Whereas, the Govemment of India has ratified the Intemational Convention for the Safety of Life at Sea, 1974 (SOLAS), and the Convention entered into force on 25th May 1980 through accession. The Intemational Ship and Port Facility Security Code (ISPS Code), was established under Chapter XI-2 of the Intemational Convention for the Safety of Life at Sea (SOLAS) 1974 w.e.f. 0lst July 2004. The ISPS Code sets forth a mandatory security framework for intemational shipping, providing comprehensive maritime and port security requirements. 2. Whereas, under SOLAS Regulation Xl-219.2, a contracting government may reqtire that ships intending to enter its port, fumish the specific information provided under Regulation XI- 219.2.1 to offrcers duly authorised by that govemment to ensure compliance prior to their entry into the port facility. Compliance with this regulation is mandatory. 3. This Directorate has issued various circulars from time to time, to provide guidance to vessels entering Indian port facilities in line with the requirements specified under ISPS Code and specifically the Pre-Arrival Notification pf Security (PANS). Accordingly, the PANS reporting for respective vessels is in format prescribed in these circulars. 4. However, there was a need felt to consolidate the existing circulars and revise the requirements in line with the Govemment policy towards ease of doing business. It may be noted that the Merchant Shipping (Ships and Port Facility Secudty) Rules, 2024 have been notified, requiring ships, ports, and companies to comply with the requirement prescribed in the notified Rules. Section 29 of the MS (ISPS) Rules makes it a mandatory obligation for any ship entering a port within the jurisdiction of India to provide information ninely-six hours prior to its arrival. 6. The reporting requirement of PANS apply to the following vessels on intemational voyages entering Indian waters, vessels trading in coastal waters or coasting between Indian Ports: a. Passenger ships, including high-speed passenger crafts; b. Cargo ships, including high-speed craft of 500 GT and above; c. Mobile offshore drilling units; and d. Pleasure Yachts e. Sailing Vessel 7. The PAITIS should be submitted to the concemed port and the relevant regional authority specified under Table 1 at least 96 hours prior to the arrival of the vessel at any Port in India. b. If the voyage of the vessel is shorter than 96 hours, the PANS may be submitted within 2 hours of departure from the last port. c. Information regarding armed guards onboard the vessel when calling Indian Ports or transiting through the Exclusive Economic Zone (EEZ) is also required to be forwarded to the Indian Nary, Maritime Rescue Coordination Centre (MRCC), Mumbai and the local Customs Authority (through the vessel's agent at the concemed port). d. All Indian Ports are advised to take appropriate measures to ensurc that only ships in possession of the relevant ISPS documentation as applicable are permitted to enter the port facility. e. Vessels without appropriate documentation would be permitted to berth only under special circumstances, with prior approval of the Port Facility Security Officer (PFSO). However, such cases should be immediately brought to the notice of the nearest Mercantile Marine Department and the Directorate General of Shipping by the PFSO explaining the circumstances under which the vessel was permitted to enter the port facility limits without PANS reporting. 9. The online reporting of PANS in the NLP Sagar Sethu Portal is under development. Once the PANS is fully developed and implemented online, it needs to be submiued online. A Notice for the implementation of PANS will be issued by the Directorate Subsequently.10. This MS Notice supersede all previous circulars on PANS, including but not limited to NT/ISPS/13/2005 dated 2l November 2005; NT/ISPS/SHIP/02/2009 dated 02 February 2009; NT/ISPS/SHIP/02/2011 dated 15 November 2011; NT/ISPS/CIRCULAR No. 01/2011 dated 28 September 2011; NT/ISPS/CIRCULAR No. 0l/2020 dated 05 February 2020 issued providing "Guidelines to vessels for entry into Indian Port Facilities - ISPS Compliance related issues". 11.
