Proceedings (TDP) Enquiry conducted – Charges held proved – Imposing 100%

O R D E R:-
Whereas, in the reference 1st read above, the competent authority has conducted
a regular enquiry and reported that the Municipal Commissioner, the then
Jaggaiahpet Nagar Panchayat, Krishna District and his staff were indulged in corrupt
practices in utilizing the Municipal funds in purchase of sanitary items like BHC
Chappal and Steel etc.
2. And whereas, in the reference 2nd read above, after examining the Enquiry
Report, Sri Ahmed Baigh, the then A.E. of Jaggaiahpet Municipality was placed on
his defense before the Tribunal for Disciplinary Proceedings along with other officials
of Jaggaiahpet Municipality.
3. And whereas in the reference 3rd read above, the TDP, duly framing charges,
conducted enquiry and submitted the enquiry report wherein, held that, Sri Ahmed
Baig Asst. Engineer and others were found guilty in the charges.
4. And whereas, in the reference 4th read above, a copy of the report of TDP was
communicated to Sri Ahmed Baigh, Asst. Engineer, as required under Rule 8 (2)(b)
of Tribunal for Disciplinary Proceedings Rules, 1989 to the representation if any in
the matter. Sri Ahmed Baigh, Asst. Engineer has submitted a representation to
Government on the findings of the TDP wherein he has denied and requested to
drop further action against him.
5. After careful examination of the explanations of the Charged Officer in
consultation with advisory bodies, a show cause notice as required under Rule 9 of
A.P. Revised Pension Rules, 1980, has been issued to Sri Ahmed Baigh, Asst.
Engineer (Retd.) as to why the punishment of 100% cut in pension including DCRG
permanently should not be imposed on them besides recovery of loss sustained by
the Municipality.

6. And whereas, in the reference 7th read above, the Engineer-in-Chief (PH)
has forwarded the representation of Sri Ahmed Baig, Asst. Engineer,(Retd.)
received through the Commissioner, Jaggaiahpet Municipality, wherein the
Municipal Commissioner has informed that Sri Ahmed Baig, Deputy Executive
Engineer (Retd.) in his letter dated 18.8.2011 addressed the Commissioner,
Jaggaiahpet Municipality stating that the Engineer-in-Chief (PH) in his letter
No.415/CS3/2000, dated: 30-01-2009 requested the Accountant General (P)
(13) to recover misappropriation amount of Rs.93,200/- from him. Accordingly,
the said amount was remitted to Jaggaiahpet Municipality through
D.D.No,006722, dated: 29-04-2009 and the same was confirmed through the
letter ROC No.909/2009/C1, dated:15-5-2009 by the Commissioner Jaggaiahpet
Municipality. Further, Sri Ahmed Baigh, Deputy Executive Engineer (Retd.) has
stated that he was aged about 70 years and he was diabetic patient in addition
to some other cronic diseases and spending 50% of his pension amount towards
medical treatment and requested to consider sympathetically.
7. And where as, Government after examination of the entire matter, have
decided to impose major punishment of withholding of 100% pension and
Gratuity permanently on him even though the loss of Rs.93,200/- was recovered
from him. In the reference 8th read above, the A.P. Public Service Commission,
has been consulted for their concurrence on the said punishment. In the
reference 9th read above, the Andhra Pradesh Public Service Commission have
agreed and conveyed their concurrence on the proposal of the Government to
impose major punishment of withholding of 100% cut in pension and Gratuity
permanently against Sri Shaik Ahmed Baigh, Deputy Executive Engineer (Retd).
8. After careful examination of the matter, Government hereby impose a
major punishment of withholding 100% pension and Death-cum-Retirement
Gratuity permanently against Sri Ahmed Baig, former Asst. Engineer
(Retd.)formerly at Jaggaiahpet Municipality in terms of Rule 9 of A.P. Revised
Pension Rules, 1980.
9. The Engineer-in-Chief (PH) Hyderabad shall take necessary action in the
matter.
