## Report on the Central Motor Vehicles Amendment Rules, 2022
**1. Executive Summary:**
This report analyzes the notification G.S.R. 745(E) issued by the Ministry of Road Transport and Highways on September 29, 2022, concerning an amendment to the Central Motor Vehicles Rules, 1989. The core purpose of this amendment is to revise the effective date of a specific provision within the rules. This report focuses on the change to rule 115A, specifically table 1, which delays the implementation of a provision initially slated for October 1, 2022, to January 1, 2023. The key finding is that this amendment grants a three-month extension for compliance with the provision detailed in rule 115A table 1.
**2. Introduction:**
This report aims to provide a concise and informative overview of the amendment to the Central Motor Vehicles Rules, 1989, as outlined in notification G.S.R. 745(E) published on September 29, 2022. The analysis is based solely on the provided text of the notification.
**3. Policy Overview:**
* This notification concerns an amendment to the Central Motor Vehicles Rules, 1989.
* The core objective of this amendment is to modify the effective date of a pre-existing rule, specifically within rule 115A, table 1.
**4. Background and Rationale:**
The provided text does not explicitly state the reason *why* the effective date of the rule within rule 115A table 1, is being changed. However, the amendment suggests that stakeholders might require additional time to comply with the requirements set forth in that specific part of the rule. The postponement from October 1, 2022, to January 1, 2023, indicates a need for either further preparation, adjustment, or a reassessment of the implementation timeline.
**5. Key Provisions / Changes:**
This amendment focuses solely on modifying the effective date of a provision within the Central Motor Vehicle Rules, 1989.
* **Specific Part Changed:** Rule 115A, in table 1, in the heading "Applicable with effect from".
* **New Rule/Provision:** The words "1st January, 2023" shall be substituted for the words and figures "1st October, 2022".
* **Difference/Effect of Change:** The amendment delays the date from which the provisions specified in rule 115A, table 1 are applicable. This provides a three-month extension, shifting the implementation deadline from October 1, 2022, to January 1, 2023.
**6. Target Audience and Stakeholders:**
Based on the nature of the Central Motor Vehicles Rules and the specific reference to rule 115A, table 1, the target audience and stakeholders likely include:
* Vehicle manufacturers.
* Automotive component suppliers.
* Testing agencies involved in vehicle certification.
* Transporters and fleet owners.
* Citizens who own or operate motor vehicles.
Specifically, those affected by the requirements detailed within Rule 115A table 1.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** Ministry of Road Transport and Highways (MoRTH) is responsible for implementing and enforcing the Central Motor Vehicles Rules, including the amended provision.
* **Timelines:** The key timeline aspect is the revised effective date of January 1, 2023, for rule 115A, table 1.
* **Procedures:** The amendment itself does not specify new procedures, but implies that existing procedures related to compliance with Rule 115A table 1, now have a revised deadline.
**8. Expected Outcomes / Impact of Changes:**
The primary intended outcome of this amendment is to provide affected parties with additional time (three months) to comply with the requirements of rule 115A, table 1. This may:
* Reduce the risk of non-compliance due to insufficient preparation.
* Allow for a smoother transition and implementation of the provision.
* Potentially mitigate any unforeseen challenges or obstacles related to the initial October 1, 2022, deadline.
**9. Conclusion:**
The amendment to the Central Motor Vehicles Rules, 1989, detailed in notification G.S.R. 745(E), primarily involves a shift in the effective date of a rule specified within rule 115A, table 1, from October 1, 2022, to January 1, 2023. This three-month extension suggests a need for extended preparation or adjustment by the affected stakeholders. The amendment is significant as it directly impacts the implementation timeline and allows for smoother compliance with the requirements of rule 115A, table 1.
