## Policy Analysis Report: Amendment to the Central Motor Vehicles Rules, 1989
**1. Executive Summary:**
This report analyzes a notification amending the Central Motor Vehicles Rules, 1989. The amendment, detailed in notification G.S.R. 645(E), focuses on enhancing fire safety standards for Type III buses and school buses, specifically requiring the implementation of Automotive Industry Standard (AIS) 135 for fire alarm and protection systems. The key finding is that these changes aim to improve passenger safety by mandating improved fire safety measures in specified vehicle categories, effective October 1, 2022. This report provides an overview of the amendment, its rationale, key changes, affected parties, and potential impacts.
**2. Introduction:**
This report aims to provide a clear and concise analysis of the amendment to the Central Motor Vehicles Rules, 1989, as outlined in the provided government notification. The analysis is based solely on the information provided within the document.
**3. Policy Overview:**
* **Original Policy:** Central Motor Vehicles Rules, 1989.
* **Core Objective(s):** Based on the amendment text, the core objective is to enhance passenger safety within specific categories of motor vehicles (Type III buses and School buses) by mandating improved fire safety standards.
**4. Background and Rationale:**
This document represents an amendment to existing motor vehicle rules. The rationale for this specific amendment appears to stem from a need to enhance fire safety measures in Type III buses and school buses. The amendment likely aims to address potential risks associated with vehicle fires and to align safety standards with AIS-135. The focus on these particular vehicle types suggests a concern for the safety of vulnerable passengers, especially children in school buses, and potentially a gap in the previous regulations concerning fire protection in these vehicles.
**5. Key Provisions / Changes:**
This notification introduces specific changes to Rule 125C of the Central Motor Vehicle Rules, 1989. The changes are as follows:
* **Change 1:** Following the last proviso under subrule 1 in Rule 125C, a new proviso is inserted:
* **New Provision:** "Provided also that the provisions of AIS135 shall be applicable to Type III buses, as specified in AIS 052Rev.1, which are manufactured on and after the 1st day of October, 2022"
* **Effect of Change:** This amendment mandates that Type III buses manufactured from October 1, 2022, onward must comply with the fire safety standards outlined in AIS135.
* **Change 2:** Following subrule 2 in Rule 125C, a new proviso is inserted:
* **New Provision:** "Provided that the provisions on fire protection in occupant compartment of AIS135 shall be applicable to school Buses, as specified in AIS063, which are manufactured on and after the 1st day of October, 2022"
* **Effect of Change:** This amendment mandates that School Buses manufactured from October 1, 2022, onward must comply with the fire protection standards outlined in AIS135 within the occupant compartment.
* **Change 3:** In rule 125C, sub clause 7, Table 1, after Sr. No. 7, Sr. No. 7A shall be inserted as under:
* **New Provision:** Sr. No. 7A Parts/components: Fire Alarm and Protection system; Vehicle Category: Type III buses of category M3 and school buses; Requirement: AIS135 in occupant compartment; Date of commencement: 1st October, 2022
* **Effect of Change:** This amendment mandates that Type III buses of category M3 and School Buses must install fire alarm and protection system.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders directly affected by these amendments include:
* Manufacturers of Type III buses (as specified in AIS 052Rev.1)
* Manufacturers of School Buses (as specified in AIS063)
* Operators and owners of Type III buses and School buses
* Passengers of Type III buses and School buses
* Testing and certification agencies involved in vehicle compliance
**7. Implementation Aspects (Inferred):**
* **Responsible Agency:** The Ministry of Road Transport and Highways (MoRTH) is the responsible agency, as indicated by the notification's origin.
* **Timelines:** The key implementation date is October 1, 2022, after which the amended rules apply to newly manufactured Type III buses and School Buses.
* **Procedures:** The amendment implies a need for manufacturers to incorporate AIS135 compliant fire alarm and protection systems during the vehicle manufacturing process. Compliance will likely be assessed through existing vehicle inspection and certification processes.
**8. Expected Outcomes / Impact of Changes:**
The expected outcome of these amendments is a significant improvement in fire safety for passengers in Type III buses and School Buses. The mandatory implementation of AIS135 standards should lead to:
* Reduced risk of fire-related injuries and fatalities in these vehicle types.
* Increased public confidence in the safety of Type III buses and School Buses.
* Potential for improved emergency response in the event of a vehicle fire.
* An increase in the manufacturing cost.
**9. Conclusion:**
The amendment to the Central Motor Vehicles Rules, 1989, mandating AIS135 compliant fire safety measures in Type III buses and School Buses manufactured from October 1, 2022, represents a significant step toward enhancing passenger safety. While the text is limited, its focus on specific vehicle categories and a clear implementation date suggests a targeted approach to improving fire safety standards within the transport sector. These amendments are likely to have a positive impact on passenger safety and potentially on the overall quality and safety standards within the automotive manufacturing industry.
