ददल् ली, 23 जसतम् बर, 2021 सा.का.जन. 653(ऄ).—मोटर यान (यान स्ट् रेपिंग सपग साजवधा का रजजस्ट् रीकरण और काय)ग जनयम, 2021 का प्रारूप मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 212 की ईपधारा (1) के ऄधीन यथाऄपेजित, भारत सरकार के सड़क पररवहन और राजमागग मंत्रालय की ऄजधसूचना संख् या सा.का.जन. 190(ऄ) तारीख 15 माचग, 2021 द्वारा भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3, ईपखंड (i) म ें प्रकाजित दकया गया था जजसमें ईन व् यज‍त यस से जजनका आसस े प्रभाजवत होना संभाव् य ह ईस तारीख स,े जजसको ई‍त ऄजधसचू ना म ें ऄतं ्व्‍ट राजपत्र की प्रजतयां जनता को ईपल्‍ध करा दी गइ थी, तीस ददन की ऄवजध के ऄवसान हो जाने से पहल ेअिेप और साझाव अमंजत्रत दकए गए थ;े ई‍त राजपत्र जजसमें ई‍त ऄजधसूचना प्रकाजित की गइ थी की प्रजतयां 16 माचग, 2021 को जनता को ईपल्‍ ध करा दी गइ थी; और ई‍त प्रारूप जनयमस के सबं ंध म ें जनता से प्रा्‍ त दकए गए अिेपस और साझावस पर के्‍ रीय सरकार द्वारा सम् यक् रूप से जवचार कर जलया गया था। ऄत:, ऄब के्‍र ीय सरकार, मोटर यान ऄजधजनयम, 1988 (1988 का 59) की धारा 64 की धारा 59 की ईपधारा (4) और खंड (त) द्वारा प्रदत् त िज‍त यस का प्रयोग करते एए, जनम्न जलजखत जनयम बनाती ह, ऄथागत ् :- 1. सजं ि्‍त नाम और प्रारंभ.- (1) आन जनयमस का संजि्‍ त नाम मोटर यान (यान स्ट् रेपिंग सपग साजवधा का रजजस्ट् रीकरण और कायग) जनयम, 2021 ह। 5392 GI/2021 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) य े25 जसतंबर, 2021 से प्रवृत् त हसगे। 2. लाग ूहोना – ये जनयम जनम्न जलजखत पर लाग ूहसग;ें - (क) यान की सभी प्रवगों और ईनके ऄंजतम स्ट् वाजमयस, मोटर कार, सग्रं हण के्‍ रस, अटोमेरटव जवखंडन, स्ट् रेपिंग सपग और ररसाआकपिंग सलग साजवधाओं और ओटोमेरटव ऄपजि्‍ट ईत् पादस की सभी प्रकार की ररसाआकपिंग सलग; (ख) दरयािील यान की समाज्‍ त के पयागवरणीय ‍ वनी प्रबंधन और ओटोमेरटव ई्ोग मानक (एअइएस) 129 के जलए मागगदिगक जसद्ांत। 3. पररभाषाएं – (1) आन जनयमस में जब तक संदभ गसे ऄ्‍ यथा ऄपेजित न हो,- (क) “ऄजधजनयम” से मोटर यान ऄजधजनयम, 1988 (1988 का 59) ऄजभप्रेत ह; (ख) “ऄपील प्राजधकारी” से रजजस्ट् रीकरण प्राजधकारी की रसेक से ईपर का कोइ असा ऄजधकारी ऄजभप्रेत ह जो रा य या संघ रा य िेत्र सरकार द्वारा नामजनर्दद्‍ ट दकया गया हो, जजसको रजजस्ट् रीकरण प्राजधकारी के जनयम (9) के ईपजनयम (5) के ऄनासार दकए गए कायग के जवरुद् ऄपील जनयम 15 के ऄधीन जनर्दद्‍ ट की जा सके; (ग) “जनिेप प्रमाणपत्र” से रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा द्वारा और जनरुपण के जलए रजजस्ट् रीकृत स्ट् रेपर के जलए रजजस्ट् रीकृत स्ट् वामी से यान के स्ट्व ामी को ऄंतरण की मा्‍ यता के जलए, जारी दकया गया प्रमाणपत्र ऄजभप्रेत ह; (घ) “यान स्ट् रेपिंग सपग प्रमाणपत्र” से दकसी यान के ऄंजतम जनपटान की मा्‍ यता के जलए रजजस्ट्र ीकृत यान स् रेपिंग सपग साजवधा द्वारा जारी दकया गया प्रमाणपत्र ऄजभप्रते ह; (ङ) “संग्रहण के्‍ र” से कोइ साजवधा या कोइ िेत्र जो केवल सग्रं हण के प्रयोजन और दरयािील यान की समाज्‍ त के भंडारण और स्ट् रेपिंग सपग याडग पर और प्रसंस्ट् करण हते ा आसे भेजने के जलए प्रया‍ त दकया जा सके, ऄजभप्रेत ह; (च) “दरयािील यान की समाज्‍ त” से सभी यान जो ऄब व ध रूप से रजजस्ट् रीकृत नह रह गए ह या ओटोमेरटड दिटनेस के्‍ र के मा‍ यम से ऄयो्‍ य घोजषत कर ददए गए ह या जजनका रजजस्ट् रीकरण, आस ऄजधजनयम के ऄ‍ याय 4 के ऄधीन या दकसी ्‍ यायालय के अदेि के कारण या आन जनयमस में यथाजवजनर्दद्‍ ट दकसी पररजस्ट् थजत के कारण व ध रजजस्ट् रीकृत स्ट् वामी द्वारा ईसे ऄपजि्‍ट यान के रूप में स्ट् वत: घोजषत दकया गया हो, रद्द कर ददया गया हो, ऄजभप्रते ह; (छ) “ऄंजतम जनपटान” से यान का असा जनरुपण ऄजभप्रेत ह जजसके कारण यान ऄब आस रूप में ईपयोग करन े म ें और सिम नह ह जजसका साक्ष्य चेजसस का कटना और आसके आंजन का जनपटान ह; (ज) “ररसाआकपिंग सलग” से मलू प्रयोजन के जलए या ऄ्‍ य प्रयोजन के जलए दकसी पयागवरणीय ‍ वजन रीजत म ें ऄपजि्‍ट का साधार और प्रसंस्ट् करण ऄजभप्रेत ह; (झ) ''दरयािील यान की समाज्‍ त का रजजस्ट् रीकृत स्ट् वामी'' स,े - (i) ऄजधजनयम की धारा 2 के खडं (30) में यथापररभाजषत वाहन का स्ट् वामी; या (ii) कोइ व् यज‍त जो के्‍र ीय मोटर यान जनयम, 1989 के जनयम, 57 के ऄनासार पज्‍ लक नीलामी म ें वाहन के स्ट् वाजमत् व को प्रा्‍ त करता ह, ऄजभप्रेत ह; (ञ) “रजजस्ट् रीकृत स्ट् रेपर” से कोइ व् यज‍त , िमग, सोसाआटी, ्‍ यास या रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा के स्ट् वाजमत् व रखने वाली और प्रचालन करन ेवाली कोइ कंपनी ऄजभप्रेत ह; (ट) “रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा” से कोइ असा स्ट् थापन ऄजभप्रेत ह जो जवखंडन और स्ट्र ेपिंग सपग प्रचालन को जारी रखन े के जलए आन जनयमस के ऄधीन जारी दकया गया यान स्ट् रेपिंग सपग के जलए रजजस्ट् रीकरण धारण करता हो; (ठ) “रजजस्ट् रीकरण प्राजधकारी” से असा ऄजधकारी ऄजभप्रेत ह जो अया‍ त (पररवहन) की रसेक से नीचे का न हो और आस प्रयोजन के जलए रा य या संघ रा य िेत्र की सरकार द्वारा नामजनर्दद्‍ ट दकया गया हो;[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 (ड) “स्ट् रेपिंग सपग” से ऄजभप्रेत ह, ‘दरयािील यान की समाज्‍ त’ की प्राज्‍ त और ररकोड ग से पारी प्रदरया जजसम ें जडपोल् यूटिटग, जवखंडन, सामग्री का पृथ‍क रण, गर -पान: प्रयोज भागस का सारजित जनपटान और मोटर यान के रजजस्ट् रीकृत स्ट् वामी को यान स्ट् रेपिंग सपग के प्रमाणपत्र का जारी दकया जाना, िाजमल ह;से (ढ) “स्ट् रेपिंग सपग याड”ग से रजजस्ट्र ीकृत यान स्ट् रेपिंग सपग साजवधा के पररसर के भीतर नामजनर्दद्‍ ट ऄवस्ट्थ ान जहा ं दरयािील यान की समाज्‍ त के और जनरुपण जजसम ें ररसाआकपिंग सलग िाजमल ह,से के जलए प्रसस्ट्ं करण दकया जा रहा ह, ऄजभप्रते ह; (ण) “जनरुपण” से दरयािील यान की समाज्‍ त के प‍ चात ् कोइ दरयाकलाप जजसमे जडपोल् यूटिटग, जवखंडन, कतरन,े िीणग करन,े िीणगक ऄपजि्‍ट के जनपटान के जलए ररकवरी या त यारी और दरयािील यान के समाज्‍ त की ररकवरी या जनपटान के जलए ऄ्‍ य चलाए गए प्रचालन और ईसके घटक के जलए रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा के संग्रहण के्‍ र को सापाद गकरना ऄजभप्रेत ह; (त) “यान” से ऄजधजनयम की धारा 2 के खडं (28) में यथापररभाजषत मोटर यान या यान ऄजभप्रेत ह। (2) ईन ि्‍द स और पदस के जो आन जनयमस म ें प्रया‍त ह,से और पररभाजषत नह ह से दक्‍ ता ऄजधजनयम म ें पररभाजषत ह,से वह ऄथ गहसगे जो ऄजधजनयम में ह। 4. रजजस्ट्र ीकृत यान स्ट्र ेपिंग सपग सजा वधा की िज‍त या ं और कतव्ग य .– (1) रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा को याजर अइडी, पासवडग संरिण के साथ यान रजजस्ट् रीकरण के वाहन डाटाबेस के जलए कनेज‍ टजवटी और पएचं ईपल्‍ध कराइ जाएगी और जो या तो प्रत् यि या ईनके संग्रहण के्‍ र के मा‍ यम से यान की स्ट् रेपिंग सपग संबंजध यजा ‍त या‍ त प्रजवज्‍ट यस को करने और जनिेप के प्रमाणपत्र और स्ट्र ेपिंग सपग प्रमाणपत्र को जारी करने के जलए ऄजधकृत होगी; (2) रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा वाहन डाटाबेस के जलए सारजित पएचं हते ा अइटी तत्रं के जलए अव‍ यक साआबर सारिा प्रमाणपत्र ऄव‍य रखेगी; (3) रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा को रा्‍र ीय ऄपराध ररकोडग ्‍ यरू ो के साथ-साथ स्ट् थानीय पाजलस द्वारा धाररत चोरी एए यानस के डाटाबेस के साथ स्ट् रेपिंग सपग के जलए प्रस्ट्त ात यानस के ररकोड ग के सत् यापन के जलए अव‍ यक कनेज‍ टजवटी ईपल्‍ ध कराइ जाएगी और दकसी यान की स्ट् रेपिंग सपग स े पहले असे सत् यापन को करन े का रजजस्ट्र ीकृत यान स्ट् रेपिंग सपग साजवधा का कतगव् य होगा; (4) रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा यान स्ट् वामी या ईसके प्राजधकृत प्रजतजनजध की वास्ट्त जवकता का ऄवधारण करने के जलए स्ट् रेपिंग सपग हते ा यान को ससपने वाले व् यज‍त यस का सत् यापन करेगा और छह मास की ्‍ यूनतम ऄवजध के जलए ईसकी एक प्रजत ऄजभलेख के जलए रखगे ा; (5) रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा के्‍ रीय मोटर यान जनयम, 1989 के जनयम 2 के खडं (गघ) के ऄनासार केवल रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा के जलए साजवधाकरण के्‍ र के रूप म ेंमा्‍ यताप्रा्‍ त होगी। 5. रजजस्ट्र ीकृत यान स्ट्र ेपिंग सपग सजा वधा के जलए पात्रता की ित – रा य सरकार या सघं रा य ित्रे सरकार जनयम 6 के ऄधीन दकसी रजजस्ट् रीकृत यान स्ट् रपिंग सपग साजवधा को प्राजधकार प्रदान करत े समय जनम्न जलजखत पात्रता मानदडं को ‍ यान म ेंरखगे ी, ऄथागत:्- (क) रजजस्ट् रीकृत यान स्ट् केपिंग सपग साजवधा दकसी जवजधक ऄजस्ट् तत् व चाह े वह असा व् यज‍त , िमग, सोसाआटी, कंपनी या जवजधज्ञ के ऄनासार स्ट् थाजपत ्‍ यास हो, जजसके पास जनम्न जलजखत दस्ट् तावेज हो, के स्ट् वाजमत् वजधन हो सकेगी या ईसके द्वारा प्रचाजलत की जा सकेंगी जजसके पास,- (i) जनगमन प्रमाणपत्र या दका ान ऄजधजनयम रजजस्ट् रीकरण या ई्म अधार हो; (ii) व ध माल और सेवा कर रजजस्ट् रीकरण; और4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (iii) व ध स्ट्थ ायी खाता संख् या हो। (ख) ऄजस्ट् तत् व, ईस रा य या संघ रा य िेत्र सरकार से जजसम ें रजजस्ट् रीकरण यान स्ट् रेपिंग सपग साजवधा ऄवजस्ट् थत करन े का अिय ह, के रजजस्ट् रीकरण प्राजधकारी से स्ट् थापन के जलए सहमती हते ा अवेदन करेंगें या ऄनामोदन प्रा्‍ त करेंग;े (ग) ऄजस्ट् तत् व, के्‍ रीय प्रदषू ण जनयंत्रण बोड ग मागगदिगक जसद्ांतस के ऄनासार सग्रं हण और जवखंडन के जलए ऄपेजित ्‍ यनू तम तकनीक पान े के जलए वचनबद् होगा; (घ) ऄजस्ट्त त् व, सारजित और पयागवरणीय ईत् तरदाजयत् व रीजत में जडपोल् यूटिटग और जवखंडन दरयाकलापस को करन े के जलए सिम, जनिज‍त और याज‍त या‍ त ईपस्ट् कर रखेगा; (ङ) ऄजस्ट्त त् व, रजजस्ट् रीकृत यान स्ट् केपिंग सपग साजवधा के रूप म ें प्रचालन के प्रारंभ स े बारह महीनस के भीतर अइएसओ 9001 (गाणवत् ता प्रबंधन तंत्र) या अइएसओ 14001 (पयागवरणीय प्रमाणत्र) या अइएसओ 45001 (व् यवसाय स्ट् वास्ट् ् य और सारिा) के ऄपेजित गणा वत् ता प्रमाणपत्र प्रा्‍ त करने के जलए वचनबद् होगा; (च) ऄजस्ट्त त् व, प्रचालन के प्रारंभ से छह मास की ऄवजध के भीतर रा य प्रदषू ण जनयंत्रण बोडग स े प्रचालन के जलए सहमती प्रा्‍ त करन े के जलए एक वचनबद् रखगे ा या ईपल्‍ ध कराएगा; (छ) ऄजस्ट् तत् व, सभी लागू श्रम संजहताओं और सभी ऄ्‍ य ऄजधजनयमस या यथालाग ू जनयमस के ईपबंधस को पालन करने के जलए वचनबद् होगा; (ज) ऄजस्ट् तत् व, स्ट् वाजमत् व या जवरय के करार या कम से कम तीन वषग की ऄवजध के प्े के जलए करार के द्वारा रा य या संघ रा य िेत्र के ओरेंज श्रेणी औ्ोजगक िेत्र में भूजम के पयाग्‍ त ईपयोगी िेत्र की ईपल्‍ धता का साि ईपल्‍ ध कराएगा; (झ) ऄजस्ट् तत् व, जनयम 4 के ईपजनयम (2) के ऄधीन जवजनर्दद्‍ ट अव‍ यक साआबर सरा िा प्रमाणपत्र रखेगा; (ञ) ऄजस्ट् तत् व, ऄनामोददत संयंत्र लअे ईट और भवन योजना ईपल्‍ ध कराएगा। 6. रजजस्ट्र ीकृत यान स्ट्र ेपिंग सपग सजा वधा के जलए रजजस्ट्र ीकरण प्रदरया,- (1) कोइ अवेदक संबंजधत रा य सरकार या संघ रा य िेत्र सरकार जहां रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा को ऄवजस्ट् थत करने का अिय ह, के रजजस्ट् रीकरण प्राजधकारी को संबोजधत करते एए जवजहत प्ररूप 1 में अवेदन कर सकेगा जजसके साथ जनम्न जलजखत संल्‍न हसग,े - (i) स्ट्थ ाजपत दकए जान े वाली प्रस्ट् ताजवत प्रत् येक रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा के जलए 1,00,000 / - (एक लाख रू. मात्र) की ऄप्रजतदाय प्रसंस्ट् करण िीस; और (ii) स्ट् थाजपत दकए जाने के जलए प्रस्ट् ताजवत प्रत् येक रजजस्ट् रीकृत यान स्ट् रेपिंग सपग साजवधा के जलए रजजस्ट् रीकरण प्राजधकरण के पि म ें 10,00,000/-(दस लाख रूपए) की बसेक गार्‍ टी के रूप म ें ऄजग्रग धन जनिेप या अरंजभक रजजस्ट् रीकरण ऄवजध जमा न्‍ ब े ददन की व धता के साथ सहजवस्ट् तारी, ऄवजध के जलए ग र ्‍ याज धारक प्रजतभूजत जनिेप के रूप में। (2) रजजस्ट् रीकरणकी स्ट् वीकृजत के जलए सभी अवेदन रजजस्ट् रीकरण प्राजधकरण द्वारा अवेदन की तारीख स े 60 ददनस की ऄवजध के भीतर जनपटाए जाएंग े । (3) अवेदन, जज्‍ ह ें स्ट्वीकार कर जलया जाता ह, को प्ररूप-1ए, के रूप में रजजस्ट् रीकरण प्रमाणपत्र जारी दकया जाएगा। (4) ईन अवेदनकतागओं जजनके अवदेन रद्द कर ददए जाते ह,से ई्‍ ह ें ईनका बयाना राजि या बसेक गारंटी वाजपस कर ददया जाएगा। (5) के्‍ रीय सरकार पिंग ससगल पिंग सवडो ‍लीयरेंस के जलए जजस पर अवेदक सभी अव‍यक दस्ट्तावेजस और रजजस्ट् रीकरण के जलए अव‍यक िीस के साथ अवेदन करेगा, एक पोटगल का जवकास करेगी।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 5 (6) रा य या संघ रा य िेत्र सरकार जवजभ्‍ न ऄजभकरणस (श्रम, प्रदषू ण आत् यादद) स े अतं ररक ऄनामोदन सजहत 60 ददनस के भीतर जनधागररत समय में प्रस्ट् ताव को पास करेगी, असे अवेदन को प्रस्ट् तता करने के बाद ही प्रस्ट् ताव को ऄनामोददत समझा जाएगा। (7) असे पोटगल को आन जनयमस की ऄजधसूचना की तारीख से 6 माह के भीतर संचाजलत दकया जाएगा और ईस समय तक, जब तक दक यह पोटगल प्रचाजलत हो जाता ह, आन मामलस म ें कायगवाजहयस संबंजधत रा य सरकारस या संघ रा य िेत्र सरकारस द्वारा हस्ट्त चाजलत रूप स ेकी जाएगी । (8) ईपजनयम (5) में संद्भत पोटगल के प्रचालन के प‍ चात सभी ईत् तरवतती ऄनामोदनस अदद को पोटगल के मा‍ यम से मंजूरी दी जाएगी और रजजस्ट्र ीकृत स्ट् र पिंग सपग यान साजवधा के जनरीिण और संपरीिा संबंधी ररपोट पोटगल पर ईपल्‍ ध कराइ जानी चाजहए। (9) असे रजजस्ट् रीकृत यान स्ट् र पिंग सपग यान साजवधा की स्ट् थापना या संचालन के जलए रा य प्रदषू ण जनयत्रं ण बोडग, श्रम जवभाग और यथा अव‍ यक दकसी ऄ्‍ य जवभाग द्वारा अव‍य क ऄनामोदन केवल आसी पोटलग के मा‍ यम स े ईपल्‍ ध कराए जान े चाजहए। (10) रा य सरकार या संघ रा य ित्रे सरकार पोटलग पर नागररक चाटगर और अस े पोटगलस पर ऄनामोदन की मंजूरी के जलए प्रदरया प्रकाजित करेंगे। (11) यह प्रदरया पारदिती तथा सचा ारु होनी चाजहए और सभी ऄजधसूचनाएं, मागगदिगक जसद्ांत, प्ररूप अदद ईपजनयम (6) में स्ट्थ ाजपत पोटलग पर ईपल्‍ ध कराए जाएंगे और अवेदन आल ‍र ॉजनक मा‍ यम से दकए जाएंग े तथा आनका जनपटान जनधागररत समय में दकया जाएगा । 7. रजजस्ट्र ीकरण की जवजधमा्‍य ता और नवीनीकरण.-- (1) जनयम 6 के ऄधीन जारी दकया गया रजजस्ट् रीकरण 10 वषों की प्रारंजभक ऄवजध के जलए जवजधमा्‍ य होगा, जजसका एक बार 10 वषों के जलए और नवीनीकरण दकया जाएगा, जो आस ित ग के ऄधीन होगा दक रजजस्ट् कृत स्ट् र पर जनयम 14 में यथा जवजनर्ददष्ट ईपबंधस का व् यजतरमी नह ह। (2) रजजस्ट् रीकरण के नवीकरण के जलए कोइ अवेदन असे रजजस्ट् रीकरण की समाज्‍ त से तीन माह पहले दकया जा सकेगा । (3) नवीनीकरण के जलए अवेदन प्ररूप-1 में दकया जाएगा और अवेदन के साथ रा य या सघं रा य िेत्र सरकार द्वारा आस ईद्दे‍ य के जलए जवजनर्ददष्ट नवीनीकरण िीस और प्रजतभूजत जमा की जाएगी। (4) रजजस्ट् रीकरण का नवीनीकरण प्ररूप-1क के ऄनासार जारी दकया जाएगा। (5) आस जनयम के ऄधीन जारी रजजस्ट् रीकरण ऄतं रणीय नह होगा। 8. यानस की स्ट्र पिंग सपग के जलए मानदंड.-- जनम्नजलजखत यानस को रजजस्ट् रीकृत स्ट् र पर को स्ट्र प करने के जलए पिे दकया जा सकता ह: (i) जजन यानस ने के्‍ रीय मोटर यान जनयम, 1989 के जनयम 52 के ऄनासार रजजस्ट् रीकरण प्रमाणपत्र का नवीनीकरण नह दकया ह। (ii) जजन यानस को के्‍ रीय मोटर यान जनयम, 1989 के जनयम 62 के ऄनासार ईपया‍ तता प्रमाणपत्र नह ददया गया ह। (iii) यान जो अग, दंगा, प्राकृजतक अपदा, दघा गटना या दकसी अपदा के कारण िजतग्रस्ट्त हो गए हसे, जजसके बाद रजजस्ट् रीकृत स्ट्वामी स्ट्वयं ईस ेस्ट्र प के रूप म ेंप्रमाजणत करता ह। (iv) यान, जो सरकार के केंरीय या रा य संगठनस द्वारा ऄप्रचजलत या ऄजधिेष या अ्थक मरम्मत से परे घोजषत दकए गए ह सेऔर स्ट्र पिंग सपग के जलए पेि दकए गए ह।से (v) रजजस्ट् रीकृत यान स्ट् र पिंग सपग सजा वधा सजहत दकसी भी एजेंसी द्वारा स्ट्र पिंग सपग के जलए नीलामी में खरीदे गए यान।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (vi) यान जो जविेष रूप स े खनन, राजमागग, जबजली, खेतस अदद म ें पररयोजनाओं के जलए ऄपनी ईपयोजगता या ईपयोजन से ऄजधक समय तक रटका एअ हो ज सा दक यान स्ट् वामी द्वारा स्ट्व-प्रमाजणत दकया जाए । (vii) जवजनमागण के जलए खाररज दकए यान, परीिण यान, प्रोटोटाआप, यान मूल ईपस्ट् कर जवजनमागता से व् यौहारी को पररवहन के दौरान िजतग्रस्ट्त यान या ऄजवरीत ऄथवा ऄरजजस्ट्र ीकृत ज सा दक यान मलू ईपस्ट्क र जवजनमागता द्वारा सत् याजपत दकया जाए। (viii) दकसी भी प्रवतगन एजेंसी द्वारा नीलाम दकए गए, ज्‍त दकए गए और छोड़ ददए गए यान। (ix) ऄ्‍ य कोइ यान जो स्ट् वामी द्वारा स्ट् र पिंग सपग के जलए रजजस्ट्र ीकृत यान स्ट् र पिंग सपग साजवधा को स्ट् वेच् छया प्रस्ट् ताजवत दकया जाए । 9. जनरीिण का ऄजधकार.--(1) रजजस्ट् रीकरण प्राजधकारी या रा य ऄथवा संघ रा य ित्रे सरकार के नाजमत ऄजधकारी द्वारा जनरीिण के जलए रजजस्ट् रीकृत स्ट् र पर को रजजस्ट्र ीकृत यान स्ट् र पिंग सपग साजवधा म ें यानस के संव् यवहार और स्ट्र प जनन के बारे में ऄजभलेख और प्राजधकृत ररसाआकलसग से आसका जजम्मेदार जनपटान और रजजस्ट् रीकृत यान स्ट् र पिंग सपग साजवधा पररसर म ेंसभी मिीनरी, ईपस्ट् कर और ईपकरण त यार रखना चाजहए। (2) वास्ट्तजवक जनरीिण और साआट का दौरा नीचे यथा सूचीबद् प्रदरया के जन्‍प ादन के प‍ चात् ही दकया जाएगा:- (i) जब ईपया‍ त प्राजधकारी द्वारा ग र ऄनापालना की ररपोटग ऄथवा रजजस्ट् रीकृत स्ट्रेपर के संबंध म ें रजजस्ट् रीकरण प्राजधकारी द्वारा जन जिकायत प्राकी की गइ ह। (ii) आस तरह की जिकायत को रजजस्ट् रीकृत स्ट् र पर को सात कायग ददवसस के भीतर जलजखत जवाब दाजखल करने के जलए भेज ददया गया ह। (iii) प्रत् यात् तर की छानबीन की गइ ह और रजजस्ट् रीकृत स्ट्क पर को तीन कायग ददवसस के भीतर और स्ट्पष्टीकरण प्रदान करने का ऄवसर प्रदान दकया गया ह। (iv) रजजस्ट् रीकरण प्राजधकारी की राय में दकया गया प्रत् यात् तर और स्ट्पष्टीकरण ऄपयागकी ह,से और साआट का एक जनरीिण अव‍ यक ह। (3) आस तरह के साआट के दौरे को रजजस्ट् रीकरण प्राजधकारी द्वारा सम् यक् रूप से प्राजधकृत दकया जाना चाजहए। (4) जनरीिण दल की ररपोट ग को रजजस्ट् रीकरण प्राजधकारी को प्रस्ट्तात दकया जाएगा और आसकी एक प्रजत रजजस्ट् रीकृत स्ट्र पर को माहय ा करायी जाएगी। (5) आन जनयमस के ऄनपा ालन की दिा म ें रजजस्ट् रीकृत स्ट् र पर को ऄपना पि रखन े का ऄवसर प्रदान करने के बाद रजजस्ट् रीकरण प्राजधकारी साजवधा के रजजस्ट् रीकरण को रद्द करन ेया जनलंजबत करने का मौजखक अदेि पाररत कर सकता ह। 10 स्ट्र पिंग सपग प्रदरया:-(1) रजजस्ट्र ीकृत स्ट्र पर द्वारा सभी एंड टू लाइि यानस के संबंध म ेंनीचे ईजल्लजखत प्रदरया का ऄनासरण करते एए यानस की स्ट्र पिंग सपग की जाएगी, ऄथागत:्- (i) रजजस्ट् रीकृत स्ट् वामी या प्राजधकृत प्रजतजनजध यान को प्ररूप-2 के ऄनासार अवेदन की दो मूल प्रजतयस के साथ रजजस्ट् रीकृत स्ट् र पर या जनिेप के जलए ऄजभजहत संग्रहण केंर को यान सौंपेंगे। (ii) यदद यान का जवजधमा्‍ य रजजस्ट् रीकरण नह ह, तो रजजस्ट् रीकृत स्ट् र पर या ईसका ऄजभजहत केंर, वाहन डेटाबेस के ऄनासार रजजस्ट् रीकृत स्ट् वामी की पहचान का जमलान यान सौंपने वाले व् यजि के साथ करेंगे और यान प्रा्‍ त करेंग े तथा वाहन डेटाबेस से जाडे जडजजटल ्‍ लेटिॉमग के मा‍ यम से रसीद जारी करेंगे। (iii) प्रवतगन एजेंसी द्वारा ज्‍त दकये गए यानस को रजजस्ट् रीकृत स्ट्र पर को सौंपा जाएगा।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 7 (iv) दकसी यान की स्ट् र पिंग सपग से पहल े रजजस्ट् रीकृत यान स्ट् र पिंग सपग साजवधा की ओर से यान स्ट्र पिंग सपग के जलए प्रस्ट् तात दकए गए यानस के ररकॉड ग का सत् यापन रा्‍र ीय ऄपराध ऄजभलेख ्‍य ूरो के साथ ही स्ट्थानीय पाजलस द्वारा ज्‍ त चोरी दकए यानस के डेटाबेस के साथ करना ऄजनवायग होगा। (v) रजजस्ट् रीकृत स्ट् र पर को स्ट् वामी या प्राजधकृत प्रजतजनजध से प्ररूप -2 के साथ जनम्नजलजखत लागू मलू दस्ट्तावेजस की अव‍यकता होगी: (क) रजजस्ट् रीकरण का मलू प्रमाण पत्र। (ख) रजजस्ट् रीकृत स्ट् वामी से प्राजधकार। (ग) ईत्तराजधकार के मामल े म,ें ईत्तराजधकारी के दकसी भी प्रमाण के साथ रजजस्ट् रीकृत स्ट् वामी का मृत्या प्रमाण पत्र। (घ) नीलामी करन े के जलए प्राजधकृत व्यजि द्वारा सम् यक रूप स े हस्ट्त ािररत ऄपन े पि में दकसी सावगजजनक नीलामी में यान की जवरय की पाजष्ट करने वाला प्रमाण पत्र या अदेि। (ङ) स्ट् वामी या प्रजतजनजध प्ररूप-2 के पर ा 4 के ऄनासार से वचनबंध लने ा जो यह दिागता ह दक यान का कोइ लंजबत अपराजधक ररकॉडग या मका दमा नह ह और यान पर कोइ िो‍ य लंजबत नह ह । (vi) रजजस्ट् रीकृत स्ट् र पर यह सत्याजपत करेगा दक ऄजधजनयम की धारा 51 की ईप-धारा (2) के ऄधीन ऄपेजित मोटर यान के रजजस्ट् रीकरण प्रमाण पत्र में भाड़ा रय, प्े या भाड़ारांजत करार का सम् यक रूप से जनवगहन दकया गया ह और आस प्रभाव का एक बचनबध स्ट् वामी या प्रजतजनजध द्वारा प्ररूप-2 के पर ा 4 म ें भी ददया जाएगा । (vii) रजजस्ट् रीकृत स्ट्र पर द्वारा स्ट् वामी ऄथवा ऄजधकृत प्रजतजनजध के मा‍यम से जनम्नजलजखत दस्ट्तावेजस की स्ट्व- प्रमाजणत प्रजतयां स्ट्वीकार की जायेगी। (क) स्ट् वामी के स्ट्थ ायी खाता संख्य ा काडग की प्रजत; (ख) स्ट् वामी के बसेक खाते का रद्द चेक; (ग) प्राजधकृत प्रजतजनजध (यदद लाग ू हो) को पहचान का सबूत ज स े पासपोटग, मतदाता पत्र, अधार पत्र, चालन ऄनाज्ञजकी , रा य सरकार या केंर सरकार द्वारा जारी िोटो पहचान पत्र; (घ) स्ट् वामी के पते का सबूत ज से जबजली का जबल, पानी का जबल, लसेड लाआन टेलीिोन का जबल, पाआ्‍ ड कािंकग ग स का जबल; (ङ) रजजस्ट् रीकृत स्ट्र पर को एंड टू लाइि यान सौंपन े वाल े स्ट् वामी या प्राजधकृत प्रजतजनजध की जडजजटल िोटो या प्ररूप-2 में सम् यक रूप से जचपकाया गया स्ट् वामी या प्रजतजनजध का िोटो और स्ट् वामी या प्रजतजनजध द्वारा प्रजत हस्ट्तािररत हो; (viii) रजजस्ट् रीकृत स्ट्र पर जवजधवत् प्राकी दकया गया दसू रा प्ररूप-2 स्ट् वामी या ईसके प्राजधकृत प्रजतजनजध को लौटा देगा और यान के स्ट्वाजमत्व के ऄंतरण के साक्ष्य के रूप म ेंजमा प्रमाणपत्र जारी करेगा। (ix) दकसी रा य में स्ट्थाजपत रजजस्ट् रीकृत यान स्ट् र पिंग सपग साजवधा दकसी भी रजजस्ट् रीकृत प्राजधकरण की ऄजधकाररता के ऄधीन दकसी भी रा य या सघं रा य िेत्रस में रजजस्ट् रीकृत यानस को स्ट्वीकार और स्ट्र प कर सकता ह। (x) पूरी प्रदरया वाहन के साथ साचारू रूप स े जाड़ी होगी और ऄजखल भारत के अधार पर दकसी भी यान रजजस्ट् रीकरण प्राजधकरण की ऄवजस्ट् थजत पर ‍ यान ददए जबना होगी। (xi) रजजस्ट् रीकृत यान स्ट् र पिंग सपग साजवधा ऄनारोध को आल ‍र ोजनक रूप स े प्रस्ट् तता करने कीप्रदरया और ऄजधजनयम के ईपबंधस के ऄनासार यान को ऄरजजस्ट् रीकृत करान े के जलए सड़क पररवहन कायागलय या िेत्रीय पररवहन कायागलय को रजजस्ट् रीकृत प्रमाण पत्र (मोहर लगा एअ या पंच दकया एअ) के पारेषण को साकर बनाएगा ।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (xii) ‘जमा प्रमाणपत्र’ स्ट् वामी के जलए एक नया यान खरीदन े के जलए समय-समय पर लाग ू दकए गए प्रोत्साहन और िायदा प्रा्‍ त करने के जलए अव‍यक और पयागकी दस्ट्तावेज होगा। (xiii) ‘जमा प्रमाणपत्र’ व्यापार करने यो्‍य होगा और आसका एक बार ईपयोग दकए जाने के बाद एजेंसी द्वारा ईि प्रमाण पत्र धारक को िायदा प्रदान करत े एए आसे स्ट्थ जगत दकया जाएगा। (xiv) जनिेप के प्रमाण पत्र को ऄजधकरण या व् यौहारी द्वारा “रद्द दकया गया” के रूप में स्ट् टांजपत दकया जाएगा और ईसे वाहन डेटा बेस म ेंआस रूप में ऄंदकत दकया जाएगा । (xv) जनिपे प्रमाण पत्र के जवरुद् खरीदे गए नए यान का रजजस्ट् रीकरण करन े वाला िेत्रीय पररवहन कायागलय जनिेप प्रमाण पत्र को सत् याजपत और ऄजधप्रमाजणत कर सकेगा । (xvi) रजजस्ट् रीकृत स्ट् र पर यान के जलए सहमत राजि का जडजजटल तरीके से या अदाता खाता चेक से भागतान करेगा और ररकॉड गके जलए स्ट् वामी या प्राजधकृत प्रजतजनजध से ईसकी एक रसीद प्राकी करेगा। (xvii) जनयम 11 के ऄधीन जारी दकए यान स्ट् र पिंग सपग प्रमाण पत्र को जारी दकए जान े की तारीख के छह मास की ऄवजध के जलए चेजसस सं॰ के कटे एए टाकड़े को सारजित ऄजभरिा में रखने की जजम् मेवारी रजजस्ट् रीकृत स्ट् र पर की होगी । (xviii) रजजस्ट् रीकृत स्ट् र पर ररकाडग और जनरीिण के दौरान जांच के जलए सभी दस्ट् तावेजस की वास्ट् तजवक प्रजत बनाए रखेगा और ईन दस्ट् तावेजस की स्ट्क न की एइ जडजजटल प्रजत दस वषग की ऄवजध के जलए ऄनारजित रखी जाएगी । (xix) रजजस्ट् रीकृत स्ट् र पर यह सजा नज‍ चत करेगा दक दरयािील यान समापन का पयागवरणीय रूप से ‍ वजन प्रबधं न के जलए केंरीय प्रदषू ण जनयंत्रण बोड ग के मागदग िती जसद्ा्‍तस और एअइएस-129 के ऄनसा ार स्ट् र प दकए गए यानस के पररसंकटमय पाजों जनवारण, पना :चरण या जनपटान दकया गया ह । (xx) यानस का तब तक स्ट् र प नह दकया जाएगा जब तक ईंधन, तेल, एंटीफ्रीज और ऄ्‍ य ग सस, तरल पदाथों अदद को जनकाल न जलया जाए और ई्‍ ह ें प्रमाजणत मानक अधानस में एकजत्रत न कर जलया जाए । (xxi) स्ट् र प दकए गए यानस का एक जडजजटल रजजस्ट् टर, प्ररुप 3 में ऄनारजित दकया जाएगा । 11. स्ट्र पिंग सपग यान का प्रमाण पत्र जारी करना–(1) रजजस्ट् रीकृत स्ट् र पर, अव‍ यक कारगवाइ पणू ग करन े के प‍ चात,् स्ट् र पिंग सपग यान का एक जडजजटल प्रमाणपत्र जारी करेगा जजसके ऄंतगगत प्ररुप-4 में चेजसस के कट अईट का एक जडजजटल िोटो, रा्‍र ीय रजजस् टर, वाहन डेटाबेस को ऄ्तन करने और रा य सरकार या संघ रा य सरकार के सिम प्राजधकारी द्वारा ऄजभलेखस को ऄ्तन करने हते ा संसूजचत करन े के जलए भी ह । (2) स्ट् र प दकए एए यानस का पथृ क ररकाड गकेंरीय सरकार द्वारा वाहन डेटाबेस पर ऄनारजित दकया जाएगा । 12. सीसीटीवी क मरस का सस्ट्ं थापन – (1) रजजस्ट् रीकृत स्ट् र पर, स्ट् र पिंग सपग याड,ग ग्राहक और यान स्ट् वागत िेत्र म ें सीसीटीवी क मरस का संस्ट्थापन करेगा और स्ट् र पिंग सपग का ररकाड ग तीन कलडसे र मासस की ऄवजध के जलए रजजस्ट् रीकृत स्ट् र पर के अइटी जसस्ट् टम पर सरा जित रखा जाएगा । (2) साजवधा में संस्ट्थाजपत सीसीटीवी क मरस की पएचं , रा य सरकार या संघ रा य िेत्र सरकार द्वारा यथा ऄपेजित प्राजधकृत ऄजभकरणस को सीसीटीवी क मरस की िाटेज ईपल्‍ध कराइ जा सकेगी । 13. स्ट्र पिंग सपग याडग और सग्रं हण केंर–(1) स्ट् र पिंग सपग याडग अस े ईजचत िेत्र म ें स्ट्थ ाजपत दकया जाएगा जजसमें साजवधा द्वारा प्रबंधन दकए जान े वाल े स्ट् र प के बड़े अकार और प्रकृजत के ऄनरूा प यानीय अवागमन, यानस या प्रा्‍ त मदस और पानचरणयो्‍य प्रा्‍ त सामग्री के भंडारण के जलए स्ट्थ ान हो । (2) स्ट् र पिंग सपग याड,ग दरयािील यान समापन, धवल माल और ऄ्‍ य स्ट् र प का प्रबधं न करन,े प्रदषू ण जनवारण और जवघटन करन े के जलए दरवाजा लगा एअ एक असा िेत्र होगा जजसमें जवदकरण को मापन े के जलए साजवधा भी हो ज सा स्ट् र प के अयात के जलए ऄनापालन दकया जाता ह ।[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 9 (3) सामग्री प्रबंधन करने वाली मिीनस का मानवीय हस्ट्त िेप कम करने और सारजित कायग स्ट्थ ल बनाने के जलए ईपयोग दकया जाएगा । (4) सभी स्ट् र पिंग सपग याड,ग दरयािील यान समापन, माल और ऄ्‍ य स्ट् र पस की प्रदरया में सिम और प्रजिजित जनिज‍त लगायेंगे । (5) स्ट् र पिंग सपग याडग म ेंिा्‍क िेत्र (जल भराव स ेमा‍ त), ऄभे् सतह ज से डामर या ठोस िि,ग डामर या कंरीट सड़क, सारजित कायस्ट्ग थ ल के रखरखाव को बनाए रखन े के जलए अतं ररक रखरखाव के जलए पया्‍ग त कायिग ाला सजा वधाओं, ऄज्‍न सारिा प्रणाली अदद और प्रदषू ण को जनयंत्रण में रखन े के जलए ऄ्‍ य सभी ऄपेजित ईपाय हस। (6) स्ट् र पिंग सपग याड,ग प्रदषू ण जनवारक संयंत्र से सासजित होगा, ऄजधमानतः िू्‍य जनस्ट्सारण संयत्रं और जवघटन कायग, दरयािील यान समापन, मालस और ऄ्‍ य स्ट् र पस का प्रसंस्ट्करण प्रौ्ोजगकी के प्रयोग द्वारा दकया जाएगा। (7) स्ट् र पिंग सपग याड,गसासंगत स्ट्वास्ट््य और सारिा जवधान या जवजनयम और पयागवरणीय मानदंडस का ऄनापालन करेगा। (8) स्ट्र पिंग सपग याडग म ेंजनम्न जलजखत होगा – (क) ग र-पारगम्य डामर या कंरीट या आपॉ‍स ी लेजपत िि,ग पयागकी जल जनकासी की साजवधा के साथ, पर ऄपजिष्ट यानस की पार्ककग के जलए ईपयाि ऄजभजनजित िेत्र और यहां तक दक अवेदनस के जमा करने की प्रदरया के दौरान भी कोइ ऄपजिष्ट या संभाजवत ऄपजिष्ट यान सड़कस पर या सावगजजनक स्ट्थानस पर पाकग नह दकया जाएगा, और केवल रजजस्ट् रीकृत स्ट् र पिंग सपग यान साजवधा के पररसरस के भीतर ही समायोजजत दकया जाएगा । (ख) ईंधन या तरल पदाथ ग या ग सस और तरल पदाथों की जनकासी के दौरान प्रदषू कस का िू्‍य ररसाव साजनजित करने हते ा प्रमाजणत प्रदषू ण जनवारक ईपस्ट्कर, सारिा जनराकरण या एयरबग को हटान,े प्री- टेंिनर अदद के जलए प्रमाजणत जोजखम जनवारक ईपस्ट्कर, पररभाजषत गजतजवजधयस (ज स े जोजखम जनवारण, प्रदषू ण जनवारण, जवघटन, छोटे छोटे टाकड़े करना, कतगन, बेपिंग सलग अदद) के जलए ईपयाि जवघटन करन े वाले ईपस्ट्कर, ऄलग दकए एए स्ट्र प के भडं ारण के जलए ऄजभजहत ित्रे , ऄलग दकए एए पजा ों का प्रबंधन और भंडारण करने के जलए पयागकी स्ट्थान, ऑटोमोरटव पररसंकटमय ऄपजिष्ट ज स े टायरस, ब टररयस, ईंधन, तले स, तरल पदाथों और ग सस के ऄस्ट्थायी भडं ारण के जलए ऄजभजहत स्ट्थान, ईपयाि सरा िा और व्यावसाजयक स्ट्वास्ट््य ईपस्ट्कर, पाजों, अदद के सारजित पररवहन के जलए सामग्री प्रबंधन करने वाल े ईपस्ट्कर । (ग) ईपयाि औ्ोजगक श्रेणी प्रकािन और संवातन संयंत्र, ‍वजन प्रदषू ण मानदडं स की ऄनारूपता और ईपयाि ऄपजिष्ट ईपचार संयंत्र या जल पानचगरण संयंत्र। (9) स्ट्र पिंग सपग याड,ग संचालन प्रारम्भ होने के बारह मास के भीतर गणा वत्ता मानकस ऄथातग अइएसओ 9001 (गणा वत्ता प्रबंधन प्रणाली), अइएसओ 14001 (पयागवरण प्रबंधन प्रणाली) और अइएसओ 45001 (व्यावसाजयक स्ट्वास्ट््य और सारिा) के नवीनतम संस्ट्करणस के साथ वे स्ट्वयं का प्रत्यायन कराएगं े । (10) यदद स्ट्र पिंग सपग याडग में पररसंकटमय ऄपजिष्ट (ज से इ-ऄपजिष्ट, सीसा ऄम्ल ब टरी, जलजथयम अयन घटक, या दला गभ भ-ू धाताओं की प्राजकी , अदद) के पानचगरण के जलए या असी स्ट्र प सामग्री के पानचगरण, जो आसकी पररजध स े परे ह, के जलए पयागकी िमता या ईपबंध नह ह से , तो असी सामजग्रयस को सम्यक रूप स े प्राजधकृत पानचगरणकतागओं या एजेंजसयस को जवरय दकया जाएगा, जजनके पास पयागकी िमता और ऄनाज्ञजकी ह। (11) संव्यवहारस का एक ररकॉडग, स्ट्पष्ट रूप से ऑि-लोडेड वॉल्यूम और प्राजधकृत पानचगरणकताग या एजेंसी का नाम, प्राजधकरण संख्या, स्ट्थायी खाता संख्यांक, माल और सेवा कर और ऄ्‍य व्यावसाजयक ्‍यौरे देते एए रखा जाएगा। अस े ररकॉडग अवजधक लेखापरीिा के ऄधीन हसगे।10 THE GAZETTE OF साजवधा का आन जनयमस की ऄनापालना के जलए रजजस्ट् रीकरण प्राजधकरण द्वारा संपरीिा की जाएगी। (2) रजजस्ट् रीकरण प्राजधकारी की ओर से केंरीय मोटरयान जनयम, 1989 के जनयम 126 में जवजनर्दद्‍ ट कोइ ऄजभकरण या ईसी सूची में कोइ ऄजभकरण जनम्न जलजखत काय गकर सकेगा, - (क) जनयामक और ऄनापालन लखे ा सपं रीिा; और (ख) रजजस्ट् रीकृत स्ट् र पिंग सपग यान साजवधा द्वारा प्ररुप 3 म ें यथा ऄनारजित मास फ्लो जववरण की संपरीिा । (3) संपरीिा ररपोट,ग रजजस्ट् रीकृत यान स्ट् र पिंग सपग साजवधा को ईनके प्रदिनग के जनबंधन ऄनासार और व्यावसाजयक स्ट्वास्ट््य और सारिा ऄनापालन, जवजनयामक, कारबार, पयागवरण और श्रम मानकस की ऄनापालना तथा रजजस्ट् रीकृत स्ट्र पर द्वारा प्राकी एइ प्ररूप 3 म ें ऄजभजलजखत संबंजधत पना चगरण दरस, मास फ्लो की जानकारी के अधार पर श्रेणी दगे ी और मूल्यांकन करेगी। (4) असी लेखा सपं रीिा ररपोटग, रजजस्ट् रीकृत स्ट्र पर द्वारा दकसी जवत्तीय वषग या ईसके दकसी भाग के जलए वा्षक रूप से पोटलग पर ऄपलोड की जाएगी और ईस जवत्तीय वषग के 31 मइ (जवत्तीय वषग के पूरा होने के दो मास के भीतर) तक प्रस्ट्तात की जाएगी । (5) लेखा सपं रीिा में ररपोटग दकए गए ग र ऄनापालन बाबत संप्रेिणस को लेखा संपरीिा ररपोटग के जारी होने के दो मास के भीतर रजजस्ट् रीकृत स्ट्र पर द्वारा सालझा जलया जाएगा जजस े रजजस्ट्रीकरण प्राजधकारी द्वारा ऄजधकतम एक मास तक बढाया जा सकेगा। (6) रजजस्ट् रीकृत स्ट्र पर यह साजनजित करेगा दक अइएसओ प्रमाणन ईनकी समाजकी से कम से कम तीन मास पूव ग पान: जवजधमा्‍य दकए ह।से 15. ऄपील–(1) रजजस्ट् रीकरण प्राजधकारी के जनयम 9 के ईपजनयम (5) के ऄधीन पाररत दकसी अदेि से पीजड़त कोइ व् यज‍त , असे अदेि की प्राज्‍ त की तारीख से 30 ददन की ऄवजध के भीतर ऄपीलीय प्राजधकरण को ऄपील कर सकेगा । (2) ऄपील, एक सादे अवेदन प्रारूप म,ें रजजस्ट् रीकरण प्राजधकारी द्वारा पाररत अदिे के अिेपस के अधारस को बताते एए की जाएगी और ईसके साथ ईस अदिे जजसके जवरुद् ऄपील की गइ ह, की एक प्रमाजणत प्रजत और 10,000/- रुपये (केवल दस हजार रुपय)े की िीस संलग्न की जाएगी । Short title and commencement- (1) These rules may be called the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021. (2) They shall come into force with effect from 25th September, 2021. 2. Application.- These rules shall apply to;- (a) all categories of vehicles and their last registered owners, automobile collection centres, automotive dismantling, scrapping and recycling facilities and recyclers of all types of automotive waste products; (b) the guidelines for Environmentally Sound Management of End-of-life vehicles (ELVs) and Automotive Industry Standard (AIS) 129. 3. Definitions - (1) In these rules, unless the context otherwise requires,- (a) ―Act‖ means the Motor Vehicles Act, 1988 (59 of 1988); (b) ―Appellate Authority‖ means any officer above the rank of Registration Authority as nominated by the State or Union territory Government to whom appeal against the action of Registration Authority taken as pre sub- rule (5) of rule (9) can be referred under rule (15); (c) ―Certificate of Deposit‖ means the certificate issued by the Registered Vehicle Scrapping Facility to recognise the transfer of ownership of the vehicle from the registered owner to the Registered Scrapper for further treatment; (d) ―Certificate of Vehicle Scrapping‖ means the certificate issued by a Registered Vehicle Scrapping Facility to recognise the final disposal of a vehicle; (e) ―Collection Centre‖ means a facility or an area that may be used for the sole purpose of collecting and storing the End of Life Vehicles and sending it for further processing at the Scrapping Yard; (f) ―End-of-Life Vehicles‖ means all vehicles which are no longer validly registered or declared unfit through Automated Fitness Centres or their registrations have been cancelled under Chapter IV of the Act or due to an order of a Court of Law or are self-declared by the legitimate registered owner as a waste vehicle due to any circumstances as specified in these rules; (g) ―Final Disposal‖ means the treatment of the vehicle so that the vehicle is no longer capable of being used as such, the evidence for which is the cut out of the Chassis and the disposal of its engine; (h) ―Recycling‖ means the reclamation and processing of waste in an environmentally sound manner for the original purpose or other;22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (i) ―Registered owner of an End of Life Vehicle‖ means, - (i) owner of the vehicle as defined in clause (30) of section 2 of the Act; or (ii) person who has gained ownership of the vehicle in a public auction in accordance with rule 57 of the Central Motor Vehicle Rules, 1989; (j) ―Registered Scrapper‖ means a person, firm, society, trust or company owning and operating a Registered Vehicle Scrapping Facility; (k) ―Registered Vehicle Scrapping Facility‖ means any establishment which holds a Registration for Vehicle Scrapping issued under these rules for carrying out dismantling and scrapping operations; (l) ―Registration Authority‖ means the officer not below the rank of the Commissioner (Transport) as designated by the Government of the State or Union territory for this purpose; (m) ―Scrapping‖ means the entire process from receipt and record of the ‗End-of-Life Vehicles‘ including depolluting, dismantling, segregation of material, safe disposal of non-reusable parts, and issuance of Certificate of Vehicle Scrapping to the registered owner of a motor vehicle; (n) ―Scrapping Yard‖ means the designated location within the premises of the Registered Vehicle Scrapping Facility where the End-of-life Vehicles are processed for further treatment including recycling; (o) ―Treatment‖ means any activity after the end of life vehicle has been handed over to a collection centre of a Registered Vehicle Scrapping Facility for depollution, dismantling, shearing, shredding, recovery or preparation for disposal of the shredder wastes, and any other operation carried out for the recovery or disposal of the end of life vehicle and its components; and (p) ―Vehicle‖ means a motor vehicle or vehicle as defined in clause (28) of section 2 of the Act. (2) Words and expression used and not defined in these rules, but defined in the Act shall have the same meanings respectively assigned to them in the Act. 4. Powers and duties of Registered Vehicle Scrapping Facility.- (1) The Registered Vehicle Scrapping Facility shall be provided connectivity and access to the VAHAN database of vehicle registration with password protected user ID and shall be authorised to make suitable entries regarding scrapping of the vehicle and issuance of Certificate of Deposit and Certificate of Scrapping, either directly or through their collection centre. (2) The Registered Vehicle Scrapping Facility must have necessary cyber security certifications for the IT Systems for safe access to the VAHAN database. (3) The Registered Vehicle Scrapping Facility shall be provided the necessary connectivity to verify the records of the vehicles produced for scrapping with the database of the stolen vehicles, held by National Crime Records Bureau as well as with the local Police and it shall be duty of the Registered Vehicle Scrapping Facility to carry out such verification before scrapping a vehicle. (4) The Registered Vehicle Scrapping Facility shall undertake verification of the persons handing over the vehicle for scrapping to determine the bonafide of the vehicle owner or his authorised representative and retain a copy of the same for record for a minimum period of six months. (5) The Registered Vehicle Scrapping Facility shall be recognised as Facilitation Centre as per clause (cd) of rule 2 of the Central Motor Vehicles Rules, 1989 for Registered Vehicle Scrapping Facility purpose only. 5. Conditions of eligibility for Registered Vehicle Scrapping Facility.- The State Government or Union territory Government when granting authorisation to any Registered Vehicle Scrapping Facility under rule 6 shall take into account the following eligibility criteria, namely:- (a) The Registered Vehicle Scrapping Facility may be owned and operated by any legal entity, be it a person, firm, society, Company or trust established in accordance with law having the following documents, - (i) Certificate of Incorporation or Shop Act Registration or Udyam Aadhar; (ii) Valid Goods and Services Tax registration; and[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 23 (iii) Valid Permanent Account Number (b) The entity shall have applied for or having an approval for consent to establish from the Registering authority of the State or Union territory Government in which the Registered Vehicle Scrapping Facility is intended to be located. (c) The entity shall undertake to meet the minimum technical requirement for collection and dismantling centres as per Central Pollution Control Board Guidelines. (d) The entity shall have competent manpower and appropriate equipment to carry out the depollution and dismantling activities in a safe and environmentally responsible manner. (e) The entity shall undertake to obtain the required quality certifications of ISO 9001(quality management system) or ISO 14001(environmental certification) or ISO 45001 (occupational health and safety) within twelve months of commencement of operations as a Registered Vehicle Scrapping Facility. (f) The entity shall possess or provide an undertaking to obtain a consent to operate from State Pollution Control Board within a period of six months from commencement of operations. (g) The entity shall undertake to abide by the provisions of all applicable Labour codes and all other Acts or Rules as applicable. (h) The entity shall provide evidence of availability of an adequate useable area of land in the orange category industrial zone of the State or Union territory by way of ownership or agreement to sell or agreement for lease of a minimum period of three years. (i) The entity shall have necessary cyber security certifications specified under sub-rule (2) of rule 4. (ii) The entity shall provide approved plant layout and the building plan. 6. Registration procedure for Registered Vehicle Scrapping Facility. - (1) An applicant may make an application in the prescribed Form-1, addressed to the Registration Authority of the concerned State Government or Union territory Government where the Registered Vehicle Scrapping Facility is intended to be located along with,- (i) a non-refundable processing fee of Rs. 1,00,000/- (Rupees One Lakh only) for each Registered Vehicle Scrapping Facility proposed to be established; and (ii) an earnest money deposit by way of a bank guarantee of Rs. 10,00,000/- (Rupees Ten Lakhs) for each Registered Vehicle Scrapping Facility proposed to be established, in favour of the Registration Authority or as a non-interest-bearing security deposit for a period, co-terminus with the validity of the initial registration period, plus ninety days. (2) All applications for grant of registration shall be disposed of by the Registration Authority within a period of sixty days from the date of application. (3) All accepted applications shall be issued a registration certificate in Form-1A. (4) Applicants whose applications are rejected shall be refunded their earnest money or bank guarantee; (5) The Central Government shall develop a portal for Single Window Clearance on which the applicant will apply with all necessary documents and required fee for registration. (6) State Government or Union territory Government shall clear the proposal in time bound manner within sixty days including the internal approval from various State agencies (Labour, Pollution etc.) after submitting such application else the proposal would be deemed approved. (7) Such portal shall be operationalised within six months from the date of notification of these rules and till such time as this portal is operationalised, processing of these cases shall be done manually by respective State Governments or Union territory Governments.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (8) After the operationalisation of the portal referred to in sub-rule (5), all subsequent approvals etc. shall be granted through the portal and reports regarding the inspection and audit of Registered Vehicle Scrapping Facility should be made available on the portal. (9) The necessary approvals by the State Pollution Control Board, Labour Department and any other department deemed necessary for the establishing or operation of such Registered Vehicle Scrapping Facility shall be provided through that portal only. (10) The State Government or Union territory Government shall publish a Citizen‘s Charter on the portal and the procedure for grant of approvals on such portal. (11) The process shall be transparent and seamless and all the notifications, guidelines, forms, etc. shall be made available on the portal established in sub-rule (5), and the applications shall be made electronically and disposed-off in time-bound manner. 7. Validity and renewal of registration.- (1) The registration issued under rule 6 shall be valid for an initial period of ten years, which shall be renewable for another ten years at a time, subject to the condition that the Registered Scrapper has not been in default of the provisions as specified in rule 14. (2) An application for renewal of registration may be made three months before expiry of such registration. (3) Application for renewal shall be in Form-1 and shall carry such renewal fee and security deposit as may be specified by the State or Union territory Government for this purpose. (4) The renewal of registration shall be issued as per Form-1A. (5) The registration issued under this rule shall not be transferable. 8. Criteria for scrapping of vehicles.- The following vehicles may be offered for scrapping to the Registered Scrapper,- (i) Vehicles which have not renewed their Certificate of Registration in accordance with rule 52 of the Central Motor Vehicles Rules, 1989. (ii) Vehicles which have not been granted a certificate of fitness in accordance with rule 62 of the Central Motor Vehicles Rules, 1989. (iii) Vehicles which have been damaged due to fire, riot, natural disaster, accident or any calamity, following which the registered owner self certifies the same as scrap. (iv) Vehicles which have been declared obsolete or surplus or beyond economic repair by the Central or State Organisations of the Government and have been offered for scrapping. (v) Vehicles bought by any agency including Registered Vehicle Scrapping Facility in an auction for scrapping the vehicles. (vi) Vehicles which have outlived their utility or application particularly for projects in mining, highways, power, farms etc. as may be self-certified by the owner. (vii) Manufacturing rejects, test vehicles, prototype, vehicles damaged during transportation from vehicle Original equipment manufacturer to dealers or Unsold or unregistered vehicles as may be certified by the vehicle original equipment manufacturer. (viii) Auctioned, impounded or abandoned vehicles by any enforcement agency. (ix) Any other vehicle voluntarily offered to a Registered Vehicle Scrapping Facility for scrapping, by the owner. 9. Right to inspection.- (1) The Registered Scrapper shall maintain in the Registered Vehicle Scrapping Facility, the records regarding the transaction of vehicles and scrap generation and its responsible disposal to authorised recyclers, and all the machinery, equipment and apparatus in the Registered Vehicle Scrapping Facility premises, ready for inspection by the Registration Authority or Designated Officer of the State Government or Union territory Government. (2) Physical inspection and site visits may be carried out after execution of process as listed below,-[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 25 (i) when a report of non-compliance by the appropriate authority or a public complaint has been received by the Registration Authority in respect of the Registered Scrapper; (ii) such complaint has been forwarded to the Registered Scrapper to file a written response within seven working days; (iii) the response has been scrutinised and an opportunity has been provided to the Registered Scrapper to provide further clarifications within three working days. (iv) the response and clarifications provided are inadequate in the opinion of the Registration Authority, and a site visit is warranted. (3) Such site visit shall be duly authorized by the Registration Authority. (4) The report of the inspection team shall be submitted to the Registration Authority and a copy of the same shall be provided to the Registered Scrapper. (5) In case of non-compliance of these rules the Registration Authority may after providing an opportunity to the Registered Scrapper of being heard, pass a speaking order to cancel or suspend the registration for the facility. 10. Scrapping Procedure.- (1) The scrapping of vehicles shall be carried out by a Registered Scrapper in respect of all End-of-Life Vehicles, by the following procedure, namely:- (i) the registered owner or the authorised representative shall hand over the vehicle together with an application as per Form-2 in two originals to the Registered Scrapper or the designated Collection Centre for deposit and further treatment of the vehicle. (ii) if the vehicle does not have a valid registration, then the Registered Scrapper or its designated centre shall match the identity of the registered owner as per the VAHAN database with the person handing over the vehicle and receive the vehicle and issue a receipt through digital platform linked to VAHAN database. (iii) vehicles impounded by an enforcement agency shall be handed over to the Registered Scrapper. (iv) the Registered Vehicle Scrapping Facility shall verify the records of the vehicles produced for scrapping with the database of the stolen vehicles held by National Crime Records Bureau as well as with the local Police before scrapping a vehicle. (v) the Registered Scrapper shall require, along with the Form-2, the following applicable original documents from the owner or the authorised representative, - (a) original Certificate of Registration; (b) authorisation from the registered owner; (c) in case of inheritance, the death certificate of the registered owner accompanied with any proof of succession; (d) certificate or order confirming the sale of the vehicle in a public auction in his favour duly signed by the person authorised to conduct the auction; and (e) an undertaking, as per para 4 of Form-2 from the owner or representative, indicating that vehicle has no pending criminal record or litigation and there are no pending dues on the vehicle. (vi) the Registered Scrapper shall verify that the hire-purchase, lease or hypothecation agreement in the certificate of registration of a motor vehicle required under sub-section (2) of section 51 of the Act has been duly discharged and an undertaking to this effect shall also be given by the owner or representative in para 4 of Form-2. (vii) The Registered Scrapper shall accept self-certified copies from the owner or through authorised representative of the following documents,- (a) copy of the Permanent Account Number card of the owner;26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (b) cancelled cheque of the bank account of the owner; (c) identity Proof of the authorised representative (if applicable) such as passport, voter card, Aadhar card, driving license or photo identity card issued by the State Government or the Central Government; (d) address proof of the owner such as electricity bill, water bill, land line telephone bill or piped cooking gas bill etc; and (e) digital photograph of the owner or authorised representative physically handing over the End-of- Life Vehicle to the Registered Scrapper, or a photograph of the owner or representative duly pasted in Form-2 and countersigned by the owner or representative. (viii) The Registered Scrapper shall return the second Form-2, duly receipted, to the owner or his authorised representative and deface or punch the Registration Certificate in the presence of the owner or his authorised representative and issue the Certificate of Deposit as evidence of transfer of ownership of the vehicle. (ix) The Registered Vehicle Scrapping Facility established in a State may accept and scrap the vehicles registered in any of the State or Union Territory under the jurisdiction of any Registration Authority. (x) The whole process shall be smoothly linked with VAHAN and on pan India basis irrespective of the location of any vehicle registering authority. (xi) The Registered Vehicle Scrapping Facility shall facilitate the process of submission of request electronically and transmission of registration certificate (defaced or punched) to road transport or regional transport office in getting vehicle deregistered as per provisions of the Act. (xii) The ‗Certificate of Deposit‘ shall be a necessary and sufficient document for the owner to avail incentives and benefits for purchase of a new vehicle as may be declared from time to time. (xiii) The Certificate of Deposit shall be tradeable and once utilised shall be collected by the agency or dealer providing the benefits to the holder of the said certificate. (xiv) The Certificate of Deposit shall be stamped as ―Cancelled‖ by the agency or dealer and marked as such in the VAHAN database. (xv) The regional transport office registering the new vehicle purchased against the Certificate of Deposit may verify and authenticate the Certificate of Deposit. (xvi) The Registered Scrapper shall digitally remit or pay by an account payee cheque, the agreed consideration for the vehicle and obtain a receipt for the same from the owner or his authorised representative for record. (xvii) The Registered Scrapper shall have the cut piece of the chassis number in safe custody for a period of six months from the date of issue of Certificate of Vehicle Scrapping issued under rule 11. (xviii) The Registered Scrapper shall maintain a physical copy of all documents for a period of two years and a digital scanned copy of those documents for a period of ten years for record and examination during inspection; (xix) The Registered Scrapper shall ensure that removal or re-cycling or disposal of hazardous parts of the scrapped vehicle is done as per CPCB guidelines for Environmentally Sound Management of End-of-Live Vehicles and AIS-129. (xx) Vehicles shall not be scrapped until the fuel, oil, antifreeze, and other gases, fluids etc. are drained and collected in certified standard containers. (xxi) A digital register of vehicles scrapped shall be maintained in Form-3. 11. Issuance of Certificate of Vehicle Scrapping.- (1) The Registered Scrapper, after completing the necessary treatment, shall issue a digital Certificate of Vehicle Scrapping including a digital photograph of the cut out of the chassis, in Form-4 to update the national register, VAHAN Database and inform the competent authority of the State Government or Union territory Government for updating of records.[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 27 (2) A separate record of the scrapped vehicles shall be maintained on the VAHAN database by the Central Government. 12. Installation of CCTV Cameras. - (1) The Registered Scrapper shall install CCTV cameras at the scrapping yard, in the customer and vehicle reception area and the record of scrapping shall be saved in the Registered Scrapper‘s IT system for a period of three calendar months. (2) The access to the CCTV footage installed in the facility may be provided to the authorised agencies as may be required by the State Government or Union territory Government. 13. Scrapping Yard and Collection Centre.- (1) The Scrapping Yard shall be set up in an adequate area having space for vehicular movement, storing the vehicles or items received and recyclable material recovered, commensurate to the size and voluminous nature of the scraps to be handled by the facility. (2) The Scrapping Yard shall be a gated area to handle, depollute and dismantle End-of-Life Vehicles, white goods and other scraps along with facility for measuring radiation as is followed for import of scrap. (3) Material handling machines shall be utilised to minimise human intervention and create safe work places. (4) All Scrapping Yards shall engage competent and trained manpower to process the End-of-Life vehicles, goods and other scraps. (5) The Scrapping Yard shall have dry areas (free from water logging), impermeable surfaces like asphalt or concrete flooring, asphalt or concrete roads, adequate workshop facilities for in-house maintenance, fire protection systems etc. to maintain safe work places and all other required measures for keeping pollution under control. (6) Scrapping Yard shall be equipped with a depollution system, preferably with zero discharge system and dismantling work shall be done using technology for processing the End-of-Life vehicles, goods and other scraps. (7) The Scrapping Yard shall comply with relevant health and safety legislation or regulation and environmental norms. (8) The Scrapping yard shall have,- (a) Suitable earmarked area for parking of waste vehicles on non-permeable asphalt or concrete or epoxy coated flooring with adequate drainage facility and no waste or potentially waste vehicle shall be parked on roads or public spaces even during processing of applications for deposit and shall be accommodated within the premises of the Registered Vehicle Scrapping Facility only. (b) Certified de-polluting equipment to ensure zero leakage of pollutants during draining of fuels or fluids or gases and liquids, certified de-risking equipment for safe neutralization or removal of airbags, pre- tensioner etc., appropriate dismantling equipment for the activities defined (such as de-risking, de- polluting, dismantling, shredding, shearing, bailing etc.), designated areas for storing the segregated scrap, adequate space for storage and handling of segregated spares, designated space for temporary storage of automotive hazardous waste such as tyres, batteries, fuel, oils, liquids and gases, suitable safety and occupational health equipment, material handling equipment for the safe transportation of spares, scrap etc. (c) Appropriate Industrial grade lighting and ventilation systems, conformity to noise pollution norms and appropriate effluent treatment plants or water recycling plants. (9) Scrapping Yards shall accredit themselves with the latest version of quality standards viz. ISO 9001 (Quality management system), ISO14001 (Environmental Management System) and ISO 45001 (Occupational health and safety) within twelve months of commencement of operations. (10) In case Scrapping Yards do not have adequate capability or provisions for responsible recycling of hazardous waste (like e-waste, lead acid batteries, lithium-ion components, or for recovery of rare earth metals, etc.), or for recycling of scrap material which is outside its scope, then such materials shall be sold to duly authorised recyclers or agencies, who have adequate capability and licence.28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (11) Records of the transactions shall be maintained, clearly stating the volumes off-loaded and the name, authorisation number, Permanent Account Number, Goods and Services Tax and other commercial details of the authorized recycler/agency. Such records shall be subjected to periodical audit. (12) Collection Centre may be established by a Registered Vehicle Scrapping Facility at any other place, other than the Scrapping Yard if collection center undertakes activities such as depollution and dismantling and the requirements applicable for Scrapping Yard shall also be applicable to such Collection Center. 14. Audits and Certifications. – (1) The Registered Vehicle Scrapping Facility shall be audited by the Registration Authority for compliance with these rules; (2) On behalf of the Registration Authority, any of the agencies specified under rule 126 of the Central Motor Vehicles Rules, 1989 or in such list, may undertake,- (a) regulatory and compliance audit; and (b) audit of the mass flow statement as maintained in Form-3 by the Registered Vehicle Scrapping Facility. (3) The audit report shall also grade and evaluate the Registered Vehicle Scrapping Facility in terms of its performance and adherence to occupational health and safety compliances, regulatory, business, environment and labour standards and the respective recycling rates basis, the mass flow information recorded in Form-3 achieved by the Registered Scrapper. (4) Such audit report shall be uploaded on the portal by the Registered Scrapper annually for a financial year or part thereof and shall be submitted by the 31st May (within two months of completion of financial year) of that financial year. (5) Observations of non-compliance as reported in the audit report shall be resolved by the Registered Scrapper within two months of issue of the audit report which may be extended by a maximum of one-month by the Registration Authority. (6) The Registered Scrapper shall ensure that ISO certifications are revalidated at least three months before their expiry. 15. Appeal.- (1) Any person aggrieved by an order passed under sub-rule (5) of rule 9, of the Registration Authority may within thirty days of the date of receipt of such order, appeal to the Appellate Authority. (2) The appeal shall be preferred in a plain application format, setting forth the grounds of objections to the order passed by the Registration Authority and shall be accompanied by a certified copy of the order appealed against and fee of Rs 10,000/- (Rupees Ten Thousand only).
