(1) इन जनयमों का संजिि नाम केन्द्रीय मोटर यान (सातवााँ संिोधन) जनयम, 2023 ह ै। (2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंग े । 6308 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केन्द्रीय मोटर यान जनयम, 1989 में,- (क) प्ररुप 20 म,ें क्रम संखयाकं 24 और उसस े संबंजधत प्रजवजष्टयों के पश्चात ् जनम्नजलजखत क्रम सखं यांक और प्रजवजष्टयां अंतःस्ट्थाजपत की िाएगी, अथातग ् :- “24क. खड़े होन े के स्ट्थान.......................................... 24ख. ियन के स्ट्थान .....................................”; (ख) प्ररुप 21 में, भाग 4 में, क्रम संखयांक 9 और उसस े संबंजधत प्रजवजष्टयों के पश्चात् जनम्नजलजखत क्रम संखयांक और प्रजवजष्टयां अतं ःस्ट्थाजपत की िाएगी, अथागत् :- “9क. खड़े होन े के स्ट्थान ...................................... 9ख. ियन के स्ट्थान ................................. ”; (ग) प्ररुप 22ख म,ें क्रम संखयांक 6.19 और उससे संबंजधत प्रजवजष्टयों के पश्चात् जनम्नजलजखत क्रम संखयांक और प्रजवजष्टयां अंतःस्ट्थाजपत की िाएगी, अथातग ् : “6.19 बैठने के स्ट्थान (चालक सजहत) खड़े होन े के स्ट्थान/ ियन के स्ट्थान (हां / नहीं ) की पररकल्पना रटप्पण: बैठन,े खड़ े होने और ियन करने वालों के िेत्र के जवन्द्यास के साथ बस बॉडी कोड में जवजनर्िगष्ट प्रदक्रया पर आधाररत बठै ने, खड़े होन े और ियन करन े वालों याजत्रयों के स्ट्थान की गणनाओं को उपिर्िगत करने वाली िीट संलग्न करें ”; (घ) प्ररुप 23क म,ें मिीन द्वारा पढ े िान े वाला भाग िीर्गक के अधीन, क्रम सखं यांक 3 के सामने, पंजि संखयांक 6 की प्रजवजष्टयों के स्ट्थान पर, जनम्नजलखत प्रजवजष्टयां रखी िाएंगी, अथागत् :- “बैठने के स्ट्थान चालक सजहत ”; (ड.) प्ररुप 23 ख म,ें पंजि संखयांक 12 और उससे संबंजधत प्रजवजष्टयों के स्ट्थान पर जनम्नजलजखत प्रजवजष्टयां रखी िाएंगी, अथागत ् :- “बैठने के स्ट्थान चालक सजहत .......................................... खड़े होने के स्ट्थान .............................................. ियन के स्ट्थान......................................... ”; (ठ) प्ररुप 51 म,ें क्रम संखयांक 5 और उससे संबंजधत प्रजवजष्टयों के पश्चात ् जनम्नजलजखत क्रम संखयांक और प्रजवजष्टया ं अंतःस्ट्थाजपत की िाएगं ी, अथागत् :- “5क. बैठने के स्ट्थान (चालक सजहत).......................... 5ख. खड़ ेहोने के स्ट्थान ................................. 5ग. ियन के स्ट्थान .................................... ” [फा.सं. आरटी -11036/163/2022-एमवीएल] महमिू अहमि, अपर सजचव रटप्प ण: मूल जनयम भारत के रािपत्र, असाधारण, भाग 2, खडं 3, उपखडं (i) म ें अजधसूचना संखयांक सा.का.जन. 590(अ) तारीख 2 िून, 1989 द्वारा प्रकाजित दकए गए थ े और अजधसूचना संखयांक सा.का.जन. 698(अ) तारीख, 27 जसतंबर, 2023 द्वारा अंजतम रुप से संिोजधत दकए गए थ े। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 4th October, 2023 G.S.R. 720(E).—Whereas, the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 405(E), dated the 30th May, 2023 in the Gazette of India, Extraordinary, Part II, Section 3, sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of thirty days from the date on which copies of the Official Gazette containing the draft rules were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 31st May, 2023;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] And whereas, no objections and suggestions were received from the public in respect of the said draft rules; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: 1. (1) These rules may be called the Central Motor Vehicles (Seventh Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989,- (a) in FORM 20, after serial number 24 and entries relating thereto, the following serial numbers and entries shall be inserted, namely:- “24A. Standing capacity ……………………………… 24B. Sleeper Capacity ……………………………….”; (b) in FORM 21, in Part IV, after serial number 9 and entries relating thereto, the following serial numbers and entries shall be inserted, namely:- “9A. Standing capacity ……………………………… 9B. Sleeper capacity ………………………………”; (c) in FORM 22B, for serial number 6.19 and entries relating thereto, the following serial number and entries shall be substituted, namely:- “6.19 Designed Seating Capacity (including Driver)/ Standing (Yes/No) Capacity/ Sleeper Capacity Note: Enclose a sheet indicating calculations of the seating, standing and sleeper passenger capacity based on the procedure specified in the bus body code along with layout of seats, standees and sleeper area. ”; (d) in FORM 23A, under the heading Machine Readable Zone, against serial number 3, for entries in row number 6, the following entries shall be substituted, namely:- “Seating capacity including driver”; (e) in FORM 23B, for row number 12 and the entries relating thereto, the following rows and entries shall be substituted, namely:- “Seating capacity including driver …………………………………. Standing capacity …………………………………. Sleeper capacity ………………………………….”; (f) in FORM 25, after serial number 11 and entries relating thereto, the following serial numbers and entries shall be inserted, namely:- “11A.
