L.-33004/99 सी.जी.-डी.एल.-अ.-07102023-249255 CG-DxLx-xEG-I0D7H1x0x2x0 23-249255 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 571] नई दिल्ली, िक्रु वार , अक्त बू र 6, 2023/आजिन 14, 1945 No. 571] NEW DELHI, FRIDAY , OCTOBER 6, 2023/ASVINA 14, 1945 सड़क पररवहन और रािमाग गमत्रं ालय अजधसचू ना नई दिल्ली, 5 अक् तूबर, 2023 सा.का.जन. 724(अ).—केंद्रीय मोटर यान जनयमावली, 1989 में और संिोधन करने के जलए जनम्न जलजखत प्रारूप जनयम, जिस े केंद्रीय सरकार मोटर यान अजधजनयम, 1988 (1988 का 59) की धारा 110 द्वारा प्रित्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताव करती ह,ै को इस अजधजनयम की धारा 212 की उप-धारा (1) के द्वारा यथा आवश्यक इसके द्वारा प्रभाजवत होने की संभावना वाले सभी व्यजियों की िानकारी के जलए प्रकाजित दकया िाता है; और एतिद्वारा नोरटस दिया िाता ह ै दक प्रारूप जनयमों को उस तारीख से तीस दिन की अवजध समाप्त होने के बाि जवचाराथग स्ट्वीकार कर जलया िाएगा जिस तारीख स े सरकारी रािपत्र म ें यथा प्रकाजित इस अजधसूचना की प्रजतयां िनता के जलए उपलब्ध करायी िाती ह;ैं 2. जवजनर्िगष्ट अवजध समाप्त होने के पहले उक्त प्रारूप जनयमों के संबंध में दकसी भी व्यजि से प्राप्त होने वाली आपजत्तयों या सुझावों पर केंद्र सरकार द्वारा जवचार दकया िाएगा। 3. इन प्रारूप जनयमों के प्रजत आपज‍ तयों एवं सझु ावों, यदि कोई हो, को अपर सजचव (एमवीएल), सड़क पररवहन और रािमागग मंत्रालय, पररवहन भवन, संसि मागग, नई दिल्ली-110001 या ईमले : comments-morth@gov.in, के माध् यम से भेिा िा सकता ह।ै प्रारूप जनयम 1. संजिप्त िीर्गक एवं प्रारंभ - (1) इन जनयमों को केन्द्द्रीय मोटर यान (........संिोधन) जनयमावली, 2023 कहा िाएगा। (2) यह अजधसूचना रािपत्र म ेंसंिोधन के अंजतम प्रकािन की तारीख से अठारह महीन े के बाि और उसके बाि लागू होगी। 6353 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 2. केंद्रीय मोटर वाहन जनयमावली (सीएमवीआर), 1989 (इसके बाि उि जनयमों के रूप म ें संिर्भगत) म,ें जनयम 47, उप- जनयम 1, खंड ि म,ें जनम्नजलजखत िब्ि, आंकड़े और अिर हटा दिए िाएंगे, अथागत्:- "और, बस बॉडी स्ट्रक्चर फैजिकेटर द्वारा चेजसस पर जनर्मतग बस बॉडी के स्ट्व-प्रमाणन के मामल े में, फॉम ग 22 ख म ें अनुपालन का प्रमाण पत्र" 3. उि जनयमों के, प्रारूप 22 ख को छोड़ दिया िाएगा। 4. उि जनयमों के, जनयम 47 म,ें उप-जनयम 5 में िब्िों और आंकड़ों के साथ "को और से... पोटगल पर" को उप-जनयम 6 के रूप म ेंदफर स ेक्रमांदकत दकया िाएगा। 5. उि जनयमों के, जनयम 47, उप-जनयम 6 म,ें जनम्नजलजखत परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथागत्:- बिते दक प्र‍येक बस बॉडी जबल्डर को पोटगल https://www.vahan.nic.in/makermodel पर संबंजधत ड्राइव अव े चेजसस के जवरूद्ध बस बॉडी का जववरण अपलोड करना होगा। 6. उि जनयमों के, जनयम 125-ग म,ें उप-जनयम 1 म,ें पहले परंतुक के बाि, जनम्नजलजखत नया परंतुक अंतःस्ट्थाजपत दकया िाएगा, अथागत:् - “बिते दक, ड्राइवर को छोड़कर 13 या अजधक याजत्रयों की बैठने की िमता वाली बसों की बॉडी जबलल्डगं का परीिण और अनुमोिन, बस बॉडी जबल्डर द्वारा समय-समय पर संिोजधत एआईएस: 052 (संिोधन 1) -2008 के अनुसार दकया िाएगा। उसम ें उजल्लजखत वाहनों के जलए, िब तक दक संबंजधत बीआईएस जवजनिेि भारतीय मानक ब्यूरो (बीआईएस) अजधजनयम, 2016 (2016 का 11) के तहत अजधसूजचत नहीं हो िाते, और सीएमवीआर 1989 के जनयम 126 के तहत जनर्िगष्ट परीिण एिेंजसयों द्वारा अनुमोदित दकए िाएगं े। 7. उि जनयमों के, जनयम 125-ग म,ें उप-जनयम 7, ताजलका 1 म,ें जनम्नजलजखत नए खंड ग को अंतःस्ट्थाजपत दकया गया है, अथागत:् - "(ग) बस बॉडी जबल्डर द्वारा जनर्मगत चालक को छोड़कर 22 याजत्रयों से अजधक बैठने की िमता वाली बसें भारतीय मानक ब्यूरो (बीआईएस) अजधजनयम, 2016 (2016 का 11) के तहत संबंजधत बीआईएस जवजनििे ों को अजधसूजचत दकए िान े तक समय-समय पर संिोजधत एआईएस -153 के अनुसार आवश्यकताओं को पूरा करेंगी। 8. उि जनयमों के, जनयम 126 म,ें "सीएमवी के जनयम 126 के तहत 10वें और 11वें प्रावधानों को हटा दिया िाएगा।" [फा.सं. आरटी -11028/02/2013-एमवीएल] महमिू अहमि, अपर सजचव रटप् पण: मलू जनयम भारत के रािपत्र, असाधारण, भाग-II, खंड 3, उप धारा (i) म ें अजधसूचना संख्या सा.का.जन. 590(अ), दिनांक 02 िून, 1989 के माध् यम स े प्रकाजित दकए गए थे और जपछली बार अजधसूचना संख् या सा.का.जन...........(अ), दिनांदकत ........... द्वारा संिोजधत दकया गया। MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 5th October, 2023 G.S.R. 724(E).—The following draft rules to further amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by Section 110 of the Motor Vehicles Act,1988 (59 of 1988) is hereby published as required by sub-section (1) of Section 212 of the said Act for information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which the copies of this notification, as published in the Gazette of India, are made available to the public. 2. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 3. Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (MVL&Transport), Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001 or on the email: comments-morth@gov.in; Draft Rules 1. Short title and commencement. — (1) these rules may be called as the Central Motor Vehicles (………. Amendment) Rules, 2023. (2) This notification shall come into force on and after eighteen months from the date of final publication of Amendment in the Official Gazette. 2. In the Central Motor Vehicle Rules( CMVR), 1989 (hereinafter referred to as the said rules), in rule 47, sub-rule 1, clause g, the following words, figures and letters shall be omitted, namely: - “and, in case of self-certification of the bus body built on a drive away chassis by a bus body structure fabricator, certificate of compliance in Form 22B” 3.In the said rules, Form 22B shall be omitted. 4.In the said rules, in rule 47, sub-rule 5 with words and figures “on and from …. on the portal” shall be renumbered as sub-rule 6. 5.In the said rules, in rule 47, the sub-rule 6, the following proviso shall be inserted, namely: - “Provided that, every bus body builder shall upload the bus body details against the relevant drive away chassis on the portal https://www.vahan.nic.in/makermodel.” 6.In the said rules, in rule 125-C, in sub-rule 1, after first proviso, following new proviso shall be inserted namely: - “Provided further that, the testing and approval of body building of buses with seating capacity of 13 or more passenger excluding driver, by bus body builder shall be in accordance with AIS:052 (Revision 1)-2008, as amended from time to time, for vehicles mentioned therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standard (BIS) Act,2016 (11 of 2016),and shall be type approved by the Test Agencies specified under Rule 126 of CMVR 1989.” 7.In the said rules, in rule 125-C, in sub-rule 7, Table 1, following new clause c inserted namely: - “(c) the buses with seating capacity exceeding 22 passenger excluding driver, built by bus body builder shall meet the requirements as per AIS-153, as amended from time to time, for vehicles mentioned therein, till the corresponding BIS specifications are notified under the Bureau of Indian Standard (BIS) Act, 2016 (11 of 2016). 8.In the said rules, in rule 126, “10th and 11th provisions under CMV Rule 126 shall be omitted.” [F.
