कोररया गणराज्य के मूल के अथवा वहा ं स े जनयााजतत ‘‘एल् यमु ीजनयम तथा जजक कोटेड फ्लटै उत् पादों’’ (जजन् ह ें यहां आगे
संबद्ध वस्ट् तु भी कहा गया ह)ै के आयातों पर जनश् चयात् मक पाटनरोधी िल्ु क कश जसफाररि करने वाल े 21 फरवरी, 2020
कश अजधसूचना स.ं 6/4/2019-डीजीटीआर के माध् यम स े जनर्ददष्ट प्राजधकारी द्वारा जारी अंजतम जांच पररणाम म ें नाम म ें
पररवतान का अनुरोध दकया गया ह ै आवेदक जवचाराधीन उत् पाद का एक उत् पादक/जनयाातक ह ै और यह कंपनी कोररया
गणराज्य म ें अजधजनगजमत ह ै आवेदक न े दावा दकया ह ै दक उन् ह ें पूव ा म ें डोंगब ू स्ट् टील कंपनी जलजमटेड, कोररया गणराज्य स े
उत् पादक/जनयाातक के रूप म ेंजाना जाता था, जजसने मूल जांच म ें भाग जलया था
क. पष्ृ ठ भजू म
1. 1995 और उसके पश् चात यथासंिोजधत सीमािुल् क टैररफ अजधजनयम, 1975 (जजसे यहां आगे ‘’अजधजनयम’’ भी
कहा गया ह)ै और समय-समय पर यथासंिोजधत सीमािुल् क टैररफ (पारटत वस्ट् तओं कु कश पहचान तथा उन पर

पाटनरोधी िुल् क का आकलन, संग्रहण तथा षा जत जनधारा ण) जनयमावली, 1995 (जजसे यहां आग े ‘’जनयमावली’’
भी कहा गया ह)ै के अनुसार जनर्ददष्ट प्राजधकारी (जजन् ह ें यहा ं आग े ‘’प्राजधकारी’’ भी कहा गया ह)ै न े चीन जन.गण.,
जवयतनाम तथा कोररया गणराज्य के मलू के अथवा वहा ं स े जनयााजतत ‘‘एल् यमु ीजनयम तथा जजक कोटेड फ्लैट
उत् पादों’’ के आयातों पर जनश्य ात् मक पाटनरोधी िुल् क कश जसफाररि करन े वाली अजधसचू ना स.ं 6/4/2019-
डीजीटीआर के माध् यम स ेअपन े अंजतम जांच पररणाम जारी दकए थ े
2. केन् र सरकार न े सीमािुल् क अजधसूचना स. 16/2020-सीमािुल् क (एडीडी) ददनांक 23 जनू , 2020 के माध् यम से
संबद्ध देिों के मूल कश अथवा वहां से जनयााजतत संबद्ध वस्ट् तु के आयातों पर जनश् यात् मक पाटनरोधी िल्ु क लगाया
था
3. वतामान मामल े में अनंजतम िुल्क सीमािुल् क अजधसूचना स.ं 40/2019-सीमािुल् क (एडीडी) ददनांक 15 अक् टूबर,
2019 के माध् यम स े लगाया गया था और अंजत म िल्ु क ददनांक 23 जून, 2020 कश सीमािुल् क अजधसूचना स.ं
16/2020-सीमािुल् क (एडीडी) के माध् यम स ेलगाया गया था
4. डोंगबू स्ट्टील कंपनी जलजमटेड न े उक्त जांच म ें भाग जलया और उसे डंजपग रोधी िल्ु क कश अलग दर प्रदान कश गई
इसके बाद, 22.06.2020 को केजी डोंगबू स्ट् टील कं. जल. ने के जी स्ट् टील कं. जल. द्वारा जनवेि के बाद डोंगबू स्ट्टील
कंपनी जलजमटेड स े केजी डोंगब ू स्ट् टील कं. जल. को उपरोक्त सीमा िुल्क अजधसूचना म ें जनमााता के नाम बदलन े के
जलए एक आवेदन दायर दकया था डोंगब ू स्ट्टील कंपनी जलजमटेड म,ें और इदिटी िेयरों के आवंटन के
पररणामस्ट्वरूप इसकश िेयरधाररता संरचना म ेंपररवतान हुआ
5. प्राजधकारी ने पाटनरोधी जनयमावली जनयमावली के जनयम 23 के साथ परठत अजधजनयम कश धारा 9क के
अनुसार आवेदक द्वारा प्रस्ट् तुत जवजधवत रूप से साषय ांदकत आवेदन के आधार पर मामला सं. एडी-एमटीआर-
11/2020 ददनांक 15 जसतंबर, 2020 के माध् यम से नाम म ें पररवतान के जलए सीजमत मध्य ावजध समीषा ा कश
िुरूआत कश थी
6. उक्त मध् यावजध समीषा ा में आयोजजत मिजखक सुनवाई कश प्रदाया के दिरान घरेलू उद्योग न े अन् य बातों के साथ-
साथ यह तकनीकश आपजि दजा कराई दक व् यापार सूचना सं. 1/2010 ददनांक 17 मई, 2010 के अनुपालन म ें
प्राजधकारी द्वारा केन् र सरकार द्वारा जनश् चयात् मक पाटनरोधी िुल् क लगाए जाने से ‘’कम स े कम एक वषा’’ कश
समाजि के पश् चात भी मध् यावजध समीषा ा िरूु कश जा सकती ह ै
7. पूवोक्त के म्ेनजर आवेदक ने प्राजधकारी से ददनांक15 जसतंबर, 2020 को नाम में पररवतान के जलए िरूु कश गई
सीजमत मध् यावजध समीषा ा को समा त करने का अनुरोध दकया ह ै तद्नुसार प्राजधकारी द्वारा ददनांक 06 जसतंबर,
2021 के जांच समाजि आदेि के माध् यम से उक्त जांच समात कश गई थी
ख. जवचाराधीन उत्प ाद
8. उक्त जांच में जवचाराधीन उत् पाद (पीयूसी) चीन जन.गण जवयतनाम तथा कोररया गणराज्य के मूल के अथवा
वहा ं स े जनयााजतत ‘‘एल् युमीजनयम तथा जजक कोटेड फ्लैट उत् पाद’’ थ े आवेदन में जवचाराधीन उत् पाद पूवावती
जांचों अथाात अजधसूचना स.ं 6/4/2019-डीजीटीआर ददनांक 21 फरवरी, 2020 के माध्य म स े जारी अंजत म
जांच पररणाम के समान रहगे ा जजसम ें पीयूसी को जनम्न ानुसार पररभाजषत दकया गया था -
"स्ट् टील के फ्लैट रोल् ड उत् पाद जो एल्युमीजनयम और जजक के अलॉय स ेल ेटेड या कोटेड हों एल् यजुमजनयम या
जजक के इस अलॉय में एक या उससे अजधक अजतररक्त तत्व हो सकते ह ैंजो अलग-अलग या संयुक् त रूप स ेभार के
रूप म ें3 प्रजतित स ेअजधक नहीं होंगे
इसके अलावा, जवचाराधीन उत् पाद कॉयल रूप में या कॉयल रूप में नहीं हो सकता ह ैचाह े लेन, नालीदार या
प्रोफाइल् ड रूप म ेंहो अथवा नहीं पीयूसी टेंपर जमल पर जस्ट्कन पास्ट्ड / प्रसंस्ट् कृत या गरै-जस्ट्ि पास्ट् ड हो सकता ह ै
चाह ेअजतररक्त गैर धाजत् वक कोटटग सजहत या उसके जबना सरफेस उपचाररत हो अथवा नहीं पीयूसी को
जवजभन् न व् यापाररक नामों से आपूतत दकया जा सकता ह ैजजसमें एलु-जजक, एएल-जैडएन, जजक-एल्युमीजनयम,
एल्युमीजनयम-जजक, जजककैलूम, गल् वालूम आदद िाजमल ह ैंपरंतु इन तक सीजमत नहीं ह ैं यह भी नोट दकया जाता
ह ैदक पीयूसी म ेंजगं प्रजतरोध होता ह ैऔर इस ेजवजभन् न अनप्रुयोगों और षा ेत्रों म ेंप्रयोग दकया जाता ह,ै जजनम ें
अवसंरचना पररयोजनाए,ं सिर जवद्युत पररयोजनाए,ं रूफफग वाजलग डेफकग क्ल ैजडग और फ्रेजमग, व् हाइट गुड्स[भाग I—खण् ड 1] भारत का राजपत्र : असाधारण 3
और उपकरण, कलर कोटेड स्ट् टील के जलए फनीचर और सबस्ट् रेड िाजमल ह ैंपरंतु इन तक सीजमत नहीं ह ैं पीयूसी
म ेंजनम्न जलजखत उत् पाद िाजमल नहीं ह ैं:-
i. अजतररक्त एल्युमीजनयम के जबना जजक स ेकोटेड फ्लैट रोल्ड स्ट्टील उत्पाद;
ii. अजतररक्त जजक के जबना एल्युमीजनयम स ेकोटेड फ्लैट रोल्ड स्ट्टील उत्पाद;
iii. प्री पेंटेड अथवा कलर कोटेड एल्य मु ीजनयम जजक अलॉय कोटेड स्ट् टील िीटें (प्री कोटेड एस जी एल िीटें)
9. इस मध् यावजध समीषा ा के जलए जवचाराधीन उत् पाद अपररवततत रहगे ा
ग. िाजमल दिे
10. वतामान समीषा ा जांच में िाजमल दिे कोररया गणराज्य (जजसे आग ेसंबद्ध देि भी कहा गया ह)ै ह ै
घ. समीषा ा के जलए आधार
11. केजी डोंगबू स्ट् टील कं. जल. न े मध् यावजध समीषा ा हते ु आवेदन एक दायर दकया ह ै जजसमें बताया गया ह ै दक
कंपनी ने केजी स्ट् टील, जो केजी समूह का एक सदस्ट् य ह,ै के पषा में 39.98 प्रजतित इदिटी िेयर जारी दकए ह,ैं
जजसके पास अब आवेदक के प्रमुख िेयरधारक के रूप में आवेदक के 39.98 प्रजतित िेयर ह ैं इस आवंटन के
पररणामस्ट् वरूप कंपनी का नाम बदलकर केजी डोंगबू स्ट् टील कं. जल. हो गया ह ै यह दावा दकया गया ह ै दक मूल
कंपनी का नाम 2 अप्रैल, 2020 को केजी डोंगबू स्ट् टील कं. जल. से बदलकर डोंगब ू स्ट् टील कं. जल. हो गया ह ै
उन्होंने आग े दावा दकया ह ै दक उपरोक्त पररवतानों के म्ेनजर, उनके सभी जनयाात केजी डोंगबू स्ट्टील कंपनी
जलजमटेड के नाम पर होंग,े और तदनुसार, डोंगबू स्ट्टील कंपनी जलजमटेड पर लाग ू एंटी-डंजपग िुल्क कश अलग दर
केजी डोंगबू स्ट्टील कंपनी जलजमटेड पर लाग ूहोनी चाजहए |

12. सीमािुल् क टैररफ अजधजनयम, और इसके अतं गता बनाई गई पाटनरोधी जनयमावली में पाटनरोधी िुल् क को जारी
रखने के जलए समय-समय पर समीषा ा करना प्राजधकारी के जलए अपेजषा त ह ै
13. आवेदक द्वारा कोररया गणराज्य से उत् पादक/जनयाात के नाम में पररवतान के जलए सीजमत मध् यावजध समीषा ा को
आवश् यक बनाने वाली पररवततत पररजस्ट्थजतयों को दिाात े हुए प्रदत् त सूचना को ध् यान में रखत े हुए जनर्ददष् ट
प्राजधकारी अजधसूचना सं. 6/4/2019-डीजीटीआर ददनांक 21 फरवरी, 2020 के माध् यम से अनुिंजसत अंजतम
जांच पररणाम और संबंजधत पाटनरोधी जनयमावली के जनयम 23 के साथ परठत सीमािल्ु क टैररफ (संिोधन)
अजधजनयम, 1995 कश धारा 9क(क) के प्रावधानों के अनुसार ददनांक 23 जून, 2020 कश सीमािुल् क अजधसूचना
स. 16/2020-सीमािुल् क (एडीडी) द्वारा लाग ू जनश् यात् मक पाटनरोधी िल्ु क कश मध् यावजध समीषा ा कश िुरूआत
करना उजचत समझत े ह ैं
14. वतामान समीषा ा ददनांक 21 फरवरी, 2020 कश अंजतम जाचं पररणाम अजधसूचना सं. 6/4/2019-डीजीटीआर
और ददनांक 23 जनू , 2020 कश सीमािुल् क अजधसूचना स. 16/2020-सीमािुल् क (एडीडी) के संबंध म ें केजी
डोंगबू स्ट् टील कं. जल. द्वारा दावा दकए गए नाम पररवतान के पहलू तक सीजमत ह ै

15. चूंदक वतामान समीषा ा जांच केवल नाम में पररवतान तक सीजमत ह,ै इसजलए प्राजधकारी समझत े ह ैं दक जांच कश
अवजध प्रासंजगक नहीं ह ै
छ. प्रदाया
16. जनयमावली के जनयम 6 में यथाप्रदत् त जसद्धांतों का वतामान जाचं में पालन दकया जाएगा
ज. सचू ना प्रस्ट्त तु करना
17 कोजवड-19 महामारी स े उत् पन्न जविेष पररजस्ट्थजतयों के म्ेजर, जनर्ददष् ट प्राजधकारी को समस्ट्त पत्र ई-मेल पतों
dd12-dgtr@gov.in तथा ad12-dgtr@gov.in, उसकश प्रजत adg13-dgtr@.gov.in और advl2-

18. संबद्ध दिे के ज्ञात उत् पादकों/जनयाातकों, भारत म ें जस्ट्थत उनके दतू ावास के जररए उनकश सरकार, भारत म ें संबद्ध
वस्ट् तु स े संबंजधत समझ े जाने वाले आयातकों और प्रयोक्त ाओं क तथा घरेल ू उद्योग को नीच े जनधााररत कश गई समय
सीमा के भीतर जवजहत प्रपत्र म ें एव ं ढंग स े समस्ट्त संगत सूचना प्रस्ट् तुत करने के जलए अलग स े सजू चत दकया जा रहा
ह ै
19. कोई अन् य जहतबद्ध पषा कार भी नीच े दी गई समय सीमा के भीतर जवजहत प्रपत्र और ढंग स े इस जांच स े संगत
अपन े अनरु ोध प्रस्ट् ततु कर सकता ह ै
20. प्राजधकारी के समषा कोई गोपनीय अनरु ोध करन े वाले दकसी पषा कार के जलए अन् य पषा कारों को उपलब् ध करान े
हते ु उसका एक अगोपनीय अंि प्रस्ट् तुत करना अपेजषा त ह ै
21. जहतबद्ध पषा कारों को यह भी सलाह दी जाती ह ै दक इस जांच के संबंध म ें दकसी भी अद्यतन सूचना के जलए व े
जनर्ददष् ट प्राजधकारी कश आजधकाररक वैबसाइट अथाात https://www.dgtr.gov.in/ को जनयजमत रूप स े देखत े
रह ें
झ. समय सीमा
22. वतामान जांच स े संबंजधत कोई सूचना पाटनरोधी जनयमावली के जनयम 6(4) के अनुसार सूचना कश प्राजि कश
तारीख स े 30 ददनों के भीतर ई-मेल पतों dd12-dgtr@gov.in तथा ad12-dgtr@gov.in, उसकश प्रजत
adg13-dgtr@.gov.in और advl2-dgtr@gov.in.पर भेजने के साथ ई-मेल के माध् यम स े जनर्ददष् ट प्राजधकारी
को भेजी जानी चाजहए तथाजप, यह नोट दकया जाये दक उक्त जनयम के स्ट्पष्टीकरण के अनुसार, सूचना और अन्य
दस्ट्तावेज मंगान े वाली सूचना को जनर्ददष् ट प्राजधकारी द्वारा पत्र भेज े जाने या जनयाातक दिे के उजचत राजजनयक
प्रजतजनजध को ददए जाने कश तारीख से एक सिाह के भीतर प्राि हुआ मान जलया जाएगा यदद जवजहत समय सीमा
के भीतर कोई सूचना प्रा त नहीं होती ह ै या प्रा त सूचना अधूरी होती ह ै तो प्राजधकारी जनयमावली के अनुसार
ररकॉडा म ें उपलब्ध तथ्य ों के आधार पर अपन े जांच पररणाम दज ा कर सकत े ह ैं
23. सभी जहतबद्ध पषा कारों को एतद्द्वारा वतामान मामल े म ें अपने जहत (जहत के स्ट् वरूप सजहत) कश सूचना दने े और
उपयुाक् त समय सीमा के भीतर प्रश् नावली का उत् तर देने कश सलाह दी जाती ह ै
ञ. गोपनीय आधार पर सचू ना प्रस्ट्ततु करना
24. प्राजधकारी के समषा कोई गोपनीय अनरु ोध करने या गोपनीय आधार पर सूचना प्रस्ट् तुत करन े वाले दकसी पषा कार
को जनयमावली के जनयम 7(2) और इस संबंध में जारी व्यापार सूचनाओं क के अनुसार उसका अगोपनीय अिं भी
साथ म ें प्रस्ट्त ुत करना अपेजषा त ह ै उपयुाक् त का पालन न करन े पर उत् तर/अनुरोध को अस्ट् वीकृत दकया जा
सकता ह ै
25. प्रश्नावली के उिर सजहत प्राजधकारी के समषा कोई गोपनीय अनुरोध (उससे संलग्न पररजिष्ट/अनुबंध सजहत) प्रस्ट्ततु
करने वाल े पषा कारों के जलए उसके दकसी भाग के संबंध म ें गोपनीयता के दाव े के मामल े म ें 2 अलग-अलग सैट
प्रस्ट् तुत अपेजषा त ह ै
क. गोपनीय रूप म ेंअंदकत पहला सैट (िीषाक, पृष्ट सं., सूची आदद सजहत)
ख. अगोपनीय रूप में अंदकत दसू रा सैट (िीषाक, पृष्ट सं., सूची आदद सजहत)
26. "गोपनीय "या" अगोपनीय "अनुरोधों पर स्ट्पष्ट रूप स े प्रत्येक पष्ठृ पर" गोपनीय "या" अगोपनीय "अंदकत होना
चाजहए ऐसे अंकन के जबना प्रस्ट्तुत सूचना को प्राजधकारी द्वारा अगोपनीय माना जाएगा और प्राजधकारी अन्य
जहतबद्ध पषा कारों को ऐसे अनरु ोध का जनरीषा ण करने कश अनुमजत देन े के जलए स्ट्वतंत्र होंगे
27. गोपनीय पाठ म ेंऐसी समस्ट्त सचू ना होगी जो स्ट्वाभाजवक रूप स े गोपनीय ह ैऔर/अथवा ऐसी अन्य सूचना जजसके
ऐसी सूचना के प्रदाता द्वारा गोपनीय होन े का दावा दकया गया ह ै स्ट्वाभाजवक रूप स े गोपनीय होने का दावा कश
गई सूचना या अन्य कारणों स े गोपनीयता का दावा कश गई सचू ना के संबंध म ें सूचना प्रदाता को प्रदि सूचना के
साथ ऐसे कारणों का जववरण प्रस्ट्तुत करना होगा दक उस सूचना का प्रकटन क्यों नहीं दकया जा सकता ह ै[भाग I—खण् ड 1] भारत का राजपत्र : असाधारण 5
28. अगोपनीय रूपांतरण को उस सूचना ,जजसके बारे में गोपनीयता का दावा दकया गया ह,ै पर जनभार रहते हुए
अजधमानत: सूचीबद्ध या ररक्त छोड़ी गई (यदद सूचीबद्ध करना व्यवहाय ा न हो) और सारांिीकृत गोपनीय सूचना
के साथ गोपनीय रूपांतरण कश अनुकृजत होना अपेजषा त ह ै अगोपनीय सारांि पयााि जवस्ट्तृत होना चाजहए तादक
गोपनीय आधार पर प्रस्ट्तुत कश गई सूचना कश जवषय वस्ट्तु को तकासंगत ढंग स े समझा जा सके तथाजप,
आपवाददक पररजस्ट्थजतयों म ें गोपनीय सूचना प्रदाता पषा कार यह इंजगत कर सकते ह ैं दक ऐसी सूचना का सारांि
संभव नही ह ै और प्राजधकारी कश संतुजष्ट के अनुसार इस आिय के कारणों का एक जववरण उपलब्ध कराया जाना
चाजहए दक सारांिीकरण क्यों सभव नहीं ह ै
29. प्रस्ट्तुत सूचना के स्ट्वरूप कश जाचं करन े के बाद प्राजधकारी गोपनीयता के अनरु ोध को स्ट्वीकार या अस्ट्वीकार कर
सकते ह ैं यदद प्राजधकारी इस बात स े संतुष्ट ह ैं दक गोपनीयता का अनुरोध अपेजषा त नहीं ह ै अथवा सूचना प्रदाता
उक्त सूचना को सावाजजनक करने या सामान्य रूप में अथवा सारांि रूप म ें उसके प्रकटन को प्राजधकृत करने का
अजनच्छुक ह ैतो वह ऐसी सूचना कश अनदेखी कर सकत े ह ैं
30. साथाक अगोपनीय रूपांतरण के जबना या गोपनीयता के दाव े के बारे म ें यथोजचत कारण के जववरण के जबना दकए
गए दकसी अनुरोध को प्राजधकारी द्वारा ररकॉडा म ेंनहीं जलया जाएगा
31. प्रदि सूचना कश गोपनीयता कश जरूरत स े संतष्टु होन े और उसे स्ट्वीकार कर लेने के बाद प्राजधकारी ऐसी सूचना के
प्रदाता पषा कार के जवजिष्ट प्राजधकार के जबना दकसी पषा कार को उसका प्रकटन नहीं करेंगे
ट. सावजा जनक फाइल का जनरीषा ण
32. जनयम 6 (7) या जनयमावली के अनुसार कोई जहतबद्ध पषा कार उस सावाजजनक फाइल का जनरीषा ण कर सकता ह ै
जजसम ें अन्य जहतबद्ध पषा कारों द्वारा प्रस्ट्तुत साषय के अगोपनीय रूपांतरण रख े गए ह ैं इलैक्र ोजनक रूप म ें
सावाजजनक फाइल को रखन े के तिर-तरीको को तैयार दकया जा रहा ह ै
ठ. असहयोग

INITIATION NOTIFICATION

Case No. AD-MTR-11/2021
Subject : Initiation of Mid-Term Review limited to change of name of producer/exporter from
Korea RP in the anti-dumping investigation concerning imports of “Aluminium and Zinc
coated flat products” originating in or exported from China PR, Vietnam and Korea RP.
F. No. 7/30/2021-DGTR.—A Mid-Term Review application has been filed by M/s KG Dongbu
Steel Co., Ltd., Korea RP (hereinafter also referred to as “Applicant”) for change in name of the producer
from Korea RP in the Final Findings issued by Designated Authority vide Notification No. 6/4/2019-DGTR
dated February 21, 2020 recommending definitive anti- dumping duty on the imports of Aluminium and
Zinc coated flat products (hereinafter also referred to as the subject goods), originating in or exported from
China PR, Vietnam and Korea RP. The Applicant is a Producer/ Exporter of the product under
consideration and the company is incorporated in the Republic of Korea. The Applicant has claimed that
they were formerly known as Dongbu Steel Co., Ltd, producer/exporter from Korea RP that participated in
the original investigation.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1]
A. Background
1. In accordance with Customs Tariff Act, 1975, as amended in 1995 and thereafter (hereinafter also
referred to as the “Act”) and the Customs Tariff (Identification, Assessment and Collection of Anti-
dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, as amended from
time to time (hereinafter also referred to as the “Rules”), the Designated Authority (hereinafter also
referred to as the Authority) had issued its final findings vide Notification No. 6/4/2019-DGTR dated
February 21, 2020 recommending definitive anti- dumping duty on the imports of “Aluminium and
Zinc coated flat products” originating in or exported from China PR, Vietnam and Korea RP.
2. The Central Government, vide Customs Notification No. 16/2020-Customs (ADD) dated June 23,
2020, had imposed definitive anti-dumping duty on the imports of the subject goods originating in or
exported from the subject countries.
3. In the instant case, the provisional duty was imposed vide Customs Notification No. 40/2019-
Customs (ADD) dated 15 October 2019 and the final duty was imposed vide Customs Notification
No. 16/2020-Customs (ADD) dated 23 June 2020.
4. Dongbu Steel Co. Ltd. participated in the said investigation and was granted separate rate of Anti-
dumping duty. Thereafter, on 22.06.2020 KG Dongbu Steel Co. Ltd. had filed an Application for
Change of Name of the producer in the aforementioned Customs Notifications from Dongbu Steel
Co. Ltd. to KG Dongbu Steel Co. Ltd., following investment by KG Steel in Dongbu Steel Co. Ltd.,
and allotment of equity shares resulting in change of its shareholding structure .
5. The Authority, on the basis of a duly substantiated application filed by the Applicant in accordance
with Section 9A of the Act read with Rule 23 of the Anti-Dumping Rules, initiated the mid-term
review limited to change of name vide Case No. AD-MTR-11/2020 dated 15th September 2020.
6. During the course of the oral hearing conducted in the said mid-term review, the domestic industry,
inter alia, raised the technical objection that a mid-term review can be initiated by this Authority only
after the lapse of “at least one year” from the imposition of definitive anti-dumping duty by the
Central Government pursuant to the Trade Notice No. 1/2010 dated 17 May 2010.
7. In view of the aforesaid, the Applicant requested the Authority to terminate the mid-term review
limited to change of name which was initiated on 15th September 2020. Accordingly, the said
investigation was terminated by the Authority, vide Termination Order dated 06 September 2021.
B. Product under consideration
8. The product under consideration (PUC) in the said investigation was “Aluminium and Zinc coated
flat products" originating in or exported from China PR, Vietnam and Korea RP. The product under
consideration in the application is the same as the previous investigations i.e. final findings issued
vide Notification No. 6/4/2019-DGTR dated February 21, 2020, which defined PUC as follows-
“Flat rolled product of steel, plated or coated with alloy of Aluminium and Zinc. This alloy of
Aluminium and Zinc may contain one or more additional elements which in individual or in
combination shall not exceed 3% by weight.
Further, the product under consideration may be in coil form or not in coil form whether or not
plain, corrugated or in profiled form. PUC may be skin-passed / processed on tempermill or non-
skin-passed whether or not surface treated with or without additional nonmetallic coating. PUC may
be supplied in various trade names including but not limited to Alu-Zinc, Al-Zn, Zinc Aluminium,
Aluminium Zinc, Zincalume, Galvalume etc. It is also noted that PUC offers resistance to corrosion
and is used in many applications and sectors including but not limited to infrastructure projects,
solar power projects, roofing, walling decking, cladding and framing, white goods and appliances,
furniture and substrate for colour coated steel. PUC does not include the following products: -
i. Flat rolled steel products coated with Zinc without addition of Aluminium;
ii. Flat rolled steel products coated with Aluminium without addition of Zinc;
iii. Pre-painted or colour coated Aluminum Zinc alloy coated steel sheets (Pre-coated SGL

9. The product under consideration for this mid-term review remains unchanged.
C. Country Involved
10. The country involved in the present review investigation is Korea RP (also referred to as subject
country).
D. Grounds for Review
11. KG Dongbu Steel Co., Ltd. has filed a Mid-Term Review application stating that the company issued
39.98% equity shares in favour of KG Steel, a member of the KG Group, which now holds 39.98%
shares of the Applicant as the major shareholder of the Applicant. Consequent to this allotment, the
name of the company was changed to KG Dongbu Steel Co. Ltd. It has been claimed that the original
company name has changed on 02 April 2020 from KG Dongbu Steel Co. Ltd. to Dongbu Steel Co.
Ltd. They have further claimed that in view of the above changes, all their exports will be in the
name of KG Dongbu Steel Co. Ltd., and accordingly, the separate rate of Anti-dumping duty
applicable on Dongbu Steel Co. Ltd. must be made applicable to KG Dongbu Steel Co. Ltd.
E. Initiation
12. The Customs Tariff Act, and the Anti-dumping Rules made thereunder, requires the Authority to
review from time to time the need for continuance of anti-dumping duties.
13. Having regard to the information provided by the applicant indicating changed circumstances
necessitating a mid-term review, limited to change of name of producer/exporter from Korea RP, the
Designated Authority considers it appropriate to initiate a Mid Term Review of the Final Findings
recommended vide Notification No. 6/4/2019-DGTR dated February 21, 2020 and the definitive
anti-dumping duty imposed vide Customs Notification No. 16/2020-Customs (ADD) dated June 23,
2020, in terms of the provisions of Section 9A (5) of Customs Tariff (Amendment) Act 1995 read
with Rule 23 of the anti-dumping Rules supra.
14. The present review is limited to the aspect of name change claimed by KG Dongbu Steel Co. Ltd.
with regard to the Final Findings Notification No. 6/4/2019-DGTR dated February 21, 2020 and
Customs Notification No. 16/2020-Customs (ADD) dated June 23, 2020.
F. Period of Investigation
15. Since the present review investigation is restricted to only change of name, the Authority considers
that the period of investigation is not relevant.
G. Procedure
16. Principles as given in Rule 6 of the Rules will be followed for the present investigation.
H. Submission of Information
17. ln view of the special circumstances arising out of this COVID-19 pandemic, all communication
should be sent to the Designated Authority via email at the email addresses, dd12-dgtr@gov.in and
ad12-dgtr@gov.in with a copy to adg13-dgtr@.gov.in and advl2-dgtr@gov.in.
18. The known producers/exporters in the subject country, their Government through their Embassy in
India, the importers and users in India known to be concerned with the subject goods and the
domestic industry are being informed separately to enable them to file all the relevant information in
the form and manner prescribed within the time limit set out below.
19. Any other interested party may also make its submissions relevant to the investigation in the
prescribed form and manner within the time limit set out below.
20. Any party making any confidential submission before the Authority is required to make a non-
confidential version of the same available to other interested parties
21. Interested parties are further advised to keep a regular watch on the official website of the
Designated Authority https://www.dgtr.gov.in/ for any updated information with respect to this

I. Time Limit
22. Any information relating to the present investigation should be sent to the Designated Authority via
email at the email addresses to dd12-dgtr@gov.in, and ad12-dgtr@gov.in with a copy to adg13-
dgtr@.gov.in, and advl2-dgtr@gov.in within from the date of receipt of the notice as per Rule 6(4) of
the Anti- Dumping Rules. It may, however, be noted that in terms of explanation of the said Rule, the
notice calling for information and other documents shall be deemed to have been received within one
week from the date on which it was sent by the Designated Authority or transmitted to the
appropriate diplomatic representative of the exporting country. If no information is received within
the prescribed time limit or the information received is incomplete, the Authority may record its
findings on the basis of the facts available on record in accordance with the Rules.
23. All the interested parties are hereby advised to intimate their interest (including the nature of interest)
in the instant matter and file their questionnaire responses within the above time limit.
J. Submission of information on confidential basis
24. Any party making any confidential submission or providing information on confidential basis before
the Authority, is required to simultaneously submit a non-confidential version of the same in terms of
Rule 7(2) of the Rules and the Trade Notices issued in this regard. Failure to adhere to the above may
lead to rejection of the response/submissions.
25. The parties making any submission (including Appendices/Annexures attached thereto), before the
Authority including questionnaire response, are required to file the same in two separate sets, in case
"confidentiality" is claimed on any part thereof:
a. one set marked as Confidential (with title, number of pages, index, etc.), and
b. the other set marked as Non-Confidential (with title, number of pages, index, etc.).
26. The "confidential" or "non-confidential" submissions must be clearly marked as "confidential" or
"non-confidential" at the top of each page. Any submission made without such marking shall be
treated as non-confidential by the Authority, and the Authority shall be at liberty to allow the other
interested parties to inspect such submissions.
27. The confidential version shall contain all information which is by nature confidential and/or other
information which the supplier of such information claims as confidential. For information which are
claimed to be confidential by nature or the information on which confidentiality is claimed because
of other reasons, the supplier of the information is required to provide a good cause statement along
with the supplied information as to why such information cannot be disclosed.
28. The non-confidential version is required to be a replica of the confidential version with the
confidential information preferably indexed or blanked out (in case indexation is not feasible) and
summarized depending upon the information on which confidentiality is claimed. The non-
confidential summary must be in sufficient detail to permit a reasonable understanding of the
substance of the information furnished on confidential basis. However, in exceptional circumstances,
the party submitting the confidential information may indicate that such information is not
susceptible to summary, and a statement of reasons why summarization is not possible must be
provided to the satisfaction of the Authority.
29. The Authority may accept or reject the request for confidentiality on examination of the nature of the
information submitted. If the Authority is satisfied the request for confidentiality is not warranted or
if the supplier of the information is either unwilling to make the information public or to authorize its
disclosure in generalized or summary form, it may disregard such information.
30. Any submission made without a meaningful non-confidential version thereof or without good cause
statement on the confidentiality claim shall not be taken on record by the Authority.
31. The Authority on being satisfied and accepting the need for confidentiality of the information
provided, shall not disclose it to any party without specific authorization of the party providing such

K. Inspection of Public File
32. In terms of Rule 6(7) or the Rules, any interested party may inspect the public tile containing non-
confidential version of the evidence submitted by other interested parties. The modality of
maintaining the public file in electronic mode is being worked out.
L. Non-cooperation
33. In case any interested party refuses access to and otherwise does not provide necessary information
within a reasonable period or significantly impedes the investigation, the Authority may declare such
interested party as non- cooperative and record its findings on the basis of the facts available to it and
make such recommendations to the Central Government as deemed fit.
