NOTIFICATION
Whereas the term of the Chairperson of Hindupur Municipal Council is going
to expiry by 25.02.2012 as per clause (a) of sub-section (1) of Section 20 and Sub-
section (2) of section 23 of the Andhra Pradesh Municipalities Act, 1965.
And whereas, according to sub-section (2) of Section 20 and sub-section
(2) of Section 23 of the Andhra Pradesh Municipalities Act, 1965, ordinary
vacancies in the office of the members and Chairpersons shall be filled at Ordinary
Elections which shall be completed before the expiry of the term of office of the
members.
And whereas, Government is of the opinion that it is not possible to hold
ordinary elections to the said Municipalities in accordance with the provisions of
this Act due to the following reasons:
(i) Upgradation of certain Gram Panchayats into Nagar Panchayats /
Municipalities, Upgradation of Municipality into Municipal Corporation,
inclusion of certain Gram Panchayats into Urban Local Bodies;
(ii) Identification of Backward Class voters as per 2012 Electoral Rolls
published is underway for reservation of seats for Backward classes; and
(iii) Final Publication of Census 2011 data yet to be done by the Registrar
General of Census, Government of India which is required for reservation
of seats for Scheduled Castes and Schedule Tribes.
Now, therefore, in exercise of the powers conferred by sub-section (1) read
with sub-section (3) of Section 62-A of the Andhra Pradesh Municipalities Act,
1965 (Andhra Pradesh Act No. 6 of 1965), the Government of Andhra Pradesh
hereby appoint Joint Collector, Ananthapur District as Special Officer to the
Hindupur Municipal Council with effect from 26.02.2012 to exercise the powers,
perform the duties and dis-charge the functions of the Council, the Chairperson
and the committees referred to under Section 43 and 74 of the said Act, for a
period of 6 (six) months or until the elected members come into office, a Chairman
is elected or Committees are constituted, whichever may be earlier.
