## Policy Analysis Report: Amendment to Motor Vehicles Act, 1988 - Notification S.O. 359(E)
**1. Executive Summary:**
This report analyzes Notification S.O. 359(E), issued by the Ministry of Road Transport and Highways on January 27, 2022, which amends a previous notification (S.O. 1365(E) dated December 13, 2004) related to the Motor Vehicles Act, 1988. The core purpose of this amendment is to extend specific deadlines for compliance with certain motor vehicle safety standards. The key finding is that this amendment provides a six-month extension, shifting the compliance deadline from March 21, 2022, to September 21, 2022, for specific safety standards outlined in the original notification's tables.
**2. Introduction:**
This report provides an informative analysis of Notification S.O. 359(E) issued on January 27, 2022, which amends a prior notification pertaining to the Motor Vehicles Act, 1988. The analysis focuses solely on the information contained within the provided policy text.
**3. Policy Overview:**
* **Amendment:** This notification is an amendment to Government of India notification number S.O. 1365(E), dated December 13, 2004, published in the Gazette of India.
* **Core Objective(s):** The core objective, as inferred from the provided text, is to revise the deadlines associated with certain motor vehicle safety standards specified in the original notification.
**4. Background and Rationale:**
* **Amendment Rationale:** The amendment extends the deadline for certain compliance requirements. It is likely that the original deadline of March 21, 2022, was found to be impractical or insufficient for affected parties to meet, necessitating a six-month extension to September 21, 2022. This could be due to various factors, such as supply chain disruptions, unforeseen technical challenges, or other logistical constraints in meeting the original safety standards.
**5. Key Provisions / Changes:**
This amendment specifically addresses deadlines outlined in the original notification (S.O. 1365(E)). The following changes are introduced:
* **Specific Part of Original Policy Changed:** The amendment modifies the deadlines stipulated within the "Table," "Table A," and "Table B Safety Standards for Erickshaws and Ecarts" of the original notification.
* **New Rule/Provision:** The figures, letters, and word "21st March, 2022," are replaced with "21st September, 2022," wherever they appear in the specified sections of the original notification.
* **Difference/Effect of Change:** This change effectively extends the compliance deadline for safety standards mentioned in serial numbers 8 and 43 of the "Table," serial number 6 of "Table A," and serial number 2 of "Table B Safety Standards for Erickshaws and Ecarts" by six months.
**6. Target Audience and Stakeholders:**
Based on the provided text, the target audience and stakeholders directly affected by this amendment include:
* Manufacturers and suppliers of motor vehicles, specifically Erickshaws and Ecarts.
* Entities responsible for ensuring compliance with motor vehicle safety standards.
* Any other parties obligated to meet the safety standards outlined in the original notification's Tables by the original March 21, 2022 deadline.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies:** The Ministry of Road Transport and Highways is the responsible body.
* **Timelines or Procedures:** The amendment establishes a revised compliance deadline of September 21, 2022. Further details on specific implementation procedures are not available within the provided text.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of this amendment is to provide affected parties with additional time to comply with the specified safety standards. This could lead to:
* Reduced pressure on manufacturers and suppliers to meet the original deadline.
* Improved compliance with safety standards due to the extended timeframe.
* Potentially smoother transition to the new standards, minimizing disruptions to the motor vehicle industry.
**9. Conclusion:**
Notification S.O. 359(E) represents a targeted adjustment to the implementation timeline of motor vehicle safety standards. By extending the compliance deadline to September 21, 2022, for specific provisions outlined in the original notification, the amendment allows relevant stakeholders additional time to adhere to the standards, potentially leading to more effective and less disruptive implementation.
