## Report on Amendment to the Central Motor Vehicles Rules, 1989 Regarding Hydrogen Fuel Vehicles **1. Executive Summary:** This report analyzes an amendment to the Central Motor Vehicles Rules, 1989, specifically focusing on the introduction of technical specifications and testing requirements for hydrogen-fueled vehicles. The core purpose of this amendment is to integrate hydrogen fuel technology into the existing regulatory framework for motor vehicles in India, specifically concerning BSVI and BSIV emission standards. The key findings indicate the establishment of specific testing procedures and reference fuel specifications for hydrogen vehicles to ensure compliance with emission regulations. **2. Introduction:** This report aims to provide a comprehensive overview of a recent amendment to the Central Motor Vehicles Rules, 1989, as detailed in the provided government notification. The analysis is based solely on the content of the document and focuses on changes related to the introduction and regulation of hydrogen-fueled vehicles. This report is intended to inform affected industry stakeholders about the implications of this amendment. **3. Policy Overview:** * This report concerns an **amendment** to the Central Motor Vehicles Rules, 1989. * **Core Objective(s):** The core objective of this amendment is to define technical specifications and testing requirements for hydrogen-fueled vehicles (both BSVI and BSIV compliant) within the framework of the Central Motor Vehicle Rules, 1989. This ensures these vehicles are adequately regulated and meet the required emission standards. **4. Background and Rationale:** * **Reason for Amendment:** The amendment is likely driven by the increasing interest in and development of hydrogen fuel technology in the automotive sector. The existing Central Motor Vehicle Rules, 1989, likely lacked specific provisions for hydrogen fuel, necessitating this amendment to address the unique characteristics and testing requirements of such vehicles to properly measure emissions and ensure safety. **5. Key Provisions / Changes:** This amendment introduces several key changes relating to hydrogen fuel vehicles: * **Amendment to Rule 115 (Subrule 18 ii):** Table 2 of Rule 115(18)(ii), which outlines the applicability of test requirements for various engine types, is being substituted. This new table explicitly includes hydrogen fuel vehicles, along with specifying the applicable tests (e.g., gaseous pollutants, particulate mass, durability, OBD, Off Cycle Emission, In-Service Conformity). * **New Table 2:** The new table provides a comprehensive overview of applicable test requirements for hydrogen-fueled vehicles related to BSVI Compression and Positive Ignition Engines. * **Effect:** This inclusion ensures that hydrogen vehicles are subject to appropriate testing protocols and emission standards. The table specifies that only NOx emissions need to be determined when the vehicle is running on Hydrogen * **Amendment to Rule 115 (Subrule 18 ii, Notes, Sr. No. 4):** Adds new items `h` and `i` specifying the reference fuel for BSVI and BSIV Hydrogen Fuel vehicles to be used during testing with reference to Annexure IVW and IVZD respectively. * **Amendment to Rule 115 (Annexure IVW):** The title of Annexure IVW is updated to specifically reference "Technical Specification of Reference Hydrogen Fuel for BS VI vehicles". This clarifies the scope of Annexure IVW, linking it to BS VI emission standards. * **Insertion of New Annexure IVZD:** A new Annexure, IVZD, is inserted, providing "Technical Specification of Reference Hydrogen Fuel for BSIV vehicles." This annexure details the minimum and maximum limits for key characteristics of reference hydrogen fuel for BSIV vehicles, including hydrogen purity, total hydrocarbon, water content, oxygen, argon, nitrogen, CO, Sulphur, and permanent particulates. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders affected by this amendment include: * Automobile manufacturers producing hydrogen-fueled vehicles. * Testing agencies and certification bodies responsible for evaluating vehicle compliance with emission standards. * Fuel suppliers and distributors involved in the production and distribution of hydrogen fuel. * Regulatory bodies responsible for enforcing motor vehicle regulations. **7. Implementation Aspects (Inferred):** * **Responsible agency:** The Ministry of Road Transport and Highways (MoRTH) is the responsible agency for implementing and enforcing these amended rules. The Joint Secretary (MVL) is the point of contact for objections and suggestions. * **Timelines:** The amendment will come into force on the date of its final publication in the Official Gazette, except as otherwise provided. Objections or suggestions regarding the amendment were to be submitted within 30 days of the notification's publication. * **Testing Procedures:** Manufacturers will need to adapt their testing procedures to align with the requirements outlined in the new Table 2 of Rule 115(18)(ii) and the specifications provided in Annexure IVW (for BSVI) and Annexure IVZD (for BSIV). **8. Expected Outcomes / Impact of Changes:** The intended outcomes of these specific changes include: * **Clear Regulatory Framework:** The amendment provides a clear regulatory framework for the introduction and testing of hydrogen-fueled vehicles in India, reducing ambiguity and fostering industry confidence. * **Standardized Testing:** The introduction of specific testing requirements and reference fuel specifications ensures standardized and reliable testing of hydrogen vehicle emissions, promoting fair competition and accurate assessment. * **Encouraging Hydrogen Adoption:** By establishing a clear pathway for compliance, the amendment encourages the development and adoption of hydrogen fuel technology in the Indian automotive market, supporting cleaner transportation alternatives. **9. Conclusion:** This amendment to the Central Motor Vehicles Rules, 1989, represents a significant step towards integrating hydrogen fuel technology into the Indian automotive sector. By establishing clear testing procedures and fuel specifications, the amendment provides a crucial regulatory foundation for the development, testing, and deployment of hydrogen-fueled vehicles, paving the way for cleaner and more sustainable transportation options. The implementation of these amendments requires proactive engagement from manufacturers, testing agencies, and fuel suppliers to ensure compliance and facilitate the successful adoption of hydrogen fuel technology.
