वचनब(cid:622)धता देगा (cid:873)क (cid:467)नलंबन आदेश के तहत (cid:467)न(cid:465)द(cid:91)(cid:231)ट उसके (cid:467)नलबं न के आधार समा(cid:220)त हो गए ह(cid:583)। (ख) स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) इसके बाद (cid:467)नलंबन आदेश पा(cid:464)रत करने के आधार(cid:585) के समाधान और ए(cid:274)ीगेटर (cid:622)वारा वचनब(cid:622)धता क(cid:551) (cid:292)ाि(cid:220)त को (cid:232)वीकार करते हुए एक और आदेश पा(cid:464)रत करेगा। (ग) इसके बाद, ए(cid:274)ीगेटर एक अव(cid:876)ध के (cid:871)लए प(cid:464)रचालन (cid:873)फर से श(cid:510)ु करेगा जो दो (2) माह स े कम नह(cid:547)ं होगी, परंतु छह (6) मह(cid:547)ने तक बढ़ाई जा सकती है, ("प(cid:464)रवी(cid:162)ा अव(cid:876)ध") िजसके दौरान, ए(cid:274)ीगेटर प(cid:464)रचालन जार(cid:547) रखगे ा और इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) का अनुपालन स(cid:467)ु नि(cid:230)चत करेगा और इस अव(cid:876)ध के दौरान कोई भी उ(cid:227)लंघन जो लाईस(cid:581)स के (cid:467)नलंबन के (cid:871)लए कार(cid:91)वाई का कारण बन सकता है, खडं (25) के तहत लाईसस(cid:581) को सीधे (cid:467)नर(cid:232)त कर सकता है। 25. ए(cid:274)ीगेटर लाईस(cid:581)स को (cid:467)नर(cid:232)त करना और उसे वापस करना 25.1. जहां, (क) ए(cid:274)ीगेटर ने तीन (cid:874)व(cid:419)ीय वष(cid:607) क(cid:551) अव(cid:876)ध के भीतर अपना लाईस(cid:581)स (cid:467)नलं(cid:466)बत कर (cid:465)दया है और खडं 24 के तहत एक और उ(cid:227)लंघन (cid:873)कया है जो (cid:467)नलंबन के (cid:871)लए कार(cid:91)वाई का कारण बन सकता है; या (ख) ए(cid:274)ीगेटर ने इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) का उ(cid:227)लंघन (cid:873)कया है या करवाया है, जो इस तरह क(cid:551) गंभीर (cid:292)कृ(cid:467)त का है (cid:873)क या(cid:287)ी या चालक क(cid:551) सरु (cid:162)ा को खतरा हो। स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) ऐसे ए(cid:274)ीगेटर को कारण बताने के (cid:871)लए नो(cid:465)टस जार(cid:547) करेगा (cid:873)क उ(cid:219)ह(cid:581) (cid:465)दये गए लाईस(cid:581)स को (cid:467)नर(cid:232)त (cid:200)य(cid:585) नह(cid:547)ं (cid:873)कया जाना चा(cid:465)हए। 24 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202525.2. स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547), उपयु(cid:200)(cid:91) त खडं (25.1) के अधीन कारण बताओ नो(cid:465)टस जार(cid:547) करने के दस (10) (cid:465)दन(cid:585) के भीतर ए(cid:274)ीगेटर को सनु वाई का अवसर (cid:292)दान कर सकेगा और उसके बाद तक(cid:91)पूण (cid:91) आदेश के मा(cid:218)यम से लाईस(cid:581)स (cid:467)नर(cid:232)त करने या अ(cid:219)यथा (cid:467)नणय(cid:91) ले सकेगा तथा ऐसे समाि(cid:220)त को अ(cid:219)य रा(cid:207)य(cid:585) और क(cid:581) (cid:289) सरकार के सं(cid:163)ान म(cid:581) ला सकेगा। 25.3. जहां लाईस(cid:581)स (cid:467)नर(cid:232)त (cid:873)कया जाता है, ए(cid:274)ीगेटर लाईस(cid:581)स के तहत सभी प(cid:464)रचालन तुरंत बंद कर देगा। 25.4. स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा पा(cid:464)रत (cid:467)नर(cid:232)तीकरण आदेश पर (cid:292)(cid:467)तकूल (cid:292)भाव डाले (cid:466)बना, सुर(cid:162)ा जमा ज(cid:222)त हो जाएगी। 25.5. ए(cid:274)ीगेटर (cid:873)कसी भी समय (cid:232)व(cid:205)े छा से लाईस(cid:581)स सर(cid:581)डर कर सकता है और ऐसे सर(cid:581)डर पर, बकाया रा(cid:871)श, य(cid:465)द कोई हो, के कारण कटौती के बाद सुर(cid:162)ा जमा ए(cid:274)ीगेटर को वापस कर द(cid:547) जाएगी। 26. अपील 26.1. स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा पा(cid:464)रत (cid:873)कसी (cid:467)नलंबन या (cid:467)नर(cid:232)तीकरण के आदेश से (cid:229)य(cid:876)थत ए(cid:274)ीगेटर, ऐसे आदेश क(cid:551) (cid:292)ाि(cid:220)त के तीस (30) (cid:465)दन(cid:585) के भीतर, (cid:874)ववा(cid:465)दत आदेश के (cid:874)व(cid:509)(cid:622)ध अपील क(cid:551) सुनवाई के (cid:871)लए रा(cid:207)य सरकार (cid:622)वारा नाम(cid:467)न(cid:465)द(cid:91)(cid:231)ट अ(cid:876)धस(cid:876)ू चत अपील(cid:547)य (cid:292)ा(cid:876)धकार(cid:547) को अपील कर सकता है। 26.2. अपील (cid:163)ापन के (cid:510)प म(cid:581) होगी, िजसम(cid:581) अपील के आधार(cid:585) को (cid:232)प(cid:231)ट (cid:873)कया जाएगा और उसके साथ रा(cid:207)य सरकार (cid:622)वारा (cid:467)नधा(cid:91)(cid:464)रत अपील के (cid:871)लए अपे(cid:879)(cid:162)त शु(cid:227)क और स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547) (cid:622)वारा पा(cid:464)रत आदेश क(cid:551) (cid:292)(cid:467)त सलं (cid:202)न करनी होगी। 26.3. अपील(cid:547)य (cid:292)ा(cid:876)धकार(cid:547) ए(cid:274)ीगेटर को सनु वाई का अवसर (cid:292)दान करेगा तथा अपील दायर करन े क(cid:551) (cid:467)त(cid:876)थ से 60 (cid:465)दन(cid:585) क(cid:551) अव(cid:876)ध के भीतर अपील पर (cid:467)नणय(cid:91) करेगा। 26.4. अपील पर (cid:467)नणय(cid:91) करते समय अपील(cid:547)य (cid:292)ा(cid:876)धकार(cid:547) ऐसे आदेश पा(cid:464)रत करेगा, जसै ा वह उ(cid:876)चत समझ।े 25 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 202527. रा(cid:207)य सरकार क(cid:551) शि(cid:200)तयां 27.1. रा(cid:207)य सरकार (cid:871)ल(cid:872)खत नो(cid:465)टस के मा(cid:218)यम से ए(cid:274)ीगेटर से ऐसी सूचना द(cid:232)तावेज या अ(cid:871)भलेख मागं ने के (cid:871)लए सश(cid:200)त होगी, जसै ा वह ए(cid:274)ीगेटर (cid:622)वारा इन (cid:465)दशा(cid:467)नद(cid:566)श(cid:585) का अनुपालन सु(cid:467)नि(cid:230)चत करने के (cid:871)लए उ(cid:876)चत समझ।े मांगी गई सचू ना म(cid:581) ए(cid:274)ीगेटर के (cid:874)व(cid:509)(cid:622)ध जांच करने क(cid:551) शि(cid:200)त भी शा(cid:871)मल होगी। 27.2. रा(cid:207)य सरकार ए(cid:274)ीगेटर को वाहन तथा सारथी पोट(cid:91)ल के मा(cid:218)यम से शा(cid:871)मल (cid:873)कए गए वाहन(cid:585), चालक(cid:585) तथा वाहन मा(cid:871)लक(cid:585) के (cid:874)ववरण को (cid:292)मा(cid:872)णत करने हेतु स(cid:162)म बनाएगी। 26 मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श 2025(cid:292)प(cid:287) I [खंड 4.1 देख(cid:581)] मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श, 2025 के तहत ए(cid:274)ीगेटर के (cid:871)लए लाईसस(cid:581) (cid:292)दान करने हेतु आवेदन सेवा म(cid:581), [पदनाम], [रा(cid:207)य का नाम] स(cid:162)म (cid:292)ा(cid:876)धकार(cid:547), [रा(cid:207)य का नाम] मोटर यान ए(cid:274)ीगेटर (cid:465)दशा(cid:467)नद(cid:566)श, 2025 के अतं गत(cid:91) रा(cid:207)य [ रा(cid:207)य का नाम] म(cid:581) ए(cid:274)ीगेटर के (cid:510)प म(cid:581) संचालन हेतु लाईसस(cid:581) (cid:292)दान करने के (cid:871)लए आवदे न करता/करती हूँ । 1. परू ा नाम 2.
