L.-33004/99 सी.जी.-डी.एल.-अ.-17072024-255480 CG-DxLx-xEG-I1D7H0x7x2x0 24-255480 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 370] नई दिल्ली, मंगलवार, िलु ाई 16, 2024/आषाढ 25, 1946 No. 370] NEW DELHI, TUESDAY, JULY 16, 2024/ASHADHA 25, 1946 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 15 िुलाई, 2024 सा.का.जन. 407(अ).— केन्द्रीय मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अपक्षे ानुसार, केन्द्रीय मोटर यान जनयम, 1989 का और सिं ोधन करन े के जलए, भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना सा.का.जन. संखयांक 126 (अ) तारीख 22 फरवरी, 2024 द्वारा उन सभी व्यजियों से, जिनके उनसे प्रभाजवत होने की संभावना थी, प्रारूप जनयम भारत के रािपत्र, असाधारण, भाग 2, खडं 3, उपखंड (i) म ें प्रकाजित दकए गए थे, उस तारीख से जिसको उि अजधसूचना से युि रािपत्र की प्रजतयां िनता को उपलब्ध करा िी गई थी, तीस दिन की अवजध के अवसान से पूवग आक्षेप और सुझाव आमंजत्रत दकए गए थे ; और उि अजधसूचना को अंतर्वगष्ट करन े वाले रािपत्र की प्रजतयां, िनता को 23 फरवरी, 2024 को उपलब्ध करा िी गई थीं ; और उि प्रारूप जनयमों की बाबत िनता स े प्राप्त आक्षेपों और सुझावों पर केन्द्रीय सरकार द्वारा सम्यकतः जवचार कर जलया गया ह ै; 4279 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] अतः, अब केन्द्रीय सरकार केन्द्रीय मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित्त िजियों का प्रयोग करत े हुए, केन्द्रीय मोटर यान जनयम, 1989 का और संिोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागत ् :- 1. सजं क्षप्त नाम और प्रारंभ.- (1) इन जनयमों का संजक्षप्त नाम केन्द्रीय मोटर यान (नवााँ संिोधन) जनयम, 2024 ह ै। (2) इन जनयमों म ेंअन्द्यथा उपबंजधत के जसवाय, य ेजनयम रािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंगे। 2. केन्द्रीय मोटर यान जनयम, 1989 (जिसे इसमें इसके पश्चात ्उि जनयम कहा गया ह)ै के जनयम 115ग में,- (i) उपजनयम 5 म,ें - (क) खंड(ग) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा, अथागत्:- “(ग) तरलीकृत पैरोजलयम गैस (एलपीिी) दकटों के साथ पनु ःसंयोजित यानों के जलए दकस्ट्म अनुमोिन ऐसा अनुमोिन िारी करन े की तारीख से छः वष ग के जलए जवजधमान्द्य होगा और इसका एक समय पर प्रत्येक छः वषग के जलए नवीकरण दकया िाएगा ।”; (ख) खंड (घ) के स्ट्थान पर जनम्नजलजखत खंड रखा िाएगा, अथागत:् - “(घ) तरलीकृत पैरोजलयम गसै (एलपीिी) प्रचालन से पुनःसंयोजित या उपांतररत यानों के जलए दकस्ट्म अनुमोिन जवजिष्ट मेक के यानों के जलए दिया िाएगा और ऐसे दकट को दकसी यान म ें नीचे दिए गए परीक्षणों के लागू होन े के साथ जवजिष्ट ईंिन क्षमता के रेंि म ेंपनु ःसंयोिन के जलए ठीक माना िाएगा :- क्रम सं. ईंिन क्षमता उपजनयम (5) के खडं (क) के अधीन सारणी के अनुसार लाग ू परीक्षण 1. 1200सीसी से कम वृहत उत्सिगन और CO 2 2. 1201 से 1600 सीसी वृहत उत्सिगन और CO 2 3. 1601 से 2000 सीसी वृहत उत्सिगन और CO 2 4. 2001 से 2500सीसी वृहत उत्सिगन और CO 2 5. 2501 और उससे अजधक वृहत उत्सिगन और CO ” 2 (ग) खंड (झ) के पश्चात ्जनम्नजलजखत खंड अंतःस्ट्थाजपत दकया िाएगा, अथागत् :- “ (ञ) जवद्यमान अनुमोिन को पुनर्वगजधमान्द्यकरण अनुित्त करने के प्रयोिन के जलए खंड (घ) में यथा लाग ू परीक्षणों के साथ, नीचे िी गई सारणी के अनुसार परीक्षण दकए िाएंगे :- क्रम संखया लाग ूपरीक्षण जनिेि िस्ट्तावेि 1. वृहत उत्सिगन परीक्षण (दकस्ट्म 1 परीक्षण) 1. सीएमवी जनयम 115(18) (i), 115 (19), 115(20) या 115 (22) िैसा दक लाग ू हों 2. ओनबोडग जनिान एमओआरटीएच/सीएमवीआर/टीएपी115/116 भाग 3. सेवा के िौरान अनुकूलता और आईयूपीऔर (सेवा 14, अध्याय-14, अनुबंध 3 के िौरान कायग जनष्पािन अनुपात) 2. एआईएस-137 4. CO उत्सिगन CO2 को मापा िाएगा और ररपोटग दकया िाएगा” 2[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 3. उि जनयमों के, जनयम 115ख के, उपजनयम क के, खडं (III) के उपखडं (ग), के स्ट्थान पर जनम्नजलजखत रखा िाएगा, अथागत ् :- “(ग) संपीजड़त प्राकृजतक गैस (सीएनिी) दकट के साथ पुनःसयं ोजित यानों के जलए दकस्ट्म अनुमोिन ऐसा अनुमोिन िारी करन े की तारीख स े छः वषग के जलए जवजधमान्द्य होगा और इसका एक समय पर प्रत्येक छः वष ग के जलए नवीकरण दकया िाएगा ।” । [स.ं आरटी-11036/60/2021-एमवीएल] महमूि अहमि,अपर सजचव रटप्पणः - मलू जनयम भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) म ें अजधसूचना सं. सा.का.जन. 590(अ), तारीख 2 िून,1989 द्वारा प्रकाजित दकए गए थ े और अंजतम संिोधन सा.का.जन. सं. 354(अ), तारीख 26 िून, 2024 द्वारा दकया गया । MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 15th July, 2024 G.S.R.407(E).—Whereas, the draft rules to amend the Central Motor Vehicles Rules, 1989, were published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 126(E), dated the 22nd February, 2024, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the official Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette containing the said notification were made available to the public on the 23rd February, 2024; And whereas, objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. Short tile and commencement.- (1) These rules may be called the Central Motor Vehicles (Ninth Amendment) Rules, 2024. (2) Save as otherwise provided in these rules, they shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules), in rule 115C,- (i) in sub-rule 5,- (a) for clause (c), the following clause shall be substituted, namely:- “(c) Type approval for vehicles retrofitted with Liquefied Petroleum Gas (LPG) kits shall be valid for six years from the date of issue of such approval and shall be renewed for every six years at a time.”; (b) for clause (d), the following clause shall be substituted, namely:- “(d) Type approval for vehicles retrofitted or modified for Liquefied Petroleum Gas (LPG) operation shall be given for vehicles of specific make and such kit shall be considered fit for retrofitment in any vehicle within a specified range of engine capacity with the applicability of tests as mentioned below:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] S. Less than 1200 cc Mass emission and CO emission 2 2. 1201 to 1600 cc Mass emission and CO emission 2 3. 1601 to 2000 cc Mass emission and CO emission 2 4. 2001 to 2500 cc Mass emission and CO emission 2 5. 2501 and above Mass emission and CO emission” 2 (c) after clause (i), the following clause shall be inserted, namely:- “(j) For the purpose of granting revalidation for the existing approval, performance tests shall be carried out as per the table below, along with tests as applicable in clause (d): - S. In the said rules, in rule 115B, in sub-rule A, in clause (III) for sub-clause (c), the following shall be substituted, namely:- “(c) Type approval for vehicles retrofitted with Compressed Natural Gas (CNG) kits shall be valid for six years from the date of issue of such approval and shall be renewed for every six years at a time.”.
