From GOI, Mo.EF, Bangalore, Lr.F (C) A/16.1/AP/58/MIN/398, dt.04-01-2012. **** ORDER: The Principal Chief Conservator of Forests, Andhra Pradesh, Hyderabad in his letter 1st read above had submitted a proposal under Forest (Conservation) Act, 1980 for diversion of 18.62 Ha. of forest land in Madhavaram R.F., Dhone Range, Kurnool Division / District, for second renewal of mining lease for Lime Stone, in favour of M/s. Deccan Lime Stone Mining Company (P) Ltd., Dhone, and requested to forward the same to Government of India, Ministry of Environment & Forests for their approval under Section-2 of Forest (Conservation ) Act, 1980. 2. The said proposal has been sent to Government of India, Ministry of Environment & Forests, for their approval under Forest (Conservation) Act, 1980 vide State Government letter 2nd read above. The Government of India, Ministry of Environment & Forests, in their letter 3rd read above, have accorded their approval in principal (Stage.I) for the proposal, for a period of 10 years, with effect from 24-01-2011, subject to compliance of certain conditions as stipulated therein. The State Government vide letter 4th read above, have furnished compliance report on the conditions stipulated by the Government of India. 3. Government of India, Ministry of Environment & Forests, in their letter 5th read above, have accorded their approval (Stage.II) under Section-2 of Forest (Conservation) Act, 1980, for diversion of 18.62 Ha. of forest land in Madhavaram R.F., Dhone Range, Kurnool Division / District for second renewal of mining lease for Lime Stone, in favour of M/s. Deccan Lime Stone Mining Company (P) Ltd., Dhone, for a period of 10 years, with effect from 24-01-2011, subject to certain conditions as stipulated therein 4. Government after careful examination of the proposal, hereby accord permission to the Principal Chief Conservator of Forests, Andhra Pradesh, Hyderabad for diversion of 18.62 Ha. of forest land in Madhavaram R.F., Dhone Range, Kurnool Division / District, for second renewal of mining lease for Lime Stone, in favour of M/s. Deccan Lime Stone Mining Company (P) Ltd., Dhone, for a period of 10 years, with effect from 24-01-2011, subject to the following conditions: 1. Legal status of the forest land shall remain unchanged.-2- 2. The demarcation of the forest area proposed for diversion shall be carried out by erecting cement concrete pillars duly numbered at an interval of 20 meters at the cost of user agency. 3. The fencing of safety zone area shall be carried out and it will be regenerated at the cost of user agency. 4. Additional amount of the Net Present Value (NPV) of the diverted forest land if any becoming due after revision of the same by the Hon’ble Supreme Court of India in future, shall be charged by the State Government from the user agency and deposited either in SB A/c.No.SB01025198-CAF Andhra Pradesh, Corporation Bank, CGO Complex, Lodhi Road, New Delhi – 110003 (RTGS/IFSC No.CORP0000371) or in SB A/c No.344902010105 407 – ANDHRA PRADESH CAMPA, Union Bank of India, Sundar Nagar, New Delhi – 110003 (RTGS/IFSC No.UBIN0534498). 5. The consent of Andhra Pradesh State Pollution Control Board shall be obtained under Air and Water Act before commencing mining operation and it shall be renewed every year. 6. The mining shall be done as per the mining plan approved by IBM. 7. Reclamation work concurrent to the mining shall be taken up by the user agency as per the plan approved by the Forest Department. 8. The construction of permanent buildings shall not be taken up in forest area. 9. Soil conservation measures shall be taken up at the cost of user agency. 10. The user agency shall protect the top soil at the project cost. 11. The user agency shall obtain environmental clearance under the Environment (Protection) Act, 1986. 12. No labour camps shall be established on the leased /diverted forest land. 13. Sufficient firewood shall be provided by the user agency to the labourers at the project cost after purchase from the State Forest Department / Forest Development Corporation. 14. The user agency shall ensure that there should be no damage to the wildlife. 15. A comprehensive monitoring shall be done at the end of five years to study the impact of mining on the surrounding flora and fauna and its watershed. If it is found that the lessee has violated or is not complying with the stipulated conditions, then the approval given under the Forest (Conservation) Act, 1980 shall be revoked. 16. The total forest area utilized for the project shall not exceed 18.62 ha. In case the land is not taken over by the user agency or the same is not used for the stipulated purpose within a period of two years, then the area in question shall be taken back by the Forest Department.-3- 17. Any other condition that the Additional Principal Chief Conservator of Forests (Central), Regional Office, Bangalore / State Government may impose from time to time for protection, improvement of flora and fauna in the forest area and public convenience shall also be applicable. 5.
