(1) इन जनयमों को केन्द्द्रीय मोटर यान (... ...संिोधन) जनयमावली, 2024 कहा िाएगा। (2) िब तक और अन्द्यथा जवजनर्िष्टग न हों, ये जनयम रािपत्र में उनके प्रकािन की तारीख से लाग ू होंगे। 2. केंद्रीय मोटर यान जनयमावली, 1989 (इसके बाि यहां मूल जनयम के रूप में उजल्लजखत) म,ें जनयम 2 म,ें खंड (आईडी) के पश् चात,् जनम्नजलजखत खंड को अंत:स्ट् थाजपत दकया िाएगा, अथागत:् - "(आईई) "श्रणे ी एल2-5" से अजभप्रेत ह,ै 2 पजहया-3 पजहया संयोिन मॉड्यलू के साथ कोई तीन पजहया मोटर वाहन ह,ै िो इस तरह से जनर्मगत दकया गया ह ै दक श्रेणी एल 2 के िो-पजहया वाहन को गैर-स्ट्व-चाजलत ररयर मॉड्यूल इकाई के साथ िोड़ा गया हो। आवश्यकता पड़न े पर इसे अलग दकया िा सकता ह ै या िोड़ा िा सकता ह;ै दकसी भी समय, या तो श्रेणी एल2 के िोपजहया वाहन या श्रेणी एल5 के तीन-पजहया वाहन का ही उपयोग दकया िा सकता ह।ै (आईएफ) "श्रणे ी एल2 - 5 एम" से अजभप्रेत ह,ै याजत्रयों को ले िाने के उद्देश्य से अपनी तकनीकी जविेषताओं के कारण एल 2-5 श्रेणी का कोई वाहन; (आईिी) "श्रणे ी एल 2 - 5 एन" स े अजभप्रेत ह,ै माल ल े िाने के उद्देश्य से अपनी तकनीकी जविेषताओं के कारण एल 2-5 श्रेणी का कोई वाहन; बिते दक एल 2-5 श्रेणी का वाहन, यात्री वाहक के जलए एल2-5एम की श्रेणी या माल वाहक के जलए एल2- 5एन श्रणे ी के वाहन के अंतगगत आ सकता है, िो चालक सजहत व्यजियों, जिनके बैठन े की व्यवस्ट्था की िाती ह,ै के विन पर जनभगर करता ह ै िो ले िा रह े माल के विन स े अजधक या कम ह।ै यह एल5 श्रेणी के वाहनों के जलए समय-समय पर यथा संिोजधत आईएस 14272:2011 म ें जनर्िष्टग ितों के अनासार हो। “ 3. उि जनयम म,ें मूल जनयमावली के जनयम 50 में उप-जनयम (8) के पश्चात ् जनम्नजलजखत उप-जनयम को अतं ःस्ट्थाजपत दकया िाएगा, अथागत:- "9. एल2-5 श्रेणी के वाहनों के मामले म,ें िोनों जवन्द्यासों अथागत् एल2 श्रेणी के अलग दकए गए िो-पजहया वाहन या एल5 श्रेणी के संयाि तीन पजहया वाहन के जलए एक एकल पंिीकरण संख्या आवंरटत की िाएगी; और दकसी भी समय जवन्द् यास के बाविूि वाहन के अगल े जहस्ट्स े म ें एक और वाहन के पीछे एक पंिीकरण जचह्न प्रिर्िगत दकया िाएगा। एल2-5 श्रेणी के वाहन के जलए प्लेट का आयाम 200 X 100 जममी होगा। 4. उि जनयम में मलू जनयमावली के जनयम 122 में उप-जनयम (3) के पश्चात् जनम्नजलजखत उप-जनयम को अंतःस्ट्थाजपत दकया िाएगा, अथागत:् - (4) "एल 2-5" श्रेणी के वाहनों के मामले म,ें जवजनमागण का माह और वषग सजहत पहचान संख्या, उभरा हुआ या उकेरा गया या जछदद्रत समय-समय पर संिोजधत एआईएस 177:2021 के अनासार होगा, िब तक दक भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) के तहत भारतीय मानक ब्यूरो जवजनिेि को अजधसूजचत नहीं दकया िाता ह।ै[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 5. उि जनयम म,ें जनयम 125-ढ़ के पश् चात् जन‍न जलजखत नए जनयम 125-त को अंत:स्ट् थाजपत दकया िाएगा, अथागत:् - "125-त: "एल 2-5 श्रेणी" के सभी वाहन, [1 अप्रलै 2024] को और उसके पश् चात् समय-समय पर संिोजधत एआईएस 177:2021 में जनर्िष्टग आवश्यकताओं के अनारूप होंगे, िब तक दक भारतीय मानक ब्यूरो अजधजनयम, 2016 (2016 का 11) के तहत भारतीय मानक ब्यूरो जवजनिेि को अजधसूजचत नहीं दकया िाता ह।ै [फा. स.ं आरटी-11036/104/2023-एमवीएल] महमूि अहमि, अपर सजचव रटप्प ण: मलू जनयम, भारत के रािपत्र, असाधारण, भाग- II, खंड 3, उप-धारा (i) में अजधसूचना संख्या सा.का.जन. 590(अ), दिनाकं 2 िनू ,1989 के माध्य म स े प्रकाजित दकए गए थ े और जपछली बार अजधसचू ना सख्ं य ा सा.का.जन...........(अ), दिनांक ........... द्वारा संिोजधत दकए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 29th February, 2024 G.S.R. 150(E).—The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 41, 109, 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (MVL), email: comments-morth@gov.in Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. DRAFT RULES 1. (1) These rules may be called the Central Motor Vehicles (…… Amendment) Rules, 2024. (2) Unless and otherwise specified, these rules shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules), in rule 2, after clause (id), the following clause shall be inserted, namely: - “(ie) “Category L2-5” means a three wheeled motor vehicle, with a 2 wheeler-3 wheeler combination module, constructed in such a way that a two-wheeled vehicle of category L2 is combined with a non-self- propelled rear module unit. It can be separated or combined, as and when required; At any point of time, either a two-wheeler of Category L2 or a three-wheeled vehicle of Category L5 can only be used. (if) “Category L2 – 5 M” means a category L2-5 vehicle on account of its technical features intended to carry passengers; (ig) “Category L2 – 5 N” means a category L2-5 vehicle on account of its technical features intended to carry goods;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Provided that category L2-5 vehicle may fall under the category of L2-5M for Passenger carrier or L2-5N Goods Carriage, depending on the weight of persons including driver for whom seating arrangements are provided is more than or less than the weight of goods carried. This shall be as per conditions specified in IS 14272:2011, as amended from time to time for L5 category of vehicles.” 3. In the said rule, in rule 50 of the principal rules, after sub-rule (8), the following sub-rule shall be inserted, namely:- “9. In case of L2-5 category of vehicles, a single registration number shall be allotted for both the configurations, namely separated two-wheeled vehicle of L2 category or combined three wheeled vehicles of L5 category; and at any point of time there shall be only one registration mark displayed on the front and one on the rear of the vehicle irrespective of the configuration. Dimensions for plate for L2-5 category of vehicle shall be 200 X 100 mm.” 4. In the said rule, in the rule 122 of the principal rules, after sub-rule (3), the following sub-rule shall be inserted, namely: - (4) In case of “L2-5” category of vehicles, the identification number including month and year of manufacture, embossed or etched or punched on it shall be in accordance with AIS 177:2021, as amended from time to time, till the corresponding Bureau of Indian Standards specification are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016). 5. In the said rule, after rule 125-N following new rule 125-P shall be inserted, namely: - “125-P: On and after [1st April 2024], all “L2-5 Category” of vehicles shall conform to the requirements specified in AIS 177:2021, as amended from time to time, till the corresponding Bureau of Indian Standards specification are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).
