ORDER:-
The Screening Committee, which met on 13.5.2009, had recommended certain names
of Assistant Directors of Animal Husbandry for inclusion in the panel for promotion to the
category of Deputy Director of Animal Husbandry (class-A) for the panel year 2008-2009. The
name of Dr.P.Padma (Sl.No.88) was included in the panel against SC(W) RP-2, since adverse
remarks were recorded in the ACR of Dr.N.Rajani Kumari (Sl.No.84) who is senior to
Dr.P.Padma, for the year 2003-04. Accordingly, Dr.P.Padma ( Sl.No.88), was promoted as
Deputy Director of Animal Husbandry (class-A) duly according RP-2, SC(W) which was
originally held by Dr.N.Rajani Kumari.
2. Aggrieved by that, Dr.N.Rajani Kumari, who is senior to Dr.P.Padmas has filed OA
before APAT and the Tribunal in its order, dated:23.06.2009, directed to consider the case of
the individual for promotion to the post of Deputy Director (AH) in the existing vacancies.
Accordingly, one post of Deputy Director (AH) had been kept vacant.
3. Subsequently, the adverse remarks recorded in the ACRβs of Dr. N. Rajani Kumari for
the year 2003-2004 have been expunged and she has become eligible for promotion to the
category of Deputy Director of Animal Husbandry (Class-A) against the vacancy which arose for
SC(W) at RP-2.
4. Accordingly, the matter was placed before the Screening Committee and the committee
recommended for inclusion of the name of Dr. N. Rajani Kumari against SC-W RP-2 in place of
Dr.P.Padma ( Sl.No.88) in the panel of Assistant Director of Animal Husbandry for the panel
year 2008-09 and for deletion of the name of Dr.P.Padma from the panel.5. In view of the recommendations of the Screening Committee, a Showcause notice was
issued to Dr.P.Padma to submit her objections against the proposed deletion of her name from
the panel year 2008-09. She has submitted a representation to consider her name in the same
panel as she is fully qualified to hold the post.
6. Accordingly, Dr.N.Rajani Kumari, AD(AH) was promoted as DD(AH) against RP 2
(SC.W). The representation of Dr.P.Padma, DD(AH) for continuation as DD(AH) and also the
proposal of DAH to conduct review DPC has been examined. As per the existing orders
issued by the Social Welfare Department on implementation of Rule of Reservation in
promotions, the unit of appointment for the purpose of reservation in the matter of promotion
and appointment by transfer involving promotion shall be hundred vacancies of which fifteen
shall be reserved for Scheduled Castes and six for Scheduled tribe employees as per the roster
point in sub-rule 22 (2) (e) of A.P.State and Subordinate Rules, 1996. Further as per rule-22 (2)
(a) (i) ( C ) Filling up the roster points shall continue till the required percentage of Scheduled
Caste and Scheduled Tribe candidates is obtained. Once the required percentage is obtained
by taking into account both the Scheduled Caste and Scheduled Tribe candidates who are
found in the list of candidates fit for promotion on account of their seniority in the feeder
category and those who are moved up to fill up the required roster point, further adjustment of
Scheduled Caste and Scheduled tribe employees against roster point has to be stopped.
Utilized roster points after the required Scheduled Caste and Scheduled Tribes percentage is
met, shall lapse. Hence, the name of Dr.P.Padma cannot be considered against RP No.22 in
the approved panel of 2008-09 in view of adequacy already achieved in ROR in the said panel.
8. After careful examination of the matter, Government hereby accepted the
recommendation of the Screening Committee held on 08-11-2010 and hereby delete the name
of Dr. P.Padma , Deputy Director of animal Husbandry from the approved panel year 2008-2009
and she is reverted to her lower post of Assistant Director of Animal Husbandry accordingly.
9. The Director of Animal Husbandry, A.P. Hyderabad shall take necessary action
accordingly.
