## Report on Amendment to the Central Motor Vehicles Rules, 1989
**1. Executive Summary:**
This report analyzes a notification amending the Central Motor Vehicles Rules, 1989. The amendment, as indicated by the provided text, focuses on revising regulations regarding vehicles carrying two-wheelers and four-wheelers. The key change allows vehicles carrying two-wheelers to have a maximum of three decks, and vehicles carrying four-wheelers can have maximum of two decks, with the load body as per AIS 113. This amendment aims to refine existing rules to accommodate different vehicle types and associated loading requirements.
**2. Introduction:**
The purpose of this report is to provide an informative overview and analysis of the amendment to the Central Motor Vehicles Rules, 1989, based solely on the provided government notification text. This report aims to inform stakeholders about the changes introduced and their potential impact.
**3. Policy Overview:**
This notification amends the Central Motor Vehicles Rules, 1989. The core objective, as inferred from the text, is to clarify and revise existing regulations related to the structural requirements of vehicles transporting other vehicles, specifically two-wheelers and four-wheelers.
**4. Background and Rationale:**
This amendment addresses potential ambiguities or limitations within the original Central Motor Vehicles Rules, 1989, regarding the number of decks allowed on vehicles transporting other vehicles. The amendment likely arises from the need to provide clearer guidelines for vehicle configurations used for transporting two-wheelers and four-wheelers.
**5. Key Provisions / Changes:**
This amendment introduces specific changes to Rule 93, sub-rule 1A, in sub-subrules VI and VII of the Central Motor Vehicle Rules, 1989:
* **Rule 93, sub-rule 1A, sub-subrule VI:** This section is being amended by inserting a new proviso after the third existing proviso. The *new* provision states that "vehicles carrying two-wheelers can have maximum of three decks to carry vehicles with load body not projecting over the driver's cabin." The effect of this change is to explicitly allow up to three decks for vehicles carrying two-wheelers, under the stated condition.
* **Rule 93, sub-rule 1A, sub-subrule VII:** This section is also being amended by inserting a new proviso after the first two existing provisos. This amendment states that "vehicles carrying a two wheelers can have maximum of three decks to carry vehicles with load body not projecting over the drivers cabin and b Four wheelers can have maximum of two decks, with the load body as per AIS 113." The effect of this change is to explicitly allow up to three decks for vehicles carrying two-wheelers with load body not projecting over the drivers cabin and up to two decks for vehicles carrying four-wheelers.
**6. Target Audience and Stakeholders:**
The primary target audience and stakeholders are:
* Manufacturers of vehicles designed to transport other vehicles (specifically two-wheelers and four-wheelers).
* Transport companies and operators involved in the logistics of transporting two-wheelers and four-wheelers.
* Regulatory bodies responsible for enforcing motor vehicle regulations.
**7. Implementation Aspects (Inferred):**
* **Responsible agency/bodies:** The Ministry of Road Transport and Highways is the responsible body, as indicated by the notification.
* **Timelines or procedures:** The draft rules are to be taken into consideration after 30 days from the date the notification is made available to the public. Objections and suggestions can be submitted to the Joint Secretary MVL, Transport Toll, Ministry of Road Transport and Highways. Final implementation will occur upon publication in the Official Gazette.
* This change will likely require manufacturers and transport companies to adjust vehicle designs and operational procedures to comply with the new deck limitations.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcomes of these changes are:
* Provide greater clarity and standardization for the construction and operation of vehicles transporting two-wheelers and four-wheelers.
* Potentially improve the efficiency of transporting vehicles by optimizing the use of space within the permitted deck configurations.
* Ensure standardization and safe transportation of vehicles by stating that the vehicles with two decks should comply with AIS 113 standard.
**9. Conclusion:**
The amendment to the Central Motor Vehicles Rules, 1989, regarding the maximum number of decks allowed on vehicles transporting two-wheelers and four-wheelers, represents a refinement of existing regulations. This change, by providing specific guidelines, aims to standardize vehicle configurations and potentially improve transport efficiency while ensuring safety and compliance with AIS 113 standard for four-wheelers.
