(1) आन जनयमों का संजिप्त नाम केंद्रीय मोटर यान (नवा ं संिोधन) जनयम, 2023 ह ै। (2) ये राजपत्र में ऄंजतम प्रकािन की तारीख को प्रवृ्‍ त होंगे । 7014 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केंद्रीय मोटर यान जनयम, 1989 के जनयम 125ठ के पश्चात् जनम्न जलजखत जनयम ऄंत:स्ट्थाजपत दकया जाएगा, ऄथागत:्-- '125ठ. आलजे ररक पावर रेन यानों और हाआजिड आलजे ररक यान का टाइप ऄनमु ोदन:- आलेजररक पावर रेन यान जजसके ऄंतगतग जविुद्ध आलेजररक यान और हाआजिड आलेजररक यान, मजबूत हाआजिड आलेजररक यान, प्लग-आन हाआजिड आलेजररक यान, श्ृंखला हाआजिड आलेजररक यान, श्ृंखला समानांतर हाआजिड आलेजररक यान भी ह,ै जनयम 124 के ऄधीन जवजनर्ददष्ट सारणी में यथा जवजनर्ददष्ट टाइप ऄनुमोदन ऄपेिाओं को पूरा करेंगे। स्ट्पष्टीकरण.- आस जनयम म,ें - '(क) "आलेजररक पावर रेन" स े एक ऐसी प्रणाली ऄजभप्रेत ह ैजजसमें एक या ऄजधक जवद्युत उजाग भडं ारण युजि जैस े बैटरी, आलेररोमैकेजनकल फ्लाइव्हील या सुपर कैपेजसटर, एक या ऄजधक आलेजररक पावर कंडीिननग युजि और एक या ऄजधक आलेजररक मिीन,ें जो यान के प्रणोदन के जलए संग्रहीत जवद्युत उजाग को पजहयों पर जवतररत यांजत्रक उजाग म ें पररवर्वतत करती ह,ैं सजम्मजलत ह;ैं (ख) "हाआजिड आलेजररक यान (एचइवी)" स े एक ऐसा यान ऄजभप्रेत ह,ै जो यांजत्रक प्रणोदन के ईद्देश्य स,े संग्रहीत उजा ग या िजि के जनम्नजलजखत दोनों यान पर के स्रोतों से उजाग प्राप्त करता ह,ै ऄथागत:् - (i) एक ईपभोज्य ईंधन; (ii) एक बैटरी, कैपेजसटर, फ्लाइव्हील या जनरेटर या ऄन्य जवद्युत उजाग या जबजली भंडारण युजि; (ग) "प्लग-आन हाआजिड आलेजररक यान" में रेंज जवस्ट्ताररत आलेजररक यान, एक मजबूत हाआजिड आलेजररक यान सजम्मजलत ह ैजजसमें ऑफ यान चार्जजग की ररचाजेबल उजाग भडं ारण प्रणाली का ईपबंध ह ै ; (घ) "िुद्ध आलेजररक यान" म ेंकेवल आलेजररक पावर रेन द्वारा संचाजलत बैटरी चाजलत यान सजम्मजलत है: परंतु दक दो पजहया िुद्ध आलेजररक यान को मोटर यान नहीं माना जाएगा यदद जनयम 126 म ेंजनर्ददष्ट दकसी परीिण ऄजभकरण द्वारा जनम्नजलजखत सभी ितें स्‍याजपत और ऄजधप्रमाजणत की जाती हैं, ऄथागत्: - (i) यान 0.25 दकलोवाट से कम तीस जमनट की िजि वाली आलेजररक मोटर से सुसजित ह;ै (ii) यान की ऄजधकतम गजत 25 दकमी प्रजत घंटे से कम ह;ै (iii) यान ईपयुि िेक और रेरो ररफ्लेजरटव युजियों से सुसजित है, जैसे दक सामने एक सफेद परावतगक और पीछे एक परावतगक; (iv) यान का लदान रजहत भार (बैटरी भार को छोड़कर) 60 दकलोग्राम से ऄजधक नहीं ह;ै (v) सहायक आलेजररक मोटर से सुसजित पैडल सहायता प्राप्त यान के मामल े में, ईपरोि के ऄजतररि्, मोटर की तीस जमनट की िजि 0.25 दकलोवाट से कम ह,ै जजसका अईटपुट ईत्तरोत्तर कम हो जाता ह ैऔर ऄतं तः यदद साआदकल चालक पडै ल चलाना बंद कर द े तो यान की गजत 25 दकमी प्रजत घंटा या आससे पहले तक पहुचं न े पर कट जाता ह।ै स्ट्पष्टीकरण.- आस ईप-जनयम के प्रयोजनों के जलए, मोटर की तीस जमनट की िजि को एअइएस:049-2003 में पररभाजित दकया गया ह ैऔर स्‍यापन की रीजत AIS:0412003 म ें जवजहत ह;ै (ङ) "श्ृंखला हाआजिड आलेजररक यान" से कोइ भी यान ऄजभप्रेत ह,ै जो केवल आलेजररक मोटर संचाजलत ररचाजेबल उजा ग भंडारण प्रणाली द्वारा चाजलत पजहयों तक जबजली पहुचं ाने को ऄनुज्ञात करता है, लेदकन जजसमें ररचाजेबल उजा ग भंडारण प्रणाली या आलेजररक मोटर को िजि प्रदान करन े के जलए दहन आंजन का ईपयोग भी सजम्मजलत ह;ै (च) "श्ृंखला समानांतर हाआजिड आलेजररक यान" स े एक समानांतर हाआजिड आलेजररक यान ऄजभप्रेत ह ै जजसम ें ररचाजेबल उजाग भडं ारण प्रणाली या आलेजररक मोटर को िजि प्रदान करन े के जलए दहन आंजन के जलए एक प्रणाली ऄजतररि रूप से सजम्मजलत होती ह;ै (छ) "मजबूत हाआजिड आलेजररक यान" से एक हाआजिड आलेजररक यान ऄजभप्रेत ह,ै जजसमें 'स्ट्टॉप-स्ट्टाट'ग व्यवस्ट्था, 'आलेजररक रीजनरेरटव िेककग जसस्ट्टम' और एक 'मोटर ड्राआव' ह ै जहां मोटर ऄकेले यान को जस्ट्थर जस्ट्थजत स े चलान े में सिम ह।ै '. [सं अरटी-11036/71/2022-एमवीएल] महमूद ऄहमद, ऄपर सजचव[भाग II—खण् ड 3(i)] भारत का राजपत्र : ऄसाधारण 3 रटप्प ण : मूल जनयम, भारत के राजपत्र, ऄसाधारण, भाग II, खंड 3, ईप-खंड (i) की ऄजधसूचना संख्या सा.का.जन. 590(ऄ), तारीख 2 जून, 1989 द्वारा प्रकाजित दकए गए थ े और ऄंजतम संिोधन ऄजधसूचना संख् या सा.का.जन. 746(ऄ), तारीख 16 ऄिूबर, 2023 द्वारा दकया गया था । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, 6th November, 2023 G.S.R. 823(E).—Whereas the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R 180(E), dated the 13th March, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas copies of the said Gazette notification were made available to the public on the 14th March, 2023; And whereas no objections and suggestions were received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. (1) These rules may be called the Central Motor Vehicles (Ninth Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989, after rule 125-L, the following rule shall be inserted, namely:- „125M. Type approval of electric power train vehicles and hybrid electric vehicle:- electric power train vehicles, including pure electric vehicles and hybrid electric vehicles, strong hybrid electric vehicle, plug-in hybrid electric vehicle, series hybrid electric vehicle, series parallel hybrid electric vehicle, shall meet type approval requirements as specified in the Table specified under rule 124. Explanation.- In this rule,- „(a) “electric power train” means a system consisting of one or more electric energy storage devices such as a battery, electromechanical flywheel or super capacitor, one or more electric power conditioning devices and one or more electric machines that convert stored electric energy to mechanical energy delivered at the wheels for propulsion of the vehicle; (b) "hybrid electric vehicle (HEV)” means a vehicle that, for the purpose of mechanical propulsion, draws energy from both of the following on-vehicle sources of stored energy or power, namely:- (i) a consumable fuel; (ii) a battery, capacitor, flywheel or generator or other electrical energy or power storage device; (c) "plug-in hybrid electric vehicle” includes range extended electric vehicle, a strong hybrid electric vehicle which has a provision for off Vehicle charging of rechargeable energy storage system; (d) "pure electric vehicle” includes battery operated vehicle powered by an electric power train only: Provided that a two wheeled pure electric vehicle shall not be deemed to be a motor vehicle if all the following conditions are verified and authorised by any testing agency specified in rule 126, namely:- (i) vehicle is equipped with an electric motor having thirty-minute power less than 0.25 KW; (ii) maximum speed of the vehicle is less than 25 Kmph; (iii) vehicle is fitted with suitable brakes and retro reflective devices, such as one white reflector in the front and one reflector at the rear; (iv) unladen weight ( excluding battery weight) of the vehicle is not more than 60 Kgs; (v) in case of a pedal assisted vehicle equipped with an auxiliary electric motor, in addition to above, the thirty minute power of the motor is less than 0.25KW, whose output is progressively reduced4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] and finally cut off as the vehicle reaches the speed of 25 km per hour, or sooner, if the cyclist stops pedaling. Explanation.- For the purposes of this sub-rule, the thirty minute power of the motor is defined in AIS:049-2003 and method of verification is prescribed AIS:0412003; (e) "series hybrid electric vehicle" means any vehicle which allows power to be delivered to the driven wheels solely by a rechargeable energy storage system powered electric motor, but which also incorporates the use of a combustion engine to provide power to the rechargeable energy storage system or electric motor; (f) "series parallel hybrid electric vehicle" means a parallel hybrid electric vehicle which additionally incorporates a system for the combustion engine to provide power to the rechargeable energy storage system or electric motor; (g) "strong hybrid electric vehicle" means a hybrid electric vehicle which has a 'stop-start' arrangement, 'electric regenerative braking system' and a 'motor drive' where motor alone is capable to propel the vehicle from a stationary condition.‟.
