मोबाइल नम्बर के सत्यापन के पश्चात ् राष्ट्रीय मोटर यान रजिस्ट्टर के प्ररूप 59 म ें इलेक्ट्राजनक रूप स े तैयार दकए िाएगं े ।’’; (iv) खंड (iii)(ख) का लोप दकया िाएगा । 3. उि जनयमों के जनयम 116 म,ें -- (क) उपजनयम (1), उपजनयम (2) और उपजनयम (3) के स्ट्थान पर जनम्नजलजखत उपजनयम रखे िाएंग,े अथागत ् :-- ‘‘(1) जनयम 115 के उपजनयम (7) म ें अंतर्मवष्ट दकसी बात के होत े हुए भी, कोई अजधकारी, िो पुजलस उपजनरीक्षक या मोटर यान जनरीक्षक की पंजि स े नीच े का न हो, जिसे यह जवश्वास करन े का कारण ह ैदक कोई मोटर यान जनयम 115 के उपजनयम (2) के उपबंधों का अनुपालन नहीं कर रहा ह,ै दकसी प्राजधकृत प्रदषू ण जनयंत्रण परीक्षण स्ट्टेिन म ें उत्सिगन के मानकों को मापने का परीक्षण करन े के जलए यान को प्रस्ट्तुत करन े हते ु सीध े चालक या यान के प्रभारी दकसी भी व्यजि को जलजखत या इलेक्ट्राजनक मोड के माध्यम स े जनदेि द ेसकता ह ै। (2) यदद चालक या यानों का प्रभारी व्यजि अनुपालन के जलए वाहन प्रस्ट्तुत करने में असफल रहता ह ैया कोई यान जनयत सात (07) ददनों की अवजध के भीतर जनयम 115 के उपजनयम (2) का अनपु ालन करन े म ें असफल रहता ह,ै तो यान का स्ट्वामी अजधजनयम की धारा 190 की उपधारा (2) के अधीन जवजहत िाजस्ट्त के जलए दायी होगा : परंतु यदद स्ट्वामी अनुपालन करने म ें असफल रहता ह,ै ऐसी अवजध तक वैध ‘‘प्रदषू ण जनयंत्रण’’ प्रमाणपत्र तैयार नहीं होता ह,ै तो रजिस्ट्रीकरण प्राजधकरण जलजखत म ें अजभजलजखत कारणों स े यान का रजिस्ट्रीकरण प्रमाणपत्र और प्रदान दकए गए दकसी भी परजमट को जनलंजबत कर देगा । (3) जनयम 115 के उपजनयम (2) के उपबंधों के अनुपालन के जलए मापन जनयम 126 म ें जनर्ददष्ट दकसी एिेंसी या राष्ट्रीय पयागवरण इंिीजनयरी अनुसंधान, नागपुर-440001 द्वारा समय-समय पर यथा संिोजधत एआईएस 137 के अनुसार अनुमोददत दकस्ट्म के जलखत का उपयोग करके द्वारा अंजतम संिोधन दकया गया था । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 14th June, 2021 G.S.R. 410(E).—Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 740 (E), dated the 27th November, 2020 in the Gazette of India, Extraordinary, Part-II, section 3, sub-section (i) inviting objections and suggestions from affected persons before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to public; Whereas, copies of the said Official Gazette on which the said notification were made available to the public on the 27th November, 2020; And whereas, the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: — 1. Short Title and commencement. -(1) These rules may be called the Central Motor Vehicles (Thirteenth Amendment) Rules, 2021. (2) They shall come into force three months from the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the said rules), in rule 115, - (a) for sub rule (1), the following shall be substituted, namely: - “Every motor vehicle, other than battery operated vehicles and those manufactured prior to the first day of March 1990, shall be maintained in such condition and shall be so driven so as to comply with the standards prescribed in these rules.”; (b) in sub rule (2), - (i) after the words, letters and figures " TAP documents Nos. 115 and 116", the words, letters and figures " or AIS 137, as applicable" shall be inserted; (ii) after the words, letters and figures "Document No. MoRTH/CMVR/TAP-115-116", the words, letters and figures " or AIS 137, as applicable" shall be inserted; (iii) for the clause (iii)(a), the following shall be substituted, namely: - “(iii) (a) The emission results obtained during testing as per clause (i) or clause (ii) above, shall be electronically generated in the Form 59 from the National Register of Motor Vehicles after verification of mobile number of the vehicle owner, as the case may be, as laid down in AIS 137 (Part 8) as amended from time to time.”; (iv) clause (iii) (b) shall be deleted. 3. In the said rules, in rule 116, - (a) for sub rules (1), (2) and (3), the following sub- rules shall be substituted, namely: - "(1) Notwithstanding anything contained in sub-rule (7) of rule 115 any officer not below the rank of Sub-Inspector of Police or the Inspector of Motor Vehicles who has reason to believe that a motor vehicle is not complying with the provisions of sub-rule (2) of rule 115, to communicate in writing or through electronic modes to direct the driver or any person in-charge of the vehicle to submit the vehicle for conducting the test to measure emission values in the vehicle at any one of the authorized Pollution Under Control testing stations. (2) If the driver or person in-charge of the vehicles fails to submit the vehicle for compliance or the vehicle fails to comply with sub-rule (2) of 115 within the stipulated period of seven (07) days, the owner of the vehicle shall be liable for penalty prescribed under sub-section (2) of section 190 of the Act: Provided that, If the owner fails to comply, the registering authority shall, for reasons to be recorded in writing, suspend the certificate of registration of the vehicle and any permit granted, until such time a valid “Pollution under Control “certificate is generated. (3) The measurement for compliance to the provisions of sub-rule (2) of rule 115 shall be carried out using the instrument type approved in accordance with AIS 137, as amended from time to time, by any agency referred to in rule 126 or by the National Environmental Engineering Research Institute, Nagpur-440 001.” (b) Sub-rules (4), (5), (6), (7), (8) and (9) shall be omitted. 4.
