District & Sessions Judge, Visakhapatnam. 11. Govt.Memo No.8294/Vig.IV.2/2001- , Dt:09.11.2011. 12. From the Commissioner, Vizianagaram Municipality, Lr.Rc. No.4113/2011/C1,Dt:15.11.2011. ---- ORDER:- It has been reported by the Appropriate Authority that, Sri.M.Appanna, while working as Bill Collector in Vizianagaram Municipality, was trapped by the officials of the Anti Corruption Bureau on 09.2.2001, when he demanded and accepted a bribe amount of Rs. 500/-, in conspiracy with a private person, from a Complainant for showing official favour in finalization of Town Survey Plan and Endorsement certificate. 2. Whereas, in the reference 2nd read above, instructions were issued to place the Accused Officer Sri.M.Appanna, Bill collector, Vizianagaram Municipality under suspension. Accordingly in the reference 3rd read above, the Accused Officer was placed under suspension. 3. Whereas, basing on the report of the appropriate authority in the reference 4th read above, sanction was accorded in the reference 5th read above, for prosecution of the Accused Officer Sri.M.Appanna, Bill Collector (under suspension) of Vizianagaram Municipality in a Court of Law, for the under Section 7 & 13(1)(d) read with 13(2) of Prevention of Corruption Act,1988. In the reference 6th read above, the Charge-Sheet was filed in the Court of Special Court for A.C.B. Cases, Visakhapatnam in CC.No.09/2002, against the Accused Officer on 26.3.2002. (P.T.O.):: 2 :: 4. Whereas, after reviewing the suspension period of the Accused Officer, Government, in the reference 7th read above, have issued instructions, for reinstatement of the Accused Officer, into duty, by revoking his suspension period. Accordingly in the reference 8th read above, Commissioner, Vizianagaram Municipality issued orders reinstating the Accused Officer into duty, without prejudice to the criminal proceedings, pending against him. 5. Whereas, in the reference 10th read above, the Hon’ble Court of the Special Judge for A.C.B. Cases, Visakhapatnam, in its judgment dated 14.3.2008, acquitted the Accused Officer Sri.M.Appanna, Bill Collector, in CC.No.09/2002. In the reference 12th read above, it was reported that the Accused Officer Sri.M.Appanna, Bill Collector expired on 20.09.2008. 6. Government, after examination of the matter duly obtaining the advice of the competent authority, hereby abate criminal proceedings in CC.No.09/2002, against Late Sri.M.Appanna, former Bill Collector, Vizianagaram Municipality, as he expired on 20.09.2008. 7. The Director of Municipal Administration, Hyderabad, shall take necessary in the matter.
