Sainikpuri, Hyderabad – Trapped on 27.10.2010 – Sanction of prosecution
under Prevention of Corruption Act, 1988 – Orders – Issued.

Read the following:
O R D E R:
Whereas, Sri R. Lokilal, General Manager, O&M Division No. XIV,
Hyderabad Metro Water Supply & Sewerage Board, Sainikpuri, Hyderabad
worked from 10.2.2009 to 27.10.2010 and as such he is a Public Servant
with in the meaning of Clause (c ) of Section 2 of Prevention of Corruption
Act, 1988 (Central Act 49 of 1988).
2. And whereas, Sri Bontha Maisaiah S/o Mariah, aged: 45 years,
Occupation: Civil Contractor, R/o 12-15-51, Manikeshwari Nagar, Osmania
University, Hyderabad, is a Civil contractor for the past several years and
since the year 2008 he is attending contract works in Division No. XIV of
Hyderabad Metro Water Supply & Sewerage Board and executing the
maintenance and repair works. Sri B. Maisaiah Civil contractor also
attended the works under Operation & Maintenance Division XIV, Kapra of
Hyderabad Metro Water Supply and Sewerage Board Sri B. Maisaiah
executed works in the year 2009 vide Measurement Book with Nos. 25, 85,
92 & 94 approximately with a total cost of Rs.6,80,000/-. Out of which, Sri
R. Lokilal, General Manager, O & M Division XIV, Sainikpuri, issued Cheque
for Rs.3,30,000/- and for sanction of rest of the amounts, Sri R. Lokilal,
General Manager demanded to pay bribe of Rs.50,000/-. Sri B. Maisaiah
regularly visited the Division office and meeting the said General Manager
Sri R. Lokilal for getting sanction of remaining amounts, but Sri R. Lokilal
insisted on his demand of bribe. Firmly Sri Lokilal said that he would not
sanction any amounts unless and until he pay the demanded bribe amount
and asked him to pay the same on the evening of 27.10.2010.
3. And whereas Sri B. Maisaiah was not willing to pay any bribe to Sri R.
Lokilal, General Manager, O&M Division No. XIV, Sainikpuri, Hyderabad has
lodged the complaint with the Deputy Superintendent of Police, Anti-
Corruption Bureau, City Range-I, Hyderabad on 26.10.2010 at 1000 hrs,
who registered the complaint as a case in Cr. No. 21/ACB-CR/2010 Under
Section 7 of Prevention of Corruption Act-1988 (Central Act 49 of 1988) on
27.10.2010 at 11.00 A.M. by following due procedure and investigated into.
4. And whereas, Sri R. Lokilal, General Manager, O & M Division No. XIV,
Sainikpuri, Hyderabad was trapped by the Deputy Superintendent of Police,
Anti Corruption Bureau, City Range-II, Hyderabad in Cr. No. 21/ACB-
CR1/2010 when he further demanded and accepted the bribe amount of
Rs.50,000/- (Rupees fifty thousand only) From Sri B. Maisaiah, as illegal
gratification other than legal remuneration, for showing an official favour
on 27.10.2010. The phenolphthalein test conducted on both the right hand
and left hand fingers of Sri R. Lokilal gave positive result and the tainted
amount of Rs.50,000/- was recovered at his instance from the right side
pant pocket of his wearing pant and seized. The inner flap of the right side
pant pocket also yielded positive result when tested in sodium carbonate
solution.//2//
5. And whereas, the above said acts of Sri R. Lokilal, General Manager,
O & M Division No. XIV, Sainikpuri, Hyderabad constitute offences
punishable under section 7 and 13 (2) r/w 13 (1) (d) of the Prevention of
Corruption Act, 1988 (Central Act, 49 of 1988).
6. And whereas, the Government of Andhra Pradesh being the
competent authority to remove the said Sri R. Lokilal, General Manager, O &
M Division No. XIV, Sainikpuri, Hyderabad from the Government service and
after fully and carefully examination of the material placed before them i.e.,
copies of F.I.R. M.R-I and II, final investigation report of the Director
General, Anti Corruption Bureau, Hyderabad statements of witnesses etc.,
in respect of the above said allegations and having regard to the facts and
circumstances of the case, consider that the said Sri R. Lokilal, General
Manager, O&M Division No. XIV, Sainikpuri, Hyderabad should be
prosecuted in a competent Court of Law for the aforesaid offences.
7. Now, therefore, in exercise of the powers conferred by clause (b) of
sub-section (i) of section 19 of the Prevention of Corruption Act, 1988
(Central Act, 49 of 1988) the Government of Andhra Pradesh do hereby
accord sanction for the prosecution of the said Sri R. Lokilal, General
Manager, O & M Division No. XIV, Sainikpuri, Hyderabad for the above said
offences punishable under sections 7 and 13 (2) r/w 13 (1) (d) of
Prevention of Corruption Act, 1988 (Central Act 49 of 1988) and for any
other cognate offences punishable under any other provisions of law for the
time being in force in respect of above said acts and for taking cognizance
of the said offences by a Court of law competent jurisdiction.
