L.-33004/99 सी.जी.-डी.एल.-अ.-11032024-252813 CG-DxLx-xEG-I1D1H0x3x2x0 24-252813 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 151] नई दिल्ली, िुक्रवार, माच ग8, 2024/फाल्ग नु 18, 1945 No. 151] NEW DELHI, FRIDAY, MARCH 8, 2024/PHALGUNA 18, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 7 माच,ग 2024 सा.का.जन. 163(अ).—मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के द्वारा यथापेजित केन्द्रीय मोटर यान जनयम, 1989 का संिोधन करन े के जलए प्रारूप जनयम भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसचू ना संख् या सा.का.जन. 911(अ), तारीख 22 दिसंबर, 2023 द्वारा भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) म ें प्रकाजित दकए गए थ,े जिसमें उन सभी व् यज‍त यों से जिनका उससे प्रभाजवत होना संभाव् य ह,ै उस तारीख से, जिसको उक्त अजधसूचना की प्रजतयां िनता को उपलब्ध करा िी गई थीं, तीस दिन की अवजध के अवसान से पूवग आिपे और सुझाव आमंजत्रत दकए गए थ े ; और उ‍त अजधसूचना की प्रजतयां 22 दिसंबर, 2023 को िनता को उपलब् ध करा िी गई थीं ; और उ‍त प्रारूप जनयमों के संबधं में िनता स ेकोई आिेप और सुझाव प्राप्त नहीं हुए थे ; अत:, अब, केन्द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 की उपधारा (1) द्वारा प्रित्त िजक्तयों का प्रयोग करत े हुए, केन्द्रीय मोटर यान जनयम, 1989 का और संिोधन करन े के जलए, जनम्नजलजखत जनयम बनाती ह,ै अथागत ्:- 1. संजिप्त नाम और प्रारंभ.—(1) इन जनयमों का संजिप्त नाम केन्द्रीय मोटर यान (पााँचवााँ संिोधन) जनयम, 2024 ह ै। (2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंग े। 1673 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केन्द्रीय मोटर यान जनयम, 1989 म,ें- (i) जनयम 115क के, उपजनयम (10) की सारणी 2 में, “से लाग”ू िीर्ग म,ें “1 अप्रैल, 2024” अंकों और िब्िों के स्ट्थान पर “1 िनवरी, 2025” अंक और िब्ि रख ेिाएंगे । (ii) जनयम 120 के, उपजनयम (6) में, “1 अप्रैल, 2024” अंकों और िब्िों के स्ट्थान पर “1 िनवरी, 2025” अंक और िब्ि रख ेिाएंग े । (iii) जनयम 120 के, उपजनयम (6) की सारणी 1 और सारणी 2 में, “1 अप्रलै , 2024” अंकों और िब्िों के स्ट्थान पर “1 िनवरी, 2025” अंक और िब्ि रखे िाएंग े । (iv) जनयम 124ग म,ें “1 अप्रलै , 2024” अंकों और िब्िों के स्ट्थान पर “1 िनवरी, 2025” अंक और िब्ि रख े िाएंगे । [सं. आरटी-11028/22/2016-एमवीएल (भाग-1)] महमूि अहमि, अपर सजचव रटप्पण.— मूल जनयम, भारत के रािपत्र, असाधारण, भाग 2, खंड 3, उपखंड (i) में अजधसूचना सख्ं यांक सा.का.जन. 590(अ), तारीख 2 िून, 1989 द्वारा प्रकाजित दकए गए थ े और उन्द्ह ें अंजतम बार अजधसूचना संख्यांक सा.का.जन. 159(अ), तारीख 6 माच,ग 2024 द्वारा संिोजधत दकया गया था । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 7th March, 2024 G.S.R. 163(E).—WHEREAS, the draft rules to amend the Central Motor Vehicles Rules, 1989, were published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 911(E), dated the 22nd December, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the official Gazette containing the said notification were made available to the public; AND WHEREAS, copies of the said Gazette containing the said notification were made available to the public on the 22nd December, 2023; AND WHEREAS, no objections and suggestions were received from the public in respect of the said draft rules; NOW, THEREFORE, in exercise of the powers conferred by sub-section(1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. Short Title and commencement.-(1) These rules may be called the Central Motor Vehicles (Fifth Amendment) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989,- (i) in rule 115A, in sub-rule (10), in Table 2, in the heading “Applicable with effect from”, for the figures and words, “1st April, 2024”, the figures and words “1st January, 2025” shall be substituted.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (ii) in rule 120, in sub-rule (6), for the figures and words, “1st April, 2024”, the figures and words “1st January, 2025” shall be substituted. (iii) in rule 120, in sub-rule (6), in Table 1 and Table 2 for the figures and words, “1st day of April, 2024”, the figures and words “1st day of January, 2025” shall be substituted.
