L.-33004/99 सी.जी.-डी.एल.-अ.-18102023-249512 xxxGIDHxxx CG-DL-E-18102023-249512 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 593] नई दिल्ली, मगं लवार, अक्त बू र 17, 2023/आज‍व न 25, 1945 No. 593] NEW DELHI, TUESDAY, OCTOBER 17, 2023/ASVINA 25, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 16 अक् तूबर, 2023 सा.का.जन 746(अ).—केन्द्रीय मोटर यान जनयम, 1989 का और संिोधन करन े के जलए कजतपय प्रारुप जनयम, मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 212 की उपधारा (1) के अधीन यथाअपेजित, भारत के रािपत्र, असाधारण, भाग II, खडं 3, उपखंड (i) म ें भारत सरकार के सड़क पररवहन और रािमागग मंत्रालय की अजधसूचना संखयांक सा.का.जन. 476 (अ), तारीख 3 िलु ाई, 2023 द्वारा प्रकाजित दकए गए थे, जिसमें उन सभी व्यजियों स,े जिनके उससे प्रभाजवत होने की संभावना थी, उस तारीख स,े जिसको उि अजधसूचना को अंतर्वगष्ट करने वाले रािपत्र की प्रजतया ं िनता को उपलब्ध करा िी गई थी, तीस दिन की अवजध के भीतर आिेप और सुझाव आमंजत्रत दकए गए थ े; और उि रािपत्र अजधसूचना की प्रजतयां िनता को 4 िलु ाई, 2023 को उपलब्ध करा िी गई थी; और उि प्रारुप जनयमों के बाबत िनता से प्राप्त आिपे ों और सुझावों पर केन्द्रीय सरकार द्वारा सम्यक् रुप से जवचार कर जलया गया ह ै; अतः अब, केन्द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1989 का 59) की धारा 110 द्वारा प्रित्त िजियों का प्रयोग करते हुए केन्द्रीय मोटर यान जनयम, 1989 का और सिं ोधन करने के जलए जनम्नजलजखत जनयम बनाती ह,ै अथागत् :- 1. संजिप्त नाम और प्रारंभ -(1) इन जनयमों का संजिप्त नाम केन्द्रीय मोटर यान (आठवााँ संिोधन) जनयम, 2023 ह ै। (2) य ेरािपत्र में उनके प्रकािन की तारीख को प्रवृत्त होंग े। 6610 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केन्द्रीय मोटर यान जनयम, 1989 में, जनयम 125ठ के पश्चात् जनम्नजलजखत जनयम अतं ःस्ट्थाजपत दकया िाएगा, अथागत् :- “ 125ड - रव या सपं ीजड़त गसै हाइड्रोिन आतं ररक िहन इंिन यानों का टाईप अनमु ोिन- रव या संपीजड़त गैस हाइड्रोिन द्वारा सिि एम और एन श्रणे ी के आंतररक िहन इंिन यानों के टाईप अनुमोिन के जलए सरु िा और प्रदिया संबंधी अपिे ाएं एआईएस 195:2023 के अनुसार होगी, िब तक दक भारतीय मानक ब्यूरो अजधजनयम, 1986 (1986 का 63) के अधीन तत्सस्ट्थानी बीआईएस जवजनिेि को अजधसूजचत नहीं दकया िाता ह ै : परंत ु आंतररक िहन इंिन यानों के जलए हाइड्रोिन ईंधन जवजनिेि आईएस 16061:2021 के अनुसार होंगे ।” [फा. सं.आरटी-11036/211/2021-एमवीएल] महमूि अहमि, अपर सजचव रटप्पण : मलू जनयम, भारत के रािपत्र, असाधारण, भाग II, खंड 3, उपखंड (i) म ें अजधसूचना सखं यांक सा.का.जन 590 (अ), तारीख 2 िनू , 1989 द्वारा प्रकाजित दकए गए थ े और अजधसूचना संखयांक सा.का.जन. 720(अ), तारीख 4 अिूबर, 2023 द्वारा अंजतम रुप से संिोजधत दकए गए थे। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 16th October, 2023 G.S.R. 746(E).—Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, were published, as required under sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of 1988), vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R. 476(E), dated the 3rd July, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby within a period of thirty days from the date on which copies of the Gazette containing the said notification were made available to the public; And whereas, copies of the said Gazette notification were made available to the public on the 4th July, 2023; And whereas, objections and suggestions received from the public in respect of the said draft rules have been duly considered by the Central Government; Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988 (59 of 1988), the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely:- 1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (Eighth Amendment) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicle Rules, 1989, after rule 125L, the following rule shall be inserted, namely:- “125M- Type approval of liquid or compressed gaseous hydrogen internal combustion engine vehicles- The safety and procedural requirements for type approval of internal combustion engine vehicles of M and N categories powered by liquid or compressed gaseous hydrogen shall be in accordance with AIS 195:2023, till corresponding BIS specification is notified under the Bureau of Indian Standard Act, 1986 (63 of 1986): Provided that the hydrogen fuel specifications for internal combustion engine vehicles shall be in accordance with IS 16061: 2021.” [F.
